The paper argues that two distinct and independent notions of plurality are involved in natural language anaphora and quantification: plural reference (the usual non-atomic individuals) and plural discourse reference, i.e., reference to a quantificational dependency between sets of objects (e.g., atomic/non-atomic individuals) that is established and subsequently elaborated upon in discourse. Following van den Berg (PhD dissertation, University of Amsterdam, 1996), plural discourse reference is modeled as plural information states (i.e., as sets of variable assignments) in a new (...) dynamic system couched in classical type logic that extends Compositional DRT (Muskens, Linguistics and Philosophy, 19, 143-186, 1996). Given the underlying type logic, compositionality at sub-clausal level follows automatically and standard techniques from Montague semantics become available. The idea that plural info states are semantically necessary (in addition to non-atomic individuals) is motivated by relative-clause donkey sentences with multiple instances of singular donkey anaphora that have mixed (weak and strong) readings. At the same time, allowing for non-atomic individuals in addition to plural info states enables us to capture the intuitive parallels between singular and plural (donkey) anaphora, while deriving the incompatibility between singular (donkey) anaphora and collective predicates. The system also accounts for empirically unrelated phenomena, e.g., the uniqueness effects associated with singular (donkey) anaphora discussed in Kadmon (Linguistics and Philosophy, 13, 273-324, 1990) and Heim (Linguistics and Philosophy, 13, 131-177, 1990) among others. Summary The object of this study is to analyse certain aspects of the debate between David Brewster and William Whewell concerning the probability of extra-terrestrial life, in order to illustrate the nature, constitution and condition of natural theology in the decades immediately preceding the publication in 1859 of Charles Darwin's Origin of species. The argument is directed against a stylised picture of natural theology which has been drawn from a backward projection of the Darwinian antithesis between natural selection and certain (...) forms of the design argument. Contrary to the popular image of natural theology as an essentially static, autonomous and monolithic set of presuppositions about the existence of design in nature, the paper underlines the existence of a fundamental divergence of strategies within natural theology, a divergence that, in the case of Brewster and Whewell, can be correlated with the religious cultures to which they most closely belonged. The fact that, in the plurality of worlds debate, their respective positions became mutually exclusive suggests that the fragmented and disordered state of natural theology, only too apparent before the Darwinian impact, was occasioned as much by the ulterior problem of rationalising the excessive space of the astronomers and the excessive time of the geologists as it was by any principle of the uniformity of nature in the biological sphere. The argument is substantiated with particular reference to the breakdown in communication as Brewster and Whewell developed conflicting strategies to expose the ?development hypothesis? that had appeared in Vestiges. Their altercation also reveals a certain conflict of status concerning the conclusions of astronomy and geology which, in turn, suggests that tensions between the physical and life sciences were not peculiar to the period following the publication of Darwin's theory. This Article examines normative arguments for legal pluralism in regulation. First I briefly set out what we know in fact about how plural regulatory orderings interact and compete with state agency regulatory action. Second, I sketch, and reject, a simple legal pluralist response to regulatory pluralism. In the third part of the Article I show that "responsive" and "reflexive" approaches to intentional pluralization in the design of law should be seen as providing different but complementary pictures of pluralized law. Finally (...) I argue that this pluralized view of law might provide us with the conceptual tools to identify a type of emergent, pluralistic law, without or beyond the state, which would be relevant to thinking about both transnational regulation and multiculturalism. Abbot Heng Lyu, the monks and nuns, and members of the Dharma Realm Buddhist Association hosted the dialogue at (...) the City of Ten Thousand Buddhas in Talmage, California. The community had transformed their Confucius Hall into a chapel, with a large, newly constructed wooden cross on a wall above an altar facing out from a raised platform, so the Catholic delegation would have a space for worship. A special poster announcing the theme of the conference, "Walking the Bodhisattva Path/Walking the Christ Path," showing a Buddhist dharma wheel at one foot of a bridge and a Celtic cross at the other foot, had been created by the hosting community.The daily schedule for the dialogue did not