ABSTRACTChildren are often perceived to be less credible testifiers than adults. Their inexperience and affinity for play can provide reason to question their credibility and sincerity as truth tellers. The discrediting of children's testimonial claims can, however, result in an injustice when it stems from an uncritical age-related identity prejudice. This injustice can lead to several consequences varying in severity, with the worst cases leading to their deaths. More commonly, and especially when this injustice is considered in combination with other (...) intersectional identities, it has the potential to render these children invisible. In this paper, we discuss common domains within which children can face epistemic injustice when testifying about their experiences. The heart of the paper explores the most severe instances of epistemic injustices by reviewing three cases where children with intersectional identities died after their testimony was not believed. The paper concludes by emphasizing some of the important considerations that a recognition of intersectionality brings to the current discussion. (shrink)

Alternative food networks, such as farmers’ markets and community-supported agricultural and fishery programs, often struggle to reach beyond a consumer base that is predominantly white and affluent. This case study explores seven inclusion strategies deployed by a community-supported fishery program (Fishadelphia, in Philadelphia, PA, USA) including discounting prices, accepting payment in multiple forms and schedules, offering a range of product types, communicating and recruiting through a variety of media (especially in person), and choosing local institutions and people of color (POC) (...) as pickup location hosts. Our analysis indicated that all of these strategies were associated with increased participation of customers of color and/or customers without a college degree. For Asian customers, accepting cash, offering whole fish, recruiting in-person, and POC-hosted pickup locations were key factors. For Black customers, discounted price, accepting cash, offering fillets, and communicating through means other than email were most important. Discounted price and communicating through means other than email were most important for customers without a college degree. Payment method, payment schedule and communication method were highly correlated with other strategies; we suggest that these strategies work in synergy to make the program attractive and feasible to these customers. We consider how Fishadelphia’s inclusion efforts have benefitted from both tactical approaches (i.e., programmatic features) and a structural approaches (i.e., the people and places represented within the project), and suggest that elements of both tactical and structural inclusion can be applied in other contexts. This work is crucial for increasing food access, and underscores the importance of relationships in recruiting diverse customers. (shrink)

