The relatively new practice of continuous sedation at the end of life (CS) is increasingly being debated in the clinical and ethical literature. This practice received much attention when a U.S. Supreme Court ruling noted that the availability of CS made legalization of physician-assisted suicide (PAS) unnecessary, as CS could alleviate even the most severe suffering. This view has been widely adopted. In this article, we perform an in-depth analysis of four versions of this ?argument of preferable alternative.? Our goal (...) is to determine the extent to which CS can be considered to be an alternative to PAS and to identify the grounds, if any, on which CS may be ethically preferable to PAS. (shrink)

Research integrity is a continuously developing concept, and increasing emphasis is put on creating RI promotion practices. This study aimed to map the existing RI guidance documents at research performing organisations and research funding organisations. A search of bibliographic databases and grey literature sources was performed, and retrieved documents were screened for eligibility. The search of bibliographical databases and reference lists of selected articles identified a total of 92 documents while the search of grey literature sources identified 118 documents for (...) analysis. The retrieved documents were analysed based on their geographical origin, research field and organisational origin of RI practices, types of guidance presented in them, and target groups to which RI practices are directed. Most of the identified practices were developed for research in general, and are applicable to all research fields and medical sciences. They were mostly written in the form of guidelines and targeted researchers. A comprehensive search of the existing RI promotion practices showed that initiatives mostly come from RPOs while only a few RI practices originate from RFOs. This study showed that more RI guidance documents are needed for natural sciences, social sciences, and humanities since only a small number of documents was developed specifically for these research fields. The explored documents and the gaps in knowledge identified in this study can be used for further development of RI promotion practices in RPOs and RFOs. (shrink)

I explore, from a proof-theoretic perspective, the hierarchy of classical and paraconsistent logics introduced by Barrio, Pailos and Szmuc in (Journal o f Philosophical Logic,49, 93-120, 2021). First, I provide sequent rules and axioms for all the logics in the hierarchy, for all inferential levels, and establish soundness and completeness results. Second, I show how to extend those systems with a corresponding hierarchy of validity predicates, each one of which is meant to capture “validity” at a different inferential level. Then, (...) I point out two potential philosophical implications of these results. (i) Since the logics in the hierarchy differ from one another on the rules, I argue that each such logic maintains its own distinct identity (contrary to arguments like the one given by Dicher and Paoli in 2019). (ii) Each validity predicate need not capture “validity” at more than one metainferential level. Hence, there are reasons to deny the thesis (put forward in Barrio, E., Rosenblatt, L. & Tajer, D. (Synthese, 2016)) that the validity predicate introduced in by Beall and Murzi in (Journal o f Philosophy,110(3), 143–165, 2013) has to express facts not only about what follows from what, but also about the metarules, etc. (shrink)

Recently there has been some discussion concerning a particular type of enhancement, namely ‘moral enhancement’. However, there is no consensus on what precisely constitutes moral enhancement, and as a result the concept is used and defined in a wide variety of ways. In this article, we develop a clarificatory taxonomy of these definitions and we identify the criteria that are used to delineate the concept. We think that the current definitions can be distinguished from each other by the criteria used (...) for determining whether an intervention is indeed moral enhancement. For example, some definitions are broad and include moral enhancement by any means, while other definitions focus only on moral enhancement by means of specific types of intervention. Moreover, for some definitions it suffices for an intervention to be aimed or intended to morally enhance a person, while other definitions only refer to ‘moral enhancement’ in relation to interventions that are actually effective. For all these differences in definitions we discuss some of their implications. This shows that definitions are significantly less descriptive and more normative than they are regularly portrayed to be. We therefore hope that the taxonomy developed in this paper and the comments on the implications for the normative debate of the variety of definitions will provide conceptual clarity in a complex and highly interesting debate. In this paper, we compare the two Global Reporting Initiative reporting standards, G3.1, and the most current version G4.0. We do this through the lens of political corporate social responsibility theory, which describes the broadened understanding of corporate responsibility in a globalized world building on Habermas’ notion of deliberative democracy and ethical discourse. As the regulatory power of nation states is fading, regulatory gaps occur as side effects of transnational business. As a result, corporations are also understood to play a (...) “political role” to fill regulatory gaps and contribute to a global governance system by voluntarily engaging in self-regulation. Such corporate political action, however, is not always legitimate as it suffers from a democratic deficit. Consistent with scholars in the field of political CSR, this paper argues that only by means of communication and discourse can this drawback be avoided. That is why CSR reporting and guidelines for standardizing the disclosed CSR information is key for political CSR. By comparing the GRI standards from a political CSR perspective, one can see whether these often-used reporting guidelines fulfill the communicative requirements and whether they are adequate tools to face the challenges of the twenty-first century. We present results from a theory-derived and criteria-driven comparison of the two guidelines. Indication of the effectiveness of voluntary self-regulation is, for example, important considering the 2014 directive of the European Union to make CSR reporting mandatory. We offer a guideline-based view on current CSR theory as well as CSR reporting practice. We discuss implications for CSR theory, particularly the appropriateness of deliberation in the Habermasian sense, which is the basis of political CSR theory. We do so by introducing the notion of “uncommitted deliberation” with regard to the refined concept of materiality in GRI 4.0, which induces subjectivity and reduces data-driven comparability. Finally, we address the limitations of this research as well as research questions for future studies. (shrink)

