We agree with van der Pijl et al that the question of how to ensure consent is obtained for procedures which occur during labour and childbirth is vitally important, and worthy of greater attention.1 However, we argue that the modified opt-out approach to consent outlined in their paper may not do enough to protect the choice and agency of birthing people. Moreover, while their approach reflects a pragmatic attempt to facilitate legal clarity and certainty in this context, this is not (...) necessarily responsive to the messy realities of decision-making during labour (and beyond). We outline some of our concerns with their proposals and demonstrate how these illuminate some broader, longstanding tensions around consent and medical law. The authors place significant focus on the particularities of labour, outlining six ways in which maternity care is ‘unlike the usual healthcare setting’ (van der Pijl M et al,1p4). We support the need for attentiveness to these particularities and the problematic nature of consent in this context. Recent scholarly attention on the possible ‘political, ethical and theoretical implications and meanings of birthing embodiment’ (Chadwick R,2p2) has invited more nuanced conversation about consent, agency and decision-making during labour. However, while recognising the embodied particularities of labour, we must also avoid essentialising the differences of labouring bodies and thereby reinforcing exclusionary norms of consent. I follow Hájek (Synthese 137:273–323, 2003c) by taking objective probability to be a function of two propositional arguments—that is, I take conditional probability as primitive. Writing the objective probability of q given r as P(q, r), I argue that r may be chosen to provide less than a complete and exact description of the world’s history or of its state at any time. It follows that nontrivial objective probabilities are possible in deterministic worlds and about the past. A very simple (...) chance–credence relation is also then natural, namely that reasonable credence equals objective probability. In other words, we should set our actual credence in a proposition equal to the proposition’s objective probability conditional on available background information. One advantage of that approach is that the background information is not subject to an admissibility requirement, as it is in standard formulations of the Principal Principle. Another advantage is that the “undermining” usually thought to follow from Humean supervenience can be avoided. Taking objective probability to be a two-argument function is not merely a technical matter, but provides us with vital flexibility in addressing significant philosophical issues. (shrink)

The basis of the Periodic Table is discussed. Electronic configuration recurs in only 21 out of the 32 groups. A better basis is derived by considering the highest classical valency (v) exhibited by an element and a new measure, the highest valency in carbonyl compounds (v*). This leads to a table based on the number of outer electrons possessed by an atom (N) and the number of electrons required for it to achieve an inert (noble) gas configuration (N*). As one of the preeminent philosophers of the twentieth century, W. V. Quine made groundbreaking contributions to the philosophy of science, mathematical logic, and the philosophy of language. This collection of essays examines Quine's views, particularly his holism and naturalism, for their value to feminist theorizing today. Some contributors to this volume see Quine as severely challenging basic tenets of the logico-empiricist tradition in the philosophy of science—the analytic/synthetic distinction, verificationism, foundationalism—and accept various of his positions as potential resources for (...) feminist critique. Other contributors regard Quine as an unrepentant empiricist and, unlike feminists who seek to use or extend his arguments, they interpret his positions as far less radical and more problematic. In particular, critics and advocates of Quine's arguments that the philosophy of science should be "naturalized"—understood and pursued as an enterprise continuous with the sciences proper—disagree deeply about whether such a naturalized philosophy is "philosophy enough." Central issues at stake in these disagreements reflect current questions of special interest to feminists and also bridge the analytic and postmodern traditions. They include questions about whether and how the philosophy of science, as a form of practice, is or can be normative as well as questions concerning the implications of Quine's philosophy of language for the transparency and stability of meaning. In representing feminist philosophy centrally engaged with the analytic tradition, this volume is important not only for what it contributes to the understanding of Quine and naturalized epistemology but also for what it accomplishes in working against restrictive conceptions of the place of feminism within the discipline. Nelson More than a dozen years ago, in the pages of The Philosophical Quarterly,1 this writer contested Sraffa and Keynes' claim, advanced in the introduction to their edition ofthe Abstract? that it was Hume and not Adam Smith (as traditionally supposed) who was the author of that work. The traditional view, which might be called the Adam Smith authorship-theory, was (...) largely inspired by and seemed nailed shut by Hume's reference to a "Mr Smith" in a letter to Francis Hutcheson, datedMarch 4, 1740.3There appeared tobe goodreasonsforidentifying this "Mr Smith" with Adam Smith and then the latter with the undivulged author of the Abstract. It was known, for instance, that previous to March 4, 1740, Adam Smith had been a student of Hutcheson's and that Hutcheson was in the habit of setting his students the task of writing abstracts of newly published philosophical works.4 Since Hutcheson had originallylooked with favor on both the Treatise and its author,5 it had to seem more than likely that he had set his students the task ofwriting an abstract ofthe newly published Treatise ofHume. When, therefore, Sraffa and Keynes in the introduction to their edition oftheAbstract pointed out that there existed another Smith who might arguably be the Mr Smith referred toin H, namely, the DubUn publisher oftwo ofHutcheson's works, John Smith "at the Philosopher's Head on the Blind Quay," its major prop being seemingly knocked out from under it, the Adam Smith authorship-theory crashed—at least in the eyes of the general world—to the ground. While much has been written on Latour’s politics and use of militaristic language, by attending to some of Latour’s lesser known or read writings, his political location within the traditional Left-Right spectrum becomes more discernable, as does the reason for his frequent resort to the language of war. This article does not seek to defend Latour’s politics or rhetoric, but to provide a corrective by incorporating, rather than taking distance from, his use of militaristic language. Die kritische Auseinandersetzung mit zeitgenössischen Strömungen der Philosophie nahm in Nelsons Lehrtätigkeit und Veröffentlichungen breiten Raum ein. Neben konkurrierenden Ausprägungen des Neukantianismus grenzte er sich gegen Pragmatismus, Positivismus und die phänomenologische Schule ab, vor allem aber auch gegen Autoren wie Bergson und Spengler, die einem Paradigma von Philosophie verpflichtet waren, das Nelson in seinen Vorlesungen mit dem Ausdruck "intuitive Philosophie" bezeichnete. Nelsons Kritik beschränkt sich nicht darauf, dieser Art Philosophie Begründungsmängel vorzuwerfen. Vielmehr sieht er die "intuitive Philosophie" in dem (...) klassischen Denkfehler befangen, gehaltvolle Aussagen aus bloßen Begriffen herzuleiten und die Gültigkeit ihrer Thesen durch die fälschliche Berufung auf begriffliche Tatsachen zu erschleichen. Wie für Wittgenstein sind auch Nelsons leitende Ideale in der Philosophie Klarheit und kompromisslose Konsequenz. Over the past two decades the growth of the organic sector has been accompanied by a shift away from first party, or peer review, systems of certification and towards third party certification, in which a disinterested party is responsible for the development of organic standards and the verification of producer compliance. This paper explores some of the limitations of the third party certification model and presents the case of Mexico as an example of how an alternative form of participatory certification (...) has emerged. The paper suggests that participatory guarantee systems (PGS) are reflective of the growing “beyond organic” movement, which focuses on reconstructing the local and re-embedding food systems into their socio-ecological contexts. It argues that PGS offers a number of benefits for producers and consumers, particularly in the South, but that it faces a number of challenges as well, such as a lack of formal recognition, social conflicts and dependence on donated resources. I present a problem for a prominent kind of conservatism, viz., the combination of traditional moral & religious values, patriotic nationalism, and libertarian capitalism. The problem is that these elements sometimes conflict. In particular, I show how libertarian capitalism and patriotic nationalism conflict via a scenario in which the thing that libertarian capitalists love – unregulated market activity – threatens what American patriots love – a strong, independent America. Unrestricted libertarian rights to buy and sell land would permit the sale (...) of all American territory by private individuals to foreign powers. Patriotic nationalists regard this as outrageous, but libertarian capitalists cannot refuse it. (shrink)

