Can the evidence provided by software systems meet the standard of proof for civil or criminal cases, and is it individualized evidence? Or, to the contrary, do software systems exclusively provide bare statistical evidence? In this paper, we argue that there are cases in which evidence in the form of probabilities computed by software systems is not bare statistical evidence, and is thus able to meet the standard of proof. First, based on the case of State v. Loomis, we investigate (...) recidivism predictions provided by software systems used in the courtroom. Here, we raise problems for software systems that provide predictions that are based on bare statistical evidence. Second, by examining the case of People v. Chubbs, we argue that the statistical evidence provided by software systems in cold hit DNA cases may in some cases suffice for individualized evidence, on a view on which individualized evidence is evidence that normically supports the relevant proposition (Smith, in Mind 127:1193–1218, 2018). Mindfulness, for example, a concept derived from the Buddhist tradition, has captivated the imagination of clinicians who package it in convenient intervention programs for patients. Spirituality and religion have been researched with reference to potential health benefits. Spirituality can be conceptualised as the alignment of the individual with the whole, experientially, motivationally and in action. For spirituality to unfold its true potential it is necessary to align this new movement with the mainstream of (...) science, and vice versa. Hence, both a historical review, and a systematic attempt at integration is called for, which we are trying to give here. It is useful to go back to one of the roots: parapsychology. Parapsychology was founded as a counter movement to the rising materialist paradigm in the 19th century. Adopting the methods of the natural sciences, it tried to prove the direct influence of consciousness on matter. After 125 years this mission must be declared unaccomplished. Surveying the database of parapsychological research it is obvious that it will not convince sceptics: Although there are enough exceptional findings, it has in general not been possible to reproduce them in replication experiments. This is, however, a characteristic signature of a category of effects which we call effects of generalised entanglement, predicted by a theoretical model analogous to quantum theory. Using this perspective, parapsychological effects can be understood, and the original aim of the founding fathers can be recovered, as well as a new, systematic understanding of spirituality be gained. Generalised entanglement is a formal and scientific way of explaining spirituality as alignment of an individual with a whole, which, according to the model, inevitably leads to non-local correlations. This article critically engages a recent essay Jeffrey Alexander has published on ‘societalization’, whose conceptualization it finds problematic; first, because in contrast to the impression conveyed by the essay, the term itself is anything but new (as shown in a summary of six theories of societalization which precede Alexander’s by decades, in two cases, by more than a century), and, second, because the way Alexander employs the term is highly aporetic, while also being emblematic of much deeper problems that afflict (...) the whole discipline. Following a reconstruction of the term’s morphology and the transmutations it underwent during its gradual incorporation into the English language, the article identifies an undertheorized concept of society as the root cause behind the difficulties into which Alexander maneuvers himself. It concludes with a brief sketch of an alternative that can contribute to overcoming these difficulties. (shrink)

This paper deals with a problem which has received a great deal of attention in the ethical literature, but about which very little is known empirically: the selection of recipients for organs in transplant medicine. Based on a larger study, it is shown how this problem is practically resolved in one European country, Germany. It is demonstrated that most of the criteria used to determine recipients are non-medical in nature, even though they generally tend to be rationalized in medical terms. (...) Moreover, the choice of criteria depends as much on prognostic considerations as on personal indiosyncrasies and values held by individual physicians who are in charge at the various programs. The article concerns itself with normative aspects of public health in light of recent debates. It starts out by introducing a few terminological and conceptual distinctions that set the stage for the subsequent discussion. This is followed by critical remarks on two proposals for developing an adequate public health ethics and the way that the growing health inequalities observed in much of the OECD-world are dealt with in parts of the pertinent literature. The article concludes with a cautionary note on (...) the ‘dangers’ of over-identification with a public health agenda and of over-moralization of empirical findings that give cause for concern. The objective of this study was to examine whether the “step back and watch” attitude of mindfulness manifests in less emotional behavior. We hypothesized that the “acceptance” facet of mindfulness, but not the “presence” facet, is negatively associated with the magnitude of emotional behavior in four tests, i.e., rating of words, rating of aversive and neutral pictures, and evaluative conditioning . Additionally, we hypothesized that the acceptance facet is associated with increased reaction time in an emotional Stroop test, and that (...) the presence facet is associated with decreased RT and lower error rate. The sample consisted of N = 247 non-clinical adults and was tested in a cross-sectional study. The results provide partial evidence that the acceptance facet of mindfulness may be associated with less aversive reactions towards aversive stimuli. Future studies should substantiate these findings but also determine their clinical relevance. (shrink)

