ABSTRACT Every social order depends on a pathway to atonement for those who breach behavioral expectations. However, observers from a variety of fields now agree that the United States has entered an age of non-apology, where the two words “I’m sorry” simply cannot be said, particularly by powerful men facing allegations of sexual misconduct. This essay draws attention to, and comments upon, this trend. We first identify the sociopolitical factors that have inaugurated the era of non-apology, namely growing political (...) polarization. We then explain the consequences of this shift in societal expectations surrounding apology. This state of affairs, which associates genuine apology with emasculation and defeat, is harmful: it foments a toxic culture that will not allow redress for survivors of sexual assault and harassment; and it provides no answers to complex questions of how society can address the guilt of those who engage in sexual misconduct. Democracy has been a flawed hegemony since the fall of communism. Its flexibility, its commitment to equality of representation, and its recognition of the legitimacy of opposition politics are all positive features for political institutions. But democracy has many deficiencies: it is all too easily held hostage by powerful interests; it often fails to advance social justice; and it does not cope well with a number of features of the political landscape, such as political identities, boundary (...) disputes, and environmental crises. Although democracy is valuable it fits uneasily with other political values and is in many respects less than equal to the demands it confronts. Habermas’s conception of a transnational democracy allows identification of the methodological components of transnational political justice: to unite in a transnational polity, people belonging to different national communities need a common purpose, principles governing the distribution of constitutional and legislative power and a common political (...) infrastructure that allows them to form democratic will as free and equal citizens. This article attempts to further expand these points through a public goods approach. European policies generate European public goods. These must be produced and accessed based on a fair cooperation scheme. Otfried Höffe is one of the foremost political philosophers in Europe today. In this major work, already a classic in continental Europe, he re-examines philosophical discourse on justice - from Classical Greece to the present day. Höffe confronts what he sees as the two major challenges to any theory of justice: the legal, positivist claim that there are no standards of justice external to legal systems; and the anarchist claim that justice demands the rejection and (...) abolition of all legal and state systems. Höffe sets out to continue the 'philosophical project of modernity', the legitimation of human rights, and their guarantee by the state, while at the same time rehabilitating the classical theory of political justice represented by Plato and Aristotle. He questions the success of the positivists in avoiding extra-legal normative claims, and casts doubt on the plausibility of their criticism of the Natural Law tradition. Most anarchists, he argues, rely on an uncritical assumption that social institutions other than states and legal orders do not coerce. In Höffe's view, some coercion is unavoidable, and the grounds for its justification must be examined. This article explores issues associated with schooling and political justice. Such issues are understood in light of the contention surrounding howWestern schooling contexts might best represent marginalised groups—in ways that accord them a political voice. The significance of group identity politics is explored drawing on international debates associated with ethnically segregated schooling. A postcolonial theorising of group identity highlights the ways in which segregated schooling can both support and undermine politically just representation for marginalised students. This theorising (...) draws attention to the problematic notion of voice in linking representation to identity in reductionist ways. The arguments presented point to the significance of people and their politics, rather than their membership to a particular identity group, in pursuing equity for marginalised groups. The article argues the imperative of understanding group identity as an aspect of negotiated social practice that can be drawn on in strategic and critical ways to address matters of political injustice. In numerous places in his Ethics and Politics, Aristotle associates political justice (or ruling in turns) and the regime of polity. I argue that there is a necessary connection between political justice and polity due to their origins in political mixing. Aristotle is the first to discover political justice and polity because his predecessors had thought that the elements which they combine -- excellence and equality in the case of political justice, (...) and oligarchy and democracy in the case of polity -- were antithetical. The novelty of Aristotle's 'discoveries' points to their connection, namely that both originate in the political mixing of elements. This article examines such political mixing in detail and shows how an institutional arrangement such as ruling in turns can be adapted to different regime-types. (shrink)

In the center of the fifth book of the Nicomachean Ethics, Aristotle elliptically characterizes political justice as a form of reciprocal rule that exists between free and equal persons pursuing a common life directed toward self-sufficiency under the rule of law. My dissertation analyzes Aristotle's thematic treatments of political justice in the Nicomachean Ethics and Politics in order to elucidate its meaning, clarify its relationship to the other forms of justice that he also discusses, and (...) compare it to contemporary neo-Aristotelian accounts of justice. ;The first chapter examines the unclear and disputed passages of Ethics V.6--7 and explains why Aristotle discusses political justice in his ethical treatise. The second chapter makes use of Aristotle's juxtaposition of political justice to household justice on the one hand and despotic justice on the other hand in order to explicate the necessary conditions of political justice, namely, freedom, equality, commonality, self-sufficiency, and the rule of law. To make sense of these concepts, the chapter explores such topics as Aristotle's understanding of the household, his notion of the self