This essay argues that, contrary to the prevailing view according to which reflection in Kant's aesthetic judgment is interpreted as ‘the logical actus of the understanding’, we should pay closer attention to Kant's own formulation of aesthetic reflection as ‘an action of the power of imagination’. Put differently, I contend in this essay that the rule that governs and orders the manifold in aesthetic judgment is imagination's own achievement, the achievement of the productive synthesis of the ‘fictive power’, entirely independent (...) of the understanding. While this view does not entail that the faculty of the understanding is not necessary in aesthetic reflection, a stronger emphasis on the role of imagination in aesthetic reflection allows us to realize that its schematizing and interpretive activity, while consistent with, goes well beyond the discursive demands of the understanding insofar as it intimates the supersensible ground of freedom that manifests itself as ‘the feeling of life’. Therefore, I show in this essay that the imagination's unique interpretive power has a special role in completing Kant's critical system by facilitating the connection of the sensible to the supersensible, which further helps us appreciate imagination's practical as opposed to merely cognitive significance. "In this book, Kenneth F. Rogerson explores the first half of Kant's Critique of Judgment, entitled the "Critique of Aesthetic Judgment.

This paper argues that the structural obscurity in Kant’s Critique of the Power of Judgment reflects his tacit employment of three correlated but distinct notions: necessity considered as the universal validity of the judgment of taste; necessity considered as a feature of the judgment itself; and necessity considered as a feature of the mental free harmony that obtains in judging certain forms with taste. These distinctions have not been sufficiently recognized by commentators so far. Clarification of these three (...) notions can shed new light on the structure of the first part of Kant’s third Critique as well as on debates over the plausibility of his claims regarding taste. The aim of this paper is to give an interpretation of the free and harmonious play of faculties. The dominant interpretations focus on how the imagination is free from the determination of understanding, but say little about the harmony that can exist between imagination and understanding; thus, in this paper an attempt is made to account for the free and harmonious relationship between these two faculties. Some of Kant’s lectures are reviewed to show the inclinations of (...) the power of imagination and understanding, respectively. As the power of imagination is inclined towards making many representations, understanding is necessary to truncate the multitudes of those representations, so that unity of the representation is achievable. Taking inspiration from the traditional board game of Go, it is possible to draw an interpretation of the play of faculties that takes into consideration both the freedom and the harmony that is present within the play. According to a common reading, Spinoza and Leibniz stand on opposite ends of the modal spectrum. At one extreme lies ‘‘Spinoza the necessitarian,’’ for whom the actual world is the only possible world. At the other lies ‘‘Leibniz the anti-necessitarian,’’ for whom the actual world is but one possible world among an infinite array of other possible worlds; the actual world is privileged for existence only in virtue of a free decree of a benevolent God. In this paper, I (...) challenge both of these readings. Spinoza is no necessitarian and Leibniz is no anti-necessitarian – at least as these characterizations are usually understood. Rather, I contend, Spinoza and Leibniz are both anti-essentialists; they believe that the modality of objects can vary relative to how those objects are conceived. This shared commitment to anti-essentialism allows them to consistently affirm both necessitarianism and its denial, relative to different ways of conceiving the world. Their embrace of this modal theory, I further argue, is grounded in their similar views on metaphysical perfection, ontological plentitude, and the principle of sufficient reason. (shrink)

As far as treatments of causation are concerned, the pre-Kantian 18th century German context has long been dismissed as a period of uniform and unrepentant Leibnizian dogmatism. While there is no question that discussions of issues relating to causation in this period inevitably took Leibniz as their point of departure, it is certainly not the case that the resulting positions were in most cases dogmatically, or in some cases even recognizably, Leibnizian. Instead, German theorists explored a range of positions regarding (...) the nature of causal powers, the appropriate systems to explain the observed agreement between the states of substances, and the ground of free actions, or so I will argue in this chapter. Focusing on these three issues, I will here sketch the development of the debates relating to causation and trace the evolution of positions among the philosophers within the so-called Leibnizian-Wolffian philosophy as well as among its many opponents. The harmonious free play of the imagination and understanding is at the heart of Kant’s account of beauty in the Critique of the Power of Judgement, but interpreters have long struggled to determine what Kant means when he claims the faculties are