Automated decision making for sentencing is the use of a software algorithm to analyse a convicted offender’s case and deliver a sentence. This chapter reviews the moral arguments for and against employing automated decision making for sentencing and finds that its use is in principle morally permissible. Specifically, it argues that well-designed automated decision making for sentencing will better approximate the just sentence than human sentencers. Moreover, it dismisses common concerns about transparency, privacy and bias as unpersuasive or inapplicable. The (...) chapter also notes that moral disagreement about theories of just sentencing are plausibly resolved by applying the principle of maximising expected moral choiceworthiness, and that automated decision making is better suited to the resulting ensemble model. Finally, the chapter considers the challenge posed by penal populism. The dispiriting conclusion is that although it is in theory morally desirable to use automated decision-making for criminal sentencing, it may well be the case that we ought not to try. (shrink)

Over the past decade, police departments in many countries have experimented with and increasingly adopted the use of police body-worn cameras. This article aims to examine the moral issues raised by the use of PBWCs, and to provide an overall assessment of the conditions under which the use of PBWCs is morally permissible. It first reviews the current evidence for the effects of using PBWCs. On the basis of this review the article sets out a teleological argument for the use (...) of PBWCs. The final two sections of the article review two deontological objections to the use of PBWCs: the idea that use of PBWCs is based on or expresses disrespectful mistrust, and the idea that the use of PBWCs violates a right to privacy. The article argues that neither of these objections is persuasive, and concludes that we should conditionally accept and support the use of PBWCs. (shrink)

We outline the drivers, main features, and conceptual underpinnings of the compliance paradigm. We then use a similar structure to investigate the drivers, main features, and conceptual underpinnings of the cooperative paradigm for working with CSR in global value chains. We argue that the measures proposed in the new cooperation paradigm are unlikely to alter power relationships in global value chains and bring about sustained improvements in workers’ conditions in developing country export industries. After that, we provide a critical appraisal (...) of the potential and limits of the cooperative paradigm, we summarize our findings, and we outline avenues for research: purchasing practices and labor standard noncompliance, CSR capacity building among local suppliers, and improved CSR monitoring by local resources in the developing world. The Ouroboros Model features a biologically inspired cognitive architecture. At its core lies a self-referential recursive process with alternating phases of data acquisition and evaluation. Memory entries are organized in schemata. The activation at a time of part of a schema biases the whole structure and, in particular, missing features, thus triggering expectations. An iterative recursive monitor process termed "consumption analysis" is then checking how well such expectations fit with successive activations. Mismatches between anticipations based on previous experience and actual (...) current data are highlighted and used for controlling the allocation of attention. In case no directly fitting filler for an open slot is found, activation spreads more widely and includes data relating to the actor, and Higher-Order Personality Activation, HOPA, ensues. It is briefly outlined how the Ouroboros Model produces many diverse characteristics and thus addresses established criteria for consciousness. Coarse-grained relationships to selected previous conceptualizations of consciousness and a sketch of how the Ouroboros Model could shed light on current research themes in artificial general intelligence and consciousness conclude this paper. Maintaining systems of military plans is critical for military effectiveness, but is also challenging. Plans will become obsolete as the world diverges from the assumptions on which they rest. If too many ad hoc changes are made to intermeshed plans, the ensemble may no longer lead to well-synchronized and coordinated operations, resulting in the system of plans becoming itself incoherent. We describe in what follows an Adaptive Planning process that we are developing on behalf of the Air Force Research Laboratory (...) (Rome) with the goal of addressing problems of these sorts through cyclical collaborative plan review and maintenance. The interactions of world state, blue force status and associated plans are too complex for manual adaptive processes, and computer-aided plan review and maintenance is thus indispensable. We argue that appropriate semantic technology can 1) provide richer representation of plan-related data and semantics, 2) allow for flexible, non-disruptive, agile, scalable, and coordinated changes in plans, and 3) support more intelligent analytical querying of plan-related data. Algorithmic discrimination has rapidly become a topic of intense public and academic interest. This article explores three issues raised by algorithmic discrimination: 1) the distinction between direct and indirect discrimination, 2) the notion of disadvantageous treatment, and 