Allen Buchanan holds that nations do not have a general primary unilateral right to secede. However, nations could legitimately secede if there were a special right to do so, if it were the result of negotiations and, more importantly, if some previous injustice had to be repaired. According to Buchanan, the three kinds of injustice that allow for unilateral secession are: violation of human rights, unjust annexation of territories, and systematic violations of previous agreements on self-government. I agree that nations (...) only have a general remedial right to unilateral secession. But I argue that nations also have a general primary right to self-determination not held by other cultural groups. In virtue of this general primary right, nations also have a primary right to internal self-determination. I will then argue that the "past injustices" should include a failure to comply with internal self-determination. I also want to show that this alternative version of the Remedial Right Only theory meets the constraints, imposed by Buchanan himself, upon any satisfactory institutionalization of the principles governing secession. In the end, it will appear that my own version fares much better than Buchanan's in meeting these constraints. (shrink)

Most states are multination states, and most peoples are stateless peoples. Just as collectives can behave as sovereign states only if they are recognized by the international community, liberal multination states must recognize stateless peoples in order to determine their political status within that state. There is, however, no agreement on the kind of principles that should be considered, especially under classical liberalism, which gives individuals preeminence over groups. Liberal theories that attempt to accommodate collective rights are often based on (...) a comprehensive version of liberalism that subscribes to moral individualism. Within such a framework, they develop a watered-down concept of collective rights. In A Liberal Theory of Collective Rights Michel Seymour explores the theoretical resources of John Rawls’s political liberalism and shows that this particular approach can accommodate genuine collective rights. By Rawls’s account, Seymour explains, peoples are moral agents and sources of valid moral claims and are therefore entitled to collective rights. These kinds of rights translate, in the constitution of the multination state, to a true political recognition for stateless peoples. Ultimately, A Liberal Theory of Collective Rights answers three important questions: Who is the subject of collective rights? What is the object of collective rights? En partant de la notion d’« accommodement raisonnable » telle que comprise dans le contexte légal du Québec et du Canada, nous parvenons à une interprétation des fondements normatifs de la distinction entre droits fondamentaux et accommodements qui repose sur la raison publique. There are nationalisms and nationalisms, and as nationalisms vary from barbarous and murderous to benign and, all things considered, perhaps desirable, so theories of nationalism vary from irrational or turgid metaphysical accounts to reasonable and carefully articulated and argued theories of nationalism. André Van de Putte has well described some of the former while David Miller, Yael Tamir, Geneviève Nootens, Ross Poole, and Robert X. Ware have carefully argued for some modest forms of nationalism, sometimes explicitly and sometimes only by (...) implication. But there are also, as the reader will have seen, forcefully argued and systematic theories setting themselves against even the most sophisticated and plausible defences of nationalism. The articles of Harry Brighouse, Omar Dahbour, and Andrew Levine fall explicitly into that category and, we would argue, so does Allen Buchanan's carefully wrought article, though implicitly and by implication but not by programmatic intent. Dans la perspective du libéralisme politique, je pars d’une conception institutionnelle du peuple. Je me propose d’indiquer ensuite comment cette approche permet d’envisager des réponses à ces questions. | : In this paper, I examine in a programmatic fashion the relationship between peoples and territories. Are the borders of sovereign peoples sacred, natural and absolute, or even irrebuttable ? Does territory plays an important role for identity ? If so, is this relationship based on the sentimental attachment of citizens or on a rational preference ? Should it be explained instead by a historical relationship ? Is territory even constitutive of the identity of a people ? Does the principle of territorial integrity have priority over the principle asserting the right to self-determination of peoples ? Such are the issues that can be raised concerning the relationship between peoples and their territories. I want to present an account that I take to be original. Depuis 2006, le Québec débat âprement des règles gouvernant la laïcité de ses institutions et se trouve confronté à deux modèles apparemment irréconciliables : le républicanisme « jacobin » et le libéralisme individualiste, issus respectivement de la France et du Canada. En s’inspirant de la pensée du philosophe politique John Rawls, les auteurs proposent ici d’explorer une voie médiane mieux adap­tée à l’expérience québécoise. Dans ses travaux tardifs, Rawls met en avant une forme de libéralisme républicain affranchi de l’indi­vidualisme normatif (...) de Kant et de Mill et récuse le paternalisme qui vise à imposer aux citoyens une certaine éthique de vie. Tout en étant neutre à l’égard des conceptions individualiste et com­munautarienne de la personne, il cherche à équilibrer les droits collectifs des peuples avec les droits individuels des personnes. -/- C’est donc une conception strictement institutionnelle de la laïcité que présentent les auteurs, qui redéfinissent au passage l’interculturalisme, la liberté rationnelle et le consentement, ainsi que l’expérience religieuse, qui devient hybride, à la fois subjective et objective. En se servant de Rawls, ils expliquent clairement pourquoi l’expression de la religion fait partie de la liberté reli­gieuse, mais aussi pourquoi il faut faire la distinction entre les objets qui relèvent des libertés fondamentales et ceux qui sont sujets à des accommodements. Ils tracent ainsi une authentique troisième voie, qui pourrait bien faire sortir de l’impasse le débat québécois sur la laïcité. (shrink)

