The paper by Susan M. Wolf and Jeffrey P. Kahn published in this issue of the Journal of Law, Medicine & Ethics notes that we are members of the Working Group on Genetic Testing in Disability Insurance and that the members of the Working Group do not necessarily subscribe to its recommendations. Although we agree with some of Wolf and Kahn's recommendations, we do not agree with recommendations 1, 3, 4, and 5 for individual disability insurance and recommendations 1, (...) 2, and 3 for group disability insurance. We use this paper to delineate our areas of disagreement, but we do not discuss areas such as employment law as they are not our areas of expertise.First, understanding our roles on the Working Group is important. As members, we provided technical expertise on disability insurance. Our input to the Working Group represents our individual opinions. (shrink)

As members of the Working Group on Genetic Testing in Disability Insurance, the authors of this alternative opinion describe their areas of disagreement with some of the conclusions in the paper written by Susan M. Wolf and Jeffrey P. Kahn.

Following Snyderman and Rothman, we surveyed expert opinions on the current state of intelligence research. This report examines expert opinions on causes of international differences in student assessment and psychometric IQ test results. Experts were surveyed about the importance of culture, genes, education, wealth, health, geography, climate, politics, modernization, sampling error, test knowledge, discrimination, test bias, and migration. The importance of these factors was evaluated for diverse countries, regions, and groups including Finland, East Asia, sub-Saharan Africa, Southern Europe, the Arabian-Muslim (...) world, Latin America, Israel, Jews in the West, Roma, and Muslim immigrants. Education was rated by N = 71 experts as the most important cause of international ability differences. Genes were rated as the second most relevant factor but also had the highest variability in ratings. Culture, health, wealth, modernization, and politics were the next most important factors, whereas other factors such as geography, climate, test bias, and sampling error were less important. The paper concludes with a discussion of limitations of the survey. (shrink)

Expert testimony figures in recent debates over how best to understand the norm of assertion and the domain-specific epistemic expectations placed on testifiers. Cases of experts asserting with only isolated second-hand knowledge (Lackey 2011, 2013) have been used to shed light on whether knowledge is sufficient for epistemically permissible assertion. I argue that relying on such cases of expert testimony introduces several problems concerning how we understand expert knowledge, and the sharing of such knowledge through testimony. Refinements are needed to (...) clarify exactly what principles are being tested by such cases; but once refined, such cases raise more questions than they answer. (shrink)

Genetic testing has historically been performed in the context of chronic disease and cancer diagnostics. The timelines for these tests are typically measured in days or weeks, rather than in minutes. As such, the concept that genetic information might be generated and then used to alter management in the acute setting has, thus far, not been feasible. However, recent advances in genetic technologies have the potential to allow genetic information to be generated significantly quicker. The m.1555A>G genetic variant is (...) present in one in 500 individuals and predisposes to profound hearing loss following the administration of aminoglycoside antibiotics. These antibiotics are used frequently in cases of neonatal sepsis and it is estimated that approximately 180 neonates in the UK are at risk of antibiotic induced hearing loss each year because of this genetic change. Knowledge of this variant in the acute setting would allow clinicians to prescribe alternative antibiotics. The Pharmacogenetics to Avoid Loss of Hearing study will implement a genetic point of care test for the m.1555A>G variant within two major UK based neonatal intensive care units. This represents the first trial of a genetic POCT aimed at altering management in the acute setting. This round table discussion outlines the novel ethical issues faced in the development of this trial and the legal barriers to implementation. We ask five stakeholders to provide their opinions on this trial and their perspectives on the concept of genetic testing in the acute setting.Trial registration numberISRCTN-13704894. (shrink)

The appeal to expert opinion is an argument form that uses the verdict of an expert to support a position or hypothesis. A previous scheme-based treatment of the argument form is formalized within a Bayesian network that is able to capture the critical aspects of the argument form, including the central considerations of the expert's expertise and trustworthiness. We propose this as an appropriate normative framework for the argument form, enabling the development and testing of quantitative predictions as (...) to how people evaluate this argument, suggesting that such an approach might be beneficial to argumentation research generally. We subsequently present two experiments as an example of the potential for future research in this vein, demonstrating that participants' quantitative ratings of the convincingness of a proposition that has been supported with an appeal to expert opinion were broadly consistent with the predictions of the Bayesian model. In recent years, institutional financial institutions such as the World Bank have taken a keen interest in the links between governance and economic development in East Asia and in other regions of the world. However, the concept of governance has proven difficult to measure in cross-national studies and its meaning in the minds of citizens and experts may differ noticeably. This article examines elite and mass perceptions of governance using the World Governance Indicators developed by scholars affiliated with the World (...) Bank and survey data derived from the 2006 wave of the AsiaBarometer Survey conducted in seven societies. The results of the analysis capture considerable variation at the country and individual levels for how citizens and experts perceive governance in this region of the world. In addition, a multivariate test uncovered some convergence between citizen and expert assessments but only for some of the various governance components. (shrink)

