This book presents a critique of dominant governance theories grounded in an understanding of existence as a static, discrete, mechanistic process, while also identifying the failures of theories that assume dynamic alternatives of either a radically collectivist or individualist nature. Relationships between ontology and governance practices are established, drawing upon a wide range of social, political, and administrative theory. Employing the ideal-type method and dialectical analysis to establish meanings, the authors develop a typology of four dominant approaches to governance. The (...) authors then provide a systematic analysis of each governance approach, thoroughly unpacking and critiquing each one and exploring the relationships and movements among them that engender reform and revolution as well as retrenchment and obfuscation of power dynamics. After demonstrating that each governance approach has fatal flaws within a diverse global context, the authors propose an alternative they call Integrative Governance. As a synthesis of the ideal-types, Integrative Governance is neither individualist nor collectivist, while still maintaining the dynamic character required to accommodate responsiveness to cultural contexts. Simone de Beauvoir’s early enthusiasm for the philosophy of Henri Bergson (1859-1941)—denied in her 1958 autobiography, Memoirs of a Dutiful Daughter—is a surprising discovery in her 1927 handwritten student diary, as I reported in 1999 and explored at more length in 2003 (Simons 1999; Simons 2003). Discovered by Sylvie Le Bon de Beauvoir after Beauvoir’s death in 1986 and now housed in the Bibliothèque nationale, Beauvoir’s student diary first appeared in print in the 2006 volume, Diary of a Philosophy Student: (...) 1926-27, followed in 2008 by the French publication, Cahiers de jeunesse: 1926-1930. Since my 1999 analysis of the 1927 diary, the publication of the 1926 diary and other posthumously discovered texts has deepened and complicated the evidence of Bergson’s influence.1 In this chapter, I propose to take up and expand upon my earlier analyses in the light of this new evidence, arguing that Beauvoir’s methodological turn to the description of immediate experience, especially her method of writing philosophy in literature and her lifelong interest in describing the subjective experience of time, drew upon Bergson’s philosophy before her first encounter with Husserl’s phenomenology which may have come as early as 1927; that her concept of bad faith and interest in exposing distortions in perception and thinking, as in the chapters in The Second Sex on myths about women, drew upon Bergson’s philosophy long before she had read Marx; and that her earliest formulation of the problem of the Other drew upon Bergson’s distinction between the “social self and the deep self,” two years before she met Jean-Paul Sartre and two decades before she first read Hegel’s Phenomenology. This is one (...) of at least ten places in this brief work in which he associates himself with “letters” or “literature”—as compared to at most four associations with philosophy. The moral to be inferred is not that Hume considered himself not to be a philosopher. Rather, he conceived of philosophy as a kind of literature. The Treatise was itself a “literary attempt.” Indeed, opposition between the “literary” and “philosophical” aspects of a text would have been foreign to Hume and his contemporaries—a notion for a later age, despite his occasional loose distinction between the relevant genres, as in his list of writings “historical, philosophical, or literary” in “My Own Life” (E-MOL: xxxvi).Yet despite Hume’s own understanding of the continuity between philosophy and literature, broadly conceived, it is still common for contemporary philosophers to ignore literary questions in their examination of Hume’s work, or to presume that one can easily distinguish the “philosophical” parts from the “literary” ones. The Testimony of Sense includes sustained engagement with Hume’s contemporaries and successors, but for the purposes of this review, I engage the book primarily as a Hume scholar for Hume scholars.Milnes’s story plays out in three acts. The first establishes the need for public trust created by a skeptical crisis, itself a product of Hume’s criticism of the epistemic