In this brief work, which is the English version of Die Permanenz Der Kunst, translated and revised by Marcuse and Erica Sherover, Marcuse offers a critique of and a contribution to Marxist aesthetic thought. In contrast to Marxist orthodoxy which explains works of art as the products of social class consciousness, and which thus reduces their truth and quality to "the totality of the prevailing relations of production", Marcuse claims that the political potential of art lies not in its explicitly (...) revolutionary content, nor in its societal context, but precisely "in art itself, in the aesthetic form as such". Marcuse draws his examples of authentic art from eighteenth and nineteenth-century literature, while he explicates and defends the claim that the revolutionary character of art lies in its "transhistorical substance," a substance constituted by its "aesthetic form," which he tentatively defines as "the result of the transformation of a given content into a self-contained whole: a poem, play, novel, etc.". Although Marcuse proffers his criticisms of advanced capitalist and state socialist ideologies to his readers throughout the text, the main thrust of his criticism is directed to Marxist treatments of art which devalue "nonmaterial forces, particularly of the individual consciousness and subconscious and their political function" ; these "nonmaterial forces" for Marcuse are Eros and Thanatos, whose tension is doubly mediated by aesthetic form: first in the sublimation or stylization of content performed by the artist, and second in the de-sublimation which occurs in the audience's perception of these works of art. In these processes of sublimation and de-sublimation, the play of the "metasocial forces" of Eros and Thanatos is exhibited "between individual and individual, male and female, humanity and nature". According to Marcuse it is through such exhibition of forces that individuals "reclaim their subjectivity, their inwardness" and consequently transcend their social determination, although for Marcuse this reclamation cannot be directly translated into political praxis. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. And by knowing this, we can start to address questions concerning human emancipation and how the world is to be transformed. (shrink)

Although tolerance is widely regarded as a virtue of both individuals and groups that modern democratic and multiculturalist societies cannot do without, there is still much disagreement among political thinkers as to what tolerance demands, or what can be done to create and sustain a culture of tolerance. The philosophical literature on toleration contains three main strands. (1) An agreement that a tolerant society is more than a modus vivendi; (2) discussion of the proper object(s) of toleration; (3) debate about (...) whether there is a ‘paradox’ of toleration and, if so, how it might be solved. Thirty years ago, Duncan Forbes published a short review, which, amongst other things, challenged the view that towards the end of his life David Hume turned Tory. Forbes's subsequent study of Hume's politics showed that, when strictly applied, ‘Tory’ and ‘Whig’ failed to capture the philosophical import of Hume's writings about politics and even of his semi-detached involvement with the politics of his time. If one took Hume at his own word, “sceptical whiggism”—a kind of moderate and scientific-minded appreciation of (...) the relative superiority of modern commercial polities, and, in Britain, of the Hanoverian régime—was a more appropriate description of what Hume's political writings were about. It also avoided the invidious problem of whether Hume should be regarded as a liberal or a conservative. (shrink)

Hume's position in the history of philosophical scepticism can hardly be questioned. But the nature of his own philosophical scepticism is a matter of contention in both the historical and philosophical literatures. In this essay, I argue that a philosophical reconstruction of Hume's scepticism needs to pay attention to the way in which Hume and his contemporaries understood the place of sceptical thinking in the history of modern philosophy. When looked at in this context, Hume's philosophy of knowledge and the (...) understanding is self-evidently sceptical. It is so, because it develops both a critical and a positive view of what a sceptical attitude implies. From a critical perspective, Hume aims to show that human reason is incapable of being its own foundation. From a more positive perspective, Hume sketches a phenomenology of the understanding by developing a probabilistic and self-referential view of philosophical knowledge, one which is not different from common knowledge and which relies on the workings of human nature and the imagination to make sense of the world and of our actions. Ferrajoli’s work offers a reflection on law and the constitutional democratic state from a post-positivist perspective, applying the axiomatic method to the theory of law and democracy. Besides his systematic approach, Ferrajoli’s theory is remarkable for a number of original and interesting reflections that he offers on the relationship between normativity and facticity, and on how to reconcile foundamental rights and democracy. For at least two centuries, democratic representation has been at the center of debate. Should elected representatives express the views of the majority, or do they have the discretion to interpret their constituents' interests? How can representatives balance the desires of their parties and their electors? What should be done to strengthen the representation of groups that have been excluded from the political system? Representative democracy itself remains frequently contested, regarded as incapable of reflecting the will of the masses, or (...) inadequate for today's global governance. Recently, however, this view of democratic representation has been under attack for its failure to capture the performative and constructive elements of the process of representation, and a new literature more attentive to these aspects of the relationship between representatives and the represented has arisen. In Creating Political Presence, a diverse and international group of scholars explores the implications of such a turn. Two broad, overlapping perspectives emerge. In the first section, the contributions investigate how political representation relates to empowerment, either facilitating or interfering with the capacity of citizens to develop autonomous judgment in collective decision making. Contributions in the second section look at representation from the perspective of inclusion, focusing on how representative relationships and claims articulate the demands of those who are excluded or have no voice. The final section examines political representation from a more systemic perspective, exploring its broader environmental conditions and the way it acquires democratic legitimacy. (shrink)