and his political criticisms of Socrates. The third chapter examines political justice or reciprocal rule in the Politics in order to understand how political justice can be both a human virtue and an institutional arrangement of offices. The fourth chapter offers a critique of Fred Miller's reconstruction of Aristotelian natural rights. Although Miller is correct to say that Aristotle recognized and understood "rights claims," he is mistaken in claiming that they are an integral part of Aristotle's practical philosophy. Aristotle understood the problems for political compromise posed by rights conceived as "trumps," and he rejects rights as philosophically fundamental on the grounds that they are an inadequate solution to both the political problem of justice and the stability of flourishing political institutions. Domination consists in subjection to the will of others and manifests itself both as a personal relation and a structural phenomenon serving as the context for relations of power. Domination has again become a central political concern through the revival of the republican tradition of political thought . However, normative debates about domination have mostly remained limited to the context of domestic politics. Also, the republican debate has not taken into account alternative ways of conceptualizing domination. Critical theorists, (...) liberals, feminists, critical race theorists, and postcolonial writers have discussed domination in different ways, focusing on such problems as imperialism, racism, and the subjection of indigenous peoples. Sugerimos que se trata de problemas estructurales que están en los límites de lo jurídico y que, por tanto, no constituyen una falla del sistema judicial en sí mismo. Con ese fin, sobre la base de los análisis realizados por Danilo Zolo y Hannah Arendt, examinamos (...) problemas estructurales en tres niveles: en la imparcialidad e independencia del tribunal, en el respeto de los principios, las normas y los procedimientos del derecho, y en el requisito de un elemento subjetivo para atribuir la responsabilidad penal de un crimen. In the debate over Spanish treatment of the natives of the New World, both sides regularly invoked Aristotle on natural slaves. This paper argues that the interpretation of the Spanish Dominican Domingo de Soto displays a greater understanding of Aristotle and the Aristotelian tradition of justice than that of Juan Gines de Sepúlveda, the Spanish Humanist. The profusion of senses of justice in NE V.1–7 has left many readers with a general impression of chaos, but also gives rise to pressing questions about Aristotle’s conception of justice. Specifically, why does Aristotle claim that there are two parts to justice as equality, but go on to discuss three types of equality in the subsequent chapters? What is the relationship between political justice and the distinction between general justice and particular justice? (...) I argue in this essay that the notion of reciprocity, central to the first question, can also help us address the second. Specifically, I show that reciprocity is not a third species of particular justice, but rather a prior condition for political community and for political justice. Political justice is best understood as a redescription of particular justice that highlights how distributive and corrective justice maintain equality among citizens in an existing political community. In addition to explaining the unity of Aristotle’s thought in these chapters of NE V, I demonstrate a number of philosophical consequences for understanding Aristotle’s conception of justice. The purpose of Aristotle's discussion of political justice (τό πολιὸν[unrepresentable symbol]δν δί[unrepresentable symbol]αιον) in "EN" V.6-7 has been a matter of dispute. Although the notion of political justice which Aristotle seeks to elucidate is relatively clear, namely the notion of justice which obtains between free and equal citizens living within a community aiming at self-sufficiency under the rule of law, confusion arises when one asks how political justice relates to the other kinds of (...) justice examined in "EN" V. Is political justice a highly determinate subdivision of justice which Aristotle examines alongside the other varieties of particular justice analyzed in "EN" V.2-5? Or is political justice related to the analysis of ethical agency which follows in "EN" V.8-11? The question is complicated by the fact that the passage in question -- "EN" V 1134a17-1135a15 -- has occasioned much speculation about textual dislocations and has been incorporated into chapter divisions differently according to the two prevalent modern editorial divisions of the Ethics. To resolve these problems, I argue that Aristotle's account of political justice is situated within an extended aporetic analysis which begins in "EN" V.6 and extends through "EN" V.8. Aristotle introduces the notion of political justice within the extended analysis concerning the ascription of character states because calling someone just or unjust presupposes that the person is a fully mature ethical agent, but anyone capable of political justice possesses such agency. Once the extended argument in the second half of "EN" V is properly understood, it appears that the received text is not in need of emendation. To further support my claim that Aristotle's account of political justice introduces a new inquiry which is not analogous to the analyses of particular justice in the first half of "EN" V, I compare political justice to the other species of justice. All modern democratic societies claim to be egalitarian. They do not agree, of course, about what egalitarianism demands; the ideal of equality is hardly transparent and can be plausibly understood to encompass any number of social arrangements and values. Thatsomeform of equality is to be prized, though, is uncontroversial. Indeed, it may be true that all political theories that have stood the test of time can be understood as specifying and interpreting the ideal of equality. Whether or not this (...) is true, I think it is hard to deny that democratic political philosophy can generally be understood as egalitarian in character; to know how to treat people as moral equals, on this account, is to know what justice demands of us. We are all, if this is correct, egalitarians now, however much we argue about what such a label truly demands. (shrink)