This book is an extensive survey and critical examination of the literature on the use of expert opinion in scientific inquiry and policy making. The elicitation, representation, and use of expert opinion is increasingly important for two reasons: advancing technology leads to more and more complex decision problems, and technologists are turning in greater numbers to "expert systems" and other similar artifacts of artificial intelligence. Cooke here considers how expert opinion is being used today, how an expert's (...) uncertainty is or should be represented, how people do or should reason with uncertainty, how the quality and usefulness of expert opinion can be assessed, and how the views of several experts might be combined. He argues for the importance of developing practical models with a transparent mathematic foundation for the use of expert opinion in science, and presents three tested models, termed "classical," "Bayesian," and "psychological scaling." Detailed case studies illustrate how they can be applied to a diversity of real problems in engineering and planning. (shrink)

This article has been designed in the context of the religious education needs of parents with orthopedically disabled children and their views on the content and method of this religious education. The aim of the study is to reveal the religious education needs of parents with orthopedically disabled children and their views on the content and method of religious education from a descriptive point of view. In this study, one of the qualitative research methods case study was preferred. The study (...) group consists of 20 parents determined by the maximum diversity sampling, one of the purposive sampling methods. The data were analyzed by coding according to the themes and titles determined in the context of the problematic of the study with the descriptive analysis method. As a result of the study, it was determined that parents need religious education based on the opinions of the parents. Parents suggested that the content of religious education for them could be in the form of the convenience in which religion provides for the disabled, the place of disability in religion, the test and the contribution of belief in the hereafter to the disabled. Parents think that it would be beneficial to provide them with religious education by preparing books and brochures on disability and by organizing religious education programs at home and in rehabilitation center. The issue of prenatal testing and selective abortion has never received open public appraisal. This is somewhat regrettable. The interest in this area, however, is rapidly growing. In part this is a result of concerns about the rate of development in genetic knowledge and questions as to its application. For instance, there will be a huge increase in the scope of conditions or features for which we will be able to screen, some of which could hardly be described as (...) significant. Further, for some time now, people with disabilities have had concerns about the practice of prenatal testing and selective abortion. This article looks at the relationship between reproductive autonomy, prenatal testing and associated practices, and the interests of people with disabilities. It asks whether such practices negatively affect the interests of such individuals, and if so, how. This is an important question for the formulation of public policy in this area. Although some groups have studied this issue in detail, policy bodies do not necessarily fully engage with their analyses. This may be a reflection of public confusion about this issue. To some degree, fear of causing offense may also inhibit both expression of public opinion and, in turn, policy analysis. This is unfortunate and needs to be acknowledged. a. (shrink)

John Stuart Mill advocated for increased interactions between individuals of dissenting opinions for the reason that it would improve society. Whether Mill and similar arguments that advocate for opinion diversity are valid depends on background assumptions about the psychology and sociality of individuals. The field of opinion dynamics is a burgeoning testing ground for how different combinations of sociological and psychological facts contribute to phenomena that affect opinion diversity, such as polarization. This paper applies some recent (...) results from the opinion dynamics literature to assess the impacts of the Millian suggestion. The goal is to understand how the scope of the validity of Mill-style arguments depends on plausible assumptions that can be formalized using agent-based models, a common modeling approach in opinion dynamics. The most salient insight is that homophily (increased interactions between like-minded individuals) does not sufficiently explain decreased opinion diversity. Hence, decreasing homophily by increasing interactions between individuals of dissenting opinions is not the simple solution that a Millian-style argument may advocate. (shrink)