interfere with the monastic routine at the City of Ten Thousand Buddhas, which included early morning chanting (4:00-5:00 am), daily rituals in the Buddha Hall, and the single large meal for monastics before noon to which all participants were invited. Catholics and Buddhists meeting in the dialogue began each day with an optional forty-five minutes of quiet sitting together in the monastery meditation hall, each following their own form of meditation and prayer. There was a Eucharist on Friday and Saturday evenings for the Catholics and to which the Buddhists were invited, and additional meals of breakfast and supper throughout the meeting at the City's Jyun Kang Restaurant.Fourteen Buddhists and fourteen Catholics participated in the formal discussions. Each participant spoke on what it means to them to follow Christ or the way of the Bodhisattvas or enlightened beings. In addition to speaking, each participant distributed a short passage, usually from a traditional text, on this topic. Several passages from Master Dogen's Shobogenzo and the Gospel of John were among those shared by the group. Other passages shared were taken from the Avatamsaka Sutra and the Shurangama Sutra and from the other gospels and the writings of Zen master HakuinZenji, the Dalai Lama, Korean Zen Master I-sahn Hye-yeon, the teachings of Master [End Page 247] Hsuan Hua, Shantideva, Origen, St. Ignatius, St. Benedict, the author of The Cloud of Unknowing, St. John of the Cross, and Chiara Lubich. A minute of silence separated the fifteen-minute segments for each presentation. With so large a group, most of the time in the formal sessions involved listening to series of presentations; however, during discussion periods the participants asked several challenging questions of one another.Some participants noted the tension they felt between belonging to a particular religious group and the need to let go of any consequential narrowness. The goal of the discussion was to promote understanding of the differences and similarities between Christianity and Buddhism. At one point, the participants noted several concerns about mutual enrichment: whether Buddhist methods can be separated from Buddhism and Christian methods from Christianity, and what specific aspects of Christian practice truly enrich Buddhists and which Buddhist practices likewise enrich Christians. Several times participants discussed their understanding of terms such as transformation, grace, the incarnation and the passion of Jesus, discernment of spirits, prayer, Buddha-nature, and related terms. There was consensus that Buddhists and Catholics can practically help one another regarding mental cultivation and religious precepts. They expressed this consensus in their choice of the topic forthe next dialogue, "Transformation of Hearts and Minds: Chan/Zen-Catholic Approaches to Precepts."The group agreed to reconvene in 2004 to respond to six presentations, three from each side, on different aspects of this topic.Chairing the sessions were Rev. The paper assesses the questions if and, if yes, how the republican conception of free statehood can and should inform a compelling understanding of a legitimate post-Westphalian political order. To answer these questions, it, first, reconstructs the foundational arguments of republican internationalists in favour of free states and, second, assesses the points of contention republican cosmopolitans raise. Third, it develops an alternative approach, a republicanism of plural polities: Based on a relational and multi-dimensional understanding of citizenship, the paper questions (...) the strong internationalist reliance on the citizenship-state-nexus and on statehood in general, but also takes issue with cosmopolitans’ neglect of the boundedness of democratic self-determination. A republicanism of plural polities as a multi-perspectival approach to democratic institution-building in and beyond the state is open to constellations of plural polities of different forms and on different political levels while simultaneously recognising the particularity of each ‘free polity’. It thereby adds a new dimension to debates on the political forms legitimate institutions can assume under post-Westphalian conditions and opens avenues for research on inter-polity relations, on more complex constellations of self-rule and shared rule as well as of multilateral decision-making, on sovereignty and independence. Firearms were associated with 30,136 deaths in the United States in 2003; of these, 11,920 were homicides. For every firearm homicide, there are four people who suffer non-fatal firearm assaults. Like many other consumer products in the US, most guns are initially sold to the public through a network of retail dealers. Persons in the business of selling firearms must obtain a federal firearm dealer's license. There were more than 54,000 federally licensed gun dealers in the United States (...) in 2005, though this reflects a seventy-eight percent decline since 1994. Some states also require a state license to sell firearms.Licensed