Background There has been considerable investment and strategic planning to introduce genomic testing into Australia’s public health system. As more patients’ genomic data is being held by the public health system, there will be increased requests from researchers to access this data. It is important that public policy reflects public expectations for how genomic data that is generated from clinical tests is used. To inform public policy and discussions around genomic data sharing, we sought public opinions on using genomic data (...) contained in medical records for research purposes in the Australian state of Queensland. Methods A total of 1494 participants completed an online questionnaire between February and May 2019. Participants were adults living in Australia. The questionnaire explored participant preferences for sharing genomic data or biological samples with researchers, and concerns about genomic data sharing. Results Most participants wanted to be given the choice to have their genomic data from medical records used in research. Their expectations on whether and how often they needed to be approached for permission on using their genomic data, depended on whether the data was identifiable or anonymous. Their willingness to sharing data for research purposes depended on the type of information being shared, what type of research would be undertaken and who would be doing the research. Participants were most concerned with genomics data sharing that could lead to discrimination, data being used for marketing, data security, or commercial use. Conclusions Most participants were willing to share their genomic data from medical records with researchers, as long as permission for use was sought. However, the existing policies related to this process in Queensland do not reflect participant expectations for how this is achieved, particularly with anonymous genomics data. This inconsistency may be addressed by process changes, such as inclusion of research in addition to clinical consent or general research data consent programs. (shrink)

Ethical problems regularly arise during daily care in nursing homes. These include violation of patients' right to autonomy and to be treated with respect. The aim of this study was to investigate how caregivers emphasize daily dialogue and mutual reflection to reach moral alternatives in daily care. The data were collected by participant observation and interviews with seven caregivers in a Norwegian nursing home. A number of ethical problems linked to 10 patients were disclosed. Moral problems were revealed as the (...) caregivers acted in ways that they knew were against patients' interest. We used a theoretical interpretation according to Habermas' discourse ethics on the importance of dialogue when deciding moral courses of action for patients. This theory has four basic requirements: communicative competence, equality, self-determination, and openness about motives. (shrink)

On 11 September 2019, the verdict was read in the first prosecution of a doctor for euthanasia since the Termination of Life on Request and Assisted Suicide (Review Procedures) Act of 2002 was installed in the Netherlands. The case concerned euthanasia on the basis of an advance euthanasia directive (AED) for a patient with severe dementia. In this paper we describe the review process for euthanasia cases in the Netherlands. Then we describe the case in detail, the judgement of the (...) Regional Review Committees for Termination of Life on Request and Euthanasia (RTE) and the judgement of the medical disciplinary court. Both the review committees and the disciplinary court came to the conclusion there were concerns with this case, which mainly hinged on the wording of the AED. They also addressed the lack of communication with the patient, the absence of oral confirmation of the wish to die and the fact that the euthanasia was performed without the patient being aware of this. However, the doctor was acquitted by the criminal court as the court found she had in fact met all due care criteria laid down in the act. We then describe what this judgement means for euthanasia in the Netherlands. It clarifies the power and reach of AEDs, it allows taking conversations with physicians and the testimony of the family into account when interpreting the AED. However, as a practical consequence the prosecution of this physician has led to fear among doctors about prosecution after euthanasia. (shrink)

Science is fundamentally devoted to generating original knowledge, and therefore concepts of scientific originality are keys to understanding its very essence. Scientific originality has long been thought of as discovery, but new studies of the humanities and social sciences have shown that other, discipline-specific concepts of originality are used in these fields of study. Does this finding also hold for disciplines in the natural science, medicine, and engineering? Are concepts of originality scientifically grounded or do they instead reflect extrascientific modes (...) of originality? These questions lie at the heart of research proposals responding to an initiative explicitly calling for original scientific projects. The proposals undergo a two-step analysis based on grounded theory[Per style, reference citation is not allowed in abstract section. Hence, we have deleted Charmaz, 2006. Please approve.]. First, three empirically identified modes of scientific originality are described: temporal, partially different, and revolutionary. The three modes of originality are consistent with extrascientific ones such as those in art and fashion. Second, six disciplines—two each in the natural science, medical, and engineering—are analyzed for ways the three modes of originality are used and for their associated disciplinary characteristics in order to identify discipline-specific concepts of originality. Background: Nurses and student nurses in Malawi often encounter challenges in taking a moral course of action. Several studies have demonstrated a need for increased awareness of ethical issues in the nursing education. Objective: To explore the challenges experienced by nurse teachers in Malawi in their efforts to enhance students’ moral competence in clinical practice. Research design: A qualitative hermeneutic approach was employed to interpret the teachers’ experiences. Participants and research context: Individual interviews (N = 8) and a focus group (...) interview with teachers (N = 9) from different nursing colleges were conducted. Ethical considerations: Ethical approval was granted and all participants signed their informed consent. Findings: Two overall themes emerged: (1) authoritarian learning climate, with three subthemes: (a) fear of making critical comments about clinical practice, (b) fear of disclosing mistakes and lack of knowledge and (c) lack of a culture of critical discussion and reflection that promotes moral competence; and (2) discrepancy between expectations on learning outcome from nursing college and the learning opportunities in practice comprising three subthemes: (a) gap between the theory taught in class and learning opportunities in clinical practice, (b) lack of good role models and (c) lack of resources. Discussion: Our findings indicated that showing respect was a central objective when the students were assessed in practice. A number of previous studies have enlightened the need for critical reflection in nursing education. Few studies have linked this to challenges experienced by teachers for development of moral competence in practice. This is one of the first such studies done in an African setting. Conclusion: There is a clear relationship between the two themes. A less authoritarian learning climate may enhance critical reflection and discussion between students, teachers and nurses. This can narrow the gap between the theory taught in college and what is demonstrated in clinical practice. Moral competence must be enhanced in order to ensure patients’ rights and safety. (shrink)

