We critically evaluate arguments in a recent Journal of Law, Medicine & Ethics article by Svoboda, Adler, and Van Howe disputing the 2012 affirmative infant male circumcision policy recommendations of the American Academy of Pediatrics. We provide detailed evidence in explaining why the extensive claims by these opponents are not supported by the current strong scientific evidence. We furthermore show why their legal and ethical arguments are contradicted by a reasonable interpretation of current U.S. and international law and ethics. After (...) all considerations are taken into account it would be logical to conclude that failure to recommend male circumcision early in infancy may be viewed as akin to failure to recommend childhood vaccination to parents. In each case, parental consent is required and the intervention is not compulsory. Our evaluation leads us to dismiss the arguments by Svoboda et al. Instead, based on the evidence, infant male circumcision is both ethical and lawful. (shrink)

Mathematical theorems are cultural artifacts and may be interpreted much as works of art, literature, and tool-and-craft are interpreted. The Fundamental Theorem of the Calculus, the Central Limit Theorem of Statistics, and the Statistical Continuum Limit of field theories, all show how the world may be put together through the arithmetic addition of suitably prescribed parts (velocities, variances, and renormalizations and scaled blocks, respectively). In the limit — of smoothness, statistical independence, and large N — higher-order parts, such as accelerations, (...) are, for the most, part irrelevant, affirming that, in the end, most of the world's particulars may be averaged over (a very un-Scriptural point of view). (We work out all of this in technical detail, including a nice geometric picture of stochastic integration, and a method of calculating the variance of the sum of dependent random variables using renormalization group ideas.) These fundamental theorems affirm a culture that is additive, ahistorical, Cartesian, and continuist, sharing in what might be called a species of modern culture. We understand mathematical results as useful because, like many other such artifacts, they have been adapted to fit the world, and the world has been adapted to fit their capacities. Such cultural interpretation is in effect motivation for the mathematics, and might well be offered to students as a way of helping them understand what is going on at the blackboard. Philosophy of mathematics might want to pay more attention to the history and detailed technical features of sophisticated mathematics, as a balance to the usual concerns that arise in formalist or even Platonist positions. In Strasbourg he was put in charge of the St. Thomas parish, located closer to the city center. Along with his colleagues he appealed relentlessly to the City Council for a stricter moral discipline, for struggle against anabaptism and celebration of the mass, which was suspended on February 20, 1529. Moreover (...) he engaged in great activity in publishing five important biblical commentaries. Outside Strasbourg he intensified his evangelical propaganda in countries speaking romanic languages. His active involvement in the Berne disputation in January 1528 helped him make contact with the European Reformation. In the disastrous sacramentary strife he continued taking part in advocating concord between the protestant theologians. That is why he joined Philip von Hessen in setting up the Marburg colloquium. Faced with whose partial failure, he did his best to encourage Zwingli's project of a defensive alliance among evangelical cities in Switzerland and in the South-West of Germany, called the “Burgrecht”. This paper aims to develop a comparative analysis of the place of emotion from Indian and Western philosophical perspectives. Both Eastern and Indian philosophy consider three mental states as being involved with the arousal of emotions, i.e., cognitive (epistemic), conative (desire), and affective. In Indian philosophy, there is no such single term or specific equivalent definition to the Western term ‘emotion.’ Further, there is no clear dichotomy (cognitive & non-cognitive) between reason and emotion in Indian culture. In Indian scriptures, there (...) are various, at times intermingled conceptions of emotion. From a religious standpoint, emotion can be an expression of religious devotion (bhakti), and often emotions are viewed as barriers to having true knowledge and are considered a cause of attachment and an obstacle to liberation. After comparing a large amount of discussion on emotion following Western and Indian conceptions, and analyzing some real-life experiences where emotion plays various roles (intellectual, personal, and spiritual) within each philosophical tradition this paper concludes that it is critical to engage in a comparative, collaborative study of emotion. This book is not a critique of digital ethics but rather a hack. It follows the method of hacking by developing an exploit kit on the basis of state-of-the-art social theory, which it uses to breach the insecure legacy system upon which the discourse of digital ethics is running. This legacy system is made up of four interdependent components: the philosophical mythology of humanism, social science critique, media scandalization, and the activities of many civil society organisations lobbying for various forms (...) of regulation. The hack exposes the bugs, the sloppy programming, and the false promises of current digital ethics, and, because it is an ethical hack, redesigns digital ethics so that it can address the problems of the global network society. The main idea of the book is that the social world of meaning is based on information, which, because of its relational nature, must be understood more as a common good than as private property. A digital ethics that relies upon humanistic individualism cannot address the issues arising from the global network society based upon information. This demands a complete revision of the philosophical foundations of current digital ethics by means of a redesign of ethics as a theory of governance by design. (shrink)

What is the primary function of consciousness in the nervous system? The answer to this question remains enigmatic, not so much because of a lack of relevant data, but because of the lack of a conceptual framework with which to interpret the data. To this end, we have developed Passive Frame Theory, an internally coherent framework that, from an action-based perspective, synthesizes empirically supported hypotheses from diverse fields of investigation. The theory proposes that the primary function of consciousness is well-circumscribed, (...) serving the 'somatic nervous system[. For this system, consciousness serves as a frame that constrains and directs skeletal muscle output, thereby yielding adaptive behavior. The mechanism by which consciousness achieves this is more counterintuitive, passive, and “low level” than the kinds of functions that theorists have previously attributed to consciousness. Passive frame theory begins to illuminate (a) what consciousness contributes to nervous function, (b) how consciousness achieves this function, and (c) the neuroanatomical substrates of conscious processes. Our untraditional, action-based perspective focuses on olfaction instead of on vision and is 'descriptive' (describing the products of nature as they evolved to be) rather than 'normative' (construing processes in terms of how they should function). Passive frame theory begins to isolate the neuroanatomical, cognitive-mechanistic, and representational (e.g., conscious contents) processes associated with consciousness. (shrink)

