This case describes a psychiatric patient who stalked and harassed her former psychiatrist. Balancing the safety risk to her physician against the duty to continue to treat this vulnerable patient, what should the current psychiatrist and the treating institution do?

Some commentators have condemned Kant’s moral project from a feminist perspective based on Kant’s apparently dim view of women as being innately morally deficient. Here I will argue that although his remarks concerning women are unsettling at first glance, a more detailed and closer examination shows that Kant’s view of women is actually far more complex and less unsettling than that attributed to him by various feminist critics. My argument, then, undercuts the justification for the severe feminist critique of Kant’s (...) moral project. (shrink)

Recent publications by several leading philosophers of chemistry have focused on the definition, scope, utility, and nomenclature of issues dealing with acidity and basicity. In this paper, molecular orbital theory is used to explain all acid–base reactions, concluding that the interaction of the highest occupied molecular orbital (HOMO) of one substrate, “the base,” with the lowest unoccupied molecular orbital (LUMO) of a second substrate, “the acid,” determines the reactivity of such systems. This paradigm provides an understanding of all acid–base reactions (...) as well as other reactions which, on the surface, may not seem like acid–base reactions but which have fundamental underpinnings of that kind of chemistry. Rather than being unable to determine a unified understanding of acidity and basicity as suggested in the philosophy of chemistry literature, we propose that acidity and basicity fit securely in a classification of many other reactions that, using classical chemistry knowledge, pre-quantum chemistry, would not be possible. We strongly support the use of all scientific knowledge and experience in the development of the ideas in the philosophy science. We further suggest increased interactions between philosophers of science and scientists, so that all scholars benefit from the values, knowledge, and perspectives of other disciplines. (shrink)

Our purpose in this paper is to characterize the methodological role of judges in clinical psychology. What, methodologically speaking, do the judges do for the experimenter in this area? Why, and in what ways, are the experimenter's procedures more respectable, his results more valid, when he employs judges? In order to present a concrete example of the use of judges we begin by describing in some detail a procedure actually employed in the testing of an hypothesis. Next we contrast this (...) procedure with a prima facie analogous one from chemistry, noting that an appeal to judges here would be clearly superfluous. Our problem then presents itself in the form: “Why these sorts of differences between chemistry and clinical psychology?”. As the argument develops it becomes clear that the methodological significance of what is called “clinical insight” must be carefully considered in any attempt to understand the peculiar importance of the judges’ role in psychology. It is argued that the absence of precise criteria for typical concepts of clinical psychology is closely connected with the frequent appeals to clinical insight. And it is urged that the full significance of the employment of judges emerges only when seen in the light of this conceptual uncertainty, and of the clinician's attempt to operate scientifically in spite of that uncertainty. In the Philippines, all transplant centers are mandated by the Department of Health (DOH) to have a Hospital Transplant Ethics Committee (HTEC) to ensure that donations are altruistic, voluntary and free of coercion/commercial transactions. This study was undertaken primarily to describe the organizational and functional profile of existing HTECs and identify areas for improvement. This is a descriptive cross‐sectional study. There was variation in their logistical arrangements (support from hospital, filing systems, office spaces), operations (length and frequency of meetings, number (...) of referrals) and membership (composition, qualifications, occupation, training). The approval rate for donor‐recipient pairs is high with the majority of cases made by living non‐related donors. Appropriate reasons were cited for rejection. The perception of HTECs is that they are competent and confident in their decision‐making. However, there is a need to standardize HTEC composition, provide operating procedures and additional training which can be done by the DOH. (shrink)

Differential privacy (DP) aims to confer data processing systems with inherent privacy guarantees, offering strong protections for personal data. But DP’s approach to privacy carries with it certain assumptions about how mathematical abstractions will be translated into real-world systems, which—if left unexamined and unrealized in practice—could function to shield data collectors from liability and criticism, rather than substantively protect data subjects from privacy harms. This article investigates these assumptions and discusses their implications for using DP to govern data-driven systems. In (...) Parts 1 and 2, we introduce DP as, on one hand, a mathematical framework and, on the other hand, a kind of real-world sociotechnical system, using a hypothetical case study to illustrate how the two can diverge. In Parts 3 and 4, we discuss the way DP frames privacy loss, data processing interventions, and data subject participation, arguing it could exacerbate existing problems in privacy regulation. In part 5, we conclude with a discussion of DP’s potential interactions with the endogeneity of privacy law, and we propose principles for best governing DP systems. In making such assumptions and their consequences explicit, we hope to help DP succeed at realizing its promise for better substantive privacy protections. (shrink)

This essay supports and encourages multiple disciplinary interactions for practitioners of the disciplines of chemistry, history of chemistry, philosophy of chemistry, and sociology of chemistry.