This paper develops a new argument from consciousness to theism: the argument from psychophysical harmony. Roughly, psychophysical harmony consists in the fact that phenomenal states are correlated with physical states and with one another in strikingly fortunate ways. For example, phenomenal states are correlated with behavior and functioning that is justified or rationalized by those very phenomenal states, and phenomenal states are correlated with verbal reports and judgments that are made true by those very phenomenal states. The notion of harmony has played a pivotal role in a number of debates in the philosophy of logic. Yet there is little agreement as to how the requirement of harmony should be spelled out in detail or even what purpose it is to serve. Most, if not all, conceptions of harmony can already be found in Michael Dummett's seminal discussion of the matter in The Logical Basis of Metaphysics. Hence, if we wish to gain a better (...) understanding of the notion of harmony, we do well to start here. Unfortunately, however, Dummett's discussion is not always easy to follow. The following is an attempt to disentangle the main strands of Dummett's treatment of harmony. The different variants of harmony as well as their interrelations are clarified and their individual shortcomings qua interpretations of harmony are demonstrated. Though no attempt is made to give a detailed alternative account of harmony here, it is hoped that our discussion will lay the ground for an adequate rigorous treatment of this central notion. It is both unusual and important to have such a systematic and thorough investigation of a topic of paramount social and philosophical significance by some of the leading minds of the day. Husserl’s first work formulated what proved to be an algorithmically complete arithmetic, lending mathematical clarity to Kronecker’s reduction of analysis to finite calculations with integers. Husserl’s critique of his nominalism led him to seek a philosophical justification of successful applications of symbolic arithmetic to nature, providing insight into the “wonderful affinity” between our mathematical thoughts and things without invoking a pre-established harmony. For this, Husserl develops a purely descriptive phenomenology for which he found inspiration in Mach’s proposal of a (...) “universal physical phenomenology.” To account for applications to any domain, Husserl envisages a theory of all possible deductive systems, which he develops extensively in his Göttingen lectures wherein he engages with Hilbert’s work on deductive systems for geometry, real arithmetic, and physics. This leads Husserl to formulate claims of decidability and proofs of completeness for various arithmetics that result from his analysis of Kronecker’s general arithmetic. Careful attention to these proofs seem to show that Husserl was not oblivious to problems that underlie our incompleteness theorems, namely that of showing that some inversions of his algorithmic arithmetic are undefined. His growing preoccupation with the issue of a pre-established harmony between mathematical thought and reality motivate his pursuit of a “supramathematics” of all possible complete theory forms to demystify such harmony, by having such a form on hand for describing any empirical domain. He soon decides that a transcendental idealism of nature will reveal the wonderful affinity of thoughts and things comprising such harmony, to be a wonderful “parallelism of objective unities and constituted manifolds of consciousness.” But the paradoxes of logic and set theory cloud the clarity of mathematics, which Weyl would restore with Brouwer’s intuitionism and Hilbert with his metamathematics. Husserl informed Weyl that his student Becker had formulated a phenomenological foundation not only for Weyl’s generalization of relativity theory but also for the Brouwer-Weyl continuum. But Weyl eventually rejected much of Becker’s work, especially when it became clear that his phenomenological intuitionism could not account for the success of Hilbert’s transfinite mathematics in quantum physics. Becker responded to this “crisis of phenomenological method” with his mantic phenomenology celebrating the magic of mathematical mysticism, which Husserl finally rejects in favor of a pluralistic phenomenology of mathematics and nature. Mereological harmony is the idea that the mereological structure of objects mirrors the mereological structure of locations. Grounding harmony is the idea that there is a similar mirroring between the grounding structure of objects and locations. Our goal in this paper is exploratory: we introduce and then explore two notions of grounding harmony: locative and structural. We outline potential locative and structural harmony principles for grounding, and show which of these principles may entail, or be entailed (...) by, principles of mereological harmony. We then present a case study in grounding harmony, by applying it to Schaffer’s :31, 2010a) specific version of priority monism. We show that, given a strong form of grounding harmony, Schaffer-style monism is inconsistent, but that this inconsistency can be resolved by offering bespoke notions of grounding harmony. We use Schaffer’s priority monism to demonstrate a broader tension within certain packages of metaphysical views, including versions of priority pluralism. Supersubstantivalism, the view that material objects are identical to their locations, has recently been defended in metaphysics and philosophy of physics. One of the most powerful arguments in its favour is the so-called argument from harmony. There is a certain harmony between material objects and their locations. Necessarily, if material object x is located at a spherical region, x is spherical. Necessarily, if material object x is located at region r, any part of x is located at a (...) part of r. Supersubstantivalism offers a straightforward explanation of such harmony. By contrast, dualism, the view that material objects are distinct from their locations, does not offer any explanation and should regard harmony principles as unexplained coincidences. In this paper I put forward a theory, which I shall call the ‘Inheritance Theory’, that does provide a straightforward explanation of harmony on behalf of dualists. (shrink)

This study aimed to explore the role of two models of well-being in the prediction of psychological distress during the COVID-19 pandemic, namely PERMA and mature happiness. According to PERMA, well-being is mainly composed of five elements: positive emotions, engagement, relationships, meaning in life, and achievement. Instead, mature happiness is understood as a positive mental state characterized by inner harmony, calmness, acceptance, contentment, and satisfaction with life. Rooted in existential positive psychology, this harmony-based happiness represents the result of (...) living in balance between positive and negative aspects of one's life. We hypothesized that mature happiness would be a more prominent protective factor during the present pandemic than the PERMA composite. A total of 12,203 participants from 30 countries responded to an online survey including the Depression Anxiety Stress Scale (DASS-21), the PERMA-Profiler, and the Mature Happiness Scale-Revised (MHS-R). Confirmatory factor analyses indicated that PERMA and mature happiness were highly correlated, but nonetheless, they represented two separate factors. After controlling for demographic factors and country-level variables, both PERMA Well-being and MHS-R were negative predictors of psychological distress. Mature happiness was a better predictor of stress, anxiety, and general distress, while PERMA showed a higher prediction of depression. Mature happiness moderated the relation between the perceived noxious effects of the pandemic and all markers of distress (depression, anxiety, stress, and total DASS-21). Instead, PERMA acted as a moderator in the case of depression and stress. These findings indicate that inner harmony, according to the mature happiness theory, is an essential facet of well-being to be taken into consideration. The results of this study can also orient policies aimed to alleviate the negative effects of the pandemic on mental health through the promotion of well-being. (shrink)

