Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. This article presents a response to Richard Rorty's paper "Is Philosophy Relevant to Business Ethics?" The author questions Rorty's views on the depreciation of the role of philosophy in applied ethics, and outlines four reasons why philosophy retains its relevance. The author addresses the role of moral reasoning in the development of the moral imagination. This article deals with public manifestations of Catholic religious officials, members of the hierarchy and recognized laity, in the context of the discussion of the National Education Plan - PNE. The focus of the analysis is a condemnation of what they call "gender ideology", present in the proposal document. Such manifestations are the reaffirmation of a conception of human beings as subject to the inexorable "laws of nature" that determine a social order marked by the rigid distinction of roles assigned (...) to women and men. The texts published at the time reveal changes and continuities in the Catholic discourse in its reference to "nature", understood in its biological materiality, as an unswerving fact of human reality, consisting in two sexes must unite under the "natural order". Gender theories are blamed by family disintegration, for providing support to new understandings of humanity, no longer based on bipolarity: men / women. A non extensive dossier of these texts formed the basis for the proposed analyzes. (shrink)

Background:The theoretical framework of Jϋrgen Habermas suggests that effective communication requires competent participants with an objective attitude that complies with the rules and worlds designated as objective, social and subjective. This situation determines communicative action, which stimulates the search for mutual understanding and results in a process of interaction that promotes self-determination.Objectives:In this study, the discharge letters of patients with myocardial infarction were explored regarding the provision of information. The patient’s right to information and the duty of informing were analysed (...) according to the perspective of Jϋrgen Habermas.Research design:This was a cross-sectional analysis (from a broader longitudinal study) of all discharge letters that were directly related to nursing interventions regarding the provision of information to 106 patients. In this major study, the difficulties faced by patients who experienced a myocardial infarction and the changes in their lifestyles were analysed based on the type of information received.Ethical considerations:The hospital Ethics Committee approved the study, which complied with ethical principles and required informed consent.Findings:In the nursing letters, interventions related to the provision of information were conducted at an average of 3.59 interventions per patient. For 8.5% of the patients, however, no interventions related to the provision of information were performed. The most common area of information during hospitalisation was related to the management of signs and symptoms and applied to 90.6% patients.Discussion:The nursing interventions did not cover patient education, transition processes or awareness of the disease. Thus, the right to information can be questioned.Conclusion:Information is a right, and communication is extremely important. Health professionals should be aware of this importance regarding both care management and the satisfaction guarantee. The sharing of information by health professionals based on their competency is essential for patients to exercise their right to self-determination and decision-making. (shrink)

The ways in which knowledge relates to power have been much discussed in radical education theory. In Getting Smart , Patti Lather makes use of her unique integration of feminism and postmodernism into critical education theory to address some of the most vital questions facing education researchers and teachers.

This analysis tests the influence of personal, job, and family status characteristics on maternal employment. We use the Merged Child/mother File from the National Longitudinal Survey of Youth to examine employment patterns of mothers who gave birth between 1979 and 1986. Logistic regression is used to estimate the probabilities; proportional hazards techniques are used to estimate rates of leaving and return to employment after childbirth. We find that family status factors and the proportion of the family income the mother earns (...) are consistently important in predicting maternal employment. Human capital factors are more significant in predicting employment exits and the rate of exit than the rate of return or employment status one year after a birth. (shrink)

O discurso funcional é tanto ubíquo quanto central na ecologia contemporânea, principalmente no contexto das pesquisas sobre biodiversidade e funcionamento ecossistêmico, que emergiram nos anos 1990 em meio à crise da biodiversidade. Entretanto, a despeito dessa forte presença na ecologia, o discurso funcional ainda não tem sido investigado de maneira adequada nesta ciência, na medida em que muitos problemas fundamentais a respeito do tema ainda permanecem sem respostas claras. Por um lado, os ecólogos que lançam mão de explicações funcionais parecem (...) simplesmente tomar como dado ou autoevidente o conceito de função. Contudo, ele nada tem de trivial, tendo em vista os problemas filosóficos suscitados pela linguagem funcional ou teleológica nas explicações biológicas, pelo menos desde Aristóteles. Por outro lado, poucos filósofos da ciência têm se mostrado especialmente interessados nos problemas epistemológicos associados ao discurso funcional em ecologia. Tomando essa situação como ponto de partida, nossa abordagem neste artigo se dá em três etapas. Inicialmente, procedemos a uma análise conceitual de função na ecologia atual, com ênfase nos estudos que relacionam a biodiversidade às propriedades ecossistêmicas. Esboçamos três significados principais do conceito, mostrando os pressupostos e as implicações associados a cada um deles. Num segundo momento, procedemos a uma análise das razões que levam a suspeitas ou objeções contra a linguagem funcional na ecologia. Por fim, num terceiro momento, lançamos algumas sugestões sobre como fundamentar ou dar mais clareza ao discurso funcional na ecologia contemporânea. (shrink)