Substructural solutions to the semantic paradoxes have been broadly discussed in recent years. In particular, according to the non-transitive solution, we have to give up the metarule of Cut, whose role is to guarantee that the consequence relation is transitive. This concession—giving up a meta rule—allows us to maintain the entire consequence relation of classical logic. The non-transitive solution has been generalized in recent works into a hierarchy of logics where classicality is maintained at more and more metainferential levels. All (...) the logics in this hierarchy can accommodate a truth predicate, including the logic at the top of the hierarchy—known as CMω—which presumably maintains classicality at all levels. CMω has so far been accounted for exclusively in model-theoretic terms. Therefore, there remains an open question: how do we account for this logic in proof-theoretic terms? Can there be found a proof system that admits each and every classical principle—at all inferential levels—but nevertheless blocks the derivation of the liar? In the present paper, I solve this problem by providing such a proof system and establishing soundness and completeness results. Yet, I also argue that the outcome is philosophically unsatisfactory. In fact, I’m afraid that in light of my results this metainferential solution to the paradoxes can hardly be called a “solution,” let alone a good one. (shrink)

In 2002 with the passing of the Euthanasia Law, Belgium became one of the few countries worldwide to legalize euthanasia. In the 18 years since the passing of the law, much has changed. We argue that in Belgium a widening of the use of euthanasia is occurring and that this can be ethically and legally problematic. This is in part related to the fact that several legal requirements intended to operate as safeguards and procedural guarantees in reality often fail to (...) operate as such. We focus on three kinds of safeguards or procedural guarantees: the legally defined due care criteria for eligibility for euthanasia; the consultation of a second physician; and the reporting of euthanasia cases to the Federal Control and Evaluation Commission for Euthanasia. We will show how each of these three safeguards can exhibit shortcomings in theory and practice. (shrink)

I introduce a novel and quite intuitive interpretation of the ternary relation that figures in the relational semantics of many relevance logics. Conceptually, my interpretation makes use only of incompatibility and parthood relations, defined over a set of states. In this way, the proposed interpretation—of the ternary relation and the conditional—extends Dunn’s and Restall’s works on negation and the Routley star operator. Therefore, the interpretation is unified, and hence not only intuitive but also parsimonious. Additionally, the interpretation provides us with (...) a cogent argument to the effect that a ternary relation is indispensable, and we cannot merely do with a binary relation. (shrink)

The use of models to assign truth values to sentences and to counterexemplify invalid inferences is a basic feature of model theory. Yet sentences and inferences are not the only phenomena that model theory has to take care of. In particular, the development of sequent calculi raises the question of how metainferences are to be accounted for from a model-theoretic perspective. Unfortunately there is no agreement on this matter. Rather, one can find in the literature two competing model-theoretic notions of (...) metainferential validity, known as the ‘global’ notion and the ‘local’ notion. In this article, I argue that, given certain plausible considerations about metainferential validity, the global notion collapses into the local notion. (shrink)