3) the moral badness of discriminatory automated decision-making. It argues that some conventional distinctions between direct and indirect discrimination appear not to apply to algorithmic discrimination, that algorithmic discrimination may often be discrimination between groups, as opposed to against groups, and that it is (...) not necessarily the case that morally bad algorithmic discrimination gives us reason to not use automated decision-making. For each of the three issues, the article explores implications for algorithmic discrimination, suggests some alternative answers, and clarifies how we may want to think of discrimination more broadly in light of lessons drawn from the context of algorithmic discrimination. How much surveillance is morally permissible in the pursuit of a socially desirable goal? The proportionality question has received renewed attention during the 2020 Coronavirus pandemic, because governments in many countries have responded to the pandemic by implementing, redirecting or expanding state surveillance, most controversially in the shape of collection and use of cell-phone location data to support a strategy of contact tracing, testing and containment. Behind the proportionality question lies a further question: in what way does a state of (...) emergency affect the proportionality of morally permissible surveillance? On the qualitative difference view, a state of emergency has the effect of suspending or altering at least some of the constraints on morally permissible action that apply under ordinary circumstances. On the quantitative difference view, the only difference between states of emergency and ordinary circumstances is that the stakes are greater in a state of emergency. If the qualitative difference view is true, then there are situations, perhaps such as the current Coronavirus pandemic, during which the proportionality condition employs a much less demanding ratio between social goods achieved and the badness of the surveillance performed. The overall objective of this article is to argue against the qualitative and for the quantitative difference view. I proceed by first setting out in somewhat greater detail how we must understand the qualitative difference view (section two). I then present a series of problematic implications of adopting the qualitative difference view and argue that jointly these give us sufficient reason to reject it (section three). This entails that our account of morally permissible surveillance should be unexceptional, i.e. the quantitative difference view: there is no morally significant difference between proportionality in ordinary circumstances and proportionality in emergencies, simply a spectrum of smaller to greater potential goods and bads of surveillance. In order to flesh out the implications of the quantitative view, I briefly sketch an unexceptional theory of proportional surveillance in exceptional circumstances (section four). In public communication contexts, such as when a company announces the proposal for an important organizational change, argumentation typically involves multiple audiences, rather than a single and homogenous group, let alone an individual interlocutor. In such cases, an exhaustive and precise characterization of the audience structure is crucial both for the arguer, who needs to design an effective argumentative strategy, and for the external analyst, who aims at reconstructing such a strategic discourse. While the peculiar relevance of multiple audience is (...) often emphasized in the argumentation literature and in rhetorical studies, proposals for modelling multi-audience argumentative situations remain scarce and unsystematic. To address this gap, we propose an analytical framework which integrates three conceptual constructs: Rigotti and Rocci’s notion of communicative activity type, understood as the implementation of an interaction scheme into a piece of institutional reality, named interaction field; the stakeholder concept, originally developed in strategic management and public relations studies to refer to any actor who affects and/or is affected by the organizational actions and who, accordingly, carries an interest in them; the concept of participant role as it emerges from Goffman’s theory of conversation analysis and related linguistic and media studies. From this integration, we derive the notion of text stakeholder for referring to any organizational actor whose interest becomes an argumentative issue which the organizational text must account for in order to effectively achieve its communicative aim. The text stakeholder notion enables a more comprehensive reconstruction and characterization of multiple audience by eliciting the relevant participants staged in a text and identifying, for each of them, the interactional role they have, the peculiar interest they bear and the related argumentative issue they create. Considering as an illustrative case the defense document issued by a corporation against a hostile takeover attempt made by another corporation, we show how this framework can support the analysis of strategic maneuvering by better defining the audience demand and, so, better explaining how real arguers design and adapt their topical and presentational choices. O marxismo aparece insistentemente na teologia e no magistério de Joseph Ratzinger-Bento XVI como um inimigo permanente ao qual o cristianismo deve se contrapor, sem possibilidades de