Integrated developmental and elemental information in teeth provide a unique framework for documenting breastfeeding histories, physiological disruptions, and neurotoxicant exposure in humans and our primate relatives, including ancient hominins. Here we detail our method for detecting the consumption of mothers’ milk and exploring health history through the use of laser ablation‐inductively coupled plasma‐mass spectrometry (LA‐ICP‐MS) mapping of sectioned nonhuman primate teeth. Calcium‐normalized barium and lead concentrations in tooth enamel and dentine may reflect milk and formula consumption with minimal modification during (...) subsequent tooth mineralization, particularly in dentine. However, skeletal resorption during severe illness, and bioavailable metals in nonmilk foods, can complicate interpretations of nursing behavior. We show that explorations of the patterning of multiple elements may aid in the distinction of these important etiologies. Targeted studies of skeletal chemistry, gastrointestinal maturation, and the dietary bioavailability of metals are needed to optimize these unique records of human health and behavior. (shrink)

The National Human Genome Research Institute, a component of the National Institutes of Health, by law is directed to designate a portion of its annual budget to furthering understanding of the ethical, legal, and social questions emerging from research on the human genome. The ability to perceive the shapes of things as enduring through changes in how they stimulate our sense organs is vital to our sense of stability in the world. But what sort of capacity is shape constancy, and how is it reflected in perceptual experience? This paper defends a pluralist account of shape constancy: There are multiple kinds of shape constancy centered on geometrical properties at various levels of abstraction, and properties at these various levels feature in the content of (...) perceptual experience, governing patterns of apparent shape similarity. I propose that the varieties of shape constancy are subserved by the syntactic complexity of perceptual shape representations. By assigning discrete constituents to various abstract shape parameters, these representations attune us to the preservation of certain abstract shape properties through changes in more determinate shape properties. Finally, I draw broader lessons concerning the nature and function of perceptual constancy. (shrink)

Many countries currently invest in technologies and data infrastructures to foster precision medicine (PM), which is hoped to better tailor disease treatment and prevention to individual patients. But who can expect to benefit from PM? The answer depends not only on scientific developments but also on the willingness to address the problem of structural injustice. One important step is to confront the problem of underrepresentation of certain populations in PM cohorts via improved research inclusivity. Yet, we argue that the perspective (...) needs to be broadened because the (in)equitable effects of PM are also strongly contingent on wider structural factors and prioritization of healthcare strategies and resources. When (and before) implementing PM, it is crucial to attend to how the organisation of healthcare systems influences who will benefit, as well as whether PM may present challenges for a solidaristic sharing of costs and risks. We discuss these issues through a comparative lens of healthcare models and PM-initiatives in the United States, Austria, and Denmark. The analysis draws attention to how PM hinges on—and simultaneously affects—access to healthcare services, public trust in data handling, and prioritization of healthcare resources. Finally, we provide suggestions for how to mitigate foreseeable negative effects. (shrink)

This book reconceives virtue epistemology in light of the conviction that we are essentially social creatures. Virtue is normally thought of as something that allows individuals to accomplish things on their own. Although contemporary ethics is increasingly making room for an inherently social dimension in moral agency, intellectual virtues continue to be seen in terms of the computing potential of a brain taken by itself. Thinking in these terms, however, seriously misconstrues the way in which our individual flourishing hinges on (...) our collective flourishing. Green’s account of virtue epistemology is based on the extended credit view, which conceives of knowledge as an achievement and broadens that focus to include team achievements in addition to individual ones. He argues that this view does a better job than alternatives of answering the many conceptual and empirical challenges for virtue epistemology that have been based on cases of testimony. The view also allows for a nuanced interaction with situationist psychology, dual processing models in cognitive science, and the extended mind literature in philosophy of mind. This framework provides a useful conceptual bridge between individual and group epistemology, and it has novel applications to the epistemology of disagreement, prejudice, and authority. (shrink)