Several authors maintain that we are capable of having inconsistent intentional states, either in cases of illusion, in certain cases of imagination, or because the observable world is (partly) inconsistent and we perceive it as such. These views are all premised on the assumption that inconsistent intentional states—even if acknowledged—are peculiar and have nothing essential to do with our perceptual capacities. In the present article, I would like to present, and argue for, a much stronger thesis: that inconsistent intentional states (...) underlie the possibility of having intentional content in mind. I argue for this thesis based on a Husserlian phenomenological analysis of our grasp of objects, which I formulate in terms of incompatibility semantics. (shrink)

When a new intervention or drug is developed, this has to pass through various phases of clinical testing before it achieves market approval, which can take many years. This raises an issue for drugs which could benefit terminally ill patients. These patients might set their hopes on the experimental drug but are unable to wait since they are likely to pass away before the drug is available. As a means of nevertheless getting access to experimental drug, many seriously ill and (...) terminally ill patients are therefore very willing to participate in randomised controlled trials. However, only very few terminally ill patients are able to actually participate, and those that do participate are at risk of participating solely as a way of getting experimental drugs. Currently, there are, however, ways of getting access to drugs that have not gained market approval. One such mean is via expanded access or compassionate use programs where terminally ill patients receive experimental new drugs that are not yet market approved. In this paper, I examine some of the common justifications for such programs. The most frequently voiced justifications for compassionate use or expanded access programs could be put in one of three categories. First, there are justifications of justice, where compassionate use programs could be seen as a just or fair way to distribute experimental new drugs to patients who are denied access to RCT’s through no fault of their own. Second, such programs could be justified by reference to the ethical principle of beneficence where it could be claimed that terminally ill patients stand to benefit greatly at very little risk. Third, there are considerations of autonomy where, it is claimed, patients should be able to exercise their autonomy and have access to such drugs if that is there free choice and they are fully aware of the risks associated with that choice. In this paper, I argue currently all justifications are potentially problematic. If they truly form the basis for justification, compassionate use programs should be designed to maximize justice, beneficence and autonomy. (shrink)

Surveys in different countries (e.g. the UK, Belgium and The Netherlands) show a marked recent increase in the incidence of continuous deep sedation at the end of life (CDS). Several hypotheses can be formulated to explain the increasing performance of this practice. In this paper we focus on what we call the ‘natural death’ hypothesis, i.e. the hypothesis that acceptance of CDS has spread rapidly because death after CDS can be perceived as a ‘natural’ death by medical practitioners, patients' relatives (...) and patients.We attempt to show that the label ‘natural’ cannot be unproblematically applied to the nature of this end-of-life practice. We argue that the labeling of death following CDS as ‘natural’ death is related to a complex set of mechanisms which facilitate the use of this practice. However, our criticism does not preclude the view that CDS may be clinically and ethically justified in many cases. (shrink)

Continuous deep sedation at the end of life is a practice that has been the topic of considerable ethical debate, for example surrounding its perceived similarity or dissimilarity with physician-assisted dying. The practice is generally considered to be legal as a form of symptom control, although this is mostly only assumed. France has passed an amendment to the Public Health Act that would grant certain terminally ill patients an explicit right to continuous deep sedation until they pass away. Such a (...) framework would be unique in the world. In this paper we will highlight and reflect on four relevant aspects and shortcomings of the proposed bill. First, that the bill suggests that continuous deeps sedation should be considered as a sui generis practice. Second, that it requires that sedation should always be accompanied by the withholding of all artificial nutrition and hydration. In the most recently amended version of the legal proposal it is stated that life sustaining treatments are withheld unless the patient objects. Third, that the French bill would not require that the suffering for which continuous deep sedation is initiated is unbearable. Fourth, the question as to whether the proposal should be considered as a way to avoid having to decriminalise euthanasia and/or PAS or, on the contrary, as a veiled way to decriminalise these practices. The French proposal to amend the Public Health Act to include a right to continuous deep sedation for some patients is a unique opportunity to clarify the legality of continuous deep sedation as an end-of-life practice. Moreover, it would recognize that the practice of continuous deep sedation raises ethical and legal issues that are different from those raised by symptom control on the one hand and assisted dying on the other hand. Nevertheless, there are still various issues of significant ethical concern in the French legislative proposal. (shrink)