in a state of free play. In this article, I develop an interpretation of the free play of the faculties in terms of the freedom of attention. By appealing to the different way that we attend (...) to objects in aesthetic experience, we can explain how the faculties are free, even when the subject already possesses a concept of the object and is bound to the determinate form of the object in perception. ABSTRACT As owner of the New Lanark cotton-mills from 1800, Robert Owen carried out a social experiment designed to transform the lives of his community of millworkers, through improved living and working conditions, free medical care and education. He intended to demonstrate how his ideas, if universally adopted, could transform society in general. Central to this experiment was his innovative and enlightened system of education in the Institute for the Formation of Character. This article looks in particular at the (...) musical life of New Lanark and explores Owen’s belief in the power of music to bind together people from different backgrounds, and to assist in the creation of a harmonious community. Lavishly funded musical activities played a major part in the curriculum, and in the life of the community as a whole. All this is well documented and fascinating insights into the lives of the New Lanark people are included in the travel journals and letters, some previously unpublished, of the many visitors who came to see Owen’s model community. The role of the imagination within Kant’s Critical framework remains an issue for any attempt to unify the three Critique s through the Doctrine of the Faculties. This work provides a reading of the imagination that serves to unify the imagination through its formal capacity, or ability to recognize harmony and produce the necessary lawfulness that grounds the possibility of judgment. The argument of this work exists in 2 parts. 1) The imagination’s formal ability is present, yet concealed, as (...) early as the Schematism in the Critique of Pure Reason and reaches its fullest exposition in instances of harmonious free play in the Critique of the Power of Judgment. 2) This formal capacity is key to not only demonstrating the imagination as an original, unified, and independent faculty across Kant’s Critical framework, but also serves as grounds for the purposiveness of nature – a key aspect of Kantian aesthetics. Kant interpreters are divided on the question of whether determinate cognition plays a role in the harmony of the faculties in aesthetic judgement. I provide a ‘non-cognitive’ interpretation that allows Kant’s statements regarding judgements of natural beauty to cohere such that determinate cognition need not be taken to perform any role in such judgements. I argue that, in aesthetic harmony, judgement privileges the free activity of the imagination over the cognizing function of the understanding for the purpose (...) of unifying the object, although the free imagination cannot violate the obscure concepts and principles of ordinary common sense. Harmony has become a major challenge for modern governance in the twenty-first century because of the multi-religious, multi-racial and multi-ethnic character of our increasingly globalized societies. Governments all over the world are facing growing pressure to integrate the many diverse elements and subcultures which make up modern pluralistic societies. This book examines the idea of harmony, and its place in politics and governance, both in theory and practice, in Asia, the West and elsewhere. It explores and analyses the (...) meanings, mechanisms, dimensions and methodologies of harmony as a normative political ideal in both Western and Asian philosophical traditions. The book argues that in Western political thought - which sees politics as primarily concerned with resolving social conflicts and protecting individual rights - the concept of harmony has often been neglected. In contrast, since earliest times harmony or ‘he’ has been a profound theme in Confucian thought, and current leaders of many East Asian governments, and the Chinese government, have explicitly declared that the realisation of a harmonious society is their aim. The book also assesses how harmony is pursued, jeopardized or deformed in the real world of politics, based upon empirical analysis of a variety of different cultural, social and political contexts, including: China, Hong Kong, Singapore, Malaysia, Singapore, Vietnam, Denmark, Latin America and the Scandinavian countries. It shows how harmony as an organizing concept can help to promote new thinking in governance, and overcome problems of modern-day governance like distrust, adversarial conflicts, hyper-individualism, coercive state intervention, and free-market alienation. It also discusses the potential problems posed by the pursuit of harmony, in particular in the grave threat of totalitarianism, and considers how these risks could best be mitigated. (shrink)

