The article is devoted to the historical analysis of teleological argumentation evolution in the legal interpretation. The ideas of ancient Greek and Roman orators, philosophers and lawyers, which served as the basis for development of the idea of teleological interpretation in the European legal tradition, are examined. The history of teleological interpretation method development in European legal theory from Medieval jurists to sociological legal approach of the late 19 th and 20 th centuries is observed, as well the existence of (...) two main approaches in understanding the teleological method of interpretation, namely subjective-teleological and objective-teleological, is ascertained. The author states that there is a direct correlation between the concept of law and the approach to understanding of the teleological interpretation method. In conclusion, the author insists on the more progressive nature of the objective-teleological method of legal interpretation. (shrink)

Die Forderung einer Philosophie als strenger Wissenschaft, von Husserl zum ersten Mal in dem bekannten Logosaufsatz erhoben, richtet sich nicht, wie meistens gedacht und auch von Dilthey selbst so verstanden ist, gegen den Historizismus von Dilthey, sondern vielmehr gegen dessen Identifizierung von Philosophie mit Weltanschauungsphilosophie und damit mit Weisheitslehre. Husserl hat vom Anfang an bis zum Ende seines Lebens sich der Herausarbeitung dieer Idee gewidmet und die Phänomenologie als Verwirklichung dieser Idee betrachtet. Dementsprechend soll man auch der geläufigen Auffassung zuwider (...) die Phänomenologie vor allem als Wissenschaftslehre auffassen und interpretieren. Die Ablehnung aller Weltanschauungsphilosophie ruft nicht nur das Problem hervor, wie Husserl sich verhält zur Metaphysik, sondern was er unter strenger Wissenschaft versteht. Einerseits ist nach ihm die Trennung und Unterscheidung von Philosophie und Weltanschauung oder Metaphysik in Übereinstimmung mit dem modernen Denken, das gerade erst dadurch zur Herausbildung einer Universitas von strengen positiven Wissenschaften (Mathematik, Naturwissenchaften, aber auch strengen Geisteswissenschaften) gekommen ist, andererseits steht aber seine Auffassung und Ausarbeitung von Philosophie als apodiktischer Wissenschaft im Gegensatz zum modernen Denken. Husserl betrachtet die Phänomenologie als die Realisierung der zuerst von Piaton gestellten Idee von Philosophie als einer endgültigen, einzigen und universalen Wissenschaft, welcher Descartes eine radikale Wendung in die Richtung einer egologischen Apodiktizität gegeben hat. Infolgedessen hat die transzendentale Phänomenologie auch die Aufgabe alle Einzelwissenschaften, sowohl die positiven Tatsachenwissenschaften als die positiven apriorischen, vernunftkritisch zu durchleuchten und dadurch zu Abzweigungen der Philosophie als universaler Wissenchaft zu machen. Wie dieses Verhältnis zwischen positiver Wissenschaft und Phänomenologie als strenger Wissenschaft gedacht werden muss, ist immer ein wichtiges Thema für Husserl gewesen. Die positiven Wissenschaften teilt Husserl ein in Tatsachenwissenschaften und apriorische Wissenschaften (Leibniz' Idee von Wissenschaft der Möglichkeiten kombiniert mit der Idee von invarianten Strukturen). Husserl ist nun der Ansicht, dass eine positive Tatsachenwissenschaft nur eine exakte und strenge Wissenschaft werden kann, wenn sie eine apriorische Wissenschaft neben sich zur Entwicklung bringt oder sich darauf stützen kann, wie es z. B. der Fall gewesen ist mit der empirischfaktischen Naturwissenschaft in Beziehung zu der Mathematik und der reinen Mechanik. Dasselbe Verhältnis soll man sich denken zwischen einer apriorischen (phänomenologischen) Psychologie, einer allgemeinen apriorischen Sprachwissenchaft und Historie und den dazu gehörenden empirischen Tatsachenwissenschaften. Philosophie und Wissenschaft sind für Husserl identisch mit Rationalismus. Dennoch unterscheidet er grundsätzlich zwischen positiver und transzendentaler Rationalität. Durch eine Verbindung von Rationalität und Verständlichmachung (die Methode des Verstehens der Geisteswissenschaften auf das höchste Niveau eines transzendentalen Verständnisses gebracht durch die konstitutive Phänomenologie) hebt die Phänomenologie als absolute Geisteswissenschaft den Gegensatz zwischen Natur-und Geisteswissenschaften auf und entwickelt sich zur sapientia universdis. Im dritten Teil kehrt der Autor zu der