Kant and Moral Theory The historian Herodotus gives (...) the anecdote of Darius, King of Persia, who summoned the Greeks and asked them if they would be willing to eat the bodies of their dead fathers. They replied they would not for any money in the world. Later, Darius asked some Indians of the tribe called Callatiae, who do eat their dead parents’ bodies, if they would ever consider burning the bodies, as was the custom among Greeks. “One can see by this what custom can do” writes Herodotus. He draws the conclusion that this story vindicates the view some acts may be right for some and wrong for others, depending on their individual conceptions of morality. The Sophists were also associated with relativistic thinking, notably Protagoras who asserts that “man is the measure of all things”. However, this view was quite uncommon and moral relativism hardly flourished, as Plato and Aristotle both defended forms of moral absolutism. Ancient Greek philosophers acknowledged moral diversity, but more often under the form of moral scepticism, which states that there is no moral knowledge (rather than moral truth is relative to a culture). This paper traces the ancestry of a familiar historiographical narrative, according to which early modern philosophy was marked by the development of empiricism, rationalism, and their synthesis by Immanuel Kant. It is often claimed that this narrative became standard in the nineteenth century, due to the influence of Thomas Reid, Kant and his disciples, or German Hegelians and British Idealists. The paper argues that the narrative became standard only at the turn of the twentieth century. This was not due to (...) the influence of Reid, German Hegelians, or British Idealists as they did not endorse the narrative, although Thomas Hill Green may have facilitated its uptake. The narrative is based on Kant’s historiographical sketches, as corrected and integrated by Karl Leonhard Reinhold. It was first fleshed out into full-fledged histories by two Kantians, Wilhelm Gottlieb Tennemann and Johann Gottlieb Buhle. Numerous historians, several of whom were not Kantians, spread it in the English-speaking world. They include Kuno Fischer, Friedrich Ueberweg, Richard Falckenberg, and Wilhelm Windelband. However, the wide availability of their works did not suffice to make the narrative standard because, until the 1890s, the Hegelian account was at least as popular as theirs. Among the factors that allowed the narrative to become standard are its aptness to be adopted by philosophers of the most diverse persuasions, its simplicity and suitability for teaching. (shrink)

Most philosophers reject what we might call "penal pluralism": the idea that punishment can and should encompass multiple penal goals or principles. This is rejected because it is often held that different penal goals or principles will conflict: the goal of punishing an offender to the degree deserved may differ and even undermine the goal of enabling deterrence or rehabilitation. For this reason, most philosophers argue that we must make a choice, such as choosing between retribution and its alternatives. In (...) "Some Remarks on Punishment," F. H. Bradley re-examines the justification of punishment in light of a critique of Darwinism's importance for ethics. My primary focus is on how Bradley's substantive discussion of punishment only because it is here that this article's arguments have most relevance for us today. (shrink)

Abstract: This essay traces the relationship between Hegel and some common portrayals of modern philosophy in the nineteenth century. I explain much of the rationale behind the neo-Kantian narrative of modern philosophy, and argue that the common division of modern philosophers into rationalists and empiricists executed a principally anti-Hegelian agenda. I then trace some failed attempts by anglophone philosophers to reconcile Hegel with the neo-Kantian history, in the interest of explaining Hegel’s subsequent unpopularity in England and America. Scholars have remained undecided how much the British Idealists owe to Hegel, how much to Kant, and how much they may be credited with minting a new intellectual coinage of their own. By way of a detailed examination of T. H. Green’s metaphysics of free will and how it stands to both its Kantian and its Hegelian predecessors, this paper attempts to make some headway on that longstanding question of pedigree. It is argued that by translating previously naturalistic considerations about (...) free will into Kantian or atemporalist terms, Green makes some useful and important advances. But he still remains subject to the tension between libertarian and autonomous approaches to the issue. It might be wondered whether any theory could ever reconcile these two approaches, but it is argued that by filtering his Kantianism through a more Hegelian lens, Green manages somewhat to reduce the friction between these two perspectives and to get closer to his ideal of a unified theory of human free will. British idealism flourished in the late 19th century and early 20th centuries. It was a movement with a lasting influence on the social and political thought of its time in particular. British idealists helped popularize the work of Immanuel Kant and G. W. F. Hegel in the Anglophone world, but they also sought to use insights from the philosophies of Kant and Hegel to help create a new idealism to address the many pressing issues of the Victorian period in Britain (...) and its aftermath. These contributions related to theories of freedom, the common good, political obligation, the state, and punishment. The British idealists also made important contributions in areas other than Hegelian scholarship and ethics, including logic, metaphysics, and the philosophy of religion. The movement declined by the start of World War I. This entry will highlight the most important work by British idealists themselves and by their best interpreters. Thus this entry will be grouped by individuals rather than by theme. (shrink)