O presente Trabalho de Conclusão de Residência multidisciplinar em Saúde possui o objetivo de conhecer a percepção e a prática de profissionais médicos, atuantes na Estratégia de Saúde da Família (ESF), no que concerne aos Cuidados Paliativos (CP) na Atenção Primária à Saúde (APS). Os seis profissionais desta amostra estão vinculados a ESF de uma Unidade Básica de Saúde (UBS) localizada em Canoas/RS. O estudo possuimetodologia de natureza qualitativa e abordagem descritiva. O referencial teórico utiliza-se de áreas da psicologia da (...) saúde, medicina paliativa, e do Sistema Único de Saúde (SUS). Os resultados apontam para necessidade de incluir nas práticas de CP dimensões subjetivas no cuidado e a interdisciplinaridade como método de trabalho. Ademais, identificaram-se lacunas referentes acapacitações e formações especificas em CP, sobrecarga de trabalho e insatisfação profissional. Essa pesquisa pretende ampliar a discussão dos muitos desafios éticos a serem vencidos na APS, referente aos CP. (shrink)

Resumo: O presente artigo pretende trazer à luz a convergência entre dois modos divergentes de superação do paradigma por excelência da filosofia moderna, qual seja, o da interioridade do sujeito, como pedra de toque epistemológica. Mais precisamente, pretende-se evidenciar o rito de passagem de um filosofar moderno para o contemporâneo, segundo a vertente que se convencionou chamar de “filosofia continental”, a aqui ser visitada com Nietzsche - equacionada a uma hermenêutica -, e a “filosofia analítica” ou “anglo-saxônica”, a aqui ser (...) visitada com o Wittgenstein dos §§ 143-178 das Investigações filosóficas -, equacionada a uma filosofia da linguagem. Em um e outro caso, cada qual à sua maneira, vai se pôr em questão o que até então se tinha como consciência pensante, transparente a si mesma e com acesso a seus próprios fundamentos e conteúdos, ou, então, uma interioridade, a qual, por um viés o mais das vezes mentalista, associa significado a entidades ou processos mentais. Desse modo, sujeito e pensamento, em vez de tomados por núcleos duros, passam a ser desvelados como funções das condições que os suscitam - de sobrevivência, no caso de Nietzsche, de condições práticas, ou seja, do uso, no caso de Wittgenstein.: The purpose of this article is bringing to light the convergence between two diverging modes of overcoming the very paradigm of modern philosophy, namely, the interiority of the subject as an epistemological milestone, and thus emphasizing the rite of passage from a modern philosophizing to a contemporary one. This process will be addressed according to the strand known as “continental philosophy”, with Nietzsche, equated with a hermeneutics, and to the “analytical philosophy” or anglo-saxon philosophy, with Wittgenstein, equated with a philosophy of language. In both cases we will put into question the conditions underlying the thinking consciousness, transparent to himself and with access to his own grounds and contents, and an interiority approached most of times by a mentalistic bias, that relates meaning to entities or mental processes. In this way, subject and act of thinking, instead of being taken as a core, are unveiled as functions of their very conditions - condition of survey, for Nietzsche, conditions of practical experience, for Wittgenstein. Intrinsic religiosity drives ethical consumer behavior; however, previous studies regarding this connection are limited solely to a Christian cultural context. This comparative study instead includes Christian Consumers from Germany and Moslem Consumers from Turkey to determine if a specific religious community moderates the connection between intrinsic religiosity and consumer ethics. The results show that Consumers in the Turkish, Moslem subsample, exhibit an even stronger connection between religiosity and ethical consumer behavior than Consumers from the German, Christian subsample.

In this article, Ms. Krieger explores the controversy concerning pregnancy disability leave presented by the case of California Federal Savings v. Guerra in light of Thomas Kuhn's model of scientific paradigm change and Carol Gilligan's theory regarding sex differences in moral reasoning. She argues that the controversy reflects a period of paradigm crisis in equality jurisprudence, brought about in part by the recent inclusion of greater numbers of women into the jurisprudential community.

Is addiction a behavioral pattern, or the underlying cause of a behavioral pattern? Both views are found in prominent accounts of addiction, but theorists generally do not notice that they are taking a controversial position, let alone justify it. A third possibility is that addiction consists in both addictive behavior and its causes, though this view is less obviously present in the literature. I argue that two important considerations favor the "cause view" over the "behavior" and "hybrid" views. The first (...) is that we want to be able to explain addictive behavior with reference to addiction. The second is that addiction seems to persist long after addictive behavior has ceased. We argue that the appraisal of models in social epistemology requires conceiving of them as argumentative devices, taking into account the argumentative context and adopting a family-of-models perspective. We draw up such an account and show how it makes it easier to see the value and limits of the use of models in social epistemology. To illustrate our points, we document and explicate the argumentative role of epistemic landscape models in social epistemology and highlight their limitations.