Following considerable debate, the practice of euthanasia was legalized in Belgium in 2002, thereby making Belgium one of the few places in the world where this practice is legal. In 2014 the law was amended for the first time. The 2014 amendment makes euthanasia legally possible for all minors who repeatedly and voluntarily request euthanasia and who are judged to possess “capacity of discernment”, as well as fulfil a number of other criteria of due care. This extension of the 2002 (...) euthanasia law generated a lot of national and international debate and has been applauded by many and heavily criticized by others. This evolution is clearly of interest to end-of-life debates in the entire world. This paper will therefore describe how this amendment came to get passed using official documents from Belgium's Senate and Chamber of Representatives where this amendment was discussed and subsequently passed. Next, some of the most commonly given arguments in favour of the law are identified, as well as the arguments most often voiced against the amendment. All these arguments will be expanded upon and it will be examined whether they hold up to ethical scrutiny. Analysing the official documents and identifying the most commonly voiced arguments gives valuable insight into how Belgium came to amend its euthanasia law and why it did so in 2014. It also becomes clear that although the current amendment is often seen as far-reaching, more radical ideas were proposed during the drafting of the law. Also, in analysing those arguments in favour of the amendment and those against, it is clear that the validity of some of these is questionable. (shrink)

The organisation of health care is rapidly changing. There is a trend to move away from individual health care institutions towards transmural integrated care and interorganizational collaboration in networks. However, within such collaboration and network there is often likely to be a pluralism of values as different health care institutions often have very different values. For this paper, we examine three different models of how we believe institutions can come to collaborate in networks, and thus reap the potential benefits of (...) such collaboration, despite having different moral beliefs or values. A first way is the pragmatic way in which the different health care institutions avoid ethical reflection and focus on solutions. A second possible route is that of consensus where health care institutions base their collaboration on values that they all share. The third, and final, approach is that of compromise. Although moral compromise is often seen in a negative light, we argue that in many cases compromise might be necessary and ethically justified. In a final section, we will shift our focus from discussing various theoretical methods to allow collaboration to the potential content of consensus or compromise. (shrink)

Health care organization is entering a new age. Focus is increasingly shifting from individual health care institutions to interorganizational collaboration and health care networks. Much hope is set on such networks which have been argued to improve economic efficiency and quality of care. However, this does not automatically mean they are always ethically justified. A relevant question that remains is what ethical obligations or duties one can ascribe to these networks especially because networks involve many risks. Due to their often (...) amorphous and complex structure, collective responsibility and accountability may increase while individual responsibility goes down. We argue that a business ethics approach to ethical obligations for health care networks, is problematic and we propose to opt for a patient perspective. Using the classic four principles of biomedical ethics it is possible to identify specific ethical duties. Based on the principle of justice, health care networks have an ethical duty to provide just and fair access for all patients and to be transparent to patients about how access is regulated. The principle of nonmaleficence implies an obligation to guarantee patient safety, whereas the principle of beneficence implies an obligation for health care networks to guarantee continuity of care in all its dimensions. Finally, the principle of autonomy is translated into a specific obligation to promote and respect patient choice. Networks that fail to meet any of these conditions are suspect and cannot be justified ethically. Faced with daunting challenges, the health care system is changing rapidly. Currently many hopes ride on integrated care and broad health care networks. Such networks are the topic of empirical debate, but more attention should be given to the ethical aspects. Health care networks raise new and pressing ethical issues and we are in need of a framework for assessing how and when such networks are justified. (shrink)

Minimally inconsistent LP (MiLP) is a nonmonotonic paraconsistent logic based on Graham Priest's logic of paradox (LP). Unlike LP, MiLP purports to recover, in consistent situations, all of classical reasoning. The present paper conducts a proof-theoretic analysis of MiLP. I highlight certain properties of this logic, introduce a simple sequent system for it, and establish soundness and completeness results. In addition, I show how to use my proof system in response to a criticism of this logic put forward by JC (...) Beall. (shrink)