program of thinkers in the Cartesian and Lockean traditions. The second explains how the essays of the long eighteenth century constitute a response to that need in various ways. The third reveals in detail how the Romantic essayists, particularly William Hazlitt and Charles Lamb, both respond to and deviate from the “neoclassical” essayists, typified by Hume and Samuel Johnson.The first chapter, “Self and Intersubjectivity,” lays the groundwork by articulating how Hume, Adam Smith, Thomas Reid, and Dugald Stewart identify the need for what we now call intersubjectivity. Milnes describes the common thread as a kind of “natural transcendentalism.” In what sense are these thinkers properly understood as [End Page 175] transcendentalists? The central idea seems to be that all posit things other than reason as “conditions of meaningful thought” (72). For Hume, it is the social, linguistic experience of a community of virtuous judges. The intricate relations between self and other essential to such a community get “internalized within the specular drama of the impartial spectator” (72) in Smith’s writing, which itself takes part in the drama through his “halting, qualified syntax” that mimics “everyday speech” (44). Reid posits a “prescience” of trust, which grounds our reliance on both human testimony and the uniformity of nature, itself undergirded by the design of a benevolent God. Stewart, who posits axiomatic truths that help constitute the “stamina of intellect,” goes furthest, actually calling these truths transcendental (55). This chapter also puts these eighteenth-century thinkers in conversation with twentieth-century theorists, including Habermas, Davidson, and Rorty.Chapter 2, “The Subject of Trust,” deepens the analysis by situating these “natural transcendentalisms” in the broader enlightenment context. The purveyors of the clandestine could be found in the Dutch Republic, Switzerland, Denmark, Spain, and not least in Paris or London. What is a crip politics of bodymind? Drawing upon Rosemarie Garland-Thomson's theory of the misfit, I explain my understanding of crip and bodymind within a feminist materialist framework, and argue that careful investigation of a crip politics of bodymind must involve accounting for two key, but under-explored, disability studies concepts: desire and pain. I trace the turn toward desire that has characterized DS theory for the last decade, and argue that while acknowledging disability desire, we must also attend to the (...) aspects of disability, including pain, that are sometimes bad. Although I don't argue that pain is always and only bad, I call for recognition of the ways pain complicates disability desire, as well as the possibilities it opens for specifically located, collective forms of care. The underdetermination of scientific theory choice by evidence is a familiar but multifaceted concept in the philosophy of science. I answer two pressing questions about underdetermination: “What is underdetermination?” and “Why should we care about underdetermination?” To answer the first question, I provide a general definition of underdetermination, identify four forms of underdetermination, and discuss major criticisms of each form. To answer the second question, I then survey two common uses of underdetermination in broader arguments against scientific realism and in (...) support of the use of values in scientific theory choice. The authors surveyed hospitals across the country on their policies regarding overlapping surgery, and found large variation between hospitals in how this practice is regulated. Specifically, institutions chose to define “critical portions” in a variety of ways, ultimately affecting not only surgical efficiency but also the autonomy of surgical trainees and patient experiences at these different hospitals.

This paper argues for a methodological point that bears on a relatively long-standing debate concerning collective beliefs in the sense elaborated by Margaret Gilbert: are they cases of belief or rather of acceptance? It is argued that epistemological accounts and distinctions developed in individual epistemology on the basis of considering the individual case are not necessarily applicable to the collective case or, more generally, uncritically to be adopted in collective epistemology.