An article by Luigino Bruni and Robert Sugden published in this journal argues that market relations contain elements of what they call ‘fraternity’. This Response demonstrates that my own views on interpersonal relations and markets – which originated in the feminist analysis of caring labour – are far closer to Bruni and Sugden's than they acknowledge in their article, and goes on to discuss additional important dimensions of sociality that they neglect.

Consequentialist reasoning and neoclassical assumptions about perfectly competitive markets encourage business school faculty and students to overlook the role of ethics in a market system. In a perfectly competitive economy, self-interest suffices to bring about a desirable outcome. However, discrepancies between an economist''s assumptions and the realities of a market economy establish a need for business ethics. This essay, written as a lecture for MBA students, first reviews Pareto optimality as an argument in favor of market allocations. It then uses (...) the discrepancies between actual and hypothetical markets to derive a Rawlsian duty of civility. This neoclassical case for business ethics requires individuals to avoid exploiting the defects that are inevitable in any social structure. (shrink)

We consider Helen Longino's proposal that "ontological heterogeneity", "complexity of relationship", and "the non-disappearance of gender" are criteria for good science and cannot be separated into cognitive and social virtues. Using a research program in neuroendocrinology investigating a hormonal basis for sex-differentiated lateralization as a case study, the authors disagree concerning whether the first two criteria can be construed as criteria for good science. Concerning the non-disappearance of gender criterion, we argue that its appropriateness is context specific, and that its (...) cognitive and social formulations are separable and should be construed as such. SUMMARYThe Machiavellian Moment was largely responsible for establishing what remains the dominant understanding of American Revolutionary ideology. Patriots, on this account, were radical whigs; their great preoccupation was a terror of crown power and executive corruption. This essay proposes to test the whig reading of patriot political thought in a manner suggested by Professor Pocock's pioneering first book, The Ancient Constitution and the Feudal Law. The whig tradition, as he taught us, located in the remote Saxon past an ‘ancient constitution’ (...) of liberty, in which elected monarchs merely executed laws approved by their free subjects in a primeval parliament. This republican idyll, whigs believed, was then tragically interrupted by the Norman Conquest of 1066, which introduced feudal tenures and monarchical tyranny. Did patriot theorists accept this narrative? The answer, I shall argue, is strikingly mixed. By the early 1770s, appeals to the ‘ancient constitution’ had become less common in patriot writing. And by the end of the 1770s, many patriots had absorbed a completely different understanding of the feudal past—one pioneered by Royalist historians of the seventeenth century and then adapted by Scottish historians of the eighteenth. This shift reflects a broader transformation in patriot political and constitutional theory. (shrink)