At the end of section §6 in the Analytic of the Beautiful, Kant defines taste as the “faculty for judging an object or a kind of representation through a satisfaction or dissatisfaction without any interest”. On the face of it, Kant’s definition of taste includes both; positive and negative judgments of taste. Moreover, Kant’s term ‘dissatisfaction’ implies not only that negative judgments of taste are those of the non-beautiful, but also that of the ugly, depending on the presence of an (...) actual displeasure. Frederick Bastiat’s last work was the Economic Harmonies, published in 1851. He died while completing it, and — though it had some uptake in the 19th century — in recent times scholarly interest has focused on his other work. In the Harmonies, he makes a remarkable claim: when properly understood, in a free market society all people’s economic interests are in harmony. If we consider that Karl Marx was arguing at the same time that those same societies are (...) afflicted by an endemic class struggle that can end only with the com-munist revolution, the contrast is sharp. The article aims at demonstrating that in attributing the creatio ex nihilo to both Plato and Aristotle as their unanimous philosophical conviction the Treatise on the Harmony between the Two Sages deeply depends upon the Neoplatonic reading of those two philosophers. The main obstacles for such a view in the works of the two sages are Plato's assumption of a precosmic chaos in the Timaeus and Aristotle's denial of any efficient causality to the unmoved mover in the Metaphysics. Both (...) of these points had been, however, done away with by the Neoplatonist commentators already, especially by Ammonius in his lost treatise on efficient and final causality in Aristotle the use of which in the Harmony is shown by a comparison with Simplicius. Christian and Muslim readers just had to transfer those arguments and hermeneutical techniques into an anti-eternalist context in order to make the two philosophers agree with one of the basic tenents of their face, a hermeneutical technique considerably different from the one employed by al-Fārābī in his exposition of Plato's and Aristotle's philosophy which is compared to the Harmony in a briefly sketched concluding section.L'article vise à montrer que le Traité sur l'harmonie des deux sages, en attribuant la creatio ex nihilo à Platon et Aristote comme conviction philosophique commune, dépend profondément de la lecture néoplatonicienne de ces deux philosophes. Since the 1990’s the rise of China provokes heated debates in the West. Numerous politicians and scholars, who study contemporary political affairs, pose the question, which will be the new role of China in international affairs? Many Western observers presume that China will act as the Western powers did in the past, promoting policy of domination, enslavement and gaining profits at all costs. The Chinese declarations on peace, co-operation, mutual interests, and harmony are often considered empty words, a certain (...) decorum of “real politics”, as it had been often practised in the West. An inquiry into the Chinese political and intellectual traditions, almost unknown in the West, challenges such widespread opinions and fears. Of course, it is an open question to which degree the traditional Chinese concepts will determine contemporary policy, since China had been westernised in enormous degree.Nevertheless, attitude to war, struggle, and competition constitutes one of the principal characteristics of each culture and appears closely related to its structure of values. Such attitudes determine political concepts and systems, foreign relations, norms of social life, etc. The analysis of Western and Chinese civilisations demonstrates that in this respect they represented divergent orientations. In Erich Fromm’s typology of societies, the Chinese culture could be considered non-destructive but aggressive, whereas Western civilisation could be called aggressive and destructiveOf course, there were great differences both within Chinese and within Western civilisations. Local/regional cultures belonging to each of them had their own characteristics in respect to struggle, and one could also notice great changes in the course of their histories. In general, at the dawn of these two civilisations, both of them were more or less bellicose, although in the cultures of the Chinese Central Plain “avoiding struggle” traits could be detected quite early. Appreciation of peace and harmony eventually prevailed with the predomination of the Confucian ideology, although Taoism and other schools of thought also condemned struggle and war. On the other hand, in the Mediterranean the bellicose cultures and war-mongering states prevailed. The beginning of this “great divergence” could approximately be dated for the middle of the 1st millennium BC, and the civilisations of East Asia and Europe took the opposite courses in theirsocial and political development. Struggle constituted a fundamental principle in the Western vision of the world-order, and its crucial archetype constituted the eternal struggle of Evil against Good, with the eventual triumph of God, who embodies Good and forces of Light. The Chinese tradition promoted instead the vision of the universe as one giant organism based on the principle of harmony, where Yin complements Yang. Hence both civilisations adopted the dualistic concepts, but one was antagonistic, and the second—complementary.In the 19th century, when Asian nations faced the colonial conquests, many of them tried to protect their independence and modernise themselves. For this end they tried to adopt not only Western armaments and military skills, but also Western bellicose ideology and values. Japan was obviously the champion of such a militarist course, but there were similar tendencies in China as well. Such bellicose ideology reached its apex there during the famous Maoist Cultural Revolution, when class struggle and