This volume continues the examination of issues of life and death which F.M. Kamm began in 'Morality, Mortality, ' Volume I (1993). Kamm continues her development of a non-consequentialist ethical theory and its application to practical ethical problems.

Recent debates on phenomenal consciousness have shown renewed interest for the idea that experience generally includes an experience of the self – a self-experience – whatever else it may present the self with. When a subject has an ordinary experience (as of a bouncing red ball, for example), the thought goes, she is not just phenomenally aware of the world as being presented in a certain way (a bouncy, reddish, roundish way in this case); she is also phenomenally aware of (...) the fact that it is presented to her. This supposed phenomenal dimension has been variously called “mineness”, “for-me-ness”, “pre-reflective self-awareness” and “subjective character”, among others. This view, associated with historical figures such as William James, Husserl, Merleau-Ponty and Sartre, is attracting a new surge of attention at the crossroads of phenomenology, analytic philosophy of mind and the philosophy of cognitive science, but also intense controversy. This book explores some of the questions running through the ongoing debate on the putative subjective dimension of experience: Does it exist?, the existence question; What is it?, the essence question; What is it for?, the function question; and What else does it explain?, the explanation question. The volume also surveys various domains of human experience, both normal and pathological, where a “sense of self” might be at play, including agency, bodily awareness, introspection, memory, emotions and values, and offers insights into the possible relations between the notions of subjective awareness involved. The first part of the book is devoted to more sceptical or deflationary views about self-experience, and the second, to more robust ones. (shrink)

Is part of a perfectly natural, or fundamental, relation? Philosophers have been hesitant to take a stand on this issue. One reason for this hesitancy is the worry that, if parthood is perfectly natural, then the perfectly natural properties and relations are not suitably “independent” of one another. In this paper, I argue that parthood is a perfectly natural relation. In so doing, I argue that this “independence” worry is unfounded. AimsThis study evaluates a protocol for early, routine ethics consultation for patients on extracorporeal membrane oxygenation to support decision-making in the context of clinical uncertainty with the aim of mitigating ethical conflict and moral distress.MethodsWe conducted a single-site qualitative analysis of EC documentation for all patients receiving ECMO support from 15 August 2018 to 15 May 2019. Detailed analysis of 20 ethically complex cases with protracted ethics involvement identifies four key ethical domains: limits of prognostication, bridge to nowhere, burden of (...) treatment and system-level concerns. There are three subthemes: relevant contextual factors, the role of EC and observed outcomes. Content analysis of transcripts from interviews with 20 members of the multidisciplinary ECMO team yields supplemental data on providers’ perceptions of the impact of the early intervention protocol.ResultsLimited outcome data for ECMO, unclear indications for withdrawal, adverse effects of treatment and an obligation to attend to programme metrics present significant ethical challenges in the care of this patient population. Upstream EC mitigates ethical conflict by setting clear expectations about ECMO as a time limited trial, promoting consistent messaging among multiple services and supporting surrogate decision-makers. When ECMO becomes a ‘bridge to nowhere’, EC facilitates decision-making that respects patient values yet successfully sets limits on non-beneficial use of this novel therapy.ConclusionData from this study support the conclusion that ECMO poses unique ethical challenges that necessitate a standardised protocol for early, routine EC—at least while this medical technology is in its nascent stages. According to the hypothesis of extended phenomenal consciousness, although the material vehicles that realize phenomenal consciousness include neural elements, they are not restricted to such elements. There will be cases in which those material vehicles additionally include not only non-neural bodily elements, but also elements located beyond the skull and skin. In this paper, I examine two arguments for ExPC, one due to Noë and the other due to Kiverstein and Farina. Both of these arguments conclude that ExPC is true (...) on the basis of an analysis of sensory substitution, the phenomenon in which technological augmentation enables one sensory modality, for instance touch, to support the kind of environmental access and interaction ordinarily supported by a different sensory modality, for instance vision. I develop considerations which reveal that, as they stand, both of these arguments fall short. If the phenomenon of sensory substitution provides evidence for the truth of ExPC, it is not because of the specific arguments offered by these authors. (shrink)