I discuss two claims defended in Fischer’s recent work. The first is the default status of compatibilism. This is part of a conception of our agency and moral responsibility as being independent of the truth or the falsity of the thesis of determinism. I try to further bolster Fischer’s arguments in favor of this position. The second is Fischer’s defense of the narrative conception of moral responsibility, according to which the value of self-expression supports and explicates the value of being (...) morally responsible. I argue that the cases and insights taken to support the idea that our lives have a distinctive kind of narrative value are best accounted for in other terms. (shrink)

Van Fraassen argues that explanatory power cannot be a conformational virtue. In this paper I will show that informational features of scientific theories can be positively relevant to their levels of conformation. Thus, in the cases where the explanatory power of a theory is tied to an informational feature of the theory, it can still be the case that the explanatory power of the theory is positively relevant to its level of confirmation.

In this article, I will present a construction of a Nishitanian ethics of sympathy primarily based on passages from Nishitani Keiji’s principal work of his middle period Religion and Nothingness (Shūkyō to ha nani『宗教とは何か』). To establish the normativity of Nishitani’s concept of sympathy I will present his concept of force (chikara 力) as its basis. I will argue that the role of force has been hereto overlooked in the analysis of Nishitani’s concept of circuminsessional relations which has impaired the task (...) of constructing an ethical theory from his thought. I will primarily engage with Brett Davis’s work on circuminsessional relations to demonstrate this point, as I believe he has provided the most robust account of it thus far. After establishing this construction, I aim to elucidate the relative advantages of Nishitanian ethics of sympathy and address potential critiques. First, I will position Nishitanian ethics of sympathy as responding to Nietzsche’s critique of Schopenhauer’s morality of compassion. Nietzsche's critique is strong and that responding to him on Nishitanian grounds will be useful in demonstrating the advantages of my construction. Next, I will respond to a critique given in Peter-Hans Liederbach’s ‘Between the Ontological and the Ontic’ that accuses Nishitani’s philosophy of being unable to offer a basis for ethics. Lastly, I wish to position Nishitanian ethics of sympathy as a starting point for expanding the tradition of sympathy-based morality in East Asian philosophy. I will do this by relating Nishitani’s concept of sympathy to Justin Tiwald’s work on sympathy in Confucianism. (shrink)

ABSTRACT Do physicians have a duty to sustain the pregnancies of women who die during the first or second trimester? Physicians cannot simply assume that the woman would have wished the pregnancy to continue, nor (in the U. S., at any rate) is it clear that the state has any interest in fetal life before viability. The conditions for beneficence‐based duties of fetal rescue will often be unmet, both because sustaining the pregnancy is not always a clear gain to the (...) born child and because it may impose a substantial burden on the benefactor. And duties of special relationship cannot readily be applied in these cases, as it is difficult to see how the relationship between someone who no longer exists and someone who does not yet exist can breed special duties. Further, to draw on Marx's distinction between the architect, who builds purposefully, and the bee, who cannot help what she is doing, I argue that human pregnancy is in a number of respects purposeful, creative, and deliberate, and that postmortem pregnancy, which follows the model of the bee, is a destructive icon that undercuts women's agency. In her final fragmentary novel Sanditon, Jane Austen develops a theme that pervades her work from her juvenilia onward: illness, and in particular, illness imagined, invented, or self-inflicted. While the “invention of odd complaints” is characteristically a token of folly or weakness throughout her writing, in this last work imagined illness is also both a symbol and a cause of how selves and societies degenerate. In the shifting world of Sanditon, hypochondria is the lubricant for a society bent on turning (...) health into a commodity. As a result, people’s rationality and their moral character come under attack. Catherine Belling’s recent subtle study, A Condition of Doubt: The Meanings of Hypochondria, unveils hypochondria’s discursive and cultural character. Running sharply against the tenor of Austen’s treatment, however, she argues in defense of the rationality of hypochondriacs; the notion that the condition may involve morally significant defects is not entertained; any connection to the commercialization of health care is muted. Here, I contrast Austen’s morally and epistemically negative rendering of her hypochondriacal characters in Sanditon with Belling’s efforts to create a sympathetic understanding of people with hypochondria. I will argue that, despite time gaps and genre differences, joint consideration of these texts can help bioethicists better appreciate how medicine can intensify, pathologize, and exploit anxieties about illness and death, thus adding to the challenges of living well in the face of mortality and morbidity.