bellicosity was exalted. The triumph of the Western bellicose approach and rejection of the traditional native heritage marked the century 1860’s–1960’s in China. However, after the unimaginable sufferings of the World War I and II, of Nazism and of communism, the West started to revalidate its traditions condemning war and violence. People started to appreciate peace and co-operation within and among nations. The United Nations and the European Union had been founded for such purposes: to promote peace and co-operation. However, the condemnation of wars did not halt military confrontation of the states, and the West still cultivates political ideologies, which propagate the “proper order” based on competition and struggle. Hence the concepts of multi-party democracy and of free market could serve as hallmarks of the West. In China, since the end of the 1970’s step by step the ancient ideological traditions have been appreciated again and the new concepts of peaceful and harmonious development evolved. At the beginning of the 21st century the Chinese leaders elaborated a new ideology of both harmonious domestic and international order aiming at peaceful development based on co-operation. Of course, there are still vivid the remnants of the previous Western-type approach of the brutal competition and of aggressive foreign policy.Notwithstanding divergent tendencies inside each of these civilisations, in general they both approach each other again, but this time in a common search for peace, cooperation and harmonious development. Their interpretations obviously differ, since in China such concepts are traditional, but rather new in the West, and in various respects both sides have different values and ideals. (shrink)

Much has been made about the ways that implicit biases and other apparently unreflective attitudes can affect our actions and judgments in ways that negatively affect our ability to do right. What has been discussed less is that these attitudes negatively affect our freedom. In this paper, I argue that implicit biases pose a problem for free will. My analysis focuses on the compatibilist notion of free will according to which acting freely consists in acting in accordance with (...) our reflectively endorsed beliefs and desires. Though bias presents a problem for free action, I argue that there are steps agents can take to regain their freedom. One such strategy is for agents to cultivate better self-knowledge of the ways that their freedom depends on the relationship between their conscious and unconscious attitudes, and the way these work together to inform action and judgment. This knowledge can act as an important catalyst for agents to seek out and implement short- and long-term strategies for reducing the influence of bias, and I offer four proposals along these lines. The upshot is that though bias is a powerful influence on our actions, we need not resign ourselves to its negative effects for freedom. (shrink)

This article examines the right to commercial speech that has been read into the right to freedom of speech and expression under Article 19(1)(a) of the Constitution of India. Restrictions on this right are only permitted if they come within the ambit of the exhaustive list of reasonable restrictions under Article 19(2), under which public health is notably absent. Nevertheless, through the doctrine of harmonious construction, the Indian judiciary have adopted a purposive interpretation to circumvent the omission of public health (...) by carving up freedom of commercial speech into two parts: protected speech which furthers public interest and unprotected speech which is purely commercial. Moreover, the Indian courts have construed these provisions in light of the right to life under Article 21 and the health-related Directive Principles of State Policy under Part IV of the Constitution. This article concludes that judicial creativity in India has consistently been used in favor of protecting public health. (shrink)

“I am me”, but what does this mean? For centuries humans identified themselves as conscious beings with free will, beings that are important in the cosmos they live in. However, modern science has been trying to reduce us into unimportant pawns in a cold universe and diminish our sense of consciousness into a mere illusion generated by lifeless matter. Our identity in the cosmos is nothing more than a deception and all the scientific evidence seem to support this idea. (...) Or is it not? The goal of this paper is to discard current underlying dogmatism (axioms taken for granted as "self-evident") of modern mind research and to show that consciousness seems to be the ultimate frontier that will cause a major change in the way exact sciences think. If we want to re-discover our identity as luminous beings in the cosmos, we must first try to pinpoint our prejudices and discard them. Materialism is an obsolete philosophical dogma and modern scientists should try to also use other premises as the foundation of their theories to approach the mysteries of the self. Exact sciences need to examine the world with a more open mind, accepting potentially different interpretations of existing experimental data in the fields of brain research, which are currently not considered simply on the basis of a strong anti-spiritual dogmatism. Such interpretations can be compatible with the notion of an immaterial spirit proposed by religion for thousands of years. Mind seems