Frage zurück, ob Husserl immer die Trennung zwischen wissenschaftlicher Philosophie und Weltanschauung aufrecht erhalten hat auch in den Krisisabhandlungen. Im allgemeinen muss das bejaht werden. Noch in 1924 wird sogar die Frage erhoben, ob Kant, der doch auch Philosophie als strenge Wissenschaft entwickeln wollte, wohl eine echte Philosophie gebracht hat und nicht darin verfehlt hat eben durch die Vermischung von wissenschaftlicher Philosophie mit Weltweisheit, die auch von ausserwissenschaftlichen Quellen schöpft, und durch den Mangel an dem Radikalismus der Apodiktizität. Husserl hat die Idee der Philosophie als strenger Wissenschaft tatsächlich zur Ausführung gebracht als transzendentale Wissenschaft der Subjektivität d. h. als Deskription oder Hermeneutik des Bewusstseinslebens. Es gibt abo bei ihm eine Verbindung zwischen Wissenschaftslehre und Ratio oder Logos einerseits und Vernunft, Subjektivität und Leben andererseits. Der spätere Husserl hat diese Verbindung immer mehr vertieft in die Richtung einer wissenschaftlichen Lebensphilosophie mit Aufrechterhaltung der Idee der Philosophie als apodiktischer Wissenschaft. Er hat nicht nur den Objektivismus der positiven Wissenchaften zu erhellen und aufzuklären versucht von ihrem Ursprung aus der Lebenswelt, die auch ihr bleibender Boden ist, sondern in dem phänomenologischen Idealismus schliesslich als geistiger Weltanschauung die Lösung aller geschichtsphilosophischen und ethischen Probleme gesehen, die besonders durch die Krise der europäischen Kultur hervorgerufen sind. Die Urstiftung der Griechen und besonders vos Platon findet in der transzendentalen Phänomenologie ihre Endstiftung und in einer geschichtsphilosophischen Deutung des Sinnes der Geschichte, die nach Husserl notwendig universal-teleologisch sein muss, hat die Phänomenologie und die Geschichte der Philosophie die Aufgabe als Selbstverwirklichung der Vernunft zu fungieren (Husserliana VI, § 73). Die Philosophie als strenge Wisenschaft schafft die Möglichkeit dem menschlichen Sein und Werden apodiktische Ziele zu geben und sich berufen zu wissen zu einem Leben und Streben in der Apodiktizität d. h. auf Vernunft hin, was den Menschen allein „selig” machen kann. In einer Zeitspanne von vier Jahren, von 1982 bis 1986, schrieb Louis Althusser eine Reihe kurzer Abhandlungen, die erst posthum veröffentlicht wurden. Kurze Abhandlungen sind für das Werk Althussers typisch, viel mehr als jede andere Art schriftlichen Schaffens, doch die Besonderheit seiner letzten Abhandlungen liegt weder in ihrer Form noch in der Methode, sie liegt vielmehr in einem radikal neuen Zugang zum Politischen. In den sechziger Jahren besteht Althusser auf einem Standpunkt nach welchem der dialektische Materialismus den philosophischen Kern (...) des Marxismus darstellt und der historische Materialismus seiner Wissenschaft entspricht. In den achtziger Jahren verändert er diesen Standpunkt zugunsten einer „Philosophie der Begegnung”, die ein nicht–teleologisches Prinzip des Materialismus seiner Ansicht nach viel genauer widerspiegelt als ein für ihn inzwischen logozentrisch und idealistisch gewordener dialektischer Materialismus. Jener wird gänzlich verworfen, und an seine Stelle tritt ein neuer Begriff: der aleatorische Materialismus. Ein Materialismus der Kontingenz und der Leere, der eine Vorrangigkeit des Sinns über die Erscheinungen radikal ablehnt. Dieser Text verfolgt diese Wende in seinem Verständnis der Philosophie und vor allem in ihrem Verhältnis zu Politik und Ideologie. (shrink)

My paper focuses on the pursuit of philosophical self-perfection. The starting point of my reflections is my experience with contemporary philosophy. Mainstream contemporary phi-losophy counsels the rational capacities of arguing and reasoning without affecting the philo-sopher′s ethical stance. I argue that this failure is due to the presuppositions made by contem-porary philosophical rationality: the agnostic belief in humankind as source of all existing sense. This agnosticism blinds one to a teleologically defined horizon of truth which is essen-tial for the philosophical (...) streaming for self-perfection. In order to regain the possibility of philosophical self-perfection I am looking for a reversion in faith. I find help in Pascal′s theory of liturgy. At the end of my proposal I try to show how a teleological horizon of truth in the Christian tradition enables philosophical self-perfection which has