conciliação entre ambos. Mas qual concepção subjaz essa rejeição tão peremptória, tão decidida? Para alcançarmos a resposta a tal questão, aprofundamos a visão de Joseph Ratzinger a partir de alguns de seus escritos teológicos (anteriores ao pontificado) e, em seguida, nas suas três encíclicas, o ponto alto de seu magistério papal ( Deus caritas (...) est, Spe salvi e Caritas in veritate ). Defendemos que a crítica de Bento XVI, antes de ser exclusivamente teológica (ou doutrinária), é filosófica, baseada na racionalidade e não na fé professada pela Igreja, que lhe permite tratar o marxismo não simplesmente como um programa político que vai contra alguns valores cristãos, mas como uma escatologia judaico-cristã secularizada, um messianismo político, portanto, como uma religião , como uma fé , que nega e esvazia o núcleo essencial da fé cristã. Escatologia política.: Marxism appears repeatedly in Pope Benedict’s theology and teaching as a permanent enemy that Christianity must oppose without any possibilities of conciliation between them. However, what underlies this decisive rejection? To answer this question we look further into Joseph Ratzinger’s perspective starting with some of his theological writings (before the pontificate) followed by three of his encyclicals, the high point of his papal teaching ( Deus caritas est , Spe salvi e Caritas in veritate ). We argue that Benedict XVI's criticism, prior to being purely theological (or doctrinal), is philosophical, based on rationality and not in the faith professed by the Church, allowing him to treat marxism not simply as a political program that goes against some Christian values, but as a secularized Judeo-Christian eschatology, as a political messianism, therefore, as a religion, as a faith , that denies and empties the essential core of the Christian faith. Stress-induced brain-mediated immunoregulation is effected by two pathways: autonomic outflow and (neuro)endocrine outflow. Particular attention is given to the interaction-effects of chronic an acute stress. Recent data have established that cells of the immune system produce neuro-peptides and hormones. In concert with cytokines released by these immune cells the brain can be informed on the nature of ongoing immune activity. The significance of conditioning of immune responses is discussed.

The article explores similarities between the philosophies of Zhuangzi and Aristippus, focusing in particular on play and eudaimonism. The main thesis is that both authors encourage the cultivation of a playful mindset, defined in the paper as the “ludic self”, which operates as a strategy for leading a flourishing life. By shaping a fluid, unstructured identity, the ludic self promotes negative subtraction from the structuring power of social nexus and proactive adaptation to shifting circumstances. Furthermore, some aspects of these philosophies (...) present an inter-disciplinary convergence with scientific findings from the psycho-biology of play, concerned with the mobilization of cathected energies and the prevention, or resolution, of addictive states. These promising connections with the fields of psychology and biology also represent an original contribution in respect to the existing debates within Zhuangzi studies, and scholarship on the Cyrenaics. From a methodological point of view, the article pursues what Rorty defines as a “rational reconstruction”, which involves a re-interpretation of past philosophies in light of present debates, ideas and vocabularies with the aim of engaging a trans-cultural, trans-historical dialogue. The value of this operation relies upon the universality of human experience, which always allows re-interpretation and re-actualization of past philosophies as a dialogical exercise of questioning otherness within a hermeneutic framework. This paper makes a contribution to ongoing debates about whether and how we can empirically assess the potential, limitations, and actual impacts of public-private partnerships in developing countries. Several United Nations and bilateral aid agencies have called for the development of impact assessment methodologies that can help clarify when, how, where, and for whom partnerships work. This paper scrutinizes some of the key assumptions underlying this debate, arguing that no objective ' truth' about the effects of PPPs can be discovered (...) through the use of such methodologies. The paper then investigates what can actually be known about a PPP's effects by testing a PPP IA framework that is recommended by the Organization for Economic Cooperation and Development. This is done using a case study from Pakistan. The paper shows that IA methodology may provide an indication of how well a PPP has fared, but not why the PPP has turned out the way it has. At the same time, win-win and win-lose outcomes may exist simultaneously, even for the same stakeholder in the PPP. While the importance of ensuring proper design, monitoring, and IA of PPPs cannot be denied, their effects must be seen as an outcome of struggles between a variety of actors over the distribution of social and environmental hazards associated with broader processes of economic development and industrialization. This article provides a review of what we know, what we do not know, and what we need to know about the relationship between industrial clusters and corporate social responsibility in developing countries. In addition to the drivers of and barriers