Physicians, nurses, and other clinicians readily acknowledge being troubled by encounters with patients who trigger moral judgments. For decades social scientists have noted that moral judgment of patients is pervasive, occurring not only in egregious and criminal cases but also in everyday situations in which appraisals of patients' social worth and culpability are routine. There is scant literature, however, on the actual prevalence and dynamics of moral judgment in healthcare. The indirect evidence available suggests that moral appraisals function via a (...) complex calculus that reflects variation in patient characteristics, clinician characteristics, task, and organizational factors. The full impact of moral judgment on healthcare relationships, patient outcomes, and clinicians' own well-being is yet unknown. The paucity of attention to moral judgment, despite its significance for patient-centered care, communication, empathy, professionalism, healthcare education, stereotyping, and outcome disparities, represents a blind spot that merits explanation and repair. New methodologies in social psychology and neuroscience have yielded models for how moral judgment operates in healthcare and how research in this area should proceed. Clinicians, educators, and researchers would do well to recognize both the legitimate and illegitimate moral appraisals that are apt to occur in healthcare settings. (shrink)

Individuals are downloading copyrighted materials at escalating rates (Hill 2007; Siwek 2007). Since most materials shared within these networks are copyrighted works, providing, exchanging, or downloading files is considered to be piracy and a violation of intellectual property rights (Shang et al. 2008). Previous research indicates that personal moral philosophies rooted in moral absolutism together with social context may impact decision making in ethical dilemmas; however, it is yet unclear which motivations and norms contextually impact moral awareness in a (...) peer-to-peer (P2P) file sharing context (Shang et al. 2008). In sum, factors affecting the decision to share copyrighted material require further clarification and investigation (Shang et al. 2008). The purpose of this study was to use a consumer-based scenario and multiple ethics measures to explore how idealism, formalism, and perceived social consensus impact users’ propensity to recognize that the sharing of copyrighted media through P2P networks was an ethical issue and their subsequent ethical intentions. Results showed that high levels of idealism and formalism were associated with an increased recognition that file sharing was an ethical issue, but neither construct had a direct effect on ethical intention. Strong social consensus among respondents that other people consider file sharing to be unethical was also positively related to the recognition that file sharing was an ethical issue, and ethical recognition was a moderate predictor of intention not to engage in file sharing. Finally, a post hoc mediation analysis indicated that idealism, formalism, and social consensus operated through recognition of an ethical issue to impact ethical intention (indirect-only mediation). It has often been thought that our knowledge of ourselves is _different_ from, perhaps in some sense _better_ than, our knowledge of things other than ourselves. Indeed, there is a thriving research area in epistemology dedicated to seeking an account of self-knowledge that would articulate and explain its difference from, and superiority over, other knowledge. Such an account would thus illuminate the descriptive and normative difference between self-knowledge and other knowledge.¹ At the same time, self- knowledge has also encountered its (...) share of skeptics – philosophers who refuse to accord it any descriptive, let alone normative, distinction. In this paper, we argue that there is at least one _species_ of self-knowledge that is different from, and better than, other knowledge. It is a specific kind of knowledge of one’s concurrent phenomenal experiences. Call knowledge of one’s own phenomenal experiences _phenomenal knowledge_. In the first chapter of his Knowledge and Lotteries, John Hawthorne argues that thinkers do not ordinarily know lottery propositions. His arguments depend on claims about the intimate connections between knowledge and assertion, epistemic possibility, practical reasoning, and theoretical reasoning. In this paper, we cast doubt on the proposed connections. We also put forward an alternative picture of belief and reasoning. In particular, we argue that assertion is governed by a Gricean constraint that makes no reference to knowledge, and that (...) practical reasoning has more to do with rational degrees of belief than with states of knowledge. We set up a general context in which one can prove Sauer-Shelah type lemmas. We apply our general results to answer a question of Bhaskar [1] and give a slight improvement to a result of Malliaris and Terry [7]. We also prove a new Sauer-Shelah type lemma in the context of op-rank, a notion of Guingona and Hill [4].

Timothy Hsiao asks a good question: Why believe animals deserve moral consideration? His answer is that we should not. He considers various other answers and finds them wanting. In this paper I consider an answer Hsiao has not yet discussed: We should accept a conservative view about how to form beliefs. And such a view will instruct us to believe that animals deserve moral consideration. I think conservatives like Hsiao do best to answer his question in a way that upholds (...) the moral status of animals. Since my answer is one Hsiao has not yet addressed, it is compatible with the main points he makes against various other motivations in his many papers on this topic. So my paper should be understood as an invitation to Hsiao to consider another answer. (shrink)