Multiple simultaneous independent discoveries, so well enunciated by Robert K. Merton in the early 1960s but already discussed for several hundreds of years, is a classic concept in the sociology of science. In this paper, the concept of multiple simultaneous independent errors is proposed, analyzed, and discussed. The concept of Selective Pessimistic Induction is proposed and used to connect MIDs with MIEs. Five types of MIEs are discussed: multiple errors in the interpretation of experimental data or computational results; multiple misjudgments (...) of the value of another’s research results or conclusions; multiple cases of false anticipation of achieving a certain experimental result; multiples of ignoring or omitting relevant precedents; and multiple instances of failure due to a not-yet-conceived scientific concept or principle. Causal MIDs and MIEs are those that can be traced directly to antecedent knowledge. Acausal MIDs and MIEs are those involving a consequential and identifiable leap from antecedent knowledge. Examples of causal and acausal MIEs are provided, mostly but not exclusively from the discipline of chemistry. Comparisons are made between MIDs and MIEs. Topics for future research are discussed and implications of these concepts are proposed. (shrink)

"Charming, interesting, thought-provoking and a great read." Rosalind Hursthouse The daughter of a pacifist rector who answered "No!" when his congregation asked him "Is everything in the bible true?", perhaps Mary Midgley was destined to become a philosopher. Yet few would have thought this inquisitive, untidy, nature-loving child would become "one of the sharpest critical pens in the west." This is her remarkable story. Probably the only philosopher to have been in Vienna on the eve of its invasion by (...) Nazi Germany in 1938 and dance in Trafalgar Square on VE day seven year later, she studied philosophy at Oxford in the same year as Iris Murdoch, Elizabeth Anscombe and Philippa Foot, all of whom became close friends. Midgley tells us in vivid and humorous fashion how they cut a swathe through the arid landscape of 1950s British philosophy, writing and arguing - often with each other - about the grand themes of character, beauty and the meaning of rudeness while the spectral figure of Ludwig Wittgenstein hovered in the background. She also charts the highs and lows of philosophy and academia in Britain. On joining the Reading philosophy department on £400 a year in 1949, she doubled its staff complement. But her many years at Newcastle University - where Mike Brearley, who later captained England at cricket, also used to teach - were rewarded with the closure of the philosophy department in the 1980s. The mother of three children, her journey is also one of a woman who in the 1950s and 1960s was fighting to combine a professional career with raising a family. In startling contrast to many of the academic stars of her generation, we learn that Midgley nearly became a novelist and started writing philosophy only when in her fifties, suggesting that Minerva's owl really does fly at dusk. Plainly told like her philosophy, this is an elegiac and moving account of friendships found and lost, bitter philosophical battles and of a profound love of teaching all too rarely acknowledged today. Plato famously promised to complement the Sophist and the Statesman with another work on a third sort of expert, the philosopher--but we do not have this final dialogue. Mary Louise Gill argues that Plato promised the Philosopher, but did not write it, in order to stimulate his audience and encourage his readers to work out, for themselves, the portrait it would have contained. The Sophist and Statesman are themselves members of a larger series starting with the Theaetetus, Plato's investigation (...) of knowledge, and the whole series relies on the Parmenides, the second part of which presents a philosophical exercise, introduced as the first step in a larger philosophical program. Gill contends that the dialogues leading up to the missing Philosopher, though they reach some substantive conclusions, are philosophical exercises of various sorts designed to train students in dialectic, the philosopher's method; and that a second version of the Parmenides exercise, closely patterned on it, spans parts of the Theaetetus and Sophist and brings the philosopher into view. This is the exercise about being, the subject-matter studied by Plato's philosopher. Plato hides the pieces of the puzzle and its solution in plain sight, forcing his students (and modern readers) to dig out the pieces and reconstruct the project. Gill reveals how, in finding the philosopher through the exercise, the student becomes a philosopher by mastering his methods. She shows that the target of Plato's exercise is internally related to its pedagogical purpose. (shrink)

This paper criticizes Langton's speech act account of MacKinnon's claim about (the subordinating force of) pornography and offers a different account of how speech might enact harmful norms and thus constitute harm.

