Aliás, das inúmeras qualidades do trabalho, talvez possa destacar a abordagem inovadora e corajosa como a que mais me chamou a atenção. Há algum tempo venho me manifestando no sentido da necessidade de uma maior integração entre o processo civil e as outras ciências que tangenciam o Direito. É certo que já houve grande evolução em nossa disciplina, desde a concretização dos Movimentos de Acesso à Justiça e da aceitação uniforme dos conceitos de Processo Justo, Garantias Fundamentais e, sobretudo, de (...) um Processo Civil Constitucionalizado. Ocorre que os problemas da atualidade vêm demonstrando ser necessário um nível ainda maior de interdisciplinaridade, extrapolando os limites do Direito e ingressando em ciências conexas como a filosofia, a sociologia, a psicanálise e a ciência política. (...) Nessa linha de raciocínio, trabalhos como este, de autoria do Roberto Darós, trazem uma inestimável contribuição a essa nada fácil tarefa. Dialogar com a filosofia, a partir dos conceitos mais relevantes cunhados por dois dos maiores filósofos do mundo moderno - Habermas e Dworkin - já seria um trabalho árduo. Identificar os pontos de interseção entre o direito processual civil e a filosofia, a partir das obras desses Mestres, e trazer conclusões concretas para as questões do Estado Democrático de Direito, é realmente algo corajoso. Der französische Philosoph Michel Serres ist am 1. Juni 2019 verstorben. Er hat etwa 50 Monographien veröffentlicht. Die Bekanntheit der Vielfältigkeit seines Denkens in Deutschland zu fördern, ist Ziel dieses Bandes.0Die Vielfältigkeit des Denkens von Serres, das Vielfältige zu denken, wird in diesem Band aus unterschiedlichen wissenschaftlichen Perspektiven beleuchtet. Thematische Akzente sind u.a.: Gemische und Gemenge, das Parasitäre, Boten und Mittler, der Mensch in den Netzen und in seiner Körperlichkeit. Zusammenfassung Patientinnen und Patienten steht das Recht auf Behandlung nach ihren eigenen Vorstellungen auch dann zu, wenn sie aktuell keinen eigenen Willen bilden können. Advance Care Planning (ACP), als ein spezielles Verfahren der gesundheitlichen Vorsorgeplanung, zielt darauf ab, dieses Dilemma durch eine Willensbestimmung im Voraus aufzulösen. Besonders ausgebildete Gesprächsbegleiter*innen bieten an, bei der Ermittlung, Formulierung und Dokumentation eines solchen, die individuelle gesundheitliche Situation berücksichtigenden Willens zu helfen. Das Umfeld der Betroffenen soll in den Gesprächsprozess einbezogen und es soll organisatorisch gesichert (...) werden, dass deren Willensbestimmung den aktuell Behandelnden im Bedarfsfall faktisch zugänglich ist. Das Verfahren kombiniert also ein kommunikatives mit einem institutionellen Element. Aus ethischer Sicht stellen sich dabei zwei wesentliche Herausforderungen. Erstens erfordert Gesprächsbegleitung mit einem so komplexen Ziel Kompetenzen und setzt bestimmte Haltungen voraus, wie sie für Professionen im strengen Sinne typisch sind. Daher wäre es wichtig, entsprechende professionelle Normen explizit zu machen, beispielsweise in Form eines Berufs-Kodex. Zweitens muss das Verfahren trotz seiner institutionellen Form für die Betroffenen freiwillig sein. Dies ist entscheidend für die Validität des Prozesses, aber auch für dessen Ergebnis. Denn wenn Letzteres rechtlich bindend sein soll, müssen die Betroffenen freiverantwortlich, d. h. ohne sog. Willensmängel handeln können. Es ist deshalb ethische Pflicht, beim Eintritt in und im Verlauf der Beratung auf die Freiwilligkeit zu achten. (shrink)

2018 waren weltweit 50 Mio. Menschen von einer Demenz betroffen. Demenz ist sowohl aus sozialer als auch aus ökonomischer Sicht eine Herausforderung für die Gesellschaft. Ein Ziel der Alzheimer-Forschung ist u. a., einen Impfstoff gegen Alzheimer herzustellen. Bisher ohne Erfolg. Dennoch ist früher oder später ein Durchbruch zu erwarten. Welchen sozialen und ethischen Herausforderungen sich die Gesellschaft dann aber aufgrund der Impfung gegen Alzheimer stellen muss, wird im vorliegenden Text diskutiert. In Anlehnung an die aktuelle Impfdebatte werden Fragen zwischen Autonomie (...) des Einzelnen und Verantwortung gegenüber der Gesellschaft betrachtet, sowie das Ziel einer Durchimpfungsrate und die damit möglicherweise verbundene Impfpflicht, das Recht auf Nicht-Wissen und das Recht auf Krankheit. Der Beitrag zeigt, dass eine Alzheimer-Impfung eine Vielzahl von ethischen Herausforderungen implizieren würde. (shrink)