firearm dealers are an important source of guns for criminals and gun traffickers. In one analysis of gun trafficking investigations conducted by the Bureau of Alcohol, Tobacco and Firearms, licensed dealers accounted for a plurality of all guns diverted to the illegal market. In the wake of recent attempts at alternate history (Bowler 2013), this paper suggests several avenues for a pluralistic approach to Charles Darwin and his role in the history of evolutionary theory. We examine in what sense Darwin could be described as a major driver of theoretical change in the history of biology. First, this paper examines how Darwin influenced the future of biological science: not merely by stating the fact of evolution or by bringing evidence for it; but by (...) discovering natural selection, and giving it pre-eminence over any other mechanism for evolution; and also by proposing a masterful and quite unique synthesis of many scientific fields. Contrasting Darwin’s views with those of A.R. Wallace, I conclude that “natural selection” is clearly an original contribution, that it had no forerunners or co-discoverers, and could barely have appeared after Darwin conceived of it. This specificity of Darwin’s contribution is an invitation to be strongly presentist (Loison 2016) and to adopt only weak counter-factuals. In contrast, there are possible ways to use strong counter-factuals as attempts to “pluralize” the history of biological theory: i.e. imagine new possible avenues for the development of evolutionary biology. The idea that evolution was a theory “in the air” suggests that evolutionary theory could have developed in a world without Darwin, especially if we accept to delete not only “Darwin” but “England”. France and Germany are examined as possible countries where evolutionary ideas would have thrived even with no contribution from the English scientists. Finally, the paper suggests another counter-factual hypothesis: deleting not Darwin and his Origin but the Darwin Industry itself. This may allow us to read the Origin of Species with fresh eyes and to discover Darwin’s life-long interest in variation and its laws, as many of his early readers did. (shrink)

The fourth-century thinker and theologian Gregory of Nyssa was a convinced realist about universals. According to him, there is just one substance man for all the individuals of the species man and this universal substance is completely instantiated by each individual. In two of his treatises – the Ad Ablabium and the Ad Graecos – he draws linguistic consequences from this realist position. This enquiry results in the thesis according to which it is incorrect to use natural kind terms in (...) the plural form, because that would involve stating a plurality of substances, when in fact there is just one substance for all the individuals of a given kind. In consequence, since the substance of all individual human beings is the same, the word ‘man’ can only be used adequately in the singular form. In this contribution, Gregory's reasoning is reconstructed. In the second part of the paper, the posterity of his theory and its endorsement by Theodore Abū Qurrah at the turn of the eighth and ninth centuries are examined. (shrink)

The paper focuses on the semantics of distributivity, grammatical number, and cardinality predicates. I argue that constructions involving so-called ‘dependent plurals’, i.e. plurals lacking cardinality predicates occurring in the scope of certain quantificational items such as all and most, pose a challenge to familiar semantic frameworks that distinguish between two sources of multiplicity: mereological plurality and distributive quantification. The successful global diffusion of formal democracy has gone hand in hand with the hollowing out of its substance. Ever more realms of domestic public policy are removed from the purview of national legislative deliberation and insulated from popular scrutiny. Rhetoric of accountability has accompanied the increasing unaccountability of international financial and trade organizations, transnational corporations as well as of states and NGOs. The new architecture of global governance characterized by legal plurality and overlapping sovereignties has facilitated a (...) game of ‘passing the blame’ among these four actors. There is a curious ambivalence in current debates on globalization about the role of the state, which is conceived of as both central and marginal. Globalization is seen to be marked by the decline of both the external and the internal sovereignty of the state. Contrary to such a view, it will be argued here that the state is both an agent and an object of globalization. Although inadequate, the state remains indispensable as its laws and policies play a key role in transposing neo-liberal agendas to the national and local levels. If in the age of globalization and of economic Empire, political violence has been replaced by legal violence, resistance to it is also articulated in the language of law. This paper focuses on the dynamic of legal politics against impoverishment and dispossession caused by the new global designs of intellectual property protection, biodiversity conservation and privatization of the commons in India. The case studies in this paper point to the emergence of intertwined structures of rule, overlapping sovereignties and complex processes of legal transnationalization that have reconfigured the relations between law, state, and territoriality. If welfare states were concerned with the redistribution of risk and resources, cunning states seek to redistribute responsibility. Sensitivity to the history of colonialism would be an important corrective to the presentism and Westerncentrism of analyses of (legal) globalization. (shrink)