Rae Langton and Jennifer Hornsby argue that there may be a free-speech argument against pornography, if pornographic speech has the power to illocutionarily silence women: women's locution ‘No!’ that aims to refuse unwanted sex may misfire because pornography creates communicative conditions where the locution does not count as a refusal. Central to this is the view that women's speech lacks uptake, which is necessary for illocutionary acts like that of refusal. Alexander Bird has critiqued this view by arguing that uptake (...) is not necessary for the illocutionary act of refusal. The Hornsby-Langton view, then, is philosophically indefensible. Here I defend the philosophical cogency of the Hornsby-Langton approach. (shrink)

The unity of aesthetic and teleological judgment, the third and earlier Critiques, is based on Kant′s discovery of a “heuristic method” for applying judgments regarding sense phenomena to abstract thought, a “second attention” which enables an “idea of the whole”. Synthetic judgment, basis for cognition and human action, depends on efficacy of non-empirical insights: the transcendental standpoint, “regulative” ideas, consciousness of “ought” and the reality of freedom, universality of natural mechanism, the principle of “fortuitous” purposiveness. The activity of reflective judgment (...) in the encounter with the beautiful, sublime, living, and two paradigmatic types of explanation, inspired by Spinoza′s distinction of extensio and cogitatio, permit Kant to bridge the gap between freedom and necessity, theoretical knowledge and morality. Science as Salvation discusses the high spiritual ambitions which tend to gather round the notion of science. Officially, science claims only the modest function of establishing facts. Yet people still hope for something much grander from it--namely, the myths by which to shape and support life in an increasingly confusing age. Our faith in science is abused by some scientists whose adolescent fantasies have spilled over into their professional lives. Salvation, immortality, mastery of the universe, humans without bodies, and intelligent (...) self-reproducing computers are just some of the notions and speculations that are now found--not on the pages of science fiction--but on the pages of science itself. The danger is that these concepts are given to a myth-hungry public who turn to science now that religion has lost its ability to create myth. Science as Salvation discusses the function and meaning of such fantasies. Midgley examines the need for and the use of myth in science, and how science and religion are related. She argues that we need to develop a realistic understanding of scientific imagination and its importance. Taking them seriously as symptoms of a genuine myth-hunger, it suggests that the proper function of science may need to include wider perspectives, which would make it plain that such desperate, compensatory dramas are unnecessary. A leader in the modern commentary on ethics and philosophy, Mary Warnock casts a critical eye over her life and times.

At the 2022 national meeting of the American Academy of Religion, the Evangelical Philosophical Society sponsored an exchange between Harold Netland, Jim Beilby, Doug Geivett, and Dolores Morris around Netland’s 2022 book, Religious Experience and the Knowledge of God. I briefly orient readers to the resulting Philosophia Christi symposium by saying a few words introducing Harold Netland and some key themes in his argument that a “critical trust” approach to religious experience offers modest—but significant—epistemic support for Christian belief and practice.

How does Plato view his philosophical antecedents? Plato and his Predecessors considers how Plato represents his philosophical predecessors in a late quartet of dialogues: the Theaetetus, the Sophist, the Politicus and the Philebus. Why is it that the sophist Protagoras, or the monist Parmenides, or the advocate of flux, Heraclitus, are so important in these dialogues? And why are they represented as such shadowy figures, barely present at their own refutations? The explanation, the author argues, is a complex one involving (...) both the reflective relation between Plato's dramatic technique and his philosophical purposes, and the very nature of his late philosophical views. For in these encounters with his predecessors we see Plato develop a new account of the principles of reason, against those who would deny them, and forge a fresh view of the best life - the life of the philosopher. In this book, Mary Midgely turns a spotlight on the fashionable view that we no longer need or use moral judgements. She shows how the question of whether or not we can make moral judgements must inevitably affect our attitudes to the law and its institutions, but also to events that occur in our daily lives.