In my Steinberger 2009 I argued that Neil Tennant’s Harmony requirement is untenable because of its failure to account for the standard quantifier rules.1 Instead of justifying the customary rules for the existential and universal quantifiers, Tennant’s account appears to sanction only wholly unrestricted – and so patently disharmonious – quantifier rules. In his characteristically thoughtful response Tennant 2010, Tennant offers a sequent calculus version of his Harmony requirement that rules out such pathological would-be quantifiers. While I agree (...) with Tennant that recasting his Harmony requirement in the sequent format as he proposes blocks the said disharmonious quantifier rules, I submit that Tennant’s revamped Harmony requirement nevertheless misses the mark. I present two objections to substantiate my claim. First, I show that the crucial additional assumption underlying Tennant’s sequent calculus-based account – what I call the admissibility assumption – is excessively strong: so strong, in fact, that it renders otiose the core of Tennant’s original account. Second, I argue that the admissibility assumption, as a global requirement on deductive systems, is ill-suited for the purposes of codifying the intuitive notion of harmony. Fortunately, though, as I will demonstrate, we can dispense with the admissibility assumption altogether. (shrink)

Why are moral actions beautiful, when indeed they are? This paper assesses the view, found most notably in Schiller, that moral actions are beautiful just when they present the appearance of freedom by appearing to be the result of internal harmony (the Schillerian Internal Harmony Thesis). I argue that while this thesis can accommodate some of the beauty involved in contrasts of the ‘continent’ and the ‘fully’ virtuous, it cannot account for all of the beauty in such contrasts, (...) and so needs to be weakened considerably (to the Internal Harmony Thesis). To account for the remaining beauty that cannot be fully accommodated even by this revised thesis, as well as the beauty contained in contrasts that involve agents who experience internal conflict as a result of being sensitive to different sources of moral value to an appropriate extent, a number of further theses need to be posited: namely, that the beauty of some moral actions is to be accommodated in terms of internal disharmony (the Internal Disharmony Thesis), and in terms of a felt harmony between the appreciator of the action and the executor of the action (the Affective Harmony Thesis). As such, in contrast to Schiller, I suggest that we need to take a pluralist and context-sensitive approach to accommodating the beauty of moral actions. (shrink)

The Law has always been an instrument to exorcise different kinds of fear, primarily the fear of differences, through the distribution of shares of power. Perhaps, this system, inherently conflictual, is behind the failure of the multicultural policies of many countries, that have divided the society in as many separate communities as are the elements that differentiate each human being. The Law has also recognized to men a total power over Nature, feeding its illusion of control, that in recent decades (...) has shattered in front of several natural disasters. Ecuador, Buthan and South Africa have introduced in their Constitutions ideas belonging to the indigenous cultural tradition (buen vivir, buddhism and ubuntu), which express harmony between men and Nature. Michael Dummett and Dag Prawitz have argued that a constructivist theory of meaning depends on explicating the meaning of logical constants in terms of the theory of valid inference, imposing a constraint of harmony on acceptable connectives. They argue further that classical logic, in particular, classical negation, breaks these constraints, so that classical negation, if a cogent notion at all, has a meaning going beyond what can be exhibited in its inferential use. I argue that Dummett gives a mistaken (...) elaboration of the notion of harmony, an idea stemming from a remark of Gerhard Gentzen's. The introduction-rules are autonomous if they are taken fully to specify the meaning of the logical constants, and the rules are harmonious if the elimination-rule draws its conclusion from just the grounds stated in the introduction-rule. The key to harmony in classical logic then lies in strengthening the theory of the conditional so that the positive logic contains the full classical theory of the conditional. This is achieved by allowing parametric formulae in the natural deduction proofs, a form of multiple-conclusion logic. (shrink)