Opinion surveys were taken in an effort to determine the philosophical beliefs of students beginning philosophy. Correlated sets were made of those who took the survey before and after a first course in philosophy; and opinion shifts noted. The acquired information may be of interest to people in various disciplines. The authors tested the semantic usage of certain epistemological terms, the change in religious beliefs, the degree of consistency between general skepticism and particular knowledge claims. Finally, the authors (...) proposed a consistency test for the measure of the extent to which a sample of students “clarified their beliefs,”; and attempted to measure their own pedagogical efficiency with reference to this test. Research on distributive justice has shown that people’s judgments on how to distribute resources justly are shaped by various criteria including equity, need, equality, and prior ownership. Yet, an important question remains open: do people’s judgments about justice take the power of the actors under consideration? In other words, to people deem the powerful to deserve a larger share even when their contribution, need, and prior ownership are equal? The paper addresses this question. Online, participants had to judge the just (...) distribution of resources among actors who were equal in all respects except regarding power. Results revealed that a substantial proportion of participants believed that more powerful actors deserved more resources, an effect referred to as power justification. The effect was related with social dominance orientation (SDO), indicating that high-SDO participants manifested enhanced power justification. These results were replicated in three countries, suggesting that, although cultural differences are possibly important, in most societies power justification might be a criterion advocated by some people in certain occasions. These findings can inspire research about important domains where judgments about justice and power are at play, such as about how juries deliberate and about how public opinion reacts to international conflicts. Male piglets in Belgium are still castrated unanesthetized in the first week of life, but animal rights organizations, supermarkets, and some consumers no longer accept this method in terms of animal welfare, and are pushing the pig industry to apply available alternative methods. This major change in pig husbandry will increase production costs without a guarantee for return of investment by consumers. Therefore, it is important to know the opinion of consumers on this matter. A questionnaire was used to (...) collect data from 1,018 people through face to face interviewing in Flanders. A Chi-square test and Fisher’s exact test were used to analyze the data. Results show that in spite of several media campaigns of animal welfare organizations over the past few years, still half of the Flemish respondents were not aware of the problem of unanesthetized piglet castration. However, after being informed, the majority wanted unanesthetized castration to be banned. Although the concern about animal welfare implications was very high, the willingness to pay extra for alternatives was low. (shrink)

This paper combines three computational argumentation systems to model the sequence of argumentation in a famous murder trial and the appeal procedure that followed. The paper shows how the argumentation scheme for argument from expert opinion can be built into a testing procedure whereby an argument graph is used to interpret, analyze and evaluate evidence-based natural language argumentation of the kind found in a trial. It is shown how a computational argumentation system can do this by combining argument (...) schemes with argumentation graphs. Frighteningly, it is also shown by this example that when there are potentially confusing conflicting arguments from expert opinion, a jury can only too easily accept a conclusion prematurely before considering critical questions that need to be asked. Design ethics has been offered as a course in undergraduate design programs in Taiwan for over a decade, but research on teaching design ethics and the results of teaching these courses is scant. We conducted two tests to examine the effect of an ethics course, and the differences among the effects of design department, gender, and study year on student opinions regarding ethical design standards at the National Yunlin University of Science and Technology in Taiwan. The participants comprised 934 undergraduates (...) from the five design departments at YunTech’s College of Design from Years 1–4. The results confirmed the effect of an ethics course on student EDS opinions. In addition, we observed significant variations among students according to design departments, suggesting that the characteristics of the design departments also affected students’ EDS opinions. The results indicated that gender did not significantly affect design students’ EDS opinions; however, students in their early years of study produced higher scores than those in their advanced years of study did, based on the six EDS opinions. The implications of these results for teaching design ethics and future research are discussed in this paper. (shrink)