Gaze following occurs automatically in social interactions, but the degree to which gaze is followed depends on whether an agent is perceived to have a mind, making its behavior socially more relevant for the interaction. Mind perception also modulates the attitudes we have towards others, and deter-mines the degree of empathy, prosociality and morality invested in social interactions. Seeing mind in others is not exclusive to human agents, but mind can also be ascribed to nonhuman agents like robots, as long (...) as their appearance and/or behavior allows them to be perceived as intentional beings. Previous studies have shown that human appearance and reliable behavior induce mind perception to robot agents, and positively affect attitudes and performance in human-robot interaction. What has not been investigated so far is whether different triggers of mind perception have an independent or interactive effect on attitudes and performance in human-robot interaction. We examine this question by manipulating agent appearance (human vs. robot) and behavior (reliable vs. random) within the same paradigm and examine how congruent (human/reliable vs. robot/random) versus incongruent (human/random vs. robot/reliable) combinations of these triggers affect performance (i.e., gaze fol-lowing) and attitudes (i.e., agent ratings) in human-robot interaction. The results show that both ap-pearance and behavior affect human-robot interaction but that the two triggers seem to operate in iso-lation, with appearance more strongly impacting attitudes, and behavior more strongly affecting per-formance. The implications of these findings for human-robot interaction are discussed. (shrink)