Continuous sedation at the end of life is the practice whereby a physician uses sedatives to reduce or take away a patient's consciousness until death. Although the incidence of CS is rising, as of yet little research has been conducted on how the administration of CS is experienced by medical practitioners. Existing research shows that many differences exist between medical practitioners regarding how and how often they perform CS. We conducted a focus group study to find out which factors may (...) facilitate or constrain the use of continuous sedation by physicians and nurses. The participants often had clear ideas on what could affect the likelihood that sedation would be used. The physicians and nurses in the focus groups testified that the use of continuous sedation was facilitated in cases where a patient has a very limited life expectancy, suffers intensely, makes an explicit request and has family members who can cope with the stress that accompanies sedation. However, this ‘paradigm case’ was considered to occur only rarely. Furthermore, deviations from the paradigm case were said to be sometimes due to physicians initiating the discussion on CS too late or not initiating it at all for fear of inducing the patient. Deviations from the paradigm case may also occur when sedation proves to be too difficult for family members who are said to sometimes pressure the medical practitioners to increase dosages and speed up the sedation. In the past quarter century C. B. MacPherson's reading of Locke has enjoyed a wide appeal. We are all by now familiar with Locke as the ardent proponent of possessive individualism, with its accompanying acquisitive tendencies and egoism. To be sure, MacPherson's interpretation has not gone unopposed. Of late it has been challenged in all its fundamentals by the scholarly and ingenious work of James Tully. Far from seeing Locke as providing the theoretical underpinnings for unbridled capitalism, Tully puts forward (...) the view that Locke was sympathetic to the possibility of radical redistributive measures. That is, that he was not in principle opposed to rights to welfare. (shrink)

Identitet učitelja inoga jezika nedovoljno je istražen koncept na području Republike Hrvatske. Stoga se u ovome radu navedeni koncept ponajprije teorijski razmatra, a potom se prikazuju rezultati istraživanja profesionalnog identiteta učitelja francuskoga jezika u RH. U istraživačkome dijelu rada razmatramo mijenjaju li učitelji francuskog jezika svoj profesionalni identitet ili ne mijenjaju, a ako mijenjaju, u kojoj je to mjeri i koji su razlozi tomu. Rezultati su pokazali kako učitelji svoj učiteljski identitet najčešće mijenjaju sudjelujući na lokalnim stručnim usavršavanjima, a najmanje (...) sudjelovanjem u organiziranim e-tečajevima. Glavnim razlogom za sudjelovanje u aktivnostima stručnoga usavršavanja pokazao se njihov unutarnji poticaj, dok su se glavnim razlogom za nesudjelovanjem pokazali financijski čimbenici. Dulje radno iskustvo, članstvo u Hrvatskoj udruzi profesora francuskoga jezika i obvezni status jezika pokazali su se faktorima koji statistički značajno pozitivno utječu na osjećaj pripadnosti zajednici učitelja francuskoga jezika u Republici Hrvatskoj. Conventionalism about logic is the view that logical principles hold in virtue of some linguistic conventions. According to explicit conventionalism, these conventions have to be stipulated explicitly. Explicit conventionalism is subject to a famous criticism by Quine, who accused it of leading to an infinite regress. In response to the criticism, several authors have suggested reconstructing conventionalism as implicit in our linguistic behaviour. In this paper, drawing on a distinction from proof theory between derivable and admissible rules, I argue that (...) implicit conventionalism has not been stated in a sufficiently precise way, as it leaves open what one needs to say about admissible yet underivable rules. Moreover, it turns out that this challenge cannot be easily met, and that any attempt to meet the challenge makes conventionalism much less attractive a thesis. (shrink)

The jargon of Japanese art criticism has always had an abundance of unique terms, categories, and concepts. This is not only true when discussing traditional Japan, since there are just as many new terms today as there were in the past. Some of the new terms have developed or evolved from old ones, while others have appeared with no seeming connection to any traditional tendency. Yet, only a few of these terms can be considered for the meta-level discussion of Aesthetics, (...) whether or not they can be linked with a certain historical linage, as they have a simple descriptive function. This article will first try to discern between aesthetic and non-aesthetic terms that are at the core of Japanese discourse today. Second, and accordingly, following the footsteps of the renowned modernist aesthetician Kuki Shūzō, this article will also try to convey a single linguistic map of the distinctive cultural Aesthetic that is in motion in Japan today. Graham Priest has formulated the minimally inconsistent logic of paradox (MiLP), which is paraconsistent like Priest’s logic of paradox (LP), while staying closer to classical logic. We present logics that stand to (the propositional fragments of) strong Kleene logic (K3) and the logic of first-degree entailment (FDE) as MiLP stands to LP. That is, our logics share the paracomplete and the paraconsistent-cum-paracomplete nature of K3 and FDE, respectively, while keeping these features to a minimum in order to stay closer to (...) classical logic. We give semantic and sequent-calculus formulations of these logics, and we highlight some reasons why these logics may be interesting in their own right. (shrink)