The development of new methods in the field of prenatal testing leads to an expansion of information that needs to be provided to expectant mothers. The aim of this research is to explore opinions and attitudes of gynecologists in Germany, Poland and Russia towards access to prenatal testing and diagnostics in these countries. Semi-structured interviews were conducted with n = 18 gynecologists in Germany, Poland and Russia. The interviews were analyzed using the methods of content analysis and thematic (...) analysis. Visible in all three countries is a connection of prenatal medicine with the politically and socially contentious issue of pregnancy termination. Respondents in Poland and Russia concentrated on the topic of inadequate resources. Quality of information for expectant mothers is an important point in all three countries. Only in Germany was the issue of language barriers in communication raised. With regard to non-invasive prenatal testing (NIPT) respondents in Germany focused on the ethical issues of routinization of testing; in Poland and Russia they concentrated on fair access to NIPT. Challenges in all three countries arise from structural factors such as imprecise and prohibitive regulations, lack of resources or organization of healthcare services. This article discusses the need for more satisfactory implicit measures in consumer psychology and assesses the theoretical foundations, validity, and value of the Implicit Association Test (IAT) as a measure of implicit consumer social cognition. Study 1 demonstrates the IAT’s sensitivity to explicit individual differences in brand attitudes, ownership, and usage frequency, and shows their correlations with IAT-based measures of implicit brand attitudes and brand relationship strength. In Study 2, the contrast between explicit and implicit measures of attitude toward the (...) ad for sportswear advertisements portraying African American (Black) and European American (White) athlete–spokespersons revealed different patterns of responses to explicit and implicit measures in Black and White respondents. These were explained in terms of self-presentation biases and system justification theory. Overall, the results demonstrate that the IAT enhances our understanding of consumer responses, particularly when consumers are either unable or unwilling to identify the sources of influence on their behaviors or opinions. We developed and pilot tested an educational video containing information regarding the informed consent process for surgery in trauma patients and a knowledge measure instrument and evaluated whether the audiovisual presentation improved the patients’ knowledge regarding their procedure and aftercare and their satisfaction with the informed consent process. A modified Delphi technique in which a panel of experts participated in successive rounds of shared scoring of items to forecast (...) outcomes was applied to reach a consensus among the experts. The resulting consensus was used to develop the video content and questions for measuring the understanding of the informed consent for debridement surgery in limb trauma patients. The expert panel included experienced patients. The participants in this pilot study were enrolled as a convenience sample of adult trauma patients scheduled to receive surgery. The modified Delphi technique comprised three rounds over a 4-month period. The items given higher scores by the experts in several categories were chosen for the subsequent rounds until consensus was reached. The experts reached a consensus on each item after the three-round process. The final knowledge measure comprising 10 questions was developed and validated. Thirty eligible trauma patients presenting to the Emergency Department were approached and completed the questionnaires in this pilot study. The participants exhibited significantly higher mean knowledge and satisfaction scores after watching the educational video than before watching the video. Our process is promising for developing procedure-specific informed consent and audiovisual aids in medical and surgical specialties. The educational video was developed using a scientific method that integrated the opinions of different stakeholders, particularly patients. This video is a useful tool for improving the knowledge and satisfaction of trauma patients in the ED. The modified Delphi technique is an effective method for collecting experts’ opinions and reaching a consensus on the content of educational materials for informed consent. The study aims to determine the role of personal factors, consumer social responsibility, and social marketing among meat anti-consumers. The study tests a model of anti-consumption using a sample of 597 participants from a cluster of young consumers through the distribution of the questionnaires in the Pakistani market. SEM employing the AMOS model for path relationships along with the Johnson-Neyman technique for moderation was mainly used. Results prescribe religiosity as the moderating driver of the anti-consumption of meat among young consumers (...) in Pakistan. Consumer social responsibility is a robust antecedent, while social marketing is significantly documented for sustainability motives. Consumers apprise the personal health and environmental domain as an auspicious component for meat anti-consumption. The study reveals social marketing motivations for anti-consumption that eventually steers marketers and policymakers in shaping the concerned strategies. Our study delivers new insights into food anti-consumption behavior that provides guidelines for policymakers who heed consumer eating behaviors. The study is among pioneer work that establishes the moderating role of religious motivations and meat anti-consumption behavior among Muslim consumers to acquire healthy wellbeing. (shrink)

Professor Meehl [2] has pointed out a very significant problem in the methodology of psychological research, indicating that statistical tests of psychological hypotheses against a null hypothesis are loaded in favor of eventual success at rejecting the null hypothesis. In my opinion this is not, however, a contrast between physics and psychology, but rather between the method of parameter estimation and that of the null hypothesis in the tradition of Fisher. A physicist could use the null hypothesis method as (...) well as the psychologist. The fact that he doesn't is probably related to the more advanced state of his measurement techniques and theoretical constructs. (shrink)