Despite decades of research and thought on the meaning and identification of revolutions in science, there is no generally accepted definition for this concept. This paper presents 13 different characteristics that have been used by philosophers and historians of science to characterize revolutions in science, in general, and in chemistry, in particular. These 13 characteristics were clustered into six independent factors. Suggestions are provided as to the use of these characteristics and factors to evaluate historical events as to their possible (...) categorization as revolutions in chemistry. Should we feel inadequate when we fail to be healthy, balanced, and well-adjusted? Is it realistic or even desirable to strive for such an existential equilibrium? Condemning our current cultural obsession with cheerfulness and "positive thinking," Mari Ruti calls for a resurrection of character that honors our more eccentric frequencies and argues that sometimes a tormented and anxiety-ridden life can also be rewarding. Ruti critiques the search for personal meaning and pragmatic attempts to normalize human beings' unruly and idiosyncratic natures. (...) Exposing the tragic banality of a happy life commonly lived, she instead emphasizes the advantages of a lopsided life rich in passion and fortitude. She also shows what matters is not our ability to evade existential uncertainty but our courage to meet adversity in such a way that we do not become irrevocably broken. We are in danger of losing the capacity to cope with complexity, ambiguity, melancholia, disorientation, and disappointment, Ruti warns, leaving us feeling less "real" and less connected and unable to process a full range of emotions. Heeding the call of our character means acknowledging the marginalized, chaotic aspects of our being, and it is precisely these creative qualities that make us inimitable and irreplaceable. (shrink)

Kant shields his architectonicby allowing it to encounter onlyepistemologically neutered noumena. In The Ethical Primate , Mary Midgley, 'one of the sharpest critical pens in the West' according to the Times Literary Supplement , addresses the fundamental question of human freedom. Scientists and philosophers have found it difficult to understand how each human-being can be a living part of the natural world and still be free. Midgley explores their responses to this seeming paradox and argues that our evolutionary origin explains both why and how human freedom and morality have come (...) about. (shrink)

In “Idolatry and the End of Apologetics,” I worried that while continental philosophy can aid Christian philosophers and theologians, it can also tempt us toward the “Idolatry of Linguistic License”—an idolatry which sets God so far beyond our words that we deny God’s normative place in the community of speakers while safeguarding our autonomy vis-à-vis God. My essay suggested that some passages in Myron Bradley Penner’s helpful book, The End of Apologetics, might pass too close to the Idolatry of Linguistic (...) License. In Penner’s irenic reply he affirmed that the Idolatry of Linguistic License is a real worry, but protested that I had misread him at several points. This response seeks to continue that irenic tone in a discussion of three points where I still have some questions. (shrink)

Clinical ethics takes on a special cast in a rehabilitation clinic for psychosis where many patients come from severely disadvantaged backgrounds and many suffer from fluctuating decisional capacity. This paper illustrates several ethical issues—truth telling and partiality, prescribing concealed medication, questionable billing practices, industry collaboration, limits of confidentiality, grounds for abandonment and the primacy of autonomy—in the hope that discussing such matters will lead to a clearer framework for work with this population.

Honoring the divine is central to Maimonides' ethical and religious phenomenology. It connotes the recognition of radical divine incommensurability and points to the hard limits of human ability to know God. Yet it also signals the importance of philosophical speculation within those limits, indicating the intellectual and ethical telos of human life. For Maimonides, to honor or show kavod to God is closely related to the meaning of the divine glory (also known as kavod ) that Moses demands to see (...) in Exodus 33. Moses' demand to see the kavod is usually interpreted as a quest for some visible sign of God's presence or, at least, for a created light whose existence could testify to the authenticity of Moses' prophecy. Maimonides is alone among early interpreters in treating Exodus 33 as a parable of the philosophical quest to apprehend divine uniqueness, which leads first to negative theology and then to imitatio Dei . This article argues that the theme of divine kavod links Maimonides' philosophical, literary, and even medical concerns with his practical religious teaching, and connects the Guide of the Perplexed with his other legal and interpretive works. Maimonides' consistent fascination with Exodus 33 helps to organize his reflections on human perfection, ethics, and the relationship between idolatry and everyday religious language, distinguishing him from dominant trends in both Judaeo-Arabic and later kabbalistic thought. Myron Penner’s work shows some ways continental philosophy could strengthen apologetics. In particular, continental philosophy can serve what Francis Schaeffer called “the final apologetic” by exposing idols that keep us from living lives of “costly, observable love.” Yet continental philosophy can also imperil apologetics and theology. The worst danger stems from what I call the “idolatry of linguistic license,” a type of idolatry where linguistic criticism denies God a place in the normative community of speakers. Although the idolatry of linguistic (...) license mars some recent critiques of apologetics inspired by continental philosophy, apologetics would still profit from measured use of continental philosophy.
