Der Artikel verfolgt, in welcher Weise Johann Gottlieb Fichte mit seiner Wissenschaftslehre die Diskussion um das Wesen der Natur in ihrem Verhältnis zum Subjekt beeinflusst. Dabei wird besonders sein Ansatz zur Fassung der Subjektivität und der Dialektisierung der Erkenntnisbeziehung zwischen Subjekt und Objekt herausgearbeitet. This essay examines which contemporary scientific and philosophical problems led to the reference points for the resumption and reformation of diaresis. These multifaceted methodological and epistemological considerations form the contemporary background for Fichte's development of a new type of analytical-synthetic method. By laying down a basic form which in itself contains the possibility of a differentiated formation, the philosophical development of the concept becomes traceable in its genesis. This marks the point where Fichte's conception crosses over the contemporary taxonomic approaches (...) and their spatially-static stratification of concepts as well as the approaches that shape hybridization with their latent temporalization of the conceptual chain. It forms a rupture in thinking related to the linking of species, in that the idea of the mediation of the species (of concepts) among themselves becomes the idea guiding the knowledge. Im vorliegenden Aufsatz wird untersucht, welche zeitgenössischen naturwissenschaftliche und philosophische Problemstellungen Anknüpfungs¬punk¬te zur Wiederaufnahme und Neuausformung der Diäresis führten. Diese vielgestaltigen methodologischen und erkenntnistheoretischen Überlegungen bilden den zeitgenössischen Hintergrund für Fichtes Ausbildung einer neuartigen analytisch-synthetischen Methode. Durch das Zugrundelegen einer Grundform, die in sich selbst die Möglichkeit zu einer differenzierenden Bildung enthält, wird die philosophische Begriffsentfaltung in ihrer Genese verfolgbar. Hiermit ist das Überschreiten der fichteschen Konzeption gegenüber den zeitgenössischen taxonomischen Ansätzen und deren räumlich-statischer Schichtung der Begriffe ebenso wie gegenüber den die Hybridisierung ausformenden Ansätzen mit ihrer latenten Verzeitlichung der Begriffskette markiert. Если Платон несомненно указывает на историческое происхождение диэрезис, то у Фихте нет прямого указания на его концептуальную дифференциацию. Additionally, it explores how his socio-economic theorems stood out against cameralistic and feudal-conservative discussions and to what extent they can be described as an early critique of capitalism. Is the essence of Fichte’s socio-economic ideas to be seen in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? (...) What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. It is known that in connection with proposed educational reforms in the German states around 1800, Johann Gottliebe Fichte, following the Enlightenment concepts, developed a program, which considered education as an indispensable human right. In this program, the idea of providing all the citizens with the opportunity to get an education has been formulated as a social task and a condition of social and political modernization. In accordance with Fichte’s thought, over the cultivation of individuals, a new morality, and then, (...) on that basis, a new civic subject had to shape itself. The science thenceforth should have obtained a function of organizing a new society, in Fichte’s vision of it, instead of theology having previously played that role, while the public education system should have mediated the application of the scientific principles of organizing the society and thus to become a driving force in this development process. The generally accessible education and science were conceived by Fichte as autonomous moments of social organization, being the area intact by any immediate influence of authorities and based on the principles of individuals’ free communication. Fichte’s theorem of intersubjectivity has introduced an understanding of teaching as a social and communicative process into the ethical and political, as well as into the educational thought. It was not limited to reproduction of predetermined skills by the subject, but took into account the subject’s formation in the course of actively perception of educational contents and the change of the subject himself taking place by that. Общедоступное образование и наука мыслились Фихте в качестве автономных моментов организации общества, областей, неподверженных непосредственному влиянию власть предержащих и основанных на принципах свободной коммуникации индивидов. Фихтевская теорема интерсубъективности ввела в этико-политическую и педагогическую мысль понимание обучения как социально-коммуникативного процесса, не ограничивающегося воспроизведением субъектом предзаданных навыков, но имеющего в виду его образование в ходе активного восприятия учебного материала и осуществляющееся при этом изменение самого субъекта. Is the essence of Fichte’s socio-economic ideas to be seen (...) in his model of state regulation or rather in his methodological claim of genetically developing the phenomena by showing their mediating links? Finally, the author criticizes a superficial „up-dating“ of Fichte’s theoretical or political-economical ideas, because this would presuppose a horizon of problems which emerged only later. What is however still relevant today is Fichte’s idea that human beings are not the objects or means of social relations but their subjects and aims. For this purpose, Fichte developed a concept of justice that is constitutive for his notion of society. Democracy aiming at an active use of reason and social justice are the two moments which depend on each other.Im Zentrum des Beitrags steht die Problemstellung: Ist Fichtes sozialökonomisches Modell eine sowohl an den entwickelten zeitgenössischen ökonomischen Lehren Westeuropas vorbeigehende und historische Realitäten missachtende geschichtsferne Utopie? Oder entwickelte Fichte ein sowohl erfahrungsbasiertes wie auch zeitgenössische Ideen aufnehmendes sozialpolitisches Handlungskonzept? Weiterhin wird untersucht, wie sich seine sozialökonomischen Theoreme