Continuous sedation until death is an increasingly common practice in end-of-life care. However, it raises numerous medical, ethical, emotional and legal concerns, such as the reducing or removing of consciousness, the withholding of artificial nutrition and hydration, the proportionality of the sedation to the symptoms, its adequacy in actually relieving symptoms rather than simply giving onlookers the impression that the patient is undergoing a painless 'natural' death, and the perception that it may be functionally equivalent to euthanasia. This book brings (...) together contributions from clinicians, ethicists, lawyers and social scientists, and discusses guidelines as well as clinical, emotional and legal aspects of the practice. The Christian doctrine of the Trinity poses a serious philosophical problem. On the one hand, it seems to imply that there is exactly one divine being; on the other hand, it seems to imply that there are three. There is another well-known philosophical problem that presents us with a similar sort of tension: the problem of material constitution. We argue in this paper that a relatively neglected solution to the problem of material constitution can be developed into a novel solution (...) to the problem of the Trinity. (shrink)

There is a pervasive view that inference—as opposed, notably, to a grasp of objects—is an intralinguistic process that does not draw on extralinguistic resources. The present paper aims to show that this dichotomy between inferring and grasping objects can be resisted. Specifically, I offer an alternative view: a phenomenological account according to which our most basic inferences draw on our grasp of objects. I motivate this account on the grounds that, although it is restricted to such basic inferences, it has (...) significant implications for the general question of whether inference involves taking one's premises to support one's conclusion. The proposed account implies that basic inferences need not involve corresponding “takings,” (even though such inferences involve conceptual content), but it leaves open the possibility that non-basic inferences do involve corresponding “takings,” while relying on basic inferences. It will turn out that such a disjunctive view, according to which non-basic reasoning is somewhat parasitic on basic reasoning, manages to avoid many of the problems with which the literature on the “taking condition” deals. Logical pluralists are committed to the idea of a neutral metalanguage, which serves as a framework for debates in logic. Two versions of this neutrality can be found in the literature: an agreed upon collection of inferences, and a metalanguage that is neutral as such. I discuss both versions and show that they are not immune to Quinean criticism, which builds on the notion of meaning. In particular, I show that the first version of neutrality is sub-optimal, and hard to (...) reconcile with the theories of meaning for logical constants, and the second version collapses mathematically, if rival logics, as object languages, are treated with charity in the metalanguage. I substantiate by proving a collapse theorem that generalizes familiar results. Thus, the existence of a neutral metalanguage cannot be taken for granted, and meaning-invariant logical pluralism might turn out to be dubious. (shrink)

Philosophical naturalism, according to which philosophy is continuous with the natural sciences, has dominated the Western academy for well over a century, but Michael Rea claims that it is without rational foundation. Rea argues compellingly to the surprising conclusion that naturalists are committed to rejecting realism about material objects, materialism, and perhaps realism about other minds.

An Introduction to the Philosophy of Religion provides a broad overview of the topics which are at the forefront of discussion in contemporary philosophy of religion. Continuous sedation is increasingly used as a way to relieve symptoms at the end of life. Current research indicates that some physicians, nurses, and relatives involved in this practice experience emotional and/or moral distress. This study aims to provide insight into what may influence how professional and/or family carers cope with such distress.

Some evidential arguments from evil rely on an inference of the following sort: ‘If, after thinking hard, we can't think of any God-justifying reason for permitting some horrific evil then it is likely that there is no such reason’. Sceptical theists, us included, say that this inference is not a good one and that evidential arguments from evil that depend on it are, as a result, unsound. Michael Almeida and Graham Oppy have argued (in a previous issue of this journal) (...) that Michael Bergmann's way of developing the sceptical theist response to such arguments fails because it commits those who endorse it to a sort of scepticism that undermines ordinary moral practice. In this paper, we defend Bergmann's sceptical theist response against this charge. (shrink)

My goal in this paper is to provide characterizations of matter, form and constituency in a way that avoids what I take to be the three main drawbacks of other hylomorphic theories: (i) commitment to the universal-particular distinction; (ii) commitment to a primitive or problematic notion of inherence or constituency; (iii) inability to identify viable candidates for matter and form in nature, or to characterize them in terms of primitives widely regarded to be intelligible.