Definition of the problem: The article discusses the ways in which sociological analyses can contribute to the problem of a just allocation of scarce donor organs.Arguments: It is argued that this contribution consists primarily in the demonstration of the ethical, rather than medical nature of the problem itself. Only if its ethical nature is acknowledged will it be possible to come to a proper understanding of the several dilemmas involved and to consider adequate means for handling them.

We argue that, to be trustworthy, Computa- tional Intelligence (CI) has to do what it is entrusted to do for permissible reasons and to be able to give rationalizing explanations of its behavior which are accurate and gras- pable. We support this claim by drawing par- allels with trustworthy human persons, and we show what difference this makes in a hypo- thetical CI hiring system. Finally, we point out two challenges for trustworthy CI and sketch a mechanism which could be (...) used to gener- ate sufficiently accurate as well as graspable rationalizing explanations for CI behavior. In the mid-1980s, German social democracy was revived like a Phoenix from the ashes. In the individual federal states, it proved its governing capability which had been lost in the final years of the Schmidt Administration: The Social Democrats not only controlled the city-states of Bremen and Hamburg widi an absolute majority, but were able to win die 1985 elections so overwhelmingly, both in the largest state of North Rhine-Westphalia and also in Saarland, that they were not forced to (...) form any coalitions. But where die Social Democrats needed a partnership, as in Hesse, diey showed diat they would wager a red-green coalition. The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. Both spiritual experiences and mindfulness as a psychological variable have been identified as components of wellbeing and health. As there is uncertainty about their relationship, we have investigated the impact of spiritual experiences and mindfulness as well as their interaction on distress in chronically ill patients. The unidimensional Daily Spiritual Experiences Scale, the multidimensional Exceptional Experiences Questionnaire, the Freiburg Mindfulness Inventory, and the Brief Symptom Inventory were administered to 109 chronically ill patients. Fifty-eight patients reported regular and frequent spiritual or (...) contemplative practice from different traditions over an average of 14.7 years. Patients with regular spiritual practice reported more positive spiritual experiences, were more mindful and less distressed. A stepwise linear regression analysis revealed that the EEQ subscale “negative spiritual experiences” was the most important single predictor for psychological distress. In contrast, both the EEQ subscale “positive spiritual experiences” as well as the DSES that also captures positives daily encounters with a transcendental realm or entity did not account for a significant amount of variance in distress. Further analysis of the regression model, confirmed that NSE was still the largest predictor for distress and that mindfulness and the interaction between mindfulness and NSE were the most important buffers protecting individuals from distress. Thus, mindfulness seems not only to be a clinically important protective factor for buffering generic distress, but particularly for distress derived from NSEs. This suggests that in addition to directly facilitating well-being and health by means of positive spiritual experiences, at least some form of regular spiritual or meditative techniques seem to endow an individual with a certain degree of resilience against negative spiritual experiences that is likely a consequence of increased mindfulness. If these findings are vindicated by further studies, spiritual experiences should not be conceived and measured as univariate but rather multivariate constructs. (shrink)

It is often argued that there are no practical reasons for belief because we could not believe for such reasons. A recent reply by pragmatists is that we can often believe for practical reasons because we can often cause our beliefs for practical reasons. This paper reveals the limits of this recently popular strategy for defending pragmatism, and thereby reshapes the dialectical options for pragmatism. I argue that the strategy presupposes that reasons for being in non-intentional states are not reducible (...) to reasons to act. Pragmatists who want to preserve a motivational constraint on reasons therefore have exactly two options: either arguing that there are irreducible reasons for being in non-intentional states ; or arguing that we can believe directly for practical reasons. I argue that the prospects for the former option are dim because irreducible reasons to be in states are hard to square with the motivational constraint on reasons. Returning to the more traditional route of arguing for pragmatism by defending a version of doxastic voluntarism therefore seems to be the more promising way for pragmatists to go. (shrink)