In this comment we take up two points made by Douglas Hollan in his article “Emerging Issues in the Cross-Cultural Study of Empathy,” and discuss their possible philosophical implications. Hollan‘s concept of complex empathy may give rise to the idea that we can learn about other people’s beliefs via empathy, which is something we do not believe is possible. Furthermore, Hollan’s description of possible negative effects of empathy, such as manipulations of a person on the basis of knowledge about their (...) emotions, might pose a problem for proponents of care ethics, who generally start from the assumption that empathy fosters altruistic behavior. We study a controversial application of algorithmic profiling in the public sector, the Austrian AMAS system. AMAS was supposed to help caseworkers at the Public Employment Service (PES) Austria to allocate support measures to job seekers based on their predicted chance of (re-)integration into the labor market. Shortly after its release, AMAS was criticized for its apparent unequal treatment of job seekers based on gender and citizenship. We systematically investigate the AMAS model using a novel real-world dataset of young job (...) seekers from Vienna, which allows us to provide the first empirical evaluation of the AMAS model with a focus on fairness measures. We further apply bias mitigation strategies to study their effectiveness in our real-world setting. Our findings indicate that the prediction performance of the AMAS model is insufficient for use in practice, as more than 30% of job seekers would be misclassified in our use case. Further, our results confirm that the original model is biased with respect to gender as it tends to (incorrectly) assign women to the group with high chances of re-employment, which is not prioritized in the PES’ allocation of support measures. However, most bias mitigation strategies were able to improve fairness without compromising performance and thus may form an important building block in revising profiling schemes in the present context. The Yugoslav wars of secession in the 1990s left traces of the past among the societies living in the successor states. Those traces can be found within the collective memory of these societies, and are transmitted through various communication channels to the next generation. Today, this post-war and post-Yugoslav generation, born during or shortly after the violent conflicts, are young adults dealing with the recent past. Based on findings from life-story interviews that are examined and interpreted using the approach of (...) sequence analysis, I elaborated a model of the transregional post-Yugoslavs’ communication system regarding the wars. I identified three communication practices on war-related topics by actively reflecting on the “Other,” which I present in this paper. During their adolescent years, post-Yugoslavs created their own narratives, and thus their own, authentic communication strategies in response to the “invisible war,” which still continues today, according to the post-Yugoslav generation. There is a good chance that “each critic becomes a Pygmalion” (as Leo Curran put it) when they bring the work of art to life in their narcissistic (and almost amorous) attention, unfolding its meaning so that they should be able to write their own interpretation. The starting point of the present text is the perfection of sculptural forms, and the author discusses “traditional” aesthetic concepts: the beautiful and the sublime along with the difference and interplay of the two qualities, (...) bearing in mind their variations and relations. The framework is provided by the occurrence of these two in the discourses on the self and taste in the eighteenth-century while the focus is on subjective criticism concerning the beautiful versus the sublime in the artistic and sensual experience of statues. Within the given framework, the author is planning to force Edmund Burke, stiffened by the experience of the sublime, and Winckelmann, softened by the sight of the Greek statues, into a dialogue on individual taste. In this article, I take up Ulrich and Dash's (2013) somewhat provocative invitation to engage in discussion and debate about current and future research. In my three-tiered response, I first discuss Ulrich and Dash's article, followed by my own observations about the APEC/Deloitte (2010) research report: "Skills and Competencies Needed in the Research Field: Objectives 2020," and finally, I explore, in some detail, challenges of building a (...) twentyfirst-century research workforce. The Perceptions of Conscience Questionnaire (PCQ) and the Stress of Conscience Questionnaire (SCQ) have previously been developed and validated within the ‘Stress of Conscience Study’. The aim was to revalidate these two questionnaires, including two additional, theoretically and empirically significant items, on a sample of healthcare personnel working in direct contact with patients. The sample consisted of 503 healthcare personnel. To test variation and distribution among the answers, descriptive statistics, item analysis and principal component analysis (PCA) were used to examine (...) the underlying factor structure of the questionnaires. Support for adding the new item to the PCQ was found. No support was found for adding the new item to the SCQ. Both questionnaires can be regarded as valid for Swedish settings but can be improved by rephrasing some of the PCQ items and by adding items about private life to the SCQ. (shrink)

Aunque muchos autores han destacado sus efectos beneficiosos al permitir que los clubes adquieran jugadores que de otra manera no podrían conseguir, en este trabajo nos centramos en enfatizar dos problemas que pueden plantear. Although many authors have highlighted their beneficial effects by allowing clubs to acquire players who otherwise they would not get, in this paper we focus on two problems. First, we have tried to show that they can generate a progressive distancing from the fans. Secondly, through the prisoner’s dilemma we intend to show that they can contribute to increasing long-term clubs debt and threaten the financial fair play. (shrink)

Developments in biotechnology present difficult social and ethical challenges that need to be resolved by regulators among others. One crucial problem for regulators of new technologies is to ensure that regulation is both clear and sufficiently flexible to respond to new developments. This is particularly difficult to achieve in contentious fields such as medical biotechnology. In the European Union there is a divergence in the solutions to this problem which has lead to different regulatory frameworks for medical biotechnology. This paper (...) compares and contrasts the British and Dutch regulatory frameworks for the selection of embryos by preimplantation genetic diagnosis as an example of the regulation of medical biotechnology. Some of the outcomes of the regulatory choices and possible reasons behind the divergent frameworks are discussed, such as the ethical outlooks and political systems in these countries. (shrink)