been abandoned by the agnostic contemporary philosophy. An important method for finding the optimal solution for linear and nonlinear models is the graphical method, which is used if the linear or nonlinear mathematical model contains one, two, or three variables. The models that contain only two variables are among the most models for which the optimal solution has been obtained graphically, whether these models are linear or non-linear in references and research that are concerned with the science of operations research, when the data of the issue under (...) study is classical data. In this research, we will present a study through, which we present the graphical method for solving Neutrosophical nonlinear models in the following case: A nonlinear programming issue, the objective function is a nonlinear function, and the constraints are linear functions. Note that we can use the same method if (i) the objective function follower is a linear follower and the constraints are nonlinear; (ii) the objective function is a non-linear follower and the constraints are non-linear. In the three cases, the nonlinear models are neutrosophic, and as we know, the mathematical model is a nonlinear model if any of the components of the objective function or the constraints are nonlinear expressions, and the nonlinear expressions may be in both. At the left end of the constraints are neutrosophic values, at least one or all of them. Then, the possible solutions to the neutrosophic nonlinear programming problem are the set of rays that fulfills all the constraints. As for the region of possible solutions, it is the region that contains all the rays that fulfill the constraints. The optimal solution is the beam that fulfills all constraints and at which the function reaches a maximum or minimum value, depending on the nature of the issue under study (noting that it is not necessary to be alone). The article addresses some aspects of Gava’s book, highlighting two main points: (1) the notion of philosophy in a cosmic sense; (2) its connection with the meaning of the concept of method. Regarding (1) I show how Gava’s interpretation of the systematic concept of philosophy does not account adequately for the scholastic concept. This has consequences for the notion of philosophy in a cosmic sense itself; its nature as an objective archetype and its personification in the ideal of a master (...) of wisdom are not properly emphasized. These features are closely related to Kant’s claim that philosophy cannot be learned, which is connected with Kant’s peculiar idea of method. Regarding (2), I argue that ‘method’ for Kant does not concern only the construction of scientific systems, but also the establishment of a way of thinking, a stance embracing thought and action. The meaning of the postulates and the notion of ‘faith’ thus acquire a ‘weaker’ connotation, as an attitude, habitus, aimed at the establishment and promotion of a ‘life-structuring’ rationality, and not as an alternative route to a theoretical ‘commitment’. Scepticism about phenomenology typically begins with worries concerning the reliability of introspection. Such worries concern the accuracy or fidelity of descriptions of experience to the experience itself, although if pressed, such worries ultimately call into question the very idea of the experience itself. This chapter considers scepticism in both its epistemological and ontological varieties and questions whether either form genuinely engages phenomenological method, properly understood. Starting from the problematic identification of phenomenology with introspection and drawing upon considerations from the work (...) of Edmund Husserl, Jean-Paul Sartre, and Maurice Merleau-Ponty, the chapter argues that phenomenological reflection, in its concern for essential structures, is largely unaffected by worries concerning how best to capture the details of particular episodes of experience. Moreover, many of the sceptical challenges phenomenology is alleged to face presuppose an overly objective understanding of experience that phenomenology typically rejects. The chapter concludes with a consideration of the underlying motives for phenomenological scepticism. These motives have little if anything to do with worries about introspection and the like, but instead involve scepticism about the viability of transcendental philosophy. The real challenge phenomenology confronts is one of establishing the legitimacy – and authority – of its distinctive methods in opposition to naturalism. (shrink)