The semeiotic of Charles Sanders Peirce is irreducibly triadic, positing that a sign mediates between the object that determines it and the interpretant that it determines. He eventually holds that each sign has two objects and three interpretants, standardizing quickly on immediate and dynamical for the objects but experimenting with a variety of names for the interpretants. The two most prominent terminologies are immediate/dynamical/final and emotional/energetic/logical, and scholars have long debated how they are related to each other. This paper seeks (...) to shed new light on the matter by reviewing the numerous manuscript drafts where Peirce develops the latter nomenclature while attempting to introduce his pragmatism to a general audience. It then goes on to examine an additional set of interpretants, intentional/effectual/communicational, and shows that the three different trichotomies can be understood as complementary, rather than redundant or conflicting. I attempt to answer the question of what Aristotle's criteria for 'being a substance' are in the Categories. On the basis of close textual analysis, I argue that subjecthood, conceived in a certain way, is the criterion that explains why both concrete objects and substance universals must be regarded as substances. It also explains the substantial primacy of concrete objects. But subjecthood can only function as such a criterion if both the subjecthood of concrete objects and the subjecthood of substance (...) universals can be understood as philosophically significant phenomena. By drawing on Aristotle's essentialism, I argue that such an understanding is possible: the subjecthood of substance universals cannot simply be reduced to that of primary substances. Primary and secondary substances mutually depend on each other for exercising their capacities to function as subjects. Thus, subjecthood can be regarded as a philosophically informative criterion for substancehood in the Categories. (shrink)

Das Buch beschreibt die Transformation des Diskurses der Kulturwissenschaft, der seit seinem Entstehen um die Jahrhundertwende auch die deutsch-jüdische Interkulturalität retten sollte, in einem Diskurs der politischen Theologie (Carl Schmitt und Gerschom Scholem), über den sich der katastrophale Trennungsprozess beider Kulturen vollstreckt.

Abstract Die moderne Physik besteht nicht nur aus neuen Entdeckungen und Erfindungen durch die Relativitätstheorie und durch die Quantenphysik. Sie besteht auch aus völlig neuen Sichtweisen und flexiblen Denkweisen von Zusammenhängen und Verschränkungen zwischen den Dingen. Die moderne Physik hat sich von dem Klischee des Schwarz-Weiß-Denkens verabschiedet, für das es nur getrennte Dinge, ohne fließende Übergänge gibt. Solche unbeweglichen, dogmatischen schwarzweißen Denkweisen können wir zurückverfolgen bis zu dem griechischen Philosophen Aristoteles. In der Zeit der Klassischen Mechanik hatten sie einen überwältigenden (...) Erfolg. Galilei behauptete, das Buch der Natur sei in der Sprache der Mathematik geschrieben. Das war die sehr kurzgefasste Formulierung der Klassischen Mechanik. Die moderne Physik hat sich keineswegs von der Mathematik verabschiedet, ganz und gar nicht. Doch der heilige Ernst und der starre und absolute Dogmatismus hat nachgelassen. Moderne Denkweisen in der Physik können mit den Begriffen von fließenden Übergängen, von Zwischenstufen, von Zusammenhängen zwischen den Dingen und von Schwingungen gekennzeichnet werden. Seit Faraday und Maxwell hat sich eine Verschiebung der Untersuchungsobjekte ergeben: Seit der Mitte des 19. Jahrhunderts, seit ca 1850, drehen sich die Denkmodelle der modernen Physik nicht mehr um getrennte, isolierten Körper, die im Nichts schwimmen, sondern um die Zwischenräume zwischen den Körpern und um die flexiblen Beziehungsgeflechte zwischen den Dingen und um die Netzwerke, die die Dinge umgeben. Das sind ganz neue physikalische Denkweisen, die durchaus Dunkelzonen und Zweifel und Ungewissheiten kennen, die den Bereich der Exaktheit überschatten. Neue Beiträge der physikalischen Denkweisen sind auch durch eine Flexibilität bei der Bildung von Begriffen gekennzeichnet. The Logic Manual is a clear and concise introduction to logic for beginning philosophy students.

Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. In response, voluntarists could propose a revision of our actual practices. This would lead us into a quite different debate. (shrink)

I present an explanatory argument for the reasons-first view: It is superior to knowledge-first views in particular in that it can both explain the specific epistemic role of perception and account for the shape and extent of epistemic justification.