to the adoption of CSR initiatives, this study highlights key lessons learned from empirical studies of CSR initiatives that aimed to improve environmental management and work conditions and reduce poverty in local industrial districts. Academic work in this area remains (...) embryonic, lacking in empirical evidence about the effects of CSR interventions on the profitability on local enterprises, workers, and the environment. Nor do theoretical frameworks offer clear explanations of the institutionalization and effects of CSR in local industrial districts in the developing world. Other key limitations in this research stream include an excessive focus on export-oriented industrial clusters, the risk that CSR becomes a form of economic and cultural imperialism, and the potential for joint-action CSR initiatives in clusters of small and medium-sized enterprises to offer a new form of greenwashing. From this review, the authors develop a theoretical model to explain why CSR has not become institutionalized in many developing country clusters, which in turn suggests that the vast majority of industrial clusters in developing countries are likely to engage in socially irresponsible behavior. This article discusses the roots of the Islam–Christianity conflict in the mid-1990s in Indonesia. The analysis showed that this conflict was motivated by various factors such as a feeling of dissatisfaction among Muslims, the problem of christianization that was happening not only in the community but also entered the bureaucracy and military, the emergence of various government policies and MUI fatwas, which added fuel to the already strained relations between the two religions and finally the economic disparity in which Christians (...) were seen as people who were rich and enjoyed the fruits of the development. The healing power of just forgiveness, without excusing injustice. Justice is closely related to forgiveness and the extent of the injustice gap experienced depends on how much or how little personal justice a wounded person desires. The experience of forgiveness includes two diverse forms of forgiveness: decisional and emotional forgiveness. Decisional forgiveness is controlling humans’ behavioural intentions, while emotional forgiveness replaces negative, unforgiving emotions with positive, other-orientated emotions. A victim may make a decision to forgive, but never feels emotional peace (...) about the decision to forgive. Both decisional and emotional forgiveness are experienced internally within a wounded person and depends on the social context of the transgression and the response to it. Justice can narrow the injustice gap, but rarely closes it, while forgiveness can heal the pain within the injustice gap. The sense of desired justice is to some degree justifiable, but by granting decisional forgiveness and experiencing emotional forgiveness a wounded person can slow down if not stop ruminating vengeful thoughts. Christians can forgive transgression and wrongdoing because they are responding in gratitude to God’s mercy, loving-kindness and forgiveness through Jesus’ death on the cross. God guides Christian believers through the example of Jesus’s humility to forgive wrongdoing and ultimately grow spiritually when Jesus requires decisional forgiveness and desires emotional forgiveness between victim and offender. Forgiveness is based on God’s forgiveness, while humans tend to both forgive and also pursue justice without excusing injustice. Humans are in their own power incapable of justly forgiving transgression, but God can guide people through the Holy Spirit to just forgiveness. (shrink)

L’enjeu de cet article est d’explorer l’histoire longue de l’Anthropocène pour identifier des perspectives de libération dans le présent. Discutant les hypothèses d’Engels sur la naissance de la propriété et du patriarcat, de James Scott sur l’invention conjointe de l’agriculture et des États, ou de Marijas Gimbutas sur les civilisations matrifocales de l’Europe archaïque, Veronika Bennholdt-Thomsen montre que la racine des crises socio-écologiques en cours doit être cherchée du côté de la domestication des femmes, c’est-à-dire de l’appropriation de leur (...) corps et de leurs savoirs en matière de subsistance et de reproduction. Mais elle montre aussi que cette domestication n’est jamais achevée et qu’elle tend même à perdre du terrain face au renouvellement contemporain de l’agriculture paysanne de subsistance, au sein de laquelle les femmes occupent le premier plan. C’est donc dans l’expérience et les pratiques des paysannes que réside la possibilité d’un monde meilleur. (shrink)

The article explores one prominent account of what makes discrimination morally bad (when it is) – the disrespect-based account. The article first reviews and clarifies the account, arguing that it is most charitably understood as the claim that discrimination is morally bad when the discriminator gives lower weight to reasons grounded in the moral status of the discriminatee(s) in her decision-making. It then presents three challenges to the account, and reviews a recent argument in defense of it. The first challenge (...) is the fact that intuitions that might support the disrespect-based account can also be explained by reference to the fact that disrespect reflects poorly on the moral character of the discriminator. The second challenge is that there are cases where disrespectful discrimination is not intuitively worse than non-disrespectful discrimination. The third challenge is that the disrespect-based account has difficulties explaining our intuitions about cases of “doing right for the wrong reasons”. Finally, pace a recent argument in its defense, cases of harmless and apparently morally bad discrimination are plausibly best explained by other factors than disrespect. In the light of this analysis, the article concludes that the disrespect-based account should be abandoned. (shrink)