Crispin Wright attempts to develop a theory of truth which could be characterized as a form of minimalism, and he is favourable to a pluralistic account which allows for many different uses of the predicate "true", including one where the word is constrained by a norm of "superassertibility". In assessing these different claims made by the author, I adopt the position held by the deflationist philosopher. I try to show that his criticism of deflationism fails, and that there is a (...) version of this doctrine which is congenial with Wright's own approach to the problem of truth. (shrink)

The purpose of this paper is twofold. First, it offers a critique of the normative foundations of the 2019 Quebec Act respecting the laicity of the State. This is primarily based on the theses we developed in La nation pluraliste. Repenser la diversité religieuse au Québec (Presses de l’Université de Montréal, 2018), and elaborates a suitable diversity management model for Quebec using the republican liberalism described in Rawls’ later work. This discussion draws attention to certain pitfalls in the concept of (...) secularism as defended by the Coalition Avenir Québec government. Second, we present a methodological discussion on how political philosophy can contribute to the formation of law, by examining how our criticism of Act respecting the laicity of the State corresponds to an exercise in implementing Rawls’ own method of thoughtful balance. According to interpretationism, nothing can be intentionally meant, thought or performed independently of our interpretational practice. The presence of an interpretation (explicit or implicit) is a necessary condition on the existence of intentional contents expressed by verbal, mental or behavioral occurrences. In this paper, I criticize Donald Davidson’s interpretationism. I first characterize the view in its broad outlines. I then proceed to formulate some criticisms against it, and sketch an alternative approach : institutionalism. This approach suggests another way to conceive (...) of the relationship between meaning, understanding, intentional states and actions on the one hand, and ascriptive practices on the other hand. It is a relation between types and not between occurrences, and it is claimed that the types of states or acts that can express intentional contents do not exist independently of certain types of institutional facts. Cet ouvrage de Pascal Engel doit être fortement recommandé pour plusieurs raisons. On est d'abord frappé par l'ampleur du travail accompli et l'étendue du domaine couvert. La documentation est fouillée, l'exposé est clair et un équilibre est toujours maintenu entre les questions générales et les questions de détail. Engel ne perd jamais de vue la perspective d'ensemble qu'il s'est donnée et qui concerne la nature de la logique, y compris lorsqu'il s'emploie à faire certaines nuances ou à proposer une distinction (...) subtile. Il aurait été facile en pareille matière de proposer un mauvais choix de thèmes. Là encore, Engel s'est bien acquitté de sa tâche. On a affaire à un ouvrage dans lequel l'auteur va toujours droit à l'essentiel. Plusieurs sujets sont à peine effleurés, mais cette décision est très souvent heureuse puisqu'elle permet à l'auteur d'établir des liens entre des problématiques qui, de prime abord, semblent très éloignées les unes des autres. L'auteur fait montre d'un étonnant esprit de synthèse et plusieurs thèmes font, à ma connaissance, une première apparition dans la littérature philosophique francophone. Il s'agit donc d'une contribution à la philosophie de la logique qui mérite d'être signalée. On regrettera peut-être la présence d'un assez grand nombre d'erreurs typographiques. Dans la plupart des cas, il ne s'agit que de coquilles mais, dans d'autres cas, elles risquent de nuire à la compréhension du texte surtout lorsqu'elles interviennent dans des formules ou des définitions. RésuméLes expériences de pensée de Tyler Burge révèlent une tension entre deux sortes d'arguments visant à prouver la détermination de l'environnement sur les contenus d'états intentionnels. On se propose dans un premier temps de montrer que l'expérience de 1979 est plus fondamentale et moins compromettante du point de vue métaphysique, et qu'il faut en ce sens insister davantage sur les déterminations de l'environnement social plutôt que de l'environnement physique. On fait valoir ensuite avec b a r que I'expérience de 1979, (...) comme telle, n'a pas d'incidence sur les contenus de pensée tels qu'individéts dans la psychologie cognitive et n'affecte que les attributions d'attitudes dans la psychologie populaire. Il est démontré enfin que l'admission d'une théorie citationnelle des contenus de penséte renforce l'argument de Burge, permet de contourner l'objection de Loar, et résout plusieurs des difficultés auxquelles était confrontée la version initiale de l'expérience. Une hypothèse fondamentale avancée par Searle et Vanderveken dans Foundations of Illocutionary Logic est que la force illocutionnaire est un élé;ment essentiel de la signification conventionnelle. La signification conventionnelle, qui est une propriété d'énoncé, s'oppose en gros ici à la signification intentionnelle, qui est une propriété prédiquée aux locuteurs. J'aimerais questionner certaines des motivations qui sont susceptibles de nous amener à accepter ce point de vue.