Yat-hung Leung debates Chenyang Li’s view of harmony and benevolence in Confucian teachings: Which is the more fundamental and important value, and ultimate ideal? In The Confucian Philosophy of Harmony, Li delineates a distinctively Confucian conception of “deep harmony” as the basic ideal of Chinese culture and especially Confucianism. Leung questions that depiction of things, arguing that benevolence does and should hold that place of honor. Leung focuses his arguments against two claims: firstly, that harmony should (...) be understood as the supreme value in Confucian thought, and secondly, that the ideal of harmony is of greater value to us today than that of benevolence. Leung points out that in the influential texts and traditions of Confucian philosophy, benevolence is of higher value than harmony. He disputes both the representative nature of the texts Li relies on as well as Li’s portrayals of some of those texts. We more properly understand Confucian harmony and benevolence in the inverse relation, with harmony as the product of benevolence, and thereby come to see that the substantive action-guiding content of benevolence in fact has the greater value to contemporary life. Chenyang Li responds to Yat-hung Leung by pointing out Leung draws on three distinct notions of benevolence, or ren, none of which on its own is a serious contender against harmony as the concept of central importance to Confucian philosophy. Ren cannot be all three of these at once, and no particular conception of ren in fact has all these qualities. Li further clarifies that it is not his aim to establish that harmony is of exclusively highest importance (...) among Confucian concepts and values, but rather merely to restore its place among the various central Confucian values. He elaborates on the essential role harmony plays when one properly values the virtue of benevolence, which itself requires or implies harmony, specifically harmonious coordination, in its practice and realization. Finally, Li argues that we cannot see the Confucian conceptions of benevolence Leung champions as possessing more practical value for contemporary life than the Confucian conception of harmony, and identifies the fundamental grounds and motivation of Leung’s criticisms to lie in allegiance to Song-Ming neo-Confucian orthodoxy, which grounds itself in philosophically empty postulates. Supporters of G.W.F. Hegel's philosophy have largely shied away from relating his logic to modern symbolic or mathematical approaches. While it has predominantly been the non-Greek discipline of algebra that has informed modern mathematical logic, philosopher Paul Redding argues that the approaches of Plato and Aristotle to logic were deeply shaped by the arithmetic and geometry of classical Greek culture. And by ignoring the fact that Hegel's logic also has this deep mathematical dimension, conventional Hegelians have missed some of Hegel's (...) greatest insights. In Conceptual Harmonies, Redding develops an account of Hegel's logic against a classical and modern historical background that is rarely considered. He stresses Hegel's attention to the Platonic background of Aristotle's original syllogistic and beyond. He then links these Platonic elements to Leibniz's modern revitalization of the logical tradition and then to new forms of algebraic geometry emerging in Hegel's lifetime. Redding thereby reestablishes aspects of Hegel's philosophy that are essential if Hegel is to be taken as a thinker relevant not only to contemporary philosophy, but also to current philosophical conceptions of logic. The paper exposes the relevance of permuting conversions (in natural-deduction systems) to the role of such systems in the theory of meaning known as proof-theoretic semantics, by relating permuting conversion to harmony, hitherto related to normalisation only. This is achieved by showing the connection of permuting conversion to the general notion of canonicity, once applied to arbitrary derivations from open assumption. According to logical inferentialists, the meanings of logical expressions are fully determined by the rules for their correct use. Two key proof-theoretic requirements on admissible logical rules, harmony and separability, directly stem from this thesis—requirements, however, that standard single-conclusion and assertion-based formalizations of classical logic provably fail to satisfy :1035–1051, 2011). On the plausible assumption that our logical practice is both single-conclusion and assertion-based, it seemingly follows that classical logic, unlike intuitionistic logic, can’t be accounted for in inferentialist terms. (...) In this paper, I challenge orthodoxy and introduce an assertion-based and single-conclusion formalization of classical propositional logic that is both harmonious and separable. The paper studies the extension of harmony and stability, major themes in proof-theoretic semantics, from single-conclusion natural-deduction systems to multiple -conclusions natural-deduction, independently of classical logic. An extension of the method of obtaining harmoniously-induced general elimination rules from given introduction rules is suggested, taking into account sub-structurality. Finally, the reductions and expansions of the multiple -conclusions natural-deduction representation of classical logic are formulated.