Looking at responsibility within a Lévinasian sense, human beings are firstly seen not in the philosophically traditional sense, of being egocentric, but rather seen as ethical subjects based on “the other” (Lévinas & Hand, 1989). The purpose of this paper is to examine the notion of responsibility as Lévinas conceptualized in the idea that human beings are responsible for not only themselves but for others. Lévinas within “Ethics as First Philosophy” (Lévinas & Hand, 1989) states that before all other (...) forms of being in the world there must be responsibility to the Other (Lévinas & Hand, 1989). Lévinas defines this to mean that before freedom of the subject, and their subjectivity, before self-consciousness, before the consciousness of consciousness, before being, and before relativity there is “responsibility for the Other pre-exists any self-consciousness” (Lévinas & Hand, 1989, p.75). Perhaps, Lévinas is saying that a human beings obligation comes before all of what follows from our being in this world, our obligation to the Other beginning with the “face to face” (Lévinas & Hand, 1989, p.75), interaction, which is our first and foremost responsibility, the responsibility to the Other. And to be ethical beings who begin with responsibility we rely on the fundamental relationship of others. This notion of responsibility appears when we encounter, in the face-to-face interaction, the unknowable other. However, does this responsibility extend to more than two individuals and to those outside our immediate proximity? For example, Lévinas states that it is the “face to face” notion of seeing one in distress, yet what if it is a group of people, and what if they are not in close proximity but on the other side of the world? What if they are on the other side of a screen that can also be artificial intelligence in our modern era. Are we still responsible? And if we are responsible, how does Lévinas’s concept of responsibility fit into that situation or is it limited? I want to examine responsibility in terms of proximity through a Lévinasian ethical lens and plurality, defined as more than two individuals, by questioning responsibility in terms of relationality, and vulnerability. I will be looking mainly at five authors Emmanuel Lévinas, Ernst Van Alphen, Judith Butler, Kevin Quashi, and Lisa Guenther, to answer the question of whether Lévinas’s definition of responsibility includes proximity, and plurality. This volume is a tribute to Roger Schwarzschild's immense contributions in the formal semantics of nouns, focus, degrees and space, and tense and aspect. Collectively, the papers in the volume reveal parallels across ontological domains, in particular in the context of elements with internal structure, like plural sets, alternative sets, degree intervals, temporal intervals, and vectors. This research suggests that the structure of an entity could inform the semantic behavior of that entity just as much than its semantic type or (...) lexical category. And because these structures dictate the formation of semantic alternatives, it can help inform focus semantics and scalar implicature as well. Old questions on plurals, focus and degree expressions get new answers in this collection of papers in honor of Roger Schwarzchild. If we are looking for an Ur-explanation for the persistence of the Ur-myth, or any other myth, in our literature, could we not more directly find it in the structure of a mind which does not have to remember in order to imitate? The occasion of both myth and literature is the social life of the species which, in Starobinski's sense, is a history of continual eviction; but as regards the apparatus of thought by which this social life is reflected (...) in art it is more a history of assimilation and repetition. "The work of the brain," to cite a recent article in Scientific American, "is to create a model of a possible world rather than to record and transmit to the mind a world that is metaphysically true…Different worlds are presumably constructed by similar species."1 And, presumably, similar worlds are constructed by similar species. The article reveals the nature and manifestations of Ukrainian religious pluralism. Despite the constant interest in the topic - the plurality of religious life in Ukraine, science has not yet clarified the causes and roots of this phenomenon. The author