This paper examines the relationship between organizational ethical culture in two large international CPA firms, auditors'' personal values and the ethical orientation that those values dictate, and judgments in ethical dilemmas typical of those that accountants face. Using an experimental task consisting of multiple judgments designed to vary in "moral intensity" (Jones, 1991), and unique as well as tried-and-true approaches to variable measurements, this study examined the judgments of more than three hundred participants in our study. ANCOVA and path analysis (...) results indicate that: (1) Ethical judgments in situations of high moral intensity are affected by personal values and by environmental variables, such as the professional code of conduct (direct and indirect effects) and previous ethics instruction (direct effect only). (2) Corporate ethical culture, and a relatively strong firm rules-orientation, affect auditors'' idealism but not relativism, and therefore indirectly affect ethical judgments. Jones'' (1991) moral intensity argument is supported: differences in the characteristics of specific judgment tasks apparently result in different decision processes. (shrink)

These two characteristics of human existence bear a close (...) relation with the vision of an embodied mind sustained by Gallagher and Zahavi in their work The Phenomenological Mind: An Introduction to Philosophy of Mind and Cognitive Science. Merleau-Ponty uses concepts like those of the lived or own body and of lived space in order to emphasize, from a first-person perspective, the co-penetration that exists between subject and world.Gallagher and Zahavi have regained the experience of phenomenology, especially that of Merleau-Ponty and Sartre, to contribute to the development of the cognitive sciences. Via the phenomenological approach to the reality of habit, a new understanding of the body becomes possible for us, such that it becomes characterized “as subject, as experiencer, as agent”, and at the same time we can understand “the way the body structures our experience” (Gallagher and Zahavi, 2008). Husserl’s writings on sociality have received increasing attention in recent years. Despite this growing interest, Husserl’s reflections on the specific role of communication remain underexplored. In this paper, we aim to fill this gap by reconstructing the various ways in which Husserl draws systematic connections between communication and communalization. As will become clear, Husserl’s analysis converges with much more recent ideas defended by Margaret Gilbert and Naomi Eilan.

A criticism of a recent article published in this journal, claiming to have reached a classical description of the Stern-Gerlach phenomenon, is presented here. The author of the article, among other mistakes, wrongly writes the total energy of each silver atom and, moreover, presents a nonsensical equation, from which his results and the conclusion of his article are derived.