Xunzi discussed solidarity in two ways, that is, distancing through ritual and unifying through music. Therefore, it can be said that the solidarity is achieved between distancing from and closing to others. In this paper, I try to find an answer to the question how the solidarity is possible in Xunzi's ideas. Xunzi emphasized that individuals are different in discussing the solidarity through the rituals. When they accept the standard for differentiating themselves, they can be unified. In other words, they (...) can form the solidarity with others through the common moral symbol of rituals. However, it is very hard to expect they have common belief or ideas by means of the symbol. Therefore, Xunzi tried to complement the imperfect solidarity of morality by means of music. The solidarity through music is based on human emotions. We can feel enjoyable when we listen to music or dance with others. The emotion of enjoyment is one of the representative phenomena when we reach to the state of flow claimed by Mihaly Csikszentmihalyi. In this state, we feel the breakdown of boundary between us and the others. The emotional entrainment or the breakdown of the boundary does not necessarily mean that we form the solidarity with them. However, people participating in the rituals interpret the symbol of morality in different ways, but can feel oneness with the others just by participating in the same activity or dancing with them by the same rhythm. People who share the same activity have higher chances of forming the common belief. Therefore, the solidarity by music is the source of the one by rituals, and music can make a stronger sense of solidarity than rituals among people. (shrink)

The Harmony Thesis says that a connective is defective unless its associated introduction and elimination rules are in harmony. It also says that a connective is defective if the logical principles which regulate its use go beyond a pair of harmonious introduction and elimination rules. The chapter scrutinizes the most influential arguments which have been put forward (...) for the Harmony Thesis. It discusses Dummett‐Prawitz's argument for Harmony, which revealed the huge difficulties that confront the project of trying to explicate the notions of consequence and validity directly in terms of the rules which, for the Inferential Role Semantics (IRS) theorist, constitute the meanings of the connectives. Many prominent writers on the philosophy of logic, including Michael Dummett, Dag Prawitz, Neil Tennant, have held that the introduction and elimination rules of a logical connective must be ‘in harmony ’ if the connective is to possess a sense. This Harmony Thesis has been used to justify the choice of logic: in particular, supposed violations of it by the classical rules for negation have been the basis for arguments for switching from classical to intuitionistic logic. The Thesis (...) has also had an influence on the philosophy of language: some prominent writers in that area, notably Dummett and Robert Brandom, have taken it to be a special case of a more general requirement that the grounds for asserting a statement must cohere with its consequences. This essay considers various ways of making the Harmony Thesis precise and scrutinizes the most influential arguments for it. The verdict is negative: all the extant arguments for the Thesis are weak, and no version of it is remotely plausible. (shrink)

Ian Rumfitt (2000) developed a bilateralist account of logic in which the meaning of the connectives is given by conditions on asserted and rejected sentences. An additional set of inference rules, the coordination principles, determines the interaction of assertion and rejection. Fernando Ferreira (2008) found this account defective, as Rumfitt must state the coordination principles for arbitrary complex sentences. Rumfitt (2008) has a reply, but we argue that the problem runs deeper than he acknowledges and is in fact related to (...) the challenge of establishing proof-theoretic harmony. We motivate a distinctively bilateral criterion for harmony and show how the bilateralist can meet it. This also resolves Ferreira's complaint. (shrink)