analyzes the historical, psychological, socio-political factors that caused the religious diversity of Ukraine. The presence of many religious traditions within one ethnic and state territory promotes tolerant relations between bearers of different religious beliefs. Ukraine's religious plurality distinguishes Ukrainians (...) from other nations. This gives grounds to consider Ukraine a unique religious phenomenon of the European level. Religious plurality is a condition for the establishment of the principles of freedom of religion, freedom of choice. The author derives worldview plurality and polydenominationalism in Ukraine from the history of the Ukrainian people, looking for their origins in the pre-Christian and later early Christian era. The presence of heresy in Ukraine as a generalized form of coexistence of different worldviews explains the current richness of religious traditions, their syncretization. The article makes an intermediate conclusion that the history itself, living conditions, national character of the people formed Ukraine denominationally plural. Based on such a historical foundation, since gaining state independence in 1991, Ukraine has been self-determined in its priorities regarding the country's spiritual / religious development. The Law “On Freedom of Conscience and Religious Organizations” adopted by the Verkhovna Rada of Ukraine created a legal basis for the equal existence and development of different religions in Ukraine. The plurality of Ukrainian society is enshrined in law. The basic principles of the plurality of religious life are confirmed by specific digital data that illustrate the richness of religious traditions in Ukraine quantitatively and qualitatively. The author provides statistics on all religions and denominations that exist in Ukraine, giving the number of communities, monasteries, schools, priests, publications and more. Detailed information seeks to form a holistic picture of the religious life of Ukraine. The analyzed data give grounds to single out the factors that determine the religious plurality of Ukraine. According to the author, at the beginning of the XXI century the denominational network of Ukraine has largely already formed. The mass emergence of new religious movements is unlikely. Nevertheless, Ukraine has not yet exhausted all the possibilities of religious pluralism. It can grow not only due to the emergence of some exotic, technological, syncretic religions, but also because of intra-confessional division or unity of communities. In Ukraine, there are structures that cultivate interreligious tolerance, which will ensure a high level of religious freedom. However, religious pluralism in Ukraine is periodically threatened by various circumstances - internal and external, general and local, collective and personal. In conclusion, religious pluralism is determined as a guarantor of religious freedom, the right of everyone to profess his chosen system of spiritual values. (shrink)

Kirk Ludwig presents a philosophical account of institutional action, such as action by corporations and nation states, arguing that it can be understood exhaustively in terms of the agency of individuals and concepts constructed out of materials that are already at play in our understanding of individual action. He thus argues for a strong form of methodological individualism. The state of affairs of some things falling under a predicate is supposedly a single entity that collects these things as its constituents. But whether we think of a state of affairs as a fact, a proposition or a possibility, problems will arise if we adopt a plural logic. For plural logic says that any plurality include themselves, so whenever there are some things, the state of affairs of their plural self-inclusion should be a single thing that collects them (...) all. This leads to paradoxes analogous to those that afflict naïve set theory. Here I suggest that they are the very same paradoxes, because sets can be reduced to states of affairs. However, to obtain a consistent theoretical reduction we must restrict the usual axiom scheme of Comprehension for plural logic to ‘stratified’ formulas, to avoid viciously circular definitions. I prove that with this modification to the background plural logic, the theory of states of affairs is consistent; moreover, it yields the axioms of the familiar set theory NFU. (shrink)