The interactive nature of the Internet is seen by some as a technological innovation that might boost participation in politics and civic affairs. That potential, however, is clouded by imprecise definitions of interactivity found among scholars and practitioners alike. Evaluation of state legislature Web sites found them to not be very interactive under most definitions of the term. Chief technology officers of the legislatures appear to differ as to which site features promote interactivity. The pedagogy of Chan Buddhism relies on a binary trend: on the one hand, it requires careful study and active participation in formalized rituals and ceremonies; on the other hand, it requires the simultaneous emancipation from such means and practices, since the transmission of the truth has the character of suddenness and immediacy. In other words, the subversion of standard doctrinal interpretations and ordinary pedagogical strategies is itself an essential part of Chan training. This chapter analyzes the fourth Case of (...) the Blue Cliff Record, which exemplifies in a bright fashion the self-negating dialectics of Chan pedagogy. First, the analysis focuses on the narrated event; second, it moves at the level of meta-narrative, focusing on glosses and commentary. The purpose is to show that the subversive hermeneutics of Chan take place at both levels, narrative and meta-narrative, demanding (and favoring) a proactive and critical progression toward understanding. The present study consists of a cross-cultural analysis of the role of irony in the Blue Cliff Record. The analysis is structured in four chapters, one devoted to methodological concerns and three to equivalent types and functions of irony within the text, a pivotal literary work of the Chan Buddhist tradition. In relation to Chan studies, a discussion of irony is particularly important since the wide corpus of Chan literature includes a significant number and a consistent variety of ironic features (...) such as puns, wordplay, extravagant acts, and so forth. The idea of the present paper is that the ironic temperament of Chan is not a contingent circumstance, but a functional strategy purposely employed in textual compositions and oral communication with soteriological purposes. Although affective facial pictures are widely used in emotion research, standardised affective stimuli sets are rather scarce, and the existing sets have several limitations. We therefore conducted a validation study of 490 pictures of human facial expressions from the Karolinska Directed Emotional Faces database (KDEF). Pictures were evaluated on emotional content and were rated on an intensity and arousal scale. Results indicate that the database contains a valid set of affective facial pictures. This article proposes a more culturalist and variegated conception of the individual than that presented by individualization theorists. Inspired by the approach of the individual advocated by Émile Durkheim, Talcott Parsons and John Meyers, it first outlines the general script of the individual-as-actor that informs modern individualism as well as the generic characteristics that are routinely attributed to persons such as agency and free will. It subsequently reconstructs three predominant interpretations of this general script, i.e. utilitarian, moral and expressive individualism. (...) For each variant, the intellectual genesis and overall definition of the institutionalization in specific societal domains and the dominant articulations in social theory are briefly presented. With this threefold distinction, the aim is to synthesize the extensive literature on individualism and to show the sociological strengths of approaching subjectivity in terms of institutionalized scripts. The invocation and necessity of a forgiveness process have become complicated and multifaceted within the South African society with its realities of crime, poverty, racism, injustice and abuse. The rhythms of forgiveness compel us to identify our present situation. Individuals, as well as larger social groups, should begin to reflect on the importance of forgiveness to deal with transgression, violence, revenge and bitterness. I suggest that forgiveness within the Christian doctrine needs to be situated and embodied in specific habits and (...) practices of Christian life within the South African society. In response, people in South Africa are called to remember past transgressions while pursuing the repairing and healing of the brokenness and separations in relationships by embodying forgiveness. It directs the importance of the Church’s prophetic task to proclaim the boundless gift of a constructive and transformative relationship with God, one another and God’s creation. Practising forgiveness includes a process of seeking to embody Christian forgiveness that involves the transformation of people’s lives, their world and their capability to restore communion within the field of social relations.