The growth of urban violence in Brazil, as in other countries, has led citizens to demand more severe and punitive measures to solve the problem of juvenile crime. One motion submitted to the Brazilian parliament, for instance, proposes to reduce the age of penal majority from 18 to 16 years. Our hypothesis is that popular opinions about this proposal are largely constrained by construal levels and psychological distance. Accordingly, we expect that the knowledge and proximity to the circumstances associated with (...) juvenile transgression will influence opinions about the proposal. To test this hypothesis, we evaluated how opinion against or for the proposal can be explained by psychological distance and moral development theory. We studied two samples, composed of people who do not have a deep experience with the subject and workers from a juvenile justice court. After collecting socio-demographic information from the subjects and their answer to moral dilemmas, the data was subjected to a multivariate analysis by multimodal logistic regression for socio-demographic characteristics, Kohlberg moral stages, and opinion on the reduction of APM as dependent variables. Our findings suggest that 1) opinion about the APM depends on psychological distance and 2) socioeconomic variables may influence the average construal level of adolescent transgressors in the public’s perspective. One moot point in bioethical debates about genetic testing concerns the conditions that have to be fulfilled to make individual genetic testing or individual participation in genetic screening programs truly voluntary. Though there is a relatively broad consensus about the non-viability of views on the extremes of the spectrum of opinions, there is considerable disagreement in the middle. This mirrors the difficulties in defining satisfactory demarcation lines between autonomous choice, pressured choice and coercion in cases in which the (...) decision to participate is triggered, wholly or partly, by factors such as material incentives, urgent health needs, massive social expectations, or moral pressure from relatives. In this contribution, some of the semantic conditions and ethical principles concerning coercion are explored with a view to applying them to genetic testing, especially in the context of insurance and participation in clinical trials. If an experiment on a small number of animals can cure a disease that affects tens of thousands, it could be justifiable. Whether this is really the case in Professor Aziz’s experiments, about which I was asked in the BBC2 documentary Monkeys, Rats and Me: Animal Testing, is a question I have not studied sufficiently to offer an opinion about. Certainly it has been disputed. In my book Animal Liberation I propose asking experimenters who use animals if they (...) would be prepared to carry out their experiments on human beings at a similar mental level — say, those born with irreversible brain damage. As gene editing technologies such as CRISPR have become increasingly prominent, so have media portrayals of them. With this in mind, the present study builds on theoretical accounts of framing effects, cultivation effects, and genre-specific viewing effects to examine how different forms of media use predict attitudes toward applications of gene editing. Specifically, the study tests how news use, overall television viewing, and science fiction viewing are related to such attitudes. The analyses draw on original data from two surveys of (...) the U.S. public, one conducted in 2020 and the other in 2021. The results from both surveys indicate that news use and overall television viewing predict support for uses of gene editing, whereas science fiction viewing is not significantly related to opinion. The findings suggest that media frames and images may carry implications for the trajectory of public opinion about gene editing technologies and, ultimately, the social context for their development and adoption. Opinion leaders within the community may lead debate on animal welfare issues and provide a path for information to their social networks. However, little is known about OLs’ attitudes, activities conducted to express their views about animal welfare and whether they are well informed, or not, about husbandry practices in the red meat industry. This study aimed to identify OLs in the general public and among producers and compare OLs and non-OLs’ attitudes, knowledge and actions to express their views (...) about the red meat industry. Two questionnaires, one for the Australian general public and one for Australian red meat producers, were developed to identify general attitudes. From these questionnaires, OLs were identified using a two-step cluster analysis. Subsequently, a sub-sample of 19 OLs participated in a follow-up phone interview. Results disclosed some clear OLs’ characteristics. Public OLs held more negative perceptions of the red meat industry and perceived they had more knowledge about husbandry procedures. However, their actual knowledge about animal husbandry was not different from non-OLs. Public OLs also used and trusted social and internet media more than did non-OLs. In the producer group, a large percentage of OLs were identified. Producer OLs had more actual knowledge about animal husbandry and engaged in more behaviours to express dissatisfaction with the industry than non-OLs. Unlike the public respondents, this group used conventional media more than social and internet media, and their levels of trust in all kinds of media were low. While there were clear differences, both groups believed that is important to increase communication and educate about farm practices. This may present an opportunity to develop an opinion leader intervention strategy where informed OLs could later disseminate accurate information to their social networks. Further studies should test if sustained and facilitated educational sessions between public and producer OLs can assist in increasing communication, knowledge and perhaps, may assist in achieving convergence of concerns and expectations between both groups. Drawing on the spiral of silence theory and heuristic information processing, we contend that individuals use likes as sources for assessing public opinion. We further argue that individuals may even adapt their personal opinions to the tenor reflected in those cues. The assumptions were tested using data from an experiment involving 501 participants, who encountered media items on two issues with or without likes. The findings show that respondents inferred public opinion from the media bias if it was (...) supported by likes, however, only in cases of high levels of fear of social isolation. This article investigates the role of historical references and arguments in the current policy debate on non‐invasive prenatal testing (NIPT) in Germany. It analyses major documents and opinion statements, including the recent parliamentary debate (2019). The implementation of NIPT is accompanied by concerns and strong criticism, particularly in Germany. Many perceive the new test to be a problematic step that facilitates selective practices and is reminiscent of eugenics. Analysis of the German policy discourse shows that ‘eugenics’, and even (...) more strongly, ‘selection’, are pivotal terms for rejecting NIPT and its coverage by public health insurance. They touch on a historical dimension in public deliberation, namely the fundamental distancing from the inhuman practices of the National Socialist period and anything that resembles them. However, using these terms to criticize prenatal genetic testing is controversial, and recent discourse demonstrates their avoidance as well, with many supporters of a limited coverage by public health insurance contrasting their approach with more widespread screening. Here, ‘screening’ has a negative connotation, and functions to demarcate the debate in a way that may reflect distance from certain modes of historical reasoning, but still expresses a special need to reconcile prenatal testing with the principles of dignity, inclusion and diversity. This article aims to elucidate the concerns involved in the national debates on prenatal testing and to increase awareness of the historical dimensions of the language and reasoning with which such methods are negotiated today and in future. The purpose of this study was to investigate the impact of euthanasia education on the opinions of health sciences students. It was performed among 111 final year students at the College of Health Sciences, Dokuz Eylül University, IRzmir, Turkey. These students train to become paramedical professionals and health technicians. Fifteen hours of educational training concerning ethical values and euthanasia was planned and the students’ opinions about euthanasia were sought before and after the course. Statistical analyses of the data were performed (...) with the related samples t -test by means of the Epi-Info program. Significant changes were shown in the students’ opinions on people’s right to decide about their own life, euthanasia in unconscious patients, and reasons for their objection to euthanasia after completing the course. Adolescents may often have opinions about whether they want genetic and genomic testing in both the clinic and research and about who should have access to the results. This legal analysis demonstrates that the law provides very little protection to minors' wishes.