Kit Fine (2000) breaks with tradition, arguing that, pace Russell (e.g., 1903: 228), relations have neither directions nor converses. He considers two ways to conceive of these new "neutral" relations, positionalism and anti-positionalism, and argues that the latter should be preferred to the former. Cody Gilmore (2013) argues for a generalization of positionalism, slot theory, the view that a property or relation is n-adic if and only if there are exactly n slots in it, and (very roughly) that each slot (...) may be occupied by at most one entity. Slot theory (and with it, positionalism) bears the full brunt of Fine's (2000) symmetric completions and conflicting adicities problems. I fully develop an alternative, plural slot theory (or pocket theory), which avoids these problems, key elements of which are first considered by Yi (1999: 168 ff.). Like the slot theorist, the pocket theorist posits entities (pockets) in properties and relations that can be occupied. But unlike the slot theorist, the pocket theorist denies that at most one entity can occupy any one of them. As a result, she must also deny that the adicity of a property or relation is equal to the number of occupiable entities in it. By abandoning these theses, however, the pocket theorist is able to avoid Fine's problems, resulting in a stronger theory about the internal structure of properties and relations. Basically, one's "vocation" is to express love and compassion toward all through engagement with the structures of existence that hinder justice through whatever social or occupational role (one's "calling") one occupies. In Luther's theology, there is no privileged ecclesiastical institution, no privileged theological class, and in his better moments, no privileged doctrinal system that mediates God's grace—meaning God's love and compassion. Instead, grace meets us where we are in the midst of whatever our "calling" might be; our "vocation" is to serve others in community through our callings: teacher, pastor, parent, physician, farmer, clerk, politician, or any other honest occupations by which persons make their way in the world. In this article, I argue that a capacity for mindreading conceived along the line of simulation theory provides the cognitive basis for forming we-centric representations of actions and goals. This explains the plural first personal stance displayed by we-intentions in terms of the underlying cognitive processes performed by individual minds, while preserving the idea that they cannot be analyzed in terms of individual intentional states. The implication for social ontology is that this makes sense of the plural subjectivity of (...) joint actions without making group agents require either a corporate body or the unity of consciousness. It has been claimed in the literature that collective intentionality and group attitudes presuppose some “sense of ‘us’” among the participants (other labels sometimes used are “sense of community,” “communal awareness,” “shared point of view,” or “we-perspective”). While this seems plausible enough on an intuitive level, little attention has been paid so far to the question of what the nature and role of this mysterious “sense of ‘us’” might be. This paper states (and argues for) the following five claims: (...) (1) it is neither the case that the sense in question has the community (or “us”) in its content or as its object nor does the attitude in question presuppose a preexistent community (or “us”) as its subject. (2) The “sense of ‘us’” is plural pre-reflective self-awareness. (3) Plural pre-reflective self-awareness plays the same role in the constitution of a common mind that singular pre-reflective self-awareness plays in the individual mind. (4) The most important conceptions of plural subjects, collective persons, or group agents in the current literature fail to recognize the nature and role of plural self-awareness, and therefore fall short in important respects. (5) In spite of the striking similarities between the plural and the singular mind, there are important differences to consider. In this paper, I distinguish three claims, which I label individual intentional autonomy, individual intentional autarky, and intentional individualism. The autonomy claim is that under normal circumstances, each individual's behavior has to be interpreted as his or her own action. The autarky claim is that the intentional interpretation of an individual's behavior has to bottom out in that individual's own volitions, or pro-attitudes. The individualism claim is weaker, arguing that any interpretation of an individual's behavior has to be given in (...) terms of individual intentional states. I argue that individual intentional autonomy implies neither individual intentional autarky, nor intentional individualism, with which it is usually lumped together. I further argue that this insight is the key to an adequate view of an important class of actions, i.e., plural actions. Modern knowledge of the world's religions brings to light the problem of religious plurality, meaning the problem of why there is such great religious diversity, and which set of religious beliefs, if any, can be judged to be true. In 1799 and in the later editions, the young Friedrich Schleiermacher offered a pioneering account of religion in his revolutionary work, widely known as the Reden, first rendered in English in 1893 with the title On Religion: Speeches to Its Cultured (...) Despisers, which this article summarises and critically evaluates in relation to that problem. Guided by the work of Eric Sharpe on the history of the comparative study of religion, the article locates Schleiermacher in the context of the state of knowledge about the plurality of