Je propose une solution à l’énigme de Kripke en distinguant tout d’abord les usages matériel et intentionnel du verbe « croire ». L’usage intentionnel est ensuite analysé à partir de l’usage matériel. Une croyance intentionnelle n’est rien d’autre qu’une croyance matérielle réitérée, c’est-à-dire, une croyance matérielle que l’agent entretient au sujet de ses propres croyances. L’énigme de Kripke peut alors être résolue pourvu que l’on accepte aussi l’inscriptionnalisme. On est ainsi en mesure de reconnaître que Pierre a bel et bien (...) des « croyances » contradictoires, mais seulement au sens matériel de l’expression. Il n’a cependant pas de croyances intentionnelles contradictoires puisque les contenus de croyance sont des inscriptions et qu’il se croit lui- même en rapport avec ces inscriptions.I offer a solution to Kripke’s puzzle by first distinguishing between material and intentional uses of "believe". The intentional use is then analysed in terms of material uses. An intentional belief is nothing but a material belief that an agent entertains towards his own beliefs. Kripke’s puzzle can then be solved if inscriptionalism is also accepted. It can indeed be claimed that Pierre has contradictory "beliefs", but only in the material sense of the word. However, he does not have intentional contradictory beliefs since the contents of his beliefs are inscriptions and he represents himself as being directed towards those inscriptions. (shrink)