In discussions of religious disagreement, some epistemologists have suggested that religious disagreement is distinctive. More specifically, they have argued that religious disagreement has certain features which make it possible for theists to resist conciliatory arguments that they must adjust their religious beliefs in response to finding that peers disagree with them. I consider what I take to be the two most prominent features which are claimed to make religious disagreement distinct: religious evidence and evaluative standards in religious contexts. I argue (...) that these two features fail to distinguish religious disagreement in the ways they have been taken to. However, I show that the view that religious disagreement is not a unique form of disagreement makes religious disagreement less, rather than more, worrisome to the theist who would prefer to rationally remain steadfast in her religious beliefs. The parasol, whatever the conditions of use, ultimately functions as a social symbol as it satisfies no utilitarian need. The operative mechanism of that symbol varies from culture to culture but the parasol is polysemous even at its least complicated, when held by the person to be protected without allusion to foreign social systems and in the context of single-sex usage. For example, as an implement of fashionable feminine attire of over a century ago, the parasol signified the maintenance of (...) a standard of beauty that precluded extended activities out of doors and the delicate constitution of the lady thus protected, both with further implications of ‘good breeding’ and economic inutility; and the wasteful employment of items that must be changed with the costume and discarded before unserviceable to suit the dictates of fashion. Both facets—termed ‘conspicuous leisure’ and ‘conspicuous consumption’ by Veblen—conjointly served to advertise the wealth of the individual man on the basis of whose property such extravagance and non-productive practice could be sustained. In this article, I urge that mainstream discussions of abortion are dissatisfying in large part because they proceed in polite abstraction from the distinctive circumstances and meanings of gestation. Such discussions, in fact, apply to abortion conceptual tools that were designed on the premiss that people are physically demarcated, even as gestation is marked by a thorough-going intertwinement. We cannot fully appreciate what is normatively at stake with legally forcing continued gestation, or again how to discuss moral responsibilities to continue (...) gestating, until we appreciate in their own terms the goods and evils distinctive of gestational connection. To underscore the need to explore further the meanings of gestation, I provide two examples of the difference it might make to legal and moral discussions of abortion if we appreciate more fully that gestation is an intimacy. Several foundational documents of bioethics mention the special obligation researchers have to vulnerable research participants. However, the treatment of vulnerability offered by these documents often relies on enumeration of vulnerable groups rather than an analysis of the features that make such groups vulnerable. Recent attempts in the scholarly literature to lend philosophical weight to the concept of vulnerability are offered by Luna and Hurst. Luna suggests that vulnerability is irreducibly contextual and that Institutional Review Boards (Research Ethics Committees) can only (...) identify vulnerable participants by carefully examining the details of the proposed research. Hurst, in contrast, defines the vulnerable as those especially at risk of incurring the wrongs to which all research ethics participants are exposed. We offer a more substantive conception of vulnerability than Luna but one that gives rise to a different rubric of responsibilities from Hurst's. While we understand vulnerability to be an ontological condition of human existence, in the context of research ethics, we take the vulnerable to be research subjects who are especially prone to harm or exploitation. Our analysis rests on developing a typology of sources of vulnerability and showing how distinct sources generate distinct obligations on the part of the researcher. Our account emphasizes that the researcher's first obligation is not to make the research participant even more vulnerable than they already are. To illustrate our framework, we consider two cases: that of a vulnerable population involved in international research and that of a domestic population of people with diminished capacity. (shrink)

Simons offers a unique perspective on Beauvoir's wide-ranging contribution to twentieth-century thought. She details the discovery of the origins of Beauvoir's existential philosophy in her handwritten diary from 1927; uncovers evidence of the sexist exclusion of Beauvoir from the philosophical canon; reveals evidence that the African-American writer Richard Wright provided Beauvoir with the theoretical model of oppression that she used in The Second (...) Sex; shows the influence of The Second Sex in transforming Sartre's philosophy and in laying the theoretical foundations of radical feminism; and addresses feminist issues of racism, motherhood, and lesbian identity. Simons also draws on her experience as a Women's Liberation organizer as she witnessed how women used The Second Sex in defining the foundations of radical feminism. We provide a novel defense of the possibility of level-splitting beliefs and use this defense to show that the steadfast response to peer disagreement is not, as it is often claimed to be, unnecessarily dogmatic. To provide this defense, a neglected form of moral disagreement is analysed. Within the context of this particular kind of moral disagreement, a similarly neglected form of level-splitting belief is identified and then defended from critics of the rationality of level-splitting beliefs. The chapter concludes by (...) showing that proponents of the steadfast response to peer disagreement can adopt this form of level-splitting belief in the context of these moral disagreements while exemplifying intellectual humility, rather than dogmatism.