Synthetic biology is a broad term covering multiple scientific methodologies, technologies, and practices. Pairing biology with engineering, synbio seeks to design and build biological systems, either through improving living cells by adding in new functions, or creating new structures by combining natural and synthetic components. As with all new technologies, synthetic biology raises a number of ethical considerations. In order to understand what these issues might be, and how they relate to those covered in ethics literature on synbio, we conducted (...) an interview study with practicing synthetic biologists affiliated with a synthetic biology centre in Australia. Scientists identified a range of ethical challenges germane to the field, including precarious employment, pressures from industry, gender inequity, and the negative effects of the hyping of synbio. These challenges differed markedly from those identified in the ethics literature, whose treatment of the harms and benefits of synbio remains largely speculative and abstract. In our discussion of the pragmatic, every day ethical issues synthetic biologists face, we illustrate how issues of waste or research integrity play pivotal roles in everything from lived experiences in the laboratory, to long-term research trajectories guiding the field. In a confirmation of the ethical relevance of our participant’s views on the field, we argue that the subjects they raise must be included in any ethical analysis of synbio as a field. (shrink)

Perceptual constancy has played a significant role in philosophy of perception. It figures in debates about direct realism, color ontology, and the minimal conditions for perceptual representation. Despite this, there is no general consensus about what constancyis. I argue that an adequate account of constancy must distinguish it from three distinct phenomena:meresensory stability through proximal change, perceptualcategorizationof a distal dimension, and stability throughirrelevantproximal change. Standard characterizations of constancy fall short in one or more of these respects. I develop an account (...) of constancy that overcomes these problems. The account has two parts: an analysis of constancy mechanisms, and an analysis of the conditions under which a constancy capacity is exercised. I then employ this account to evaluate whether constancy is a necessary condition for perceptual representation, as some have conjectured. I argue that explanatory practice in perceptual psychology fails to support this view. Rather, it fits better with the weaker principle that representation requires specific tracking of a distal dimension. (shrink)

Clinical trials play a crucial role in generating evidence about healthcare interventions and improving outcomes for current and future patients. For individual trial participants, however, there are inevitably trade‐offs involved in clinical trial participation, given that trials have traditionally been designed to benefit future patient populations rather than to offer personalised care. Failure to understand the distinction between research and clinical care and the likelihood of benefit from participation in clinical trials has been termed the ‘therapeutic misconception’. The evolution of (...) the clinical trials landscape, including greater integration of clinical trials into healthcare and development of novel trial methodologies, may reinforce the significance of the therapeutic misconception and other forms of misunderstanding while at the same time (paradoxically) challenging its salience. Using cancer clinical trials as an exemplar, we describe how methodological changes in early‐ and late‐phase clinical trial designs, as well as changes in the design and delivery of healthcare, impact upon the therapeutic misconception. We suggest that this provides an impetus to re‐examine the ethics of clinical research, particularly in relation to trial access, participant selection, communication and consent, and role delineation. In this sequel to his prize-winning book, The Eyes of the People, Jeffrey Edward Green draws on philosophy, history, social science, and literature to ask what democracy can mean in a world where it is understood that socioeconomic status to some degree will always determine opportunities for civic engagement and career advancement. Under this shadow of unfairness, Green argues that the most advantaged class are rightly subjected to compulsory public burdens, but he also attends to the uncomfortable aspects (...) of ordinary, “second-class” citizenship as well: above all, the “reasonable envy,” “principled vulgarity,” and need for “extrapolitical solace” that will inform everyday citizens’ efforts to seek democratic ends within a political landscape permanently darkened by plutocracy. Deeply engaged in the history of political thought, the book is still first and foremost an effort to illuminate present-day politics. With the plebeians of ancient Rome as his muse, Green develops a plebeian conception of contemporary liberal democracy, at once disenchanted yet idealistic in its insistence that the Few-Many distinction might be enlisted for progressive purpose. Green’s analysis is likely to unsettle all sides of the political spectrum, but its purpose looks beyond narrow partisan concerns and aims instead to understand what the ongoing quest for free and equal citizenship might require once it is accepted that our political and educational systems will always be tainted by economic inequality. Cognitive scientists have long known that the modalities interact during perceptual processing. Cross-modal illusions like the ventriloquism effect show that the course of processing in one modality can alter the course of processing in another. But how do the modalities interact in the specific domain of object perception? This paper distinguishes and analyzes two kinds of multisensory interaction in object perception. First, the modalities may bind features to a single object or event. Second, the modalities may cooperate when differentiating an (...) object or event from its surroundings. I critically evaluate evidence for various forms of multisensory binding. I then consider the case for multisensory differentiation. I argue that existing evidence for multisensory differentiation is inconclusive. I highlight ways that the issue might be empirically resolved. (shrink)