that is not the by-product of matter, but the opposite: its master. No current materialistic theory can explain how matter may give rise to what we call “self” and only a drastic paradigm shift towards more idealistic theories will help us avoid rejecting our own nature. Fichte’s early review of C. A. L. Creuzer’s neglected and idiosyncratic skeptical book on free will posed a serious challenge to what at the time was emerging as a consensus Kantian position on the role of free choice in the generation of imputable action. Fichte’s review was directed as much against Reinhold’s important letter on freedom of the will as it was against Creuzer himself. In the course of his brief review, Fichte suggests an important recasting of the (...) strategy of the Kantian postulates of rational faith; he poses a dilemma for the Reinholdian understanding of the relationship among an autonomous practical will, a free power of choice, and the actions of natural human organisms; and he hints at a radical reappropriation of the rationalist doctrine of pre-established harmony in re-orienting the search for a defensible reconstruction of a broadly Kantian position on the problem of free will. I argue that Nietzsche’s criticism of the Kantian theory of disinterested pleasure in beauty reflects his own commitment to claims that closely resemble certain Kantian aesthetic principles, specifically as reinterpreted by Schiller. I show that Schiller takes the experience of beauty to be disinterested both (1) insofar as it involves impassioned ‘play’ rather than desire-driven ‘work’, and (2) insofar as it involves rational-sensuous (‘aesthetic’) play rather than mere physical play. In figures like Nietzsche, Schiller’s generic notion of play—which is itself (...) influenced by Kant’s claim that aesthetic pleasure is orthogonal to desire-satisfaction—becomes decoupled from his (further) Kantian view that aesthetic play essentially involves a harmony of sensuous receptivity and rational spontaneity. The result, I suggest, is a self-standing opposition between desires and passions. This motivates a recognizably Romantic vision of aesthetic disinterestedness, as freedom from desire realized in a state of creative determination by passion. (shrink)

I argue against a reading of Kant's moral theory according to which Kant proposes no substantial conception of the good. Against those who place Kant in the liberal tradition on the basis of his formal, 'neutral framework,' principles, I suggest that Kant's practical and political theory rests on a valuation of the practical and cognitive virtues of self-mastery , self-sufficiency, and regularity. The appeal of Kant's principles, and hence their chances of ever being put into action, accordingly lies not in (...) their fairness or reasonableness, but in their promise to make real repose, unity, and harmony. I support these claims by examining the role of interest in Kant's understanding of agency; by showing that the categorical imperative serves as a practical guide only on the understanding that it expresses and protects free rational activity, in which it assumes an interest; and by pulling together the scattered passages in which Kant describes the features and promises of free rational activity that have for us tremendous appeal. ABSTRACTChildren are often perceived to be less credible testifiers than adults. Their inexperience and affinity for play can provide reason to question their credibility and sincerity as truth tellers. The discrediting of children's testimonial claims can, however, result in an injustice when it stems from an uncritical age-related identity prejudice. This injustice can lead to several consequences varying in severity, with the worst cases leading to their deaths. More commonly, and especially when this injustice is considered in combination with other (...) intersectional identities, it has the potential to render these children invisible. In this paper, we discuss common domains within which children can face epistemic injustice when testifying about their experiences. The heart of the paper explores the most severe instances of epistemic injustices by reviewing three cases where children with intersectional identities died after their testimony was not believed. The paper concludes by emphasizing some of the important considerations that a recognition of intersectionality brings to the current discussion. (shrink)

I explore how empathetic visual argument may be the mode best suited for eliciting appropriate force to the reasons given by arguers who face systematic identity prejudices. In the verbal mode, this force is often skewed through epistemic injustice (Fricker 2007), argumentative injustice (Bondy 2010), and discursive injustice (Kukla 2010). Highlighting their reliance on the Aristotelian sense of enthymeme, I show how visual arguments are highly context specific. Using Ian Dove’s Visual Scheming (2016) and the theory of the Retort collective (...) (2004) via case study, I demonstrate how the visual mode can leave the appropriate force in the arguer’s control. Many jurisdictions have put regulatory strategies in place to provide incentives and safeguards to whistleblowers to encourage whistleblowing on corporate wrongdoings. One such strategy is the provision of a financial incentive to the whistleblower if the complaint leads to a successful regulatory enforcement action against the offending organization. We conducted an experiment using