religions when he wrote the Reden, compared to our present knowledge. The evaluation takes as its primary critical criteria the requirements of the academic study of religions, not the theological interests relevant to Schleiermacher as a Christian thinker. The evaluation yields a mixed verdict, noting four significant strengths in Schleiermacher's account of religion but also three important limitations, the main one arising, understandably, from his personal faith, but nonetheless a problem in the academic study of religions. At present, there is a widely shared doubt about theoretical or practical validity of “nation state” as a framework to grasp the reality of the social. This doubt legitimately boils down to a more fundamental question, within or without the realm of social science, that is, whether or not the current conceptualization of the social is caught in a sort of anachronism that blocks thinking and acting in terms of transforming reality. In this paper, I would like to delineate the (...) situation not merely as a theoretical shortcoming of cotemporary social science but as a challenge: a call for reactivated social sensitivity. In an effort to meet this challenge, the socio-political significance of dialogue and human plurality as its critical element will be elaborated in search of cosmopolitan opening to the ways to think and act for the social in the making. Resumo O autor defende uma descrição normativa fraca do constitucionalismo internacional à luz de dois factos: a contínua relevância da soberania do Estado face à hegemonia de superpotências e a necessidade imperiosa de um regime supranacional eficaz de direitos humanos. Ao defender uma institucionalização constitucional de direitos humanos, que inclui aspectos de justiça processual e material, mostra-se que, como nos casos domésticos, tal institucionalização pode e, talvez deva, incorporar um procedimento de controlo judicial que ascende ao nível de controlo constitucional. (...) De facto, o parecer do Tribunal Europeu de Justiça no caso Kadi estabeleceu um possível precedente para o controlo do Conselho de Segurança no sentido do cumprimento dos direitos humanos e outras normas peremptórias. Dada a necessidade de perícia técnico legal para a elaboração de tal controlo, um caso prima facie pode ser feito para o estabelecimento de um Tribunal Constitucional especializado ao nível internacional. Contudo, dado o impacto desempenhado pelo poder político na resolução técnica da adjudicação de casos específicos e concretos, dentro de um sistema jurídico altamente fragmentado, e dado o facto de que o controlo constitucional também toca questões mais abstractas e menos técnicos de justiça social, o autor recomenda, que a função de controlo constitucional seja disseminada por várias instituições globais, incluindo a actual Assembleia Geral das Nações Unidas e na esfera pública global. O controlo constitucional pluricêntrico, bem como a institucionalização dos direitos humanos decorre do desacordo multicultural existente acerca do significado desses direitos e da ameaça da hegemonia de superpotências sobre as instituições globais. Palavras-chave : Constitucionalização, Controlo Constitucional, Direitos Humanos, Habermas, Nações Unidades, Pluralismo LegalI defend a weakly normative description of international constitutionalism in light of two facts: the continued salience of state sovereignty in the face of superpower hegemony and the overriding need for an effective supranational human rights regime. In arguing for a constitutional institutionalization of human rights that includes aspects of procedural and substantive justice, I show that, as in the domestic case, such an institutionalization could and perhaps should incorporate a procedure for judicial review ascending to the level of constitutional review. In fact, the European Court of Justice’s review of the Kadi case establishes a possible precedent for reviewing Security Council compliance with human rights and other peremptory norms. Given the need for technical legal expertise in elaborating such review, a prima facie case can be made for establishing a specialized constitutional court at the international level. However, given the impact that political power plays in the technical resolution of concrete, case-specific adjudication within a highly fragmented legal system, and given the fact that constitutional review also touches on more abstract and less technical issues of social justice, I recommend that the function of constitutional review be dispersed in several global institutions, including the current United Nations General Assembly and a global public sphere. The pluralization of constitutional review and the accompanying interpretation and institutionalization of human rights recognizes existing multicultural disagreement on the meaning of human rights and the threat of superpower hegemony over global institutions while anticipating the realization of a more monistic constitutionalization of international law with the growth of global solidarity between peoples.