The COVID‐19 pandemic has had an immense and worldwide impact. In light of future pandemics or subsequent waves of COVID‐19 it is crucial to focus on the ethical issues that were and still are raised in this COVID‐19 crisis. In this paper, we look at issues that are raised in the testing and tracing of patients with COVID‐19. We do this by highlighting and expanding on an approach suggested by Fineberg that could serve as a public health approach. In this (...) way, we highlight several ethical issues. As regards testing, questions are raised such as whether it is ethical to use less reliable tests in order to increase testing capacity or minimize harm for patients. Another issue is how wide testing should be and whether selective testing is in accordance with principles of social justice. Patients who have recovered from COVID‐19 might have some degree of immunity but attributing certain ‘immunopriviliges’ raises ethical questions. The use of various tracing methodologies (mobile apps or databases and trained tracers) raised evident questions of social justice and privacy. We argue why it is key to always uphold a test of proportionality where a fair balance must be sought. (shrink)

Dans cet article, nous nous questionnons sur la manière dont le terrorisme est représenté en tant que référent créé en discours par les commissions du Parlement européen de la législation en cours. Tout en adoptant une approche de lexicologie discursive, qui est également redevable de l’analyse du discours « à la française », nous mènerons une enquête pour cerner les contours de l’utilisation discursive des mots « terrorisme » et « terroriste » ainsi que de quelques mots qui y sont (...) liés. Bien au-delà de l’existence de référents sociaux circulant dans les discours français de l’Hexagone, le discours tissé par le Parlement européen autour du terrorisme construit et réitère un référent discursif qui se produit dans des conditions de production discursive précises et est donc influencé par les procédures de « lissage » de la matérialité discursive typique de ce type de discours institutionnel. The first half of the twentieth century was a dark time for philosophical theology. Sharp divisions were developing among philosophers over the proper aims and ambitions for philosophical theorizing and proper methods for approaching philosophical problems. But many philosophers were united in thinking, for different reasons, that the methods of philosophy are incapable of putting us in touch with theoretically interesting truths about God.

This paper defends Mereological Universalism(the thesis that, for any set S of disjoint objects, there is an object that the members of S compose. Universalism is unpalatable to many philosophers because it entails that if there are such things as my left tennis shoe, W. V. Quine, and the Taj Mahal, then there is another object that those three things compose. This paper presents and criticizes Peter van Inwagen's argument against Universalism and then presents a new argument in favor of (...) Universalism. It turns out that the most reasonable way to resist the argument for Universalism is to deny the existence of artifacts; thus, if we believe in artifacts, we have no real choice other than to embrace Universalism. Philosophy in the English-speaking world is dominated by analytic approaches to its problems and projects; but theology has been dominated by alternative approaches. Many would say that the current state in theology is not mere historical accident, but is, rather, how things ought to be. On the other hand, many others would say precisely the opposite: that theology as a discipline has been beguiled and taken captive by 'continental' approaches, and that the effects on the discipline have been largely deleterious. (...) The methodological divide between systematic theologians and analytic philosophers of religion is ripe for exploration. The present volume represents an attempt to begin a much-needed interdisciplinary conversation about the value of analytic philosophical approaches to theological topics. Most of the essays herein are sympathetic toward the enterprise the editors are calling analytic theology; but, with an eye toward balance, the volume also includes essays and an introduction that try to offer more critical perspectives on analytic theology. We lay out the fatalist’s argument, making sure to clarify which dialectical moves are available to the libertarian. We then offer a more robust presentation of Ockhamism, responding to obvious objections and teasing out the implications of the view. At this point, we discuss presentism and eternalism in more detail. We then present our argument for the claim that the libertarian cannot take Ockham’s way out of the fatalism argument unless she rejects presentism. Finally, we consider and dispense with objections (...) to our argument. In the end, it ought to be clear that the libertarian must make a choice between Ockham’s way out and presentism. (shrink)