This open access book investigates the role played by identity of proofs in proof-theoretic semantics. It develops a conception of proof-theoretic semantics as primarily concerned with the relationship between proofs (understood as abstract entities) and derivations (the linguistic representations of proofs). It demonstrates that identity of proof is a key both to clarify some —still not wholly understood— notions at the core of proof-theoretic semantics, such as harmony; and to broaden the range of the phenomena which can be analyzed (...) using the tools of this semantic paradigm, so as to include for instance paradoxes. The volume covers topics such as the philosophical significance of different criteria of identity of proofs, and adequacy conditions for an intensional account of the notion of harmony. The author also examines the Prawitz-Tennant analysis of paradoxes by investigating on the one hand the prospects of turning it into a theory of meaning for paradoxical languages, and on the other hand two distinct kinds of phenomena, first observed by Crabbe and Ekman, showing that the Tennant-Prawitz criterion for paradoxicality overgenerates. Only recently, however, have people tormented with such recollections been diagnosed as suffering from "post-traumatic stress disorder." Here Allan Young traces this malady, particularly as it is suffered by Vietnam veterans, to its beginnings in the emergence of ideas about the unconscious mind and to earlier manifestations of traumatic memory like (...) shell shock or traumatic hysteria. In Young's view, PTSD is not a timeless or universal phenomenon newly discovered. Rather, it is a "harmony of illusions," a cultural product gradually put together by the practices, technologies, and narratives with which it is diagnosed, studied, and treated and by the various interests, institutions, and moral arguments mobilizing these efforts. This book is part history and part ethnography, and it includes a detailed account of everyday life in the treatment of Vietnam veterans with PTSD. To illustrate his points, Young presents a number of fascinating transcripts of the group therapy and diagnostic sessions that he observed firsthand over a period of two years. Through his comments and the transcripts themselves, the reader becomes familiar with the individual hospital personnel and clients and their struggle to make sense of life after a tragic war. One observes that everyone on the unit is heavily invested in the PTSD diagnosis: boundaries between therapist and patient are as unclear as were the distinctions between victim and victimizer in the jungles of Southeast Asia. One of Ludwik Fleck’s ideas about the development of scientific knowledge is that—once a system of interpretation is in place—the process that follows can be characterised as one of inertia: any new evidence comes under a strong pressure to be incorporated into the established frame. This can result in what Fleck called a harmony of illusions when contradictory evidence becomes almost invisible or is incorporated into the established frame only by huge efforts.The paper analyses early explanations of the tuberculin (...) reaction as a case study of Fleck’s argument. For Robert Koch, who had presented tuberculin in 1890, the compound was supposed to be a diagnostic tool and a cure for tuberculosis. His conception of its effect was rather peculiar, but strictly in line with ideas on the pathogenesis of infectious diseases he had developed much earlier. After tuberculin was released in late 1890, whether Koch’s conception was convincing depended on the place that a given observer had in the medical world in late-nineteenth-century Germany. Inside Koch’s group, the status of the tuberculin reaction remained stable and tuberculin retained its value as a diagnostic and curative tool. On the other hand, observers from outside that thought collective, and in particular from clinical medicine, soon pointed to flaws in its conception. These critics developed a rather different picture of tuberculin as a mysterious and dangerous drug. No reconciliation followed and what we find instead in German medicine around the year 1900 is the presence of rather contradictory concepts and practices surrounding Koch’s wonder cure. (shrink)

Retributive theories of punishment hold that moral desert is a necessary and sufficient condition for punishment. This principle has been justified in light of rectifying a 'balance of justice' upset by wrongdoing. Many opposed to retributivism, such as Nussbaum, have argued such a ‘balance’ is nothing more than ‘magical’ thinking and retributivism is, in fact, positively harmful. On the contrary, I will argue that there is a compelling way to make sense of that intuition. The Chinese Neo-Confucian tradition and medieval (...) Latin theologian Thomas Aquinas hold that moral wrongs upset a normative order of relationships and, in this respect, disrupt the order that ought to exist in the human community. Despite criticisms that retributivism about punishment requires outlandish metaphysical assumptions, I therefore propose the theory remains plausible without any such appeal. (shrink)

Inferentialism claims that expressions are meaningful by virtue of rules governing their use. In particular, logical expressions are autonomous if given meaning by their introduction-rules, rules specifying the grounds for assertion of propositions containing them. If the elimination-rules do no more, and no less, than is justified by the introduction-rules, the rules satisfy what Prawitz, following Lorenzen, called an inversion principle. This connection between rules leads to a general form of elimination-rule, and when the rules have this form, they may (...) be said to exhibit “general-elimination” harmony. Ge-harmony ensures that the meaning of a logical expression is clearly visible in its I-rule, and that the I- and E-rules are coherent, in encapsulating the same meaning. However, it does not ensure that the resulting logical system is normalizable, nor that it satisfies the conservative extension property, nor that it is consistent. Thus harmony should not be identified with any of these notions. (shrink)