Swedish welfare has for decades served as a role model foruniversalistic welfare. When the economic recession hit Swedish economyin the beginning of the 1990s, a period of more than 50 years ofcontinuous expansion and reforms in the welfare sector came to an end.Summing up the past decade, we can see that the economic downturnenforced rationing measures in most parts of the welfare state, althoughmost of this took place in the beginning of the decade. Today, most ofthe retrenchment has stopped and (...) in some areas we can see tendencies ofrestoration – but more so in financial benefits than in the caringsectors. In the article this process is discussed as a process ofreallocation where general principles of solidarity become manifest.Various levels of decision making are discussed within the context ofsocio-political action. Current transitions in Swedish health care aredescribed with respect to coverage rates, content, marketisation anddistribution. Basic principles of distribution are highlighted in orderto analyse the meaning of social solidarity in a concrete allocativesetting. The significance of popular opinion – it's shifts anddeterminants – is also considered. The article concludes with adiscussion of how the (once salient) features of universalism inwelfare and health care provision have been affected by the developmentsin the past decade in Sweden. Introduction: Uncertainty is omnipresent in cancer care, including the ambiguity of diagnostic tests, efficacy and side effects of treatments, and/or patients' long-term prognosis. During second opinion consultations, uncertainty may be particularly tangible: doubts and uncertainty may drive patients to seek more information and request a second opinion, whereas the second opinion in turn may also affect patients' level of uncertainty. Providers are tasked to clearly discuss all of these uncertainties with patients who may feel overwhelmed by it. (...) The aim of this study was to explore how oncologists communicate about uncertainty during second opinion consultations in medical oncology.Methods: We performed a secondary qualitative analysis of audio-recorded consultations collected in a prospective study among cancer patients who sought a second opinion in medical oncology. We purposively selected 12 audio-recorded second opinion consultations. Any communication about uncertainty by the oncologist was double coded by two researchers and an inductive analytic approach was chosen to allow for novel insights to arise.Results: Seven approaches in which oncologists conveyed or addressed uncertainty were identified: specifying the degree of uncertainty, explaining reasons of uncertainty, providing personalized estimates of uncertainty to patients, downplaying or magnifying uncertainty, reducing or counterbalancing uncertainty, and providing support to facilitate patients in coping with uncertainty. Moreover, oncologists varied in their choice of words/language to convey uncertainty.Discussion: This study identified various approaches of how oncologists communicated uncertain issues during second opinion consultations. These different approaches could affect patients' perception of uncertainty, emotions provoked by it, and possibly even patients' behavior. For example, by minimizing uncertainty, oncologists may consciously steer patients toward specific medical decisions). Future research is needed to examine how these different ways of communicating about uncertainty affect patients. This could also facilitate a discussion about the desirability of certain communication strategies. The debate about the criterion of truth has always been closely linked with the battle lines of philosophy. Philosophers of different philosophical lines use different criteria of truth, each of which is consistent with the criterion of truth common to its philosophical line. Idealist philosophies advocate the primacy of thinking [, implying more the structure or process of thought, as compared to "thought" , implying a more or less coherent idea, viewpoint, or system, the result of thinking - Tr.] and (...) regard the material world as secondary, believing that human thought and truth are dropped from heaven, or are generated by the subjective consciousness itself. The idealist criterion of truth is sought in thought itself. Idealist philosophers cannot use the criterion of practice because the entire theory of idealism, including its view of truth, is made up wholly of subjective and empty constructs which would not pass the test of practice. If idealist philosophy used the criterion of practice it would undoubtedly refute itself. Only the materialist philosophical line is linked by its very nature with the criterion of practice. Materialism affirms the primacy of the material world, and the secondary nature of thinking as a reflection of the material world, regarding truth as a correct or accurate reflection of objective things. To test whether or not such a reflection is correct, it is not permissible to appeal to thought itself; we must rely on social practice. To discuss the truth of thinking, separate from social practice, would be to abandon materialism and fall into idealism. Therefore we say that the materialist philosophical line, as part of its basic fundamental nature, embraces the acceptance of the criterion of practice, or we say that it is fundamentally linked to the criterion of practice. Of course, to say that the materialist philosophical line is fundamentally linked to the criterion of practice is not to say that every materialist is able to consciously adopt the criterion of practice, rather that materialism ought to use social practice as the criterion of truth. Only in this way can one maintain a thoroughgoing materialism. However, ought to is one thing, while reality is quite another. In reality, the materialists coming before Marx did not self-consciously adopt the criterion of practice, but for the most part used subjective criteria. For example, the well-known materialist [Ludwig] Feuerbach [1804-18721 thought that "agreement of the majority" or "common opinion" was a criterion of truth. "Agreement" and "opinion" are subjective, and such a theory of the criterion of truth stands in contradiction to the materialist line that Feuerbach advocated. With a criterion of that sort, not only would it be impossible to validate the objective truth that Feuerbach sought; on the contrary, one could refute objective truth totally, refute the materialist line. Since subjective criteria of truth solve the problem of truth within the subjective realm and must refute the objective nature of truth, subjective criteria of truth are therefore fundamentally incompatible with the materialist line of thought. Only the criterion of practice accepts objective truth, and is compatible with the materialist line of thought. That materialists before Marx were unable to self-consciously employ the criterion of practice and used subjective criteria of truth reveals the limited and partial nature of materialism. By introducing social practice into the theory of knowledge and by determining that practice is the criterion of truth, thereby overcoming the limitations and incompleteness of the old materialism, Marxism developed the materialist theory of knowledge into a completely scientific theory. This was an enormous contribution to the history of philosophy. However, the acceptance or rejection of the criterion of practice is not a minor problem, but rather a major problem that affects all philosophical lines of thought. To uphold the criterion of practice is to stand on the side of materialism. On the other hand, to use the criterion of thought to refute the criterion of practice is to fall into idealism. (shrink)

