Aliás, das inúmeras qualidades do trabalho, talvez possa destacar a abordagem inovadora e corajosa como a que mais me chamou a atenção. Há algum tempo venho me manifestando no sentido da necessidade de uma maior integração entre o processo civil e as outras ciências que tangenciam o Direito. É certo que já houve grande evolução em nossa disciplina, desde a concretização dos Movimentos de Acesso à Justiça e da aceitação uniforme dos conceitos de Processo Justo, Garantias Fundamentais e, sobretudo, de (...) um Processo Civil Constitucionalizado. Ocorre que os problemas da atualidade vêm demonstrando ser necessário um nível ainda maior de interdisciplinaridade, extrapolando os limites do Direito e ingressando em ciências conexas como a filosofia, a sociologia, a psicanálise e a ciência política. (...) Nessa linha de raciocínio, trabalhos como este, de autoria do Roberto Darós, trazem uma inestimável contribuição a essa nada fácil tarefa. Dialogar com a filosofia, a partir dos conceitos mais relevantes cunhados por dois dos maiores filósofos do mundo moderno - Habermas e Dworkin - já seria um trabalho árduo. Identificar os pontos de interseção entre o direito processual civil e a filosofia, a partir das obras desses Mestres, e trazer conclusões concretas para as questões do Estado Democrático de Direito, é realmente algo corajoso. Polygynous families had been living legally in Russia in the areas inhabited by Muslims from the October Revolution to the mid-twentieth century. However, such a family model was not common among the followers of Islam. An act penalizing bigamy or polygamy was introduced into the Penal Code in 1960. During perestroika, and later changes in the political system, imams who came from abroad began to visit areas inhabited by Muslims. They contributed to the rebirth of religion and promoted the idea (...) of polygamy. Polygyny is the visible sign of dissimilarity and Muslim identity and was an important point in their teaching. In this context the number of polygynous relationships in Russia has increased significantly. The article is dedicated to the analysis of social and political discourse in Russia that has been taking place for several years. (shrink)

Der französische Philosoph Michel Serres ist am 1. Juni 2019 verstorben. Er hat etwa 50 Monographien veröffentlicht. Recent developments in biotechnology and genetic research are raising complex ethical questions concerning the legitimate scope and limits of genetic intervention. As we begin to contemplate the possibility of intervening in the human genome to prevent diseases, we cannot help but feel that the human species might soon be able to take its biological evolution in its own hands. 'Playing God' is the metaphor commonly used for this self-transformation of the species, which, it seems, might soon be within our grasp. (...) In this important new book, Jurgen Habermas - the most influential philosopher and social thinker in Germany today - takes up the question of genetic engineering and its ethical implications and subjects it to careful philosophical scrutiny. His analysis is guided by the view that genetic manipulation is bound up with the identity and self-understanding of the species. We cannot rule out the possibility that knowledge of one's own hereditary factors may prove to be restrictive for the choice of an individual's way of life and may undermine the symmetrical relations between free and equal human beings. The aim of this paper is to elaborate on the phenomenological approach to expertise as proposed by Dreyfus and Dreyfus and to give an account of the extent to which their approach may contribute to a better understanding of how athletes may use their cognitive capacities during high-level skill execution. Dreyfus and Dreyfus's non-representational view of experience-based expertise implies that, given enough relevant experience, the skill learner, when expert, will respond intuitively to immediate situations with no recourse to deliberate actions (...) or mental representations. The paper will subsequently outline some implications and consequences of such an approach and will also examine to what extent Dreyfus and Dreyfus's skill model is capable to resist different attacks that have been made against their view, and in particular regarding the practical application of their approach to the skill domain of competitive sport. In these essays, Habermas explores the relations between Christian and Jewish thought, on one hand, and the Western philosophical tradition on the other. Two countervailing trends mark the intellectual tenor of our age the spread of naturalistic worldviews and religious orthodoxies. Advances in biogenetics, brain research, and robotics are clearing the way for the penetration of an objective scientific self-understanding of persons into everyday life. For philosophy, this trend is associated with the challenge of scientific naturalism. At the same time, we are witnessing an unexpected revitalization of religious traditions and the politicization of religious communities across the world. From a philosophical perspective, this (...) revival of religious energies poses the challenge of a fundamentalist critique of the principles underlying the modern Wests postmetaphysical understanding of itself. The tension between naturalism and religion is the central theme of this major new book by Jrgen Habermas. On the one hand he argues for an appropriate naturalistic understanding of cultural evolution that does justice to the normative character of the human mind. On the other hand, he calls for an appropriate interpretation of the secularizing effects of a process of social and cultural rationalization increasingly denounced by the champions of religious orthodoxies as a historical development peculiar to the West. These reflections on the enduring importance of religion and the limits of secularism under conditions of postmetaphysical reason set the scene for an extended treatment the political significance of religious tolerance and for a fresh contribution to current debates on cosmopolitanism and a constitution for international society.
