Este artículo revisa los fundamentos del utilitarismo de Jeremy Bentham y las principales críticas a esta doctrina, profundizando en aquella que sostiene su incompatibilidad con el respeto irrestricto de los derechos humanos. Insertándose en esta problemática, analiza una paradigmática propuesta política del filósofo inglés: el panóptico, proyecto arquitectónico formulado por Bentham a finales del siglo XVIII con el fin de reformar el sistema penitenciario europeo. A partir del análisis del Panóptico –que se descubre como una aplicación coherente del utilitarismo benthamiano–, (...) se postula que: a) esta doctrina fomenta un trato humanitario; b) los derechos humanos no quedan garantizados, sino condicionados al grado de beneficio colectivo que generen; c) este utilitarismo supone un cuestionamiento por la universalidad e irrevocabilidad de dichos preceptos. The article traces origins of the contradiction that calls into being the polemics on the moral status of duties to close persons. Special obligations are created by the unique life narrative of an actor that makes different recipients of her actions more or less distant. Those who are less distant are “close ones.” Those who are more distant are “strangers.” The basis of this distance can be different: individual sympathy, consanguinity, belonging to cultural, territorial and political communities. Special obligations presuppose (...) that the preferential treatment of “close ones” is not only permissible but obligatory. This feature of moral duties to close persons makes moral philosophers suspicious because they are prone to endow moral requirements with two interrelated properties: universality and the high level of generality. The main reason for this is that the typical moral duty is a duty of every human being to another human being without any further qualifications. Against the background of such duties, any preference to close persons looks like the breach of moral equality and manifestation of impermissible partiality. Though, common moral beliefs persistently include special obligations in the whole system of moral duty. R. Goodin thinks that they have a priority over positive general duties and yield to negative general duties. The empirical researches of moral evaluations which reviewed in this article in general confirm this conclusion. The ethical theory cannot ignore fundamental features of common moral beliefs. That is why it is doomed to look for ways of reconciling the moral equality and impartiality with the preferential treatment of close persons embedded into special obligations. (shrink)

This paper seeks to address the question of schooling for democracy by, first, identifying at least one form of social character, dependent, after Marcuse, on the historical emergence of a “new sensibility.” It then explores one pedagogical thread related to the emergence of this form of subjectivity over the course of the last two centuries in the west, and traces its influence in the educational counter-tradition associated with philosophical anarchism, which is based on principles of dialogue and social reconstruction as (...) opposed to monologue and reproduction. The idea of a dialogical school has been made possible by a historical shift in adult views of child as interlocutor rather than “othered” object of adult formation—a shift that can be observed in an historical process of “closer approaches” between adult and child and a recognition of childhood and adulthood as forms of subjectivity that lie on a synchronous rather than a diachronic lifespan continuum. Finally the author identifies an archetype of “school” understood as a specific type of intentional community—an experimental zone in which participants are allowed and encouraged, through explicitly dialogical practice, to develop the personal and relational habits that make authentic democracy possible—a communal form that gives practical meaning to Dewey’s notion of school as “embryonic society”: a utopian space where natality is recognized as a fundamental cultural force, and where the evolutionary possibilities inherent in neoteny are taken as normative. The contemporary situation within the realm of ethical theories is quite complicated. Were it not enough that many classical ethical theories are evolving into the new modern forms, new types of ethical theories are arising, as well. The main aim of the paper is to introduce this issue of ethical theories which are known under the term hybrid ethical theories. A secondary aim of the paper is to describe and characterize the contemporary ethical theory of ethics of social consequences, and (...) look for the answer whether it can be an example of this type of theory. To achieve the scope, the paper begins with a short introduction into the issue of contemporary consequentialism, followed by a presentation of the concept of hybrid ethical theories and its examples. Later the variability of consequentialism and ethics of social consequences are presented. The normative basis of this theory is subsequently analysed and explored in the context of hybrid ethical theories. Finally, the study clarify that the ethics of social consequences might be considered as a hybrid ethical theory. (shrink)

Among three possible avenues toward a good society ? revolutionary Marxism, liberal?democratic reform, and radical citizenship education ? this paper examines and advocates the third. Societies are held to be ?good? so long as the Most Basic Rights are in fact enjoyed by all (i.e. the right (1) to stay alive, (2) to remain unmolested, and (3) to be free to develop one's potentialities). Some key propositions in ?contract theory? as represented by such diverse theorists as Socrates, Hobbes, Locke, Rousseau, (...) and Tussman and Meiklejohn are discussed, and an alternative tradition, ?freedom theory?, is sketched, with contributions from Socrates, Godwin, Thoreau, and Camus. An argument is then developed to the effect that the contract theorists have all contributed to the basis on which the contemporary ?liberal make?believe? rests. This term refers to the myth that our society is democratic, i.e. that working (only) within the system of our constitutional procedures will or can lead toward a just society. Finally, it is argued that the highest priority in citizenship education is to destroy this liberal make?believe, and that freedom theory provides a better foundation than contract theory in the struggle for human rights, and for mankind's survival. This article ascertains what philosophical implications can be drawn from the moral idea of personhood dominant in African philosophy. This article aims to go beyond the oft-made submission that this moral idea of personhood is definitive of African moral thought. It does so by advancing discourse with regards to personhood by exploring its relationship with another under-explored idea in African ethics, the idea of partialism. This article ultimately argues that the idea of personhood can be associated with two (related) sorts (...) of partialisms: agent-related and other-centered partialisms. (shrink)
