In this paper, I draw a distinction between two fundamentally different kinds of commitments by highlighting some previously unnoticed subtleties in the pragmatics of “commissive” utterances. I argue that theories which seek to model all commitments on promises, or to ground them all on voluntary consent, can account only for one sort of obligation and not for the other. Since social groups are most perspicuously categorized in terms of the sorts of commitments that bind their members together, this puts me (...) in a position to distinguish two importantly different kinds of social groups, which I call aggregations and associations. I try to show that this position can account for features of the normative structure of social groups that are overlooked by those theorists (e.g. Margaret Gilbert) who have attempted to offer a unitary, voluntarist account of the phenomena under investigation. The author develops and elaborates on her account of collective belief, something standardly referred to, in her view, when we speak of what we believe. This paper focuses on a special response hearers may experience in the context of expressions of belief, a response that may issue in offended rebukes to the speaker. It is argued that this response would be appropriate if both speakers and hearers were parties to what the authors calls a joint commitment to believe a certain (...) proposition as a body. This joint commitment puts speakers under an obligation to refrain from speaking in certain ways, and gives hearers a correlative right to such refraining, and hence a basis for offended rebukes. This paper challenges the common assumption that an agreement is an exchange of promises. Proposing that the performance obligations of some typical agreements are simultaneous, interdependent, and unconditional, it argues that no promise-exchange has this structure of obligations. In addition to offering general considerations in support of this claim, it examines various types of promise-exchange, showing that none satisfy the criteria noted. Two forms of conditional promise are distinguished and both forms are discussed. A positive account of agreements as joint (...) decisions founded in a joint commitment is sketched. A feature of David Lewis's account of conventions in his book "Convention" which has received admiring notices from philosophers is his use of the mathematical theory of games. In this paper I point out a number of serious flaws in Lewis's use of game theory. Lewis's basic claim is that conventions cover 'coordination problems'. I show that game-Theoretical analysis tends to establish that coordination problems in Lewis's sense need not underlie conventions.

A high level of citizen involvement in civic life is presumed crucial to the well-being of democracy, but the actual discourse of citizen involvement has rarely been analyzed. This article analyzes citizen participation in the school board meetings of one US community that was in the midst of conflict. After providing background on education governance practices and the community that was studied, citizen participation is examined. Citizen commentaries at school board meetings are shown to be a distinct speech genre and (...) the genre is described. Then, we characterize the discourse practices used to express negative sentiment. Feeling-limned description, avowal of feelings, rhetorical questions, reported speech, use of god and devil terms, and using meeting rules as weapons were the main negative sentiment strategies. In the conclusion we suggest when low levels of citizen involvement should be acceptable, and why `reasonable hostility' is a desirable form of citizen expression. (shrink)

Many have asked how and why feminist theory makes a distinctive contribution to bioethics. In this essay, I outline two ways in which feminist reflection can enrich bioethical studies. First, feminist theory may expose certain themes of androcentric reasoning that can affect, in sometimes crude but often subtle ways, the substantive analysis of topics in bioethics; second, it can unearth the gendered nature of certain basic philosophical concepts that form the working tools of ethical theory.

This article examines two modalities of law, depicted spatially as the vertical and the horizontal. The intellectual background for seeing law in vertical and horizontal dimensions is to be found in much socio-legal scholarship. These approaches have challenged the modernist, legal positivist and essentially vertical view of law as a system of imperatives emanating from a hierarchically superior source such as a sovereign. In keeping with the socio-legal critical tradition, but approaching it from the perspective of legal philosophy, my aim (...) is to address three matters. First, why is vertical law problematic for feminists? Second, what are the theoretical characteristics of law in its horizontal register? Third, how is an appreciation of this ‘flat’ law useful for feminist legal theory and practice? In particular, I consider the ways in which feminist legal theory operating in the horizontal dimension can transgress, without transcending, the vertically determined perimeters of the nation state. A number of prominent royalists during the mid-seventeenth century British Civil Wars expended quite some effort in the collection of medical recipes, including Queen Henrietta Maria herself, as well as William and Margaret Cavendish, and the Talbot sisters—Elizabeth Grey and Alethea Howard. This essay looks at these Royalists and four of their collections: three (...) published (Henrietta Maria, Grey, Howard), and one manuscript (the Caven­dishes), in order to determine how they conceptualized experience and its role in medical practice. The claim that such recipe collections represent a new, anti-Aristotelian idea of experience as a specific, particular event is disputed through a quantitative and qualitative analysis of these collections. Instead, it is argued that there a number of related conceptions of experience found in these Royalist recipe collections, but the basic idea is one where experience indicates long experience or expertise, an idea that can traced back at least to humanist medicine of the Renaissance, and likely back to Galen. Can it ever be appropriate to feel guilt just because one's group has acted badly? Some say no, citing supposed features of guilt feelings as such. If one understands group action according to my plural subject account of groups, however, one can argue for the appropriateness of feeling guilt just because one's group has acted badly - a feeling that often occurs. In so arguing I sketch a plural subject account of groups, group intentions and group actions: for a group (...) to intend (in the relevant sense) is for its members to be jointly committed to intend that such-and-such as a body. Individual group members need not be directly involved in the formation of the intention in order to participate in such a joint commitment. The core concept of joint commitment is in an important way holistic, not being reducible to a set of personal commitments over which each party holds sway. (shrink)

These differ in many aspects and this requires the testing of new hypotheses to explain -/- La présente contribution traite de la nécessité d’étudier les pratiques d’enseignement à partir du constat de ce qu’elles sont au delà de ce qu’elles devraient être. Cette tâche dévolue aux chercheurs en sciences de l’éducation vise à mieux connaître les pratiques d’enseignement dans leurs relations aux apprentissages des élèves afin de constituer la base de données utiles aux formateurs d’enseignants et nécessaire à toute réflexivité des enseignants à propos de leur propre pratique. Les notions de compétence, de schème et d’instrument sont utiles à cette entreprise d’explication et de compréhension des pratiques. La proposition de cadrage théorique est illustrée par une mise en perspective des pratiques d’enseignement de professeurs des écoles et de collèges. This volume examines the influence that Epicureanism and Stoicism, two philosophies of nature and human nature articulated during classical times, exerted on the development of European thought to the Enlightenment. Although the influence of these philosophies has often been noted in certain areas, such as the influence of Stoicism on the development of Christian thought and the influence of Epicureanism on modern materialism, the chapters in this volume forward a new awareness of the degree to which these philosophies and their (...) continued interaction informed European intellectual life well into early modern times.