In this paper I examine the ways in which the concept of “public interest” is used in biomedical policymaking to justify the preemption or overruling of decisions made by individuals about their own, their family's, or group interests in the field of healthcare. I discuss six variants of public-interest justification, before going on to consider a concrete example, the use of personal health data in health services management and medical research. I distinguish between the global public interest and particular public (...) interests and consider critically how the global public interest can be said to arise from private interests. I show that there is always room for the private individual to defeat appeals to public interest on moral grounds, and hence that public interest cannot have overriding moral force. Hence, public-interest claims need to be considered as political appeals about competing claims and conceptions of justice, rather than as shortcuts to defining the universal solidary interest. My dissertation aims to spell out the implications of moral relativism for political justice. The first part develops and defends a kind of moral relativism I call "Speaker Relativism". According to this view, moral expressions are indexicals; their content depends on the moral system of the speaker. I defend Speaker Relativism from some prominent objections, and provide an argument in favor of the view. ;The second part investigates the question of how, given relativism, citizens might establish public and (...) mutually acceptable principles serving to justify their society's basic institutions. I examine and criticize accounts of justice offered by theorists in the democratic and liberal traditions. I then propose a pragmatic conception of justice, Hobbesian in structure, but purged of Hobbes' bleak picture of human nature and inadequate moral psychology. ;The final chapter delimits the scope of the relativist's solution to the problem of justice, and considers the appropriate attitude for a relativist to adopt toward societies or groups whose deepest moral convictions differ importantly from our own. I explore the issue of cultural and personal autonomy, and conclude on a suitably relativist note. (shrink)

William Godwin, also known as Edward Baldwin and Theophilus Marcliffe, (1756-1836) was an English journalist, political philosopher and novelist. He is considered one of the first exponents of utilitarianism, and one of the first modern proponents of philosophical anarchism. He is most famous for two books that he published within the space of a year: Enquiry Concerning Political Justice and its Influence on Modern Morals and Happiness (1793), an attack on political institutions, and Caleb Williams; or, (...) Things as They Are (1794), which attacks aristocratic privilege, but also is virtually the first mystery novel. He wrote prolifically in the genres of novels, history and demography throughout his life time. With his wife, Mary Jane Clairmont, he wrote children's primers on Biblical and classical history, which he published along with such works as Charles and Mary Lamb's Tales From Shakespeare. He also has had considerable influence on British literature and literary culture. Seyla Benhabib’s The Claims of Culture: Equality and Diversity in the Global Era (2002), is considered in terms of three main virtues: first, it moves the question of political justice beyond the debate on the priority of recognition over distribution; second, it contributes to the expansion of the notion of communicative freedom and how it relates to rights; and third, it lays down the foundation for a cosmopolitan, post-nationalistic, form of citizenship that would have as its core the (...) rights of association and existence. Three areas of concern and potential disagreement are discussed: first, whether Benhabib could be accused of a type of culturalism that celebrates too quickly postethnic America at the expense of the agenda of racial justice still to be addressed in the United States; second, whether in this work Benhabib has given enough attention to the political claims of memory, especially when these claims are enunciated from colonial pasts; third, in conclusion, how cultural justice, or respect for cultural diversity, can contribute to biodiversity’s preservation in the age of the coming largest extinction of biodiversity. This article offers a political reading of Franz Kafka's posthumous work The Trial. In this novel, the main protagonist is subject to an arrest and trial conducted by the ambiguous authority of a shadowy court and its officials. This article explores Joseph K.'s experience of being subject to the Law, and relates this to our own understanding and experience of political subjectivity in modern times. K.'s doomed search for order through a ‘permanent resolution’ of his case is related (...) to the modern desire for order: Specifically, the desire for both philosophical and political frameworks that provide narratives or certainty. Here modernity is understood to be characterized by an anxiety brought about by a crisis in authorship and authority. The article then considers K.'s desire for justice and the Law, and his entanglement with the power of the court, as analogous to the modern experience of the triad of justice–law–power, which is subsumed under the banner of ‘sovereignty’. In particular, the article explores K.'s inability to locate, read, or fix the Law; a problem that is also reflected in the aporia of sovereignty as justice–law–power. This article offers a political reading of Franz Kafka's posthumous work The Trial. In this novel, the main protagonist (Joseph K.) is subject to an arrest and trial conducted by the ambiguous authority of a shadowy court and its officials. This article explores Joseph K.'s experience of being subject to the Law, and relates this to our own understanding and experience of political subjectivity in modern times. K.'s doomed search for order through a ‘permanent resolution’ of his case (...) is related to the modern desire for order: Specifically, the desire for both philosophical and political frameworks that provide narratives or certainty. Here modernity is understood to be characterized by an anxiety brought about by a crisis in authorship and authority. The article then considers K.'s desire for justice and the Law, and his entanglement with the power of the court, as analogous to the modern experience of the triad of justice–law–power, which is subsumed under the banner of ‘sovereignty’. In particular, the article explores K.'s inability to locate, read, or fix the Law; a problem that is also reflected in the aporia of sovereignty as justice–law–power.