von kameralistischen und feudal-konservativen Erörterungen unterscheiden und inwieweit die These einer bereits kapitalismuskritischen Position Fichtes haltbar ist. Darüber hinaus wird erörtert, ob das Wesentliche der fichteschen sozialökonomischen Ideen in seinem Modell staatlicher Regulation zu sehen ist oder in seinem mit der genetischen Darstellungsweise verbundenen Anspruch, die Erscheinungen durch den Nachweis ihrer Vermittlungsglieder in ihrem Wesenszusammenhang theoretisch zu entwickeln. Abschließend wendet sich der Autor gegen das Zuschreiben einer vordergründig theoretischen oder politisch-ökonomischen Aktualität der Fichteschen Ideen. Aktuell erscheint dagegen der Gedanke, wonach der Mensch nicht Objekt oder Mittel sozialer Beziehungen, sondern deren Subjekt und Zweck ist. Dazu entwickelt Fichte einen für seine Gesellschaftsauffassung konstitutiven Gerechtigkeitsbegriff: Auf eingreifenden Vernunftgebrauch abzielende Demokratie und soziale Gerechtigkeit sind dabei einander bedingende Momente. Obgleich Fichte keine explizite philosophiegeschichtliche Ausarbeitung hinterließ, so ist doch mit der durch ihn vollzogenen "Revolution in der Philosophie" (Hegel) auch in der Problemsicht auf die Geschichte der Philosophie ein Paradigmenwechsel verbunden: Die in der Wissenschaftslehre vollzogene Ableitung der theoretischen und praktischen Philosophie war in der Geschichte der Philosophie der erste Versuch, die Deduktion der Kategorien als Form der Gedankenentwicklung des zu sich kommenden Begriffs (Phänomenologie) vorzustellen. In einer solchen Sicht treten für Fichte die unterschiedlichen Gestalten philosophischen Denkens zunehmend aus ihrer Zufälligkeit des Wissens heraus, treten sie in ihrer Allgemeinheit und Wesentlichkeit hervor. Der Beitrag verfolgt die von Fichte formulierte Problemstellung, das skeptische Kritik – soll sie nicht zur bloßen Polemik verkommen – eines theoretisch-methodischen Fundaments bedarf. Nur dadurch könne sie konstruktiv wirken. In der Auseinandersetzung mit dem Skeptizismus wie auch mit anderen Kritikern seines Denkansatzes inaugurierte Fichte das wissenschaftliche Verfahren der ›immanenten Kritik‹ im Gegensatz zur ›dogmatischen‹ Kritik: Theoretische Auffassungen sind als zeitgebunden, als Momente der Vernunftentwicklung zu erklären. In dealing with skepticism as well as with other critics of his approach, Fichte inaugurated the scientific procedure of 'immanent criticism' in contrast to 'dogmatic' criticism: theoretical conceptions are to be explained as time-bound, as moments of the development of reason. The consequences of this paradigm shift were followed in the article in different directions of Fichte's thinking: history of philosophy/the development of theory, conception of religion, theory of natural law or the consciously wrong use of the symbol in the political sphere. -/- El artículo persigue el problema formulado por Fichte, que la crítica escéptica -para no degenerar en meras polémicas- requiere una fundamentación teórica y metódica. Esta es la única forma en que puede ser constructivo. Al tratar con el escepticismo, así como con otros críticos de su enfoque, Fichte inauguró el procedimiento científico de la "crítica inmanente" en contraste con la crítica "dogmática": las concepciones teóricas deben explicarse como limitadas en el tiempo, como momentos del desarrollo de razón. The author analyzes the new understanding of the concept of form developed by Fichte. This made it possible for Fichte to substantiate the autonomy of human thought and action, and consequently of freedom, in a new way. With this, an approach was developed that designed the natural law situation to be filled out in human striving in a non-empirical way. Traditional arguments for privacy in public suggest that intentionally public activities, such as political speech, do not deserve privacy protection. In this article, I develop a new argument for the view that surveillance of intentionally public activities should be limited to protect the specific good that this context provides, namely democratic legitimacy. Combining insights from Helen Nissenbaum’s contextualism and Jürgen Habermas’s theory of the public sphere, I argue that strategic surveillance of the public sphere can undermine the capacity of citizens (...) to freely deliberate in public and therefore conflicts with democratic self-determination. The link between the right to privacy and the right to democratic self-determination is often understood to imply that privacy rights have only instrumental value for democratic participation, and that they consist solely in the possibility to retreat from participation in a public. I examine three arguments for an internal link between both sets of rights: The right to privacy protects political public spheres from epistemic inequality, it protects groups in public from a loss of their deliberative autonomy and it (...) blocks the colonisation of deliberative publics by strategic action orientations. Empirical research into the ethics of emerging technologies, often involving foresight studies, technology assessment or application of the precautionary principle, raises significant epistemological challenges by failing to explain the relative epistemic status of contentious normative claims about future states. This weakness means that it is unclear why the conclusions reached by these approaches should be considered valid, for example in anticipatory ethical assessment or governance of emerging technologies. This paper explains and responds to this problem by proposing an account of (...) how the epistemic status of uncertain normative claims can be established in ethical and political discourses based on Jürgen Habermas’ discourse ethics. To better understand the nature of the problem, the relationship between norms, facts and the future is explored in light of potential meta-ethical fallacies faced in the field of empirical ethics. Weaknesses of current approaches to anticipatory ethical assessment and governance are then explored, including the Precautionary Principle and Technology Assessment. We