Irish Supreme Court upholds paramountcy of parental right to determine a child's best interests at the expense of the rights of children themselvesCan a court force on parents who are careful and conscientious a view of their child's welfare which is rational, but quite contrary to the parents sincerely held but non-rational beliefs? The Supreme Court of Ireland has recently held that it cannot do so, and that the Irish Constitution requires that the right of the family to determine its (...) own direction must be respected except in the most narrow of circumstances, such as an immediate threat to the life of the child or risk of serious injury. The ruling leaves the assessment of a child's best interests to the wide discretion of parents, but at the same time fails to offer a means to resolve potential conflicts between the rights of the family and the rights of the child.FACTS OF THE CASEIn North Western Health Board v W 1 an action was brought by a local health board against the parents of 14 month old Paul, seeking a declaration that their refusal to submit their son to the heel prick test for phenylketonuria was a failure to vindicate their son's rights and that it would be lawful to proceed without parental consent. Phenylketonuria is a metabolic condition which can lead to severe and untreatable mental impairment if not detected in its early stages, but a simple variation in diet can stave off this outcome. While Paul's parents did not doubt the veracity of this medical opinion, nor indeed the importance of the test, they refused to subject their son to the invasive heel prick, offering instead samples of urine or hair, such that the test could be carried out by non-invasive means. Background There has been considerable investment and strategic planning to introduce genomic testing into Australia’s public health system. As more patients’ genomic data is being held by the public health system, there will be increased requests from researchers to access this data. It is important that public policy reflects public expectations for how genomic data that is generated from clinical tests is used. To inform public policy and discussions around genomic data sharing, we sought public opinions on using genomic (...) data contained in medical records for research purposes in the Australian state of Queensland. Methods A total of 1494 participants completed an online questionnaire between February and May 2019. Participants were adults living in Australia. The questionnaire explored participant preferences for sharing genomic data or biological samples with researchers, and concerns about genomic data sharing. Results Most participants wanted to be given the choice to have their genomic data from medical records used in research. Their expectations on whether and how often they needed to be approached for permission on using their genomic data, depended on whether the data was identifiable or anonymous. Their willingness to sharing data for research purposes depended on the type of information being shared, what type of research would be undertaken and who would be doing the research. Participants were most concerned with genomics data sharing that could lead to discrimination, data being used for marketing, data security, or commercial use. Conclusions Most participants were willing to share their genomic data from medical records with researchers, as long as permission for use was sought. However, the existing policies related to this process in Queensland do not reflect participant expectations for how this is achieved, particularly with anonymous genomics data. This inconsistency may be addressed by process changes, such as inclusion of research in addition to clinical consent or general research data consent programs. (shrink)