Un argument en faveur de l'infaillibilité a priori est considéré puis rejeté. Il s'agit de critiquer un argument de type cartésien visant à fonder la connaissance de soi sur un type privilégié de rapport épistémique. On montre que plusieurs catégories d'énoncés psychologiques à la première personne ne peuvent donner lieu à un tel savoir infaillible. La discussion culmine sur l'examen du Cogito. Il est démontré que le philosophe cartésien ne peut savoir a priori qu'il pense puisqu'il ne peut savoir a (...) priori que chaque inscription en lui de la forme verbale « Je pense » constitue un acte intentionnel de penser.An argument favourable to a priori infallibility is considered and then rejected. Specifically, it is a cartesian argument which purports to justify infallible self-knowledge on the basis of a special epistemic access. Many first person psy- chological sentences are shown to be defective in this respect. The discussion culminates with an examination of the Cogito. It is shown that the cartesian philosopher cannot claim to know a priori that he is thinking since he does not know a priori that all inscriptions in himself of the verbal form "I think" constitute an intentional act of thinking. I submit what I believe is a new definition of the nation. This paper is intended in part as a piece of conceptual analysis. Of course, in the attempt to be as clear as possible, I run the risk of becoming fairly abstract, and there are those who feel that abstraction in these matters is inappropriate. But I wish to face this challenge because disagreements over the nature of nationalism very often rest upon misunderstandings which are partly due to different (...) uses of the same words, or to an unclear understanding of the notions involved. I believe that the philosopher may modestly contribute to some clarification even if the hope of reaching "clear and distinct ideas" is most probably not going to be fulfilled. Intolerance and political differences are perhaps sometimes not totally unrelated to the difficulty of conceptualizing complex notions. Our inability in this regard stems from an inability to reflect upon a complex reality. This is why a philosophical account may be useful. (shrink)

RÉSUMÉ Je veux m'attarder à trois aspects importants du Droit des gens de John Rawls. Je veux tout d'abord montrer que cette oeuvre contribue à réfuter l’interprétation erronée selon laquelle Rawls souscrirait à une conception individualiste du libéralisme. Je veux en deuxième lieu souligner l’importance d'intégrer un droit des peuples au sein de la philosophie politique libérale. Le principe de l’égalité entre les peuples peut être interprété comme ayant un corollaire, à savoir, le principe du développement égal des peuples, et (...) ce dernier principe est susceptible de nombreuses applications progressistes au niveau de la justice internationale. En troisième lieu, je veux suggérer que même si des amendements importants étaient apportés à la version initiale du Droit des gens, au point d'inclure, à l’encontre de l’opinion exprimée par Rawls, le principe de différence et d'en reconnaître l’universalité, on ne serait quand même pas en présence d'un libéralisme de type individualiste. ABSTRACT I would like to consider three important aspects of Rawls' Law of Peoples. I want to show, first, that the work serves to refute the mistaken interpretation according to which Rawls would subscribe to an individualistic interpretation of liberalism. Second, I also want to underline the importance of incorporating a law of peoples within a liberal political philosophy. The principle of equality between peoples can be interpreted as having a corollary, the principle of an equal development between peoples, and this last principle paves the way to many progressist applications at the level of international justice. Third, I want to suggest that even if amendments were made to the initial version of The Law of Peoples in such a way that, pace Rawls, it would now contain among its principles the difference principle and would recognize its universal status, the resulting approach would still not be a liberal individualism. Critical reflections by established academics on the crisis of multiculturalism that occurred in Great Britain, Netherlands and Canada. It provides an occasion to develop a sophisticated understanding of societies characterized by religious, ethnic and cultural diversity.

ABSTRACT: I submit what, I believe, is a fairly new definition of the nation, one which I call the sociopolitical conception. I try to avoid as much as possible the traditional dichotomy between the exclusively civic and ethnic accounts, and try to explain my reasons for doing so. I also adopt as a general framework a certain conceptual pluralism which allows me to use many different concepts of the nation. After that, I proceed by formulating some constraints on any acceptable (...) new definition. My own sociopolitical conception is then finally introduced. The sociopolitical nation is a political community, most often composed, sociologically, of a national majority, national minorities, and individuals with other national origins. The concept of national majority is crucial for the account and refers to the largest sample in the world of a given population sharing a common language, history, and culture. National minorities are defined as extensions of neighbouring nations, while individuals of other national origins are those members of ethnic minorities that have come from immigration. There would be no sociopolitical nation if there were no national majority, but this is compatible with a pluricultural and multi-ethnic view of the nation, since the political community may also include national minorities and individuals with a different origin. I end the article by showing that this definition meets the constraints that were initially introduced. (shrink)