argue that the epistemic status of uncertain normative claims can be understood within Habermas’ approach to political discourse, which requires ‘translation’ of uncertain claims to be comprehensible to other stakeholders in discourse. Translation thus provides a way to allow for uncertain normative claims to be considered alongside other types of validity claims in discourse. The paper contributes a conceptual account of the epistemic status of uncertain normative claims in discourse and begins to develop a ‘methodology of translation’ which can be further developed for approaches to research and ethical assessment supporting anticipatory evidence-based policy, governance and system design. When we criticize social institutions and practices, what kinds of reasons can we offer for such criticism? Political philosophers often assume that we must rely on universal moral principles that are not necessarily connected to the particular social practices of our communities. Traditionally,continental critical theory has rejected this claim through its endorsement of the method of immanent critique. Immanent critique is a critique of social practices that draws on norms already present within these practices to demand social change, rather than (...) merely conservatively reproducing them. This book defends the claim that such a critique is not only possible, but also has politically powerful potential. Taking up recent developments in analytic collective intentionality theory and in the philosophy of language, the book argues that all social practices rest on structures of mutual recognition between persons that allow social theorists to reconstruct hidden norms present within these practices. Starting from a comprehensive critique of contemporary critical theory, the book also spells out the consequences of this line of thought for the practice of social critique, for the social sciences and for political philosophy. Recent disclosures suggest that many governments apply indiscriminate mass surveillance technologies that allow them to capture and store a massive amount of communications data belonging to citizens and non-citizens alike. This article argues that traditional liberal critiques of government surveillance that center on an individual right to privacy cannot completely capture the harm that is caused by such surveillance because they ignore its distinctive political dimension. As a complement to standard liberal approaches to privacy, the article develops a critique of (...) surveillance that focuses on the question of political power in the public sphere. (shrink)

According to Jürgen Habermas, his Theory of Communicative Action offers a new account of the normative foundations of critical theory. Habermas’ motivating insight is that neither a transcendental nor a metaphysical solution to the problem of normativity, nor a merely hermeneutic reconstruction of historically given norms, is sufficient to clarify the normative foundations of critical theory. In response to this insight, Habermas develops a novel account of normativity, which locates the normative demands of critical theory within the socially instituted practice (...) of communicative understanding. Although Habermas has claimed otherwise, this new foundation for critical theory constitutes a novel and innovative form of “immanent critique.” To argue for and to clarify this claim, I offer, in section 1, a formal account of immanent critique and distinguish between two different ways of carrying out such a critique. The hope for a better future can, and frequently does, motivate political action. Political hope is therefore often considered a positive force. However, not all forms of political hope are beneficial. Some scholars and activists claim that some kinds of hope also function as an ideology. I argue that we can give a precise meaning to the notion of ‘ideological hope,’ and I argue that to say of a given instance of hope that it is ‘ideological’ means more than that (...) it is irrational or immoral. I distinguish two forms of ideological hope: forms where the ideological nature of hope derives from underlying ideological beliefs and judgments, and structural forms. The case of structurally ideological hope shows that even the rational hopes of political agents can undermine their purposes by binding them to distorted political self-understandings. (shrink)

The role of power in healthcare can raise many ethical challenges. Power is ownership, whether given, ceded, or taken of another person’s autonomy. When a person has power over someone else, they can control or strongly influence the decision-making freedom of that person. From the principalist perspective1,2 of healthcare ethics, denying a person their freedom to choose, should only occur when justifying conditions related to beneficence and nonmaleficence are sufficiently satisfied. In healthcare, it is rare to be able to identify (...) situations where paternalism is justified. However, experience suggests that abusive power in healthcare is used too frequently without justifying criteria. (shrink)

The problem of the social foundations of normativity can be illuminated by discussing the narrower question whether rule-following is necessarily a social matter. The problems with individualistic theories of rule-following seem to make such a conclusion unavoidable. Social theories of rule-following, however, seem to only push back one level the dilemma of having to choose either an infinite regress of interpretations or a collapse into non-normative descriptions. The most plausible of these models, Haugeland's conformism, can avoid these objections if it (...) is supplemented with an ontologically reasonable concept of the collective attitude of a group. Groups of individuals who are bound to shared norms by recognizing each other as equipped with a standard authority of criticism have the necessary properties for ascribing to those groups such collective attitudes. Given such a weak notion of a collective attitude, there is hope for a plausible collectivist theory of rule-following. (shrink)