In this paper, we first briefly survey the main responses to the challenge that experimental philosophy poses to the method of cases, given the common assumption that the latter is crucially based on intuitive judgments about cases. Second, we discuss two of the most popular responses in more detail: the expertise defense and the mischaracterization objection. Our take on the expertise defense is that the available empirical data do not support the claim that professional philosophers enjoy relevant expertise in their (...) intuitive judgments about cases. In contrast, the mischaracterization objection seems considerably more promising than its largely negative reception has suggested. We argue that the burden of proof is thus on philosophers who still hold that the method of cases crucially relies on intuitive judgments about cases. Finally, we discuss whether conceptual engineering provides an alternative to the method of cases in light of the challenge from experimental philosophy. We argue that this is not clearly the case, because conceptual engineering also requires descriptive information about the concepts it aims to improve. However, its primarily normative perspective on our concepts makes it largely orthogonal to the challenge from experimental philosophy, and it can also benefit from the empirical methods of the latter. Argumentation, which can be abstractly defined as the interaction of different arguments for and against some conclusion, is an important skill to learn for everyday life, law, science, politics and business. The best way to learn it is to try it out on real instances of arguments found in everyday conversational exchanges and legal argumentation. The introductory chapter of this book gives a clear general idea of what the methods of argumentation are and how they work as tools that can (...) be used to analyze arguments. Each subsequent chapter then applies these methods to a leading problem of argumentation. Today the field of computing has embraced argumentation as a paradigm for research in artificial intelligence and multi-agent systems. We prove that the intuitionistic sentential calculus is Ł-decidable, i.e. the sets of these of Int and of rejected formulas are disjoint and their union is equal to all formulas. A formula is rejected iff it is a sentential variable or is obtained from other formulas by means of three rejection rules. One of the rules is original, the remaining two are Łukasiewicz's rejection rules: by detachement and by substitution. We extensively use the method of Beth's semantic tableaux.

Plato’s Theaetetus, Sophist, and Statesman exhibit several related dialectical methods relevant to Platonic education: maieutic in Theaetetus, bifurcatory division in Sophist and Statesman, and non-bifurcatory division in Statesman, related to the ‘god-given’ method in Philebus. I consider the nature of each method through the letter or element paradigm, used to reflect on each method. How does experimental philosophy address philosophical questions and problems? That is: What projects does experimental philosophy pursue? What is their philosophical relevance? And what empirical methods do they employ? Answers to these questions will reveal how experimental philosophy can contribute to the longstanding ambition of placing philosophy on the ‘secure path of a science’, as Kant put it. We argue that experimental philosophy has introduced a new methodological perspective – a ‘meta-philosophical naturalism’ that addresses philosophical questions about a phenomenon by (...) empirically investigating how people think about this phenomenon. This chapter asks how this novel perspective can be successfully implemented: How can the empirical investigation of how people think about something address genuinely philosophical problems? And what methods – and, specifically, what methods beyond the questionnaire – can this investigation employ? We first review core projects of experimental philosophy and raise the question of their philosophical relevance. For ambitious answers, we turn to experimental philosophy’s most direct historical precursor, mid-20th century ordinary language philosophy, and discuss empirical implementations of two of its research programmes that use experimental methods from psycholinguistics and corpus methods from the digital humanities.