News media coverage on education plays a ?uniquely important role in shaping public opinion?, can influence educational policy, and can affect and concern teachers. Yet, research examining how teachers have been represented in the news is scarce. What is particularly scarce are investigations with a historical dimension. The study reported in this paper is offered as a contribution towards rectifying the deficit and pointing the way towards one of a number of avenues of research that other scholars in the (...) field could take for various contexts (including different countries) and time periods. It is part of a much larger study whose aim was to provide a historical analysis of The West Australian newspaper?s representation of teachers in its reporting of five major educational developments in the State of Western Australia that were the subject of sustained coverage at various times between 1987 and 2007. This study examines Japanese reactions to neighboring countries’ behavior by addressing possible micro-motives, such as patriotism, the rational demand for national defense, and retrospective policy evaluation. This theoretical development leads to distinctive hypotheses from different motivations and directly tests them using macro-data . This research will apply this framework to Japanese politics and will show that foreign threats stimulate patriotism in the public mind and enhance political support for national leaders. It will also demonstrate that the Japanese public has no (...) optimistic view of the new prime minister and that the honeymoon effect in previous research may be confounded with the patriotic effect because the new leader is less experienced and is often challenged by foreign countries. This paper examines the effects of a decrease in auditor litigation risk in a setting that isolates a change in auditor litigation risk from changes in auditor reputation. _StoneRidge Investment Partners v. Scientific Atlanta_ is a 2008 U.S. Supreme Court ruling that restricted secondary actor liability in class action suits, resulting in a decrease in class actions that listed auditors as defendants. We document that the _StoneRidge_ decision is associated with a negative CAR for clients of Big 4 auditors and (...) industry specialist auditors, in particular those associated with high-litigation risk, low cash, and past incidences of modified going concern opinions. These findings are consistent with investor perception of lower potential payoffs from secondary defendants in class action suits, in particular auditors, following the _StoneRidge_ decision. We also document that auditors are more (less) likely to accept (reject) risky clients and charge lower audit fees to risky clients after _StoneRidge_, consistent with a decrease in auditor litigation risk that increases auditor risk tolerance. Finally, we provide evidence that audit firms issue fewer going concern opinions following _StoneRidge_, consistent with a decrease in litigation risk leading to lower audit quality_._ Our results are relevant to policy makers as they consider the disciplinary role of litigation on audit markets. There has been a tendency, even among authors who have regarded Valerius Maximus as worthy of independent study, to use theFacta et Dictaas a neutral conduit of information about other wider areas. Valerius has thus sometimes become a sourcebook mined for nuggets of information but effectively invisible to those who work it. The past thirty years have seen valuable contributions that raise awareness of the importance of the genre of theFacta et Dictaand the personal input of Valerius, but traces of (...) the ‘conduit’ approach are still preserved in some authors’ attempts to justify their study of the work. For instance, Valerius provides an insight into the historical image of Marius, and is valuable precisely because he has no opinion or personal ideas to offer, because he preserves the language of school rhetoric, because his collection gives us strictly conventional material about religion, because he presents an unadulterated mirror-image of imperial policy and propaganda and because he is ‘middle-brow’ and thus depicts common attitudes. The text has also sometimes been studied for what it reveals about Early Imperial Latin, non-Republican culture and the organisation of Roman knowledge. Most recently, Tara Welch has argued that Valerius deliberately stripsexemplaof all authorial input, including his own, in an attempt to make himself a conduit fortraditio.Alternatively, study of the text is justified by interest in the time period in which it was written. Organic farming is expected to contribute to conserving national biodiversity on farms, especially remnant, old, and undisturbed small biotopes, forests, and permanent grassland. This objective cannot rely on the legislation of organic farming solely, and to succeed, farmers need to understand the goals behind it. A set of indicators with the purpose of facilitating dialogues between expert and farmer on wildlife quality has been developed and tested on eight organic farms. “Weed cover in cereal fields,” was used as an indicator (...) of floral and faunal biodiversity in the cultivated land, and “uncultivated biotope area” on the farm was used as a general measure of wildlife habitats. Functional grouping of herbaceous plants (discriminating between “high conservation value” plant species and “competitive”/“ruderal” species) and low mobility butterflies were used as indicators of conservation value, especially focusing on the few sites left with considerable remnant conservation value. The dialog processes revealed that the organic farmers’ ideas and goals of conservation of wildlife quality were not necessarily the same as for biologists; the farmers expressed very different opinions on the biological rooted idea, that wildlife quality is related to the absence of agricultural impact. However, farmers also stated that the information given by the indicators and especially the dialogue with the biologist had influenced their perception and awareness of wildlife. We conclude that, combined with a dialogue process, using these indicators when mapping wildlife quality could be an important key component of a farm wildlife management advisory tool at farm level.