Christopher Hill's Perceptual experience is a must‐read for philosophers of mind and cognitive science. Here I consider Hill's representationalist account of spatial perception. I distinguish two theses defended in the book. The first is that perceptual experience does not represent the enduring, intrinsic properties of objects, such as intrinsic shape or size. The second is that perceptual experience does represent certain viewpoint‐dependent properties of objects—namely, Thouless properties. I argue that Hill's arguments do not establish the first thesis, and then I (...) raise questions about the Thouless‐property view and its role in Hill's defense of representationalism. (shrink)

During the eighteenth century, elite women participated in the philosophical, scientific, and political controversies that resulted in the overthrow of monarchy, the reconceptualisation of marriage, and the emergence of modern, democratic institutions. Children and adults with dementia are vulnerable populations. Both groups are also relatively seldom included in biomedical research. However, including them in clinical trials is necessary, since both groups are in need of scientific innovation and new therapies. Their dependence and limited decision-making capacities increase their vulnerability, necessitating extra precautions when including them in clinical trials. Beside these similarities there are also many differences between the groups. The most obvious one is that children have an entire life ahead of them (...) and will become persons with certain ideals and preferences, while adults with dementia have lived a life in which they have expressed their ideals and preferences. Some of the available research guidelines recognize these differences, setting one list of specific requirements for groups of incapacitated adults and another list for children. Other documents, however, do not differentiate and only set requirements for subjects unable to consent as a single category of subjects. In this article we analyse to what extent the similarities and differences between the two groups are represented in legal documents and ethical guidelines. The article presents an overview and an analysis of the requirements for doing research with children and dementia patients. We conclude with suggestions about how to better incorporate the morally relevant aspects of these two groups in legislation and ethical guidelines. (shrink)

The translation of both ‘bedeuten’ and ‘Bedeutung’ in Frege's works remains sufficiently problematic that some contemporary authors prefer to leave these words untranslated. Here a case is made for returning to Russell's initial choice of ‘to indicate’ and ‘indication’ as better alternatives than the more usual ‘meaning’, ‘reference’, or ‘denotation’. It is argued that this choice has the philosophical payoff that Frege's controversial doctrines concerning the semantic values of sentences and predicative expressions are rendered far more comprehensible by it, and (...) that this translational strategy fulfills the desiderata of offering a translation which is acceptable both before and after Frege introduced the distinction between sense and reference or, as this paper would have it, between the sense of an expression and what it indicates. We explore the desirability of an idea that has not received the attention it deserves by political philosophers: that governments should bring privately-owned fossil fuel companies into public ownership with a view to managing their wind-down in the public interest – often simply referred to as ‘nationalising the fossil fuel industry’. We aim to make a conditional case for public ownership of fossil fuel companies. We will assume certain conditions about government motivations and capacities that are similar to assumptions made (...) generally in the philosophical and economic analysis of climate policies: that the government is suitably motivated, has effective control over the companies it acquires, and is able to sustain this motivation and control for long-enough to wind-down acquired companies in the public interest. We argue that bringing fossil fuel companies into public ownership, under these conditions, allows the government to take ten actions that are in the public interest, which will enhance social justice, enable a fair division of burdens and benefits, and strengthen democracy. We consider four plausible objections. While some of these point to the need for further research, they do not undermine our claim that nationalising the fossil fuel industry is a policy option that merits serious consideration. (shrink)