professional accountants as participants to examine whether such an incentive encourages potential whistleblowers to report an observed financial reporting fraud to a relevant external authority. We also examine (...) the effect of perceived seriousness of the wrongdoing on accountants’ intention to whistleblow. We find that a financial incentive results in a higher intention to whistleblow to a relevant external authority. We also find that perceptions of the seriousness of the wrongdoing are significantly and positively associated with accountants’ intention to whistleblow to a relevant external authority. We find a significant interaction between the provision of a financial incentive and the perceived seriousness of the wrongdoing on the intention to report the wrongdoing externally. The intention to report the financial reporting fraud externally is higher when the level of perceived seriousness is higher, regardless of the availability of a financial incentive. However, when the perceived level of seriousness is lower, the presence of financial incentive results in a higher intention to report the financial reporting fraud externally. These findings indicate that the impact of a financial incentive on the intention to whistleblow is moderated by perceptions of the seriousness of the wrongdoing. (shrink)

For much of the last 50 years, a key platform animating public sector reform in Canada and elsewhere has been that efficiency and effectiveness can be achieved by adapting private sector financial management methods and practices. We argue that the recent re-establishment of the Office of the Comptroller General (OCG) of Canada represents a key element of a program of strengthening financial accountability that has emerged within the Canadian Federal Government. Although this program is longstanding and is associated Canada’s implementation (...) of new public management initiatives, it has recently drawn particular sustenance from the sponsorship scandal in Canada. We demonstrate that the reincarnated OCG, re-established amid a rhetoric of “modernization” and of “strengthening” accountability, has a wide-ranging mandate to enhance financial and audit controls, create financial standards, nurture professional development, and oversee government spending. We explore some of the consequences of this development and of the broader financial accountability mechanisms introduced in response to the Sponsorship scandal within the Canadian public sector. Technology used in online marketing has advanced to a state where collection, enhancement and aggregation of information are instantaneous. This proliferation of customer information focused technology brings with it a host of issues surrounding customer privacy. This article makes two key contributions to the debate concerning digital privacy. First, we use theories of justice to help understand the way consumers conceive of, and react to, privacy concerns. Specifically, it is argued that an important component of consumers' privacy concerns relates to (...) fairness judgments, which in turn comprise of the two primary components of distributive and procedural justice. Second, we make a number of prescriptions, aimed at both firms and regulators, based on the notion that consumers respond to perceived privacy violations in much the same way they would respond to an unfair exchange. The aim of UK-REACH (“The United Kingdom Research study into Ethnicity And COVID-19 outcomes in Healthcare workers”) is to understand if, how, and why healthcare workers (HCWs) in the United Kingdom (UK) from ethnic minority groups are at increased risk of poor outcomes from COVID-19. In this article, we present findings from the ethical and legal stream of the study, which undertook qualitative research seeking to understand and address legal, ethical, and social acceptability issues around data protection, privacy, and information (...) governance associated with the linkage of HCWs’ registration data and healthcare data. We interviewed 22 key opinion leaders in healthcare and health research from across the UK in two-to-one semi-structured interviews. Transcripts were coded using qualitative thematic analysis. Participants told us that a significant aspect of Big Data research in public health is varying drivers of mistrust—of the research itself, research staff and funders, and broader concerns of mistrust within participant communities, particularly in the context of COVID-19 and those situated in more marginalised community settings. However, despite the challenges, participants also identified ways in which legally compliant and ethically informed approaches to research can be crafted to mitigate or overcome mistrust and establish greater confidence in Big Data public health research. Overall, our research indicates that a “Big Data Ethics by Design” approach to research in this area can help assure (1) that meaningful community and participant engagement is taking place and that extant challenges are addressed, and (2) that any new challenges or hitherto unknown unknowns can be rapidly and properly considered to ensure potential (but material) harms are identified and minimised where necessary. Our findings indicate such an approach, in turn, will help drive better scientific breakthroughs that translate into medical innovations and effective public health interventions, which benefit the publics studied, including those who are often marginalised in research.