In ordinary circumstances, human actions have a myriad of unintended and often unforeseen consequences for the lives of other people. Problems of pollution are serious examples, but spillovers and side effects are the rule, not the exception. Who knows what consequences this essay may have? This essay is concerned with the problems of justice created by spillovers. After characterizing such spillovers more precisely and relating the concept to the economist's notion of an externality, I shall then consider the moral conclusions (...) concerning spillovers that issue from a natural rights perspective and from the perspective of welfare economics supplemented with theories of distributive justice. I shall argue that these perspectives go badly awry in taking spillovers to be the exception rather than the rule in human interactions. I. Externalities Economists have discussed spillovers under the heading of “externalities.” To say this is not very helpful, since there is so much disagreement concerning both the definition and significance of externalities. Many contemporary logicians acknowledge a plurality of logical theories and accept that theory choice is in part motivated by logical evidence. However, just as there is no agreement on logical theories, there is also no consensus on what constitutes logical evidence. In this paper, I outline Jean Piaget’s psychological theory of reasoning and show how he used it to diagnose and solve one of the paradoxes of material implication. I assess Piaget’s use of psychology as a source of evidence for (...) logical theory in light of reservations raised by psychologism, and I highlight some ramifications for exceptionalism and anti-exceptionalism about logic by considering his use of psychology as logical evidence in the framework of genetic epistemology, Piaget’s research programme. I conclude that Piaget’s psychological theory of reasoning not only plausibly serves as a source of evidence for logical theory but also makes a strong case for anti-exceptionalism about logic. M. Hakan Yavuz offers an insightful and wide-ranging study of the Gulen Movement, one of the most controversial developments in contemporary Islam. Founded in Turkey by the Muslim thinker Fethullah Gulen, the Gulen Movement aims to disseminate a ''moderate'' interpretation of Islam through faith-based education.

Restorative justice should have greater weight as a criterion in criminal justice sentencing practice. It permits a realistic recognition of the kinds of harm and damage caused by offences, and encourages individualized non-custodial sentencing options as ways of addressing these harms. Non-custodial sentences have proven more effective than incarceration in securing social reconciliation and preventing recidivism, and they avoid the serious social and personal costs of imprisonment. This paper argues in support of restorative justice as a guiding idea in sentencing. (...) As part of this defence, it considers whether the use of the idea of restorative justice will conflate criminal law with civil law or displace the authority of the criminal courts, and whether the sentences it recommends are best thought of as punishments or alternatives to punishment. The present study seeks to lay out the most basic elements of the ontology of classical Aš‘arite theology. In several cases this requires a careful examination of the traditional and the formal lexicography of certain key expressions. The topics primarily treated are: how they understood “Being/ existence” and “being/existent” and essential natures; the systematic exploitation of the equivocities of certain expressions within a general context in which other than words there are no universals proves to be elegant as well as (...) insightful; the basic categories of primary entities: independant beings and nonindependant beings, created and uncreated, the equivocity of “being/existent” as predicated of contingent entities on the one hand and of God and His attributes on the other, and certain problems that arise because of the rigid application of the system's underlying analytic principles. Nous essayons ici de presenter les éléments fondamentaux de l'ontologie de l'aš‘arisme classique. Pour quelques expressions, il a fallu examiner la lexicographie et ordinaire et technique pour bien comprendre leur emploi et leur signification. "My work has had nothing to do with gay liberation," Michel Foucault reportedly told an admirer in 1975. And indeed there is scarcely more than a passing mention of homosexuality in Foucault's scholarly writings. So why has Foucault, who died of AIDS in 1984, become a powerful source of both personal and political inspiration to an entire generation of gay activists? And why have his political philosophy and his personal life recently come under such withering, normalizing scrutiny by commentators as (...) diverse as Camille Paglia, Richard Mohr, Bruce Bawer, Roger Kimball, and biographer James Miller? David M. Halperin's Saint Foucault is an uncompromising and impassioned defense of the late French philosopher