In the Realm of Criminal Law, Antony Duff seeks to defend the view that we should criminalize conduct only if it is wrongful. Skeptics of legal moralism argue that this occurs all the time in supposedly overinclusive offenses whose definitions capture not only the kind of conduct that constitutes the target wrong, but also a wider class of conduct that is not wrongful prior to prohibition. An example is statutory rape. Duff, in response, contends that such offenses need not violate (...) the requirements of legal moralism. Having exploitative sex with juveniles is obviously wrong even prior to its legal regulation. But having non-exploitative sex with juveniles is also potentially wrong, inasmuch as it involves a violation of a prohibition that society has decided is justified for instrumental reasons. While Duff’s analysis offers an ingenious explanation for why offenses like statutory rape need not violate the bare minimum requirements of legal moralism, it simultaneously exposes separate, largely unacknowledged, problems of fair labeling and proportionality. By combining in a single offense wrongs that are primarily malum in se with ones that are primarily malum prohibitum—a process referred to as “wrongfulness conflation”—we risk treating unlike wrongs alike, imposing disproportionate punishments, and blurring offense labels. And such problems occur not just in the context of statutory rape, but also with respect to a host of other supposedly overinclusive offenses, including various forms of sexual assault. (shrink)

A Citizen Public Debt Audit is an emancipatory praxis that can mobilize citizens to make legible public debt that has been accrued in their name. Ideally, it should hold creditors accountable for debt that is determined to be odious. This study examines the public debt crisis in Puerto Rico to illustrate the historically unjust circumstances under which public debt was accumulated on the island in the context of US federal taxation and economic policies. It explains how citizens are mobilizing via (...) a CPDA to make these circumstances legible and argues that citizens should not be obliged to service debt that was accrued contrary to their own welfare, especially if conditions of repayment threaten their current and future well-being. Christian Piska, one of the leading Austrian authorities in constitutional and administrative law, published a seventh revised edition of his Casebook—Introduction to Legal Studies in 2019. The work is intended to assist first-year law students in dealing with the challenging of the Written Module Examination Introduction to Legal Studies (“Schriftliche Modulprüfung ‘Einführung in die Rechtswissenschaften’” (University of Vienna, Faculty of Law. 2024). This reflective essay focuses not only on the question what is taught and exemplified as the foundations of legal (...) skills and knowledge first-year law students are expected to acquire, but also how and to which degree Piska’s Casebook is likely to achieve the goal it sets, i.e. to provide strategic guidance in preparing for one of the most challenging entrance examinations at the University of Vienna. We find that Piska’s Casebook constitutes a useful resource for students seeking to prepare for the Module Entrance Examination at the University of Vienna but also for legal educators and legal language teachers in legal literacy programmes. We find that the work lives up to its purpose of providing strategic guidance in preparing for the entrance examinations at the University of Vienna. We recommend integrating the growing body of research in applied legal linguistics, legal semiotics and in legal language teaching in future editions of the work which would likely enhance its educational value for students of law and those interested in advancing legal language teaching, legal language learning and legal language assessment. This comment on Professor ter Meulen's paper, "Solidarity and Justice in Health Care," offers additional perspectives on solidarity's importance for health. Noting the findings of social epidemiology, the paper explains that health has important public good dimensions. It is both non-rivlalrous because one person's health does not diminish another's, and it is largely determined by non-excludable access goods, including social networks, social determinants, and public health efforts. The public good dimension of health underscores the mutual dependence and shared stake that (...) people have with respect to health, and highlights the importance of coming together in solidarity for the sake of health. This is not to say that solidarity cannot also foster exclusionary tendencies; however, the recognition of mutual dependency with respect to health can foster an inclusive solidarity for the health of all people. This article answers questions about the consistency, coherence, and motivation of Hobbes's account of the right to punish. First, it develops a novel account of authorization that explains how Hobbes could have consistently held both that the subjects do not give the sovereign the right to punish and also that they authorize the sovereign to punish. Second, it shows that, despite appearances, the natural and artificial elements of Hobbes's account form a coherent whole. Finally, it explains why Hobbes thought it (...) was important to establish the sovereign's right to punish apart from the sovereign's power to punish. (shrink)