A dialogue between virtue and care ethics is formed as a step towards meeting Pellegrino's challenge to create a more comprehensive moral philosophy. It is also a dialogue between nursing and medicine since each practice draws on the Greek Virtue Tradition and the Judeo-Christian Tradition of care differently. In the Greek Virtue Tradition, the point of scrutiny lies in the inner character of the actor, whereas in the Judeo-Christian Tradition the focus is relational, i.e. how virtues are lived out in (...) specific relationships, particularly unequal relationships where vulnerability of one of the members is an issue. In a care ethic relational qualities such as attunement rather than inner qualities are the point of scrutiny. A dialogue between these two traditions makes it possible to consider the relational virtues and skills of openness and responsiveness that are required for a respectful meeting of the other. Nursing research using concept analysis plays a critical role for knowledge development, particularly when concerning to broad and foundational concepts for nursing practice, such as dignity. This study aimed to synthesize research concerning concept analysis of dignity in nursing care. Based on a literature review, electronic databases were searched using the terms “dignity,” “human dignity,” “concept analysis,” and nurs*. Papers in Portuguese or English were included. The research synthesis was conducted independently by two reviewers. A total of 35 citations were (...) identified and seven papers were included. Six studies were elected using Walker and Avant concept analysis methodology while one applied the Beth Rodgers evolutionary model. The concept of dignity has been studied by nurses, and its attributes, antecedents, consequences, and similar concepts were synthesized into a definition. Dignity emerged as a fundamental concept in nursing ethics and the main attributes synthesized were personhood, sociability, respect, and autonomy. The antecedents identified were: facilitators—patient focus care, recognition, education, and ethical competence; threats—vulnerability and organizational environment. The consequences were positive coping, empowerment, and dignity preservation. The synthesis of these seven studies using concept analysis provided a clear definition of dignity. These findings challenge future research and education, particularly for the study of undergraduate and postgraduate nursing education programs to enhance skills for preserving patient dignity in clinical practice. Neurophenomenological (NP) methods integrate objective and subjective data in ways that retain the statistical power of established disciplines (like cognitive science) while embracing the value of first-person reports of experience. The present paper positions neurophenomenology as an approach that pulls from traditions of cognitive science but includes techniques that are challenging for cognitive science in some ways. A baseline study is reviewed for “lessons learned,” that is, the potential methodological improvements that will support advancements in understanding consciousness and cognition using (...) neurophenomenology. These improvements, we suggest, include (1) addressing issues of interdisciplinarity by purposefully and systematically creating and maintaining shared mental models among research team members; (2) making sure that NP experiments include high standards of experimental design and execution to achieve variable control, reliability, generalizability, and replication of results; and (3) conceiving of phenomenological interview techniques as placing the impetus on the interviewer in interaction with the experimental subject. Functional language is ubiquitous in ecology, mainly in the researches about biodiversity and ecosystem function. However, it has not been adequately investigated by ecologists or philosophers of ecology. In the contemporary philosophy of ecology we can recognize a kind of implicit consensus about this issue: while the etiological approaches cannot offer a good concept of function in ecology, Cummins’ systemic approach can. Here we propose to go beyond this implicit consensus, because we think these approaches are not adequate for ecology. (...) We argue that a sound epistemological framework to function in ecology is to be found in organizational approaches. In this line, we define function in ecology as a precise effect of a given constraint on the ecosystem flow of matter and energy performed by a given item of biodiversity, within a closure of constraints. Ex parte communications can become an administrative quagmire for anyone trying to deal with tribunals that regulate business matters. These communications involve contact between a decision maker and one party outside the presence of another, interested party. At a time when codes of ethics are enacted to make corporate financial officers and boards of directors more accountable to their stockholders, and thus, to restore the confidence of the investing public, it appears most important that administrative judges and hearing officers adhere (...) strictly to their own Codes of Conduct. This article defines and explains ex parte contacts and consequent problems that might arise during administrative appeals. It is not the author’s intent to present the law of any specific jurisdiction, but to present a general overview of typical state law in the United States, a market of interest to many entrepreneurs and exporters worldwide. Evidence-Based Medicine (EBM) is defined as the conscious, and judicious use of current best evidence in making decisions about the care of individual patients. The greater the level of evidence the greater the grade of recommendation. This pioneering explicit concept of EBM is embedded in a particular view of medical practice namely the singular nature of the patient-physician relation and the commitment of the latter towards a specific goal: the treatment and the well being of his or her client. Nevertheless, (...) in many European countries as well as the United States, this integration of the best evidence from systematic research with clinical expertise and patient values appears to be re-interpreted in light of the scarcity of healthcare resources. The purpose of this paper is double. First, to claim that from an ethical perspective EBM should be a guideline to clinical practice; and second, that in specific circumstances EBM might be a useful tool in macro-allocation of healthcare resources. Methodologically the author follows Norman Daniels' theory of democratic accountability to justify this assumption. That is, choices in healthcare must be accountable by democratic procedures. This perspective of distributive justice is responsible for the scope and limits of healthcare services. It follows that particular entitlements to healthcare — namely expensive innovative treatments and medicines —may be fairly restricted as long as this decision is socially and democratically accountable and imposed by financial restrictions of the system. In conclusion, the implementation of EBM, as long as it limits the access to drugs and treatments of unproven scientific results is in accordance with this perspective. The use of EBM is regarded as an instrument to facilitate the access of all citizens to a reasonable level of healthcare and to promote the efficiency of the system. (shrink)