and historian as a galvanizing thinker whose career as a theorist and activist will continue to serve as a model for other gay intellectuals, activists, and scholars. A close reading of both Foucault and the increasing attacks on his life and work, it explains why straight liberals so often find in Foucault only counsels of despair on the subject of politics, whereas gay activists look to him not only for intellectual inspiration but also for a compelling example of political resistance. Halperin rescues Foucault from the endless nature-versus-nurture debate over the origins of homosexuality and argues that Foucault's decision to treat sexuality not as a biological or psychological drive but as an effect of discourse, as the product of modern systems of knowledge and power represents a crucial political breakthrough for lesbians and gay men. Halperin explains how Foucault's radical vision of homosexuality as a strategic opportunity for self-transformation anticipated the new anti-assimilationist, anti-essentialist brand of sexual identity politics practiced by contemporary direct-action groups such as ACT UP. Halperin also offers the first synthetic account of Foucault's thinking about gay sex and the future of the lesbian and gay movement, as well as an up-to-the-minute summary of the most recent work in queer theory. "Where there is power, there is resistance," Michel Foucault wrote in The History of Sexuality, Volume I. Erudite, biting, and surprisingly moving, Saint Foucault represents Halperin's own resistance to what he views as the blatant and systematic misrepresentation of a crucial intellectual figure, a misrepresentation he sees as dramatic evidence of the continuing personal, professional, and scholarly vulnerability of all gay activists and intellectuals in the age of AIDS. City archives, mined by Aristotle for his Didaskaliai, preserved a reasonably complete record of dramatic productions in the fifth century. But how far back did these archives go? The so-called Fasti, an inscription set up c. 346 and listing dithyrambic, comic and tragic victors year by year, must have been based on the same archives, but went back, it is thought, only as far as 502/1. Its heading πρ]τον κμοι ἦσαν τ[ι διονσ]ωι τραγωιδο δ[, however supplemented, implies an intention of (...) going back to the beginning of things, in other words to the beginning of the archival record. This raises serious doubt as to whether that record went back to the alleged date of Thespis' première, or indeed to those given for Choerilus' and Phrynichus'. (shrink)

We extend the framework of Inductive Logic to Second Order languages and introduce Wilmers' Principle, a rational principle for probability functions on Second Order languages. Originally published in 1988, M.C. Dillon's classic study of Merleau-Ponty is now available in a revised second edition containing a new preface and a new chapter on "Truth in Art." Dillon's thesis is that Merleau-Ponty has developed the first genuine alternative to ontological dualism seen in Western philosophy. From his early work on the philosophical significance of the human body to his later ontology of flesh, Merleau-Ponty shows that the perennial problems growing out of dualistic conceptions of mind and body, (...) subject and object, immanence and transcendence can be resolved within the framework of a new way of thinking based on the exemplar of the worldly embodiment of thought. Marjorie Grene has argued in a number of contexts that any attempt to reduce the explanation of human actions to “mechanistic” explanations is doomed to failure in advance because it is absurd. “This argument examines the status of the reductivist thesis in its own terms and reduces it to absurdity …” ; “the attempt to reduce human purposive, or ‘intentional,‘ action to physiology and ultimately to physics and chemistry is an absurdity rather than simply a confusion”. I wish to show (...) that this argument is fallacious because it involves a petitio principii; and if Plato can be credited with introducing the same argument in the Theaetetus, as she suggests, so much the worse for Plato. One finds the main ideas ‘Kammouflaged’ because the relevant causal distinctions are so fine-grained and the cases that illustrate them so numerous. Some say that they do not have the intuitions about many cases that I have, that I concoct dubious and ad hoc distinctions and invest them with moral significance; I am Ptolemaic in that new crystalline spheres and epicycles are constantly being added in an attempt to fix (...) the appearances. M. F. Burnyeat taught for 14 years in the Philosophy Department of University College London, then for 18 years in the Classics Faculty at Cambridge, 12 of them as the Laurence Professor of Ancient Philosophy, before migrating to Oxford in 1996 to become a Senior Research Fellow in Philosophy at All Souls College. The studies, articles and reviews collected in these two volumes of Explorations in Ancient and Modern Philosophy were all written, and all but two published, before that decisive (...) change. Whether designed for a scholarly audience or for a wider public, they range from the Presocratics to Augustine, from Descartes and Bishop Berkeley to Wittgenstein and G. E. Moore. Their subject-matter falls under four main headings: 'Logic and Dialectic' and 'Scepticism Ancient and Modern', which are contained in this first volume; 'Knowledge' and 'Philosophy and the Good Life' make up the second volume. The title 'Explorations' well expresses Burnyeat's ability to discover new aspects of familiar texts, new ways of solving old problems. In his hands the history of philosophy becomes itself a philosophical activity. (shrink)