It is argued that we should distinguish ontic truth––the True––that Frege claimed is sui generis and indefinable, from the semantic concept, for which Tarski provided a definition. Frege’s argument that truth is not definable is clarified and Wittgenstein’s introduction of the distinction between saying and showing is interpreted as an attempted response to Frege’s rejection of the correspondence theory. It is argued that conflicts between realism and Dummettian anti-realism result from their proponents not thoroughly distinguishing between the two closely connected (...) ways of thinking about truth. Leo Strauss is widely recognized as one of the foremost interpreters of Maimonides. His studies of the medieval Jewish philosopher led to his rediscovery of esotericism and deepened his sense that the tension between reason and revelation was central to modern political thought. His writings throughout the twentieth century were chiefly responsible for restoring Maimonides as a philosophical thinker of the first rank. With _Leo Strauss on Maimonides_, Kenneth Hart Green presents for the first time a comprehensive, annotated collection of Strauss’s writings on Maimonides, comprising sixteen essays, three of which appear in English for the first time. Green has also provided careful translations of materials that had originally been quoted in Hebrew, Arabic, Latin, German, and French; written an informative introduction highlighting the original contributions found in each essay; and brought references to out-of-print editions fully up to date. The result will become the standard edition of Strauss’s writings on Maimonides. (shrink)

Surveying developments in a quarter-century of Anglophone legal philosophy, Leslie Green argues that there has been progress in some problems, such as the understanding of rules and reasons in the law; that in other areas —in particular, in discussions of the relationship between law and morality— there has been a marked narrowing of attention; and that with respect to the relationship between law and coercion, we have advanced very little beyond HLA Hart’s 1961 argument against reductionism. Here, we have (...) lost sight of one of the reasons for attending to the coercive aspect of law in the first place: that this is the most obvious way that law exercises power. Finally, the recent ‘methodological turn’ in jurisprudence is examined. To its benefit, the subject has become more self-conscious about its own status and methods. The paper concludes by exploring Dworkin’s revival of Fuller’s idea that a theory of law must be potentially useful to a lawyer or judge. Resisting this view, Green holds that while law is practical, a theory of the nature of law must answer to the truth about law. Study of a fascinating medieval Jewish philosopher, focusing on his twin conceptions of history. The philosopher and biblical commentator Joseph Ibn Kaspi (1280–1345) was a provocative Jewish thinker of the medieval era whose works have generally been overlooked by modern scholars. Power and Progress is the first book in English to focus on a central aspect of his work: Ibn Kaspi’s philosophy of history. Alexander Green argues that Ibn Kaspi understood history as guided by two distinct but interdependent forces: (...) power and progress, both of which he saw manifest in the biblical narrative. Ibn Kaspi discerned that the use of power to shape history is predominantly seen in the political competition between kingdoms. Yet he also believed that there is historical progress in the continuous development and dissemination of knowledge over time. This he derived from the biblical vision of the divine chariot and its varied descriptions across different biblical texts, each revealing more details of a complex, multifaceted picture. Although these two concepts of what drives history are separate, they are also reliant upon one another. National survival is dependent on the progress of knowledge of the order of nature, and the progress of knowledge is reliant on national success. In this way, Green reveals Ibn Kaspi to be more than a mere commentator on texts, but a highly innovative thinker whose insights into the subtleties of the Bible produced a view of history that is both groundbreaking and original. “Controversial in his day, and often denounced, Ibn Kaspi has fallen off the radar of contemporary scholarship.