Perhaps one of the most underappreciated philosophical movements is British Idealism. This movement arose during the latter half of the nineteenth century and began to wane after the outbreak of the First World War. British Idealism has produced a number of important figures, such as Bernard Bosanquet, R. G. Collingwood, F. H. Bradley and T. H. Green, as well as other important, but less well known, figures, such as J. S. Mackenzie, John Henry Muirhead and James Seth. It has also (...) given us a number of lasting philosophical ideas. Although T. H. Green is primarily remembered today as a moral and political philosopher, many of his philosophical concerns owe their origins to the Victorian crisis of faith in which a widespread belief in the literal truth of Scripture confronted seemingly incompatible scientific theories. Green attributed this crisis to the inability of science and religion to find accommodation in the popular version of empiricism widely accepted by educated men and women of his day. Was Thomas Hill Green a Millian utilitarian in practice? Controversially, David Weinstein claims that he was. This paper examines the theories of crime and punishment held by Green and John Stuart Mill. I argue that this special focus raises new and significant practical differences between Green and Mill that have been overlooked by both Weinstein and his critics. I will argue that these differences between Green and Mill over crime and punishment give practical effect to their competing moral philosophies. If (...) Green and Mill did indeed hold quite different positions on crime, punishment, and other fundamental matters of law, then we simply cannot say that Green was a Millian utilitarian in practice. The British idealists have not fared well during the past century. Still, there has been in recent years a renewed interest in the movement's (...) principal figures: F. H. Bradley and T. H. Green. And, while Bradley's polemical style has found a wider audience, Green's work—especially his Principles of Political Obligation—appears to have had the steadier following. Green agrees with Kant on the abstract character of moral law as categorical imperatives and that intentional dispositions are central to a moral justification of punishment. The central problem with Kant's account is that we are unable to know these dispositions beyond a reasonable estimate. Green offers a practical alternative, positing moral law as an ideal to be achieved, but not immediately enforceable through positive law. Moral and positive law are bridged by Green's theory of the common good through the (...) dialectic of morality. Thus, Green appears to offer an alternative that remains committed to Kantian morality whilst taking proper stock of our cognitive limitations. Unfortunately, Green fails to unravel fully Kant's dichotomy of moral and positive law that mirrors Green's solution, although Green offers a number of improvements, such as the importance of the community in establishing rights and linking the severity of punishment to the extent that a criminal act threatens the continued maintenance of a system of rights. This paper examines Thomas Hill Green's changing attitude to the Reform Question between 1865 and 1876. sketches the Radical landscape against which Green advocated reform between 1866 and 1867, paying particular attention to the respective positions of Gladstone, J.S. Mill and Bright on the relationship between responsible citizenship and class membership. examines Green's theories of social balance and responsible citizenship at the time of his lectures on the English Civil War. argues that, contrary to the established scholarship, Green's Radicalism was (...) closer to Bright than to Gladstone and Mill during this period. counters Richter's claim that Green abandoned democracy following the 1874 General Election, while arguing that even sympathetic commentators misunderstand Green's attitude to the Reform Question immediately after this date. This paper examines T. H. Green's and Henry Sidgwick's differing views of desireand the will, and connectedly, their differing views of an individual's good and freedom. It is argued that Sidgwick makes effective criticisms of Green, but that important elements in Green's idealist view of an individual's good and freedom survive the criticism and remain significant today. It is also suggested that Sidgwick's own account of an individual's good is unclear in an important way.

This is a new edition of T. H. Green's Prolegomena to Ethics (1883), a classic of modern philosophy, in which Green sets out his perfectionist ethical theory. In addition to the text of the Prolegomena itself, this new edition provides an introductory essay, a bibliographical essay, and an index. Brink's extended editorial introduction examines the context, themes, and significance of Green's work and will be of special interest to readers working on the history of ethics, ethical theory, political philosophy, and (...) nineteenth century philosophy.
