“Excited Delirium Syndrome” (ExDS) is a controversial diagnosis. The supposed syndrome is sometimes considered to be a potential cause of death. However, it has been argued that its sole purpose is to cover up excessive police violence because it is mainly used to explain deaths of individuals in custody. In this paper, we examine the epistemic conditions giving rise to the controversial diagnosis by discussing the relation between causal hypotheses, evidence, and data in forensic medicine. We argue that the practitioners’ (...) social context affects causal inquiry through background assumptions that enter inquiry at multiple stages. Este artigo mostra que não há uma tese de subdeterminação de teorias científicas pelos indícios observacionais, mas várias. Identificamos quatro, com significados, plausibilidades e implicações distintos. Mostra-se que as mais fortes não passam de conjeturas, e que as mais fracas são mais plausíveis, mas não possuem implicações filosóficas robustas – em particular, não implicam o antirrealismo científico –, embora forneçam indícios de alternativas teóricas sistematicamente ignoradas na ciência, bem como do emprego de critérios em parte valorativos de escolha de teorias.

This paper provides an exposition of the structuralist approach to underdetermination, which aims to resolve the underdetermination of theories by identifying their common theoretical structure. Applications of the structuralist approach can be found in many areas of philosophy. I present a schema of the structuralist approach, which conceptually unifies such applications in different subject matters. It is argued that two classic arguments in the literature, Paul Benacerraf’s argument on natural numbers and W. V. O. Quine’s argument for the indeterminacy of (...) translation, can be analyzed as instances of the structuralist schema. These two applications illustrate different kinds of conclusions that can be drawn through the structuralist approach; Benacerraf’s argument shows that we can derive an ontological conclusion about the given subject matter, while Quine’s structuralist approach leads to a semantic conclusion about how to determine linguistic meanings given radical translation. Then, as a case study, I review a recent debate in metaphysics between Shamik Dasgupta, Jason Turner, and Catharine Diehl to consider the extent to which different instances of the structuralist schema are conceptually unified. Both sides of the debate can be interpreted as utilizing the structuralist approach; one side uses the structuralist approach for an ontological conclusion, while the other side relies on a semantic conclusion. I argue that this has a strong dialectical consequence, which sheds light on the conceptual unity of the structuralist approach. (shrink)

One of the reasons for relativistic attitudes toward science is the impossibility of justifying scientists’ decisions in the face of alternative theories. According to this paper, an alternative theory can challenge scientific rationality only if the conditions of “methodological shortcomings of scientists” and the “existence of alternative theories” are met at a specific time. A commonly used technique to counter relativism is to try to supplement and equip scientists’ methodologies when confronted with alternative theories. However, this paper focuses on evaluating (...) the possibility of “existence an alternative theory.” To this end, by referring to the different definitions of being alternative, we try to show that only “after the decision” and “the conversion of the scientific community” can a theory be considered justifiably “alternative.” Therefore, the relativistic claim is inconsistent because relativists must first accept the validity of scientists’ decisions to attribute being alternative to a theory. In this work, we provide evidence for our claim using a historical example. We also defend conservatism as a corollary of our discussion. (shrink)

This article introduces a dilemma regarding conceptual schemes and suggests a solution. The dilemma is about whether there are conceptual schemes or not. There are good reasons for maintaining either position. There must be conceptual schemes because theory is underdetermined by evidence. And there cannot be conceptual schemes because Davidson has given an almost unassailable argument against it. I resolve the dilemma by arguing that Davidson’s argument is based on a false dilemma generated by too strong a principle of charity. (...) One way of trying to justify the thesis of the underdetermination of scientific theories is by actual examples. In this paper, I present a paradox which arises from trying to justify the thesis in this way.

The volume of literature on taphonomic modifications to faunal remains created by a particular animal species in an actualistic neotaphonomic (ANT) context has grown rapidly since the 1960s. A sample of 454 investigations on the taphonomic traces created by bone modifying animal species published starting in 1911 and through mid-2018 includes studies of 115 species of mammal and 78 species of bird. The most frequently studied bone modifying mammal species is spotted hyaena (Crocuta crocuta) and the most studied bird is (...) barn owl (Tyto alba). One-hundred seventy two of 609 individuals (28.2%) have authored more than one investigation. One-hundred eight of 417 texts (25.9%) compare faunal remains accumulated and modified by ≥ 2 species in an effort to establish signature criteria—modifications to carcasses and bones diagnostic of a particular bone modifying species. Two hundred and four texts (of 417 [48.9%]) document how one or more animal species modify bones, many with the unelaborated warrant that such documentation has paleozoological implications. Commonly reported variables include the kinds of modifications to bones (238 of 417 [57.1%] texts) and skeletal part frequencies (217 of 417 [52.0%] texts). Thoughtful consideration of taphonomic variables chosen for measurement and construction of interpretive models having dynamic sufficiency (the model includes the correct processes and variables to account for the field of inquiry), empirical sufficiency (included variables can be measured in the real world), and agreed upon tolerance limits (the model matches the empirical record sufficiently closely to be analytical useful) will enhance the value of ANT research.