: The aim of the present paper is to discuss how the legal metaphors in Kant’s Critique of Pure Reason can help us understand the work’s transcendental argumentation. I discuss Dieter Henrich’s claim that legal deductions form a methodological paradigm for all three Critiques that exempts the deductions from following a stringent logical structure. I also consider Rüdiger Bubner’s proposal that the legal metaphors show that the transcendental deduction is a rhetorical argument. On the basis of my own reading of (...) the many different uses of legal analogies in the first Critique, I argue that they cannot form a consistent methodological paradigm as Henrich and Bubner claim. Dillon LOVE IN WOMEN IN LOVE: A PHENOMENOLOGICAL ANALYSIS Despite his sexism, his turgid prose, and his antiquated social conscience, Lawrence is on every bookshelf. This is not merely because of the vicarious erotic entertainment to be found in the saga of John Thomas and Lady Jane, but because Lawrence remains a major guru of romance. We take him seriously, look to him for guidance, measure ourselves (...) against Ursula and Birkin. If he is on our shelves—and his thoughts not far from our pillows—then his ideas starid in need of scrutiny. Women in Love is as much a treatise as a novel: we witness more talking about than making of love. The agon of ideas engulfs the agon of flesh. Hence, the book suits the present purpose. It cannot be taken as Lawrence's definitive statement on love—later works, notably Lady Chatterly's Lover, move in different directions—but it is his most philosophical treatment and, I think, most clearly expresses his conceptual framework, the parameters which define and limit his thinking. What he says about love in Women in Love may therefore illumine his depictions of the behavior of lovers in other works. Lawrence is a romantic. In the popular sense of the word he is one who makes of romance or erotic adventure a dominant life value. Lawrence is also a romantic in another sense insofar as he takes the transcendence or unattainability of the other as essential to the project of loving. These two senses are conceptually compatible but existentially in conflict. That is, if one's major undertaking in life is to seek erotic satisfaction, and if one desires only so long as the object is beyond reach, then one has established the groundwork for continual frustration. This, I will try to show, is what Lawrence has done. I Many writers have tried to bring the ideas implicitly present in and constitutive of romantic love to the level of explicit reflective awareness. 190 M.C.Dillon191 The most successful treatment I know is given by a writer who did not know—or at least did not say—that he was writing about romantic love. Sartre purports to reveal the inner structures of love itself—the unqualified, unrestricted essence of love. As I have tried to show elsewhere,1 he fails at this. But he succeeds admirably in unveiling the inner contradictions of romantic love. Our project here is to draw upon Sartre's insights: first, to develop a conception of romantic love, and then to discern the model of Eros which informs Women in Love. The key idea in romantic love is transcendence. Something is transcendent when it is beyond me, when I cannot adequately prehend it conceptually or master it with my will. The role of transcendence in romantic love is demonstrated clearly in Denis de Rougemont's book on Love in the Western World.2 There he shows that Tristan's passion for Iseult is directly proportional to her distance from him: he is increasingly attracted as she becomes further removed. On the other hand, when through various deeds of gallantry and subterfuge, he succeeds in winning her to his side, he loses interest and must create circumstances which put her again beyond his reach. The culmination of romantic love, according to de Rougemont, is death—it sets the other absolutely beyond reach. It also arrests and preserves at their apices the youth and beauty of the lovers and the intensity of the erotic relationship. It is, I believe, this complex of ideas that led Kierkegaard to this cynical reflection on the nature of romantic love: "When two beings fall in love with one another and begin to suspect that they were made for each other, it is time to have the courage to break it off; for by going on they have everything to lose and nothing to gain."3 The same idea, qualified by increased optimism, underlies Stendhal's notion of crystallization in his book On Love.* Love is predicated on the attribution of perfection to the beloved.