In diesem Beitrag soll systematisch untersucht werden, wie in der Moderne der Begriff der Tyrannis umgedeutet wird, und wie die moderne Auffassung der Tyrannis mit der Aufwertung des Antagonismus zusammenhängt. Von der Antike bis zum Spätmittelalter wird die tyrannische Herrschaft über die durch sie selbst herbeigeführte Auflösung des Staates definiert: Als tyrannisch gilt die Regierung, die jene in der Antike als normativ gesetzte und im Mittelalter als gottgegeben aufgefasste Harmonie des Gemeinwesens zerstört. In der Moderne gelten dagegen alle Regierungen als (...) tyrannisch, die das Individuum bei oder gar in der Entfaltung seiner Talente und Eigenschaften hindern. Diese neue Begriffsbestimmung gründet auf die Aufwertung der Antagonismen als Bestandteile der menschlichen Natur und zugleich als Triebfeder des staatsrechtlichen Fortschritts. Die neuzeitliche Aufwertung der Antagonismen und das mit ihm zusammenhängende Primat der individuellen Freiheit haben zur Folge, dass vom Staat die Fähigkeit gefordert wird, die aus der Entfaltung der individuellen Freiheit entstehenden Antagonismen anzuerkennen. Erst in der Moderne wird nämlich der Anspruch zur Geltung gebracht, einen staatsrechtlichen Raum zu gestalten, der Antagonismen ohne Schmälerung der individuellen Freiheit zu regeln vermag. (shrink)