Jolles greift damit den morphologischen Gedanken einer Vielgestaltigkeit von Form vor dem Hintergrund der sprachwissenschaftlichen Debatten seines politisierten akademischen Umfelds in Leipzig auf, das den Saussure’schen Systemgedanken der Sprache unter Rückbezug auf Wilhelm von Humboldt holistisch umdeuten wollte. Der Aufsatz verortet Jolles’ Überlegungen in der formorientierten Literatur- und Kulturtheorie der Zeit. (...) Anhand seiner Zeitbegriffe und seines Formkonzepts wird gezeigt, wie er die zeitgenössischen Ideen der Ganzheit und der Verzeitlichung von Form im Ausgang morphologischer Fragen auf eigenwillige Weise interpretierte.In his book Einfache Formen André Jolles develops the idea of a special temporality of so-called »simple forms«, which he calls »Jedesmaligkeit«, referencing Goethe’s reflections on the ›versatile forms‹ of nature. Jolles adopted the morphological idea of a versatility of form against the background of the linguistic debates of his politicized academic environment in Leipzig. In accordance with contemporary holistic thinking his colleagues reinterpreted Saussure’s idea that language is a system, drawing in particular on Wilhelm von Humboldt. The essay situates Jolles’ reflections in the form-oriented literary and cultural theory of the time. On the basis of his concepts of time and his thinking in terms of form, the article shows how he adapted the contemporary ideas of the wholeness and temporalization of form in an idiosyncratic way in the wake of morphological questions. Beauvoir's Second Sex seems to be acknowledged as one of the most influential books of the twentieth century. However, its relation to structuralism still has to be elaborated. The aim of this chapter is to analyze Beauvoir's reliance on Lévi‐Strauss, his elementary structures of kinship and the exchange of women (and not men). As the very asymmetry of sexual division became a target of Beauvoir's attack, she came close to asking Lévi‐Strauss the same question as Althusser, namely: Why is this (...) possible, and not something else? We conclude that the later Althusser's “repressed” aleatory materialism could account for Beauvoir's reasoning as to why the point of view of psychoanalysis and historical materialism are insufficient, and that Beauvoir's place could be identified with the repressed of the repressed. Hobbes’s theory of authorisation poses numerous puzzles to scholars. The weightiest of these conundrums is a supposed contradiction between chapter 17 of Leviathan, that calls for unconditional submission to the sovereign, and chapter 21, that defends the liberties of the subject. This article offers a fresh perspective on the theory’s consistency, function and addressees. While existing research doubts the theory’s consistency, focuses on its immunisation function and on the subjects as the theory’s main addresses, the paper argues that Hobbes’s theory (...) of authorisation is consistent with the doctrine of the liberty of subjects, and that it serves the dual purpose of immunising the sovereign against criticism and disciplining the sovereign via a counsel of memento mori: A hitherto underexplored element of authorisation theory is a reminder of the mortality of sovereignty directed at the sovereign to convince him to make restricted use of his absolute right to rule. Hobbes’s theory of authorisation can thus be read as part of a complex argumentative strategy for peace, rooted in a ‘liberal absolutism’ which is not as paradoxical as it sounds, and which is reflected in the frontispiece by the friendly smile of the sovereign. In this critique of Michael Goodhart's "Human Rights and Global Democracy," Eva Erman argues that Goodhart has reconceptualized democracy and therefore does not offer a better understanding of the relationship between human rights and global democracy.

Being poor can influence how one makes ethical decisions in various fields. Nepotism is one such area, emerging as kinship-based favoritism in the job market. People can be poor on at least three levels: one can live in a poor country, be poor compared to others around them, or feel poor in their given situation. We assumed that these levels can simultaneously influence nepotistic hiring decisions among Hungarian and US participants. Prior cross-cultural, non-experimental studies demonstrated that nepotism is more prevalent (...) in poorer countries such as Hungary than in richer countries such as the United States. However, contrary to our expectations, in our non-representative, preliminary study, US participants showed stronger nepotistic behavioral tendencies than Hungarians. Furthermore, people with lower socioeconomic status had less nepotistic intentions than richer people. When participants were asked to imagine themselves as a poor person, they tended to be more nepotistic than had they imagined themselves to be rich. Finally, nepotistic hiring intentions were in general stronger than non-nepotistic hiring intentions. These seemingly paradoxical results were interpreted in the light of the COVID-19 job market context and were explained by the mechanisms described by research on wealth and immoral behaviors, as well as the presence of risk aversion. _ Source: _Volume 30, Issue 2, pp 123 - 155 While there are old questions in research on Hobbes regarding which audience he addressed in each of his different works – e.g. there are speculations that _De Cive_ is addressed to scientists and _Leviathan_ to the English people – another question has rarely been discussed and only recently reconsidered: Might Hobbes have addressed different audiences also _within_ one and the same text, and if so, might he have intended to communicate (...) different messages to different readers? As ‘Straussian’ as this question might sound, it does not require us to impose external principles of hermeneutics on Hobbes’s texts. As this paper will argue, there is strong plausibility for the claim that Hobbes himself believes in the possibility and the necessity of ‘diversified communication’ or, to state it differently, to communicate different things to different people within one and the same text. By analysing Hobbes’s passion-grounded hermeneutics that is expressed both in Hobbes’s political writings and in his writings on science and on poetry, I show that it is very likely that Hobbes wrote ‘not all to all’ but instead designed different arguments for different people. Employing the heterogeneity principle in interpreting Hobbes’s texts might thus shed new light on some persistent puzzles of Hobbes’s political philosophy. (shrink)

While we applaud the careful breakdown by Clark and Fischer of the representation of social robots held by the human user, we emphasise that a neurocognitive perspective is crucial to fully capture how people perceive and construe social robots at the behavioural and brain levels.