Moral phenomenology is (roughly) the study of those features of occurrent mental states with moral significance which are accessible through direct introspection, whether or not such states possess phenomenal character – a what-it-is-likeness. In this paper, as the title indicates, we introduce and make prefatory remarks about moral phenomenology and its significance for ethics. After providing a brief taxonomy of types of moral experience, we proceed to consider questions about the commonality within and distinctiveness of such experiences, with an eye (...) on some of the main philosophical issues in ethics and how moral phenomenology might be brought to bear on them. In discussing such matters, we consider some of the doubts about moral phenomenology and its value to ethics that are brought up by Walter Sinnott-Armstrong and Michael Gill in their contributions to this issue. In "Milk, Honey, and the Good Life on Moral Twin Earth", David Copp explores some ways in which a defender of synthetic moral naturalism might attempt to get around our Moral Twin Earth argument. Copp nicely brings out the force of our argument, not only through his exposition of it, but through his attempt to defeat it, since his efforts, we think, only help to make manifest the deep difficulties the Moral Twin Earth argument poses for the synthetic moral naturalist.

Evidence is drawn together to connect sources of inconsistency that Frege discerned in his foundations for arithmetic with the origins of the paradox derived by Russell in "Basic Laws" I and then with antinomies, paradoxes, contradictions, riddles associated with modal and intensional logics. Examined are: Frege's efforts to grasp logical objects; the philosophical arguments that compelled Russell to adopt a description theory of names and a eliminative theory of descriptions; the resurfacing of issues surrounding reference, descriptions, identity, substitutivity, paradox in (...) the debates concerning modal and intensional logics; the development of the New Theory of Reference. The hypothesis of the mental state-causation of behavior asserts that the behaviors we classify as actions are caused by certain mental states. A principal reason often given for trying to secure the truth of the MSC hypothesis is that doing so is allegedly required to vindicate our belief in our own agency. I argue that the project of vindicating agency needs to be seriously reconceived, as does the relation between this project and the MSC hypothesis. Vindication requires addressing what I (...) call the agent-exclusion problem: the prima facie incompatibility between the intentional content of agentive experience and certain metaphysical hypotheses often espoused in philosophy. This essay first distinguishes different questions regarding moral objectivity and relativism and then sketches a broadly Kantian position on two of these questions. First, how, if at all, can we derive, justify, or support specific moral principles and judgments from more basic moral standards and values? Second, how, if at all, can the basic standards such as my broadly Kantian perspective, be defended? Regarding the first question, the broadly Kantian position is that from ideas in Kant's later formulations of the (...) Categorical Imperative, especially human dignity and rational autonomous law-making, we can develop an appropriate moral perspective for identifying and supporting more specific principles. Both the deliberative perspective and the derivative principles can be viewed as “constructed,” but in different senses. The philosophical account of vagueness I call "transvaluationism" makes three fundamental claims. First, vagueness is logically incoherent in a certain way: it essentially involves mutually unsatisfiable requirements that govern vague language, vague thought-content, and putative vague objects and properties. Second, vagueness in language and thought (i.e., semantic vagueness) is a genuine phenomenon despite possessing this form of incoherence—and is viable, legitimate, and indeed indispensable. Third, vagueness as a feature of objects, properties, or relations (i.e., ontological vagueness) is impossible, because of (...) the mutually unsatisfiable conditions that such putative items would have to meet. In this paper I set forth the core claims of transvaluationism in a way that acknowledges and explicitly addresses a challenging critique by Timothy Williamson of my prior attempts to articulate and defend this approach to vagueness. I sketch my favored approach to truth and ontological commitment, and I explain how it accommodates the impossibility of ontological vagueness. I argue that any approach to the logic and semantics of vagueness that both (i) eschews epistemicism and (ii) thoroughly avoids positing any arbitrary sharp boundaries (either first-order or higher-order) will have to be not an alternative to transvaluationism but an implementation of it. I sketch my reasons for repudiating epistemicism. I briefly describe my current thinking about how to accommodate intentional mental properties with vague content within an ontology that eschews ontological vagueness. And I revisit the idea, which played a key role in my earlier articulations of transvaluationism, that moral conflicts provide an illuminating model for understanding vagueness. (shrink)

John Stuart Mill is the father of modern liberalism. His most remembered work, On Liberty, which was published in 1859, changed the course of the liberal tradition. What is less well-known is that his ideas have profoundly influenced the American constitutional rights tradition of the latter half of the twentieth century. Mill's 'harm principle' inspired the constitutional right to privacy recognized in Griswold v Connecticut, Roe vs Wade and other cases. His defense of freedom of expression influenced Justices Holmes, Brandeis, (...) Douglas, Brennan and others and led to greatly expanded freedom of speech in the twentieth century. Finally, Mill was an ardent feminist whose last important work, The Subjection of Women, was a full-scale and, for its time, radical defense of complete gender equality.