In _A Relational Moral Theory: African ethics in and beyond the continent_ ( 2022 ), Thaddeus Metz proposes an African moral theory according to which we ought to respect and honour the capacity of individuals to be party to harmonious relationship. He aims to present a moral theory that should ‘be weighed up against at least contemporary Western moral theories’ (p. 2). As Metz intends his theory to be a serious contender with other moral theories, I assess how his moral (...) theory can be applied and contribute to contemporary moral discussions _‘beyond the continent’_, as the subtitle of the book puts it. In particular, as Metz’s relational moral theory is grounded on the value of harmony, an important question is how well his theory handles _disharmony_ especially if his theory is to have application in our non-ideal world in which disharmony is rife. And here, I hold up Metz’s account to one area of disharmony, disruptive emotions and affective injustice. By first establishing how disruptive emotions and affective injustice pose a challenge to similar relational moral theories grounded in harmony, I argue that Metz’s theory has distinct advantages in the way in which it can indeed engage with such phenomena. I close the paper by considering the objection that Metz’s account is limited in making sense of a common form of disruptive emotion in response to structural injustices where affective injustice can arise, but ultimately conclude that such a limitation is superficial. In 2005, Chinese President Hu Jintao instituted a “Harmonious Society” policy marking a new China’s approach toward development. This generated intense excitement among observers of Corporate Social Responsibility (CSR) who perceive an overlap in objectives between CSR and Harmonious Society and believe that Harmonious Society will lead to increased CSR engagement in China. However, there is little exploration of how Harmonious Society will contribute to increasing CSR engagement. This article seeks to explore whether Harmonious Society will meet this promise. It (...) does so by drawing up a list of actions that if taken by the government would increase the level of CSR in China and make Harmonious Society a relevant factor in the development of Chinese CSR. To do so, my article studies comparative literature on CSR development to develop a framework that divides causes of CSR in a country into environmental constraints and discretionary responses. Understanding what drives the development of CSR allows us to understand what measures the Chinese government can take to influence the level of CSR. Using this framework, my article suggests that Harmonious Society is unlikely to promote CSR in China’s growing private sector because policy measures that affect the “constraints” driving CSR are bounded by other political considerations. Whereas the concept of "socialist rule of law" punctuated political discourse in the late 1990s, the idea of a "socialist harmonious society" is today casting a strange light on Chinese legal reform. Is there a Confucian vision of China's marketing law and practice? To what extent have China's norms for marketing, mainly intellectual property and advertising law, been challenged by the new government policy toward a harmonious society? In the post World Trade Organization accession period, the theoretical framework of the (...) "socialist harmonious society" has turned law into a disciplinary principle given over to society's moral construction. If law is seen as an instrument for legitimizing power, it remains implicitly bound primarily to ensure the regime's durability. Although more and more ordinary citizens and foreign companies are seizing hold of normative tools being put at their disposal, this does not necessarily mean that Chinese law is implemented in a uniform and timely manner throughout China's territory. China still suffers from a lack of coherence and political will in the drafting of a legal reform that aims mainly at preserving the current fragile political balance. Contradictory forces are indeed at work in this legal construction that is torn between liberal leanings and socialist authoritarianism. Without a deep change in perspective, one can expect only relatively slow progress in protecting the intellectual property rights of the many Chinese and foreign goods and services that can be found on the Chinese market. Perfect Harmony and Melting Strains assembles interdisciplinary essays investigating concepts of harmony during a transitional period, in which the Pythagorean notion of a harmoniously ordered cosmos competed with and was transformed by new theories about sound - and new ways of conceptualizing the world. From the perspectives of philosophy, literary scholarship, and musicology, the contributions consider music's ambivalent position between mathematical abstraction and sensibility, between the metaphysics of harmony and the physics of sound. Essays examine the late (...) medieval and early modern history of ideas concerning the nature of music and cosmic harmony, and trace their transformations in early modern musico-literary discourses. Within this framework, essays further offer original readings of important philosophical, literary, and musicological works. This article explores how `social harmony' as cultural performance, is conducted by Chinese in their conversation at the surface level, with turbulence and manipulation concealed beneath superficial politeness. Although their more collective cultural orientation may lead them to greater cooperation and less confrontation, Chinese also develop artfully crafted messages to communicate competition and frustration. Selected discourse samples collected in Taiwan were analyzed in depth to show how social harmony may become a matter of external display, constructed, enacted and (...) negotiated through participants' verbal exchanges in their moment-to-moment interaction. It is concluded that superficial harmony allows the extensive web of interpersonal connections and hierarchical positioning to be maintained with minimal discord, while at the same time concealing underlying aggressiveness and ulterior motives. The philosophical discussion about logical constants has only recently moved into the substructural era. While philosophers have spent a lot of time discussing the meaning of logical constants in the context of classical versus intuitionistic logic, very little has been said about the introduction of substruc-tural connectives. Linear logic, affine logic and other substructural logics offer a more fine-grained perspective on basic connectives such as conjunction and disjunction, a perspective which I believe will also shed light on debates in the (...) philosophy of logic. In what follows I will look at one particularly interesting instance of this: The development of the position known as logical inferentialism in view of substructural connectives. I claim that sensitivity to structural properties is an interesting challenge to logical inferentialism, and that it ultimately requires revision of core notions in the inferentialist litera-ture. Specifically, I want to argue that current definitions of proof theoretic harmony give rise to problematic nonconservativeness as a result of their insensitivity to substructurality. These nonconservativeness results are undesirable because they make it impossible to consistently add logical constants that are of independent philosophical interest. (shrink)

This paper takes a close look at the thought that mereological relations on material objects mirror, and are mirrored by, parallel mereological relations on their exact locations. This hypothesis is made more precise by means of a battery of principles from which more substantive consequences are derived. Mereological harmony turns out to entail, for example, that atomistic space is an inhospitable environment for material gunk or that Whiteheadian space is not a hospitable environment for unextended material atoms.

In the present paper we discuss a recent suggestion of Schroeder-Heister concerning the possibility of defining an intensional notion of harmony using isomorphism in second-order propositional logic. The latter is not an absolute notion, but its definition is relative to the choice of criteria for identity of proofs. In the paper, it is argued that in order to attain a satisfactory account of harmony, one has to consider a notion of identity stronger than the usual one (based on (...) β- and η-conversions) that the authors have investigated in recent work.