As we begin to contemplate the possibility of intervening in the human genome to prevent diseases, we cannot help but feel that the human species might soon be able to take its biological evolution in its own hands. 'Playing God' is the metaphor commonly used for this self-transformation of the species, which, it seems, might soon be within our grasp. (...) In this important new book, Jurgen Habermas - the most influential philosopher and social thinker in Germany today - takes up the question of genetic engineering and its ethical implications and subjects it to careful philosophical scrutiny. His analysis is guided by the view that genetic manipulation is bound up with the identity and self-understanding of the species. We cannot rule out the possibility that knowledge of one's own hereditary factors may prove to be restrictive for the choice of an individual's way of life and may undermine the symmetrical relations between free and equal human beings. In the concluding chapter - which was delivered as a lecture on receiving the Peace Prize of the German Book Trade for 2001 - Habermas broadens the discussion to examine the tension between science and religion in the modern world, a tension which exploded, with such tragic violence, on September 11th. Two countervailing trends mark the intellectual tenor of our age the spread of naturalistic worldviews and religious orthodoxies. Advances in biogenetics, brain research, and robotics are clearing the way for the penetration of an objective scientific self-understanding of persons into everyday life. For philosophy, this trend is associated with the challenge of scientific naturalism. At the same time, we are witnessing an unexpected revitalization of religious traditions and the politicization of religious communities across the world. From a philosophical perspective, this (...) revival of religious energies poses the challenge of a fundamentalist critique of the principles underlying the modern Wests postmetaphysical understanding of itself. The tension between naturalism and religion is the central theme of this major new book by Jrgen Habermas. On the one hand he argues for an appropriate naturalistic understanding of cultural evolution that does justice to the normative character of the human mind. On the other hand, he calls for an appropriate interpretation of the secularizing effects of a process of social and cultural rationalization increasingly denounced by the champions of religious orthodoxies as a historical development peculiar to the West. These reflections on the enduring importance of religion and the limits of secularism under conditions of postmetaphysical reason set the scene for an extended treatment the political significance of religious tolerance and for a fresh contribution to current debates on cosmopolitanism and a constitution for international society. Comment saisir la diversité de ses intérêts, des théories de l'action et du langage à la morale et au droit? C'est aussi un acteur, qui intervient régulièrement dans la presse et les débats publics. Researchers sometimes engage in various forms of dishonesty and unethical behavior, which has led to regulatory efforts to ensure that they work according to acceptable standards. Such regulation is a difficult task, as research is a diverse and dynamic endeavor. Researchers can disagree about what counts as good and acceptable standards, and these standards are constantly developing. This paper presents and discusses recent changes in research integrity and ethics regulation in Norway, Denmark, and Sweden. Recognizing that research norms are developed (...) through practice and are therefore unsuited for comprehensive national regulation, the Scandinavian countries focus on empowering the research community to regulate itself instead, except for the most severe cases of misconduct. This empowerment takes the form of giving research institutions tools and investigatory powers while also holding them responsible for ensuring that both the institution and individual researchers are up to date on relevant norms. In this way, the Scandinavian governments seek to avoid some of the challenges found in more legalistic approaches, which risk lagging behind the continuous development of research norms and can be insensitive to the fact that different disciplines have different norms. While the new approach in Scandinavian has several potential benefits, it also involves potential trade-offs and limitations. The new laws can create confusion about what researchers are allowed to do. Another issue is that it only addresses the fundamental drivers of misconduct to a limited extent. (shrink)

Over the past 25 years, Jürgen Habermas has presented what is arguably the most coherent and wide-ranging defence of the project of European unification and of parallel developments towards a politically integrated world society. In developing his key concepts of the transnationalisation of democracy and the constitutionalisation of international law, Habermas offers the main players in the struggles over the fate of the European Union a way out of the current economic and political crisis, should they choose to follow it. The traditional square of opposition is generalized and extended to a cube of opposition covering and conveniently visualizing inter-sentential oppositions in relational syllogistic logic with the usual syllogistic logic sentences obtained as special cases. The cube comes about by considering Frege–Russell’s quantifier predicate logic with one relation comprising categorical syllogistic sentence forms.