Available from UMI in association with The British Library. ;This study of David Hume suggests that the unity of his thought is to be found more in an attitude of mind than in a precise body of epistemological statements. His 'mitigated scepticism' was the original combination of an experimental approach with a searching mind and a rather disenchanted attitude towards the attainment of perfection in knowledge and in the practical world. But my thesis addresses these questions only implicitly. The general (...) picture of the Humean approach to things political and philosophical is depicted against the background of a close examination of two other themes: Hume's development towards a more 'popular' philosophy and the philosophical import of his moral and political theory. The first subject is studied through an analysis of the formal qualities of Hume's philosophical writings; the second, through a discussion of Hume's position on the origin of justice and government and one's obligation to them. The conclusion that my thesis tentatively advances is that both in metaphysics and politics Hume's approach is based upon the attainment of a state of equilibrium between theoretical and practical considerations, and between sceptical and naturalistic tendencies. Hume's desire for balance can only be understood within the intellectual context of eighteenth century thought. This is the reason for the considerable attention that the thesis devotes to the reconstruction of the historical setting within which Hume's thought developed. However, when correctly interpreted, Hume's ideas clearly have a contribution to make to an understanding of a world which is very different from his own. (shrink)

This article discusses the normative implications of the European integration process by addressing the question of the legitimacy deficit in the EU and its member states. It starts from an analysis of legitimacy as implying a distinction between `polity' and `regime', each of which has an `internal' and an `external' dimension relating respectively to the subjective perceptions of citizens and to more objective- and universalist-oriented criteria. Standard accounts of the integration process and the constitutionalisation of the EU have overlooked the (...) complex ways in which polity- and regime-building interact. They have also emphasized the external legitimacy of the EU while neglecting the internal dimension. Both descriptively and prescriptively, the EU lies in between the interpretations offered by neofunctionalist or intergovernmental realists and federal idealists. The `internal' norms channelled through the EU's `regime' have helped form the economic interests appealed to by the former, but in rather different ways to that assumed by the latter. The result has been a polycentric `polity' with a multi-level `regime'. Consequently, we reject having either an EU written constitution that goes beyond the treaties or a federal legislature, advocating instead the `republican' model of a `mixed commonwealth'. (shrink)

Abstract:This paper is a preliminary attempt to better understand the concept of legitimacy in stakeholder theory. The normative component of stakeholder theory plays a central role in the concept of legitimacy. Though the elaboration of legitimacy contained herein applies generally to all “normative cores” this paper relies on Phillips’s principle of stakeholder fairness and therefore begins with a brief description of this work. This is followed by a discussion of the importance of legitimacy to stakeholder theory as well as the (...) general ambiguity of the term. A distinction is then drawn between normative and derivative legitimacy. Reference to this distinction helps distinguish between a relationship with the organization based on direct moral obligation and one based on the power to help or harm the organization. It is concluded that stakeholders who retain the ability to affect the organization arelegitimate(derivatively), but that this legitimacy is derived from the moral obligation owed other (normative) stakeholders and that the two sorts of legitimacy are importantly different from one another. An example of the normative/derivative distinction at work in managerial decision making is elaborated upon and managerial and research implications are then suggested. (shrink)

Abstract:Should the responsibilities of business managers be understood independently of the social circumstances and “market forces” that surround them, or (in accord with empiricism and the social sciences) are agents and their choices shaped by their circumstances, free only insofar as they act in accordance with antecedently established dispositions, their “character”? Virtue ethics, of which I consider myself a proponent, shares with empiricism this emphasis on character as well as an affinity with the social sciences. But recent criticisms of both (...) empiricist and virtue ethical accounts of character deny even this apparent compromise between agency and environment. Here is an account of character that emphasizes dynamic interaction both in the formation and in the interplay between personal agency and responsibility on the one hand and social pressures and the environment on the other. In “The Sources of Knowledge,” Robert Audi distinguishes what he calls the “four standard basic sources” by which we acquire knowledge or justified belief: perception, memory, consciousness, and reason. With the exception of memory, he distinguishes each of the above as a basic source of knowledge. Audi contrasts basic sources with nonbasic sources, concentrating on testimony. After clarifying the relationship between a source and a ground, or “what it is in virtue of which one knows or justifiedly believes,” Audi (...) evaluates the basic sources’ individual and collective autonomy as well as their vulnerability to defeasibility. In eukaryotes, small amounts of nitrite confer cytoprotection against ischemia/reperfusion‐related tissue damage in vivo, possibly via reduction to nitric oxide (NO) and inhibition of mitochondrial function. Several hemeproteins are involved in this protective mechanism, starting with deoxyhemoglobin, which is capable of reducing nitrite. In facultative aerobic bacteria, such as Pseudomonas aeruginosa, nitrite is reduced to NO by specialized heme‐containing enzymes called cd1 nitrite reductases. The details of their catalytic mechanism are summarized below, together with a hypothesis on the biological role (...) of the unusual d1‐heme, which, in the reduced state, shows unique properties (very high affinity for nitrite and exceptionally fast dissociation of NO). Our results support the idea that the nitrite‐based reactions of contemporary eukaryotes are a vestige of earlier bacterial biochemical pathways. The evidence that nitrite reductase activities of enzymes with different cellular roles and biochemical features still exist today highlights the importance of nitrite in cellular homeostasis.
