This book focuses on the ritualized forms of mobility that constitute phenomena of pilgrimage in South Asia and establishes a new analytical framework for the study of ritual journeys. The book advances the conceptual scope of 'classical' Pilgrimage Studies and provides empirical depth through individual case studies. A key concern is the strategies of ritualization through which actors create, assemble and (re-)articulate certain modes of displacement to differentiate themselves from everyday forms of locomotion. Ritual journeys are understood as being both (...) productive of and produced by South Asia's socio-economically uneven, politically charged and culturally variegated landscapes. From various disciplinary angles, each chapter explores how spaces and movements in space are continually created, contested and transformed through ritual journeys. Aliás, das inúmeras qualidades do trabalho, talvez possa destacar a abordagem inovadora e corajosa como a que mais me chamou a atenção. Há algum tempo venho me manifestando no sentido da necessidade de uma maior integração entre o processo civil e as outras ciências que tangenciam o Direito. É certo que já houve grande evolução em nossa disciplina, desde a concretização dos Movimentos de Acesso à Justiça e da aceitação uniforme dos conceitos de Processo Justo, Garantias Fundamentais e, sobretudo, de (...) um Processo Civil Constitucionalizado. Ocorre que os problemas da atualidade vêm demonstrando ser necessário um nível ainda maior de interdisciplinaridade, extrapolando os limites do Direito e ingressando em ciências conexas como a filosofia, a sociologia, a psicanálise e a ciência política. "Discourse ethics" attempts to reconstruct a moral point of view from which normative claims can be impartially judged. The theory of justice it develops replaces Kant's categorical imperative with a procedure of justification based on reasoned agreement among participants in practical discourse.Habermas connects communicative ethics to the theory of social action via an examination of research in the social psychology of moral and interpersonal development. I consider argumentation from the point of view of context-transcendent cognitive transformation through reference to the critical social theory of Jürgen Habermas. My aim is threefold. First, to make the case for a concept of context-transcendent cognitive transformation. Second, to clarify the transformatory role of argumentation itself by showing that, while argumentation may contribute constructively to context-transcendent cognitive transformation, such transformation presupposes the existence of a reality conceptually independent of argumentation. Third, to cast light on the problem of how (...) to justify argumentatively the poetically formulated, novel and innovative semantic contents that may be required for context-transcendent cognitive transformation. I conclude that the difficulties involved in argumentatively assessing novel and innovative semantic contents should not be misconstrued as evidence of an unbridgeable gap between language and experience but rather suggest the need for a more dynamic normative conception of language and for a more receptive model of autonomous agency. The present volume contains ten essays that provide an overview of Habermas's political thought since the original appearance of Between Facts and Norms in 1992 and extend his model of deliberative democracy in novel ways to issues untreated in the earlier work.Habermas's (...) theory of democracy has at least three features that set it apart from competing positions. First, it combines a concern with questions of normative justification with an empirical analysis of the social conditions necessary for the realization of democratic institutions. Second, at the heart of his model is the assertion of an internal relationship between liberalism and democracy. On this account, the rights of the individual that are central to liberalism can be guaranteed only within a constitutional framework that at the same time fosters democratic rights of political participation through the public sphere. Finally, Habermas defends a conception of universal human rights that is not only sensitive to cultural differences but also calls for legal and political institutions that facilitate the cultivation of cultural and religious identities within pluralistic societies.These essays demonstrate the extraordinary power of Habermas's theory of democracy through a further engagement with Rawls's political liberalism and through original contributions to current debates over nationalism, multiculturalism, and the viability of supranational political institutions. Ideals of democratic participation and rational self-government have long informed modern political theory. As a recent elaboration of these ideals, the concept of deliberative democracy is based on the principle that legitimate democracy issues from the public deliberation of citizens. Stethoscopes, x-rays and other medical technologies are two-edged swords. They make medical treatment and diagnosis more accurate and effective, but do at the same time reveal our perceptual inadequacy. By transcending our senses, these technologies reveal that we can be seriously diseased without experiencing any symptoms at all. This situation has changed our attitude towards our relations and ourselves. The situation can be analysed using Jürgen Habermas’ conception of systems colonisation of the lifeworld. Medical technologies colonise our life world. (...) They change the way we think and act. They make us all accept that we can become patients almost any minute, even if we feel perfectly healthy. This article provides a survey of key topics on just inheritance taxation. It does so by first presenting the main arguments in the debate. Here, I distinguish between arguments in the academic literature and the various arguments which have proven important in the public debate. Secondly, I outline four influential proposals when it comes to how inheritance should be taxed. Finally, I examine a recent controversy and point towards a number of themes that have not been sufficiently discussed.

Given the prominent position Habermas' philosophy has gained, it is surprising that his method, rational reconstruction, has not caused more debate. This article clarifies what this method consists of, and shows how it is used in two of Habermas' research programs. The method is an interesting, but problematic way of confronting some of the basic epistemological questions in the social sciences. It represents an alternative to both the empirical-analytical and the hermeneutic tradition. On the basis of this methodology, Habermas' work (...) is situated between the transcendental and the empirical approach. A fundamental problem is that it remains unclear how to test the hypothesis put forward through rational reconstruction. (shrink)

Jürgen Habermas’s theories have received enormous attention in the public sphere as well as in political science. It is therefore surprising that his method, rational reconstruction, is not more debated. In political science the method is of particular interest because of its ambition to bridge the gap between empirical and normative approaches. In this article the author traces Habermas’s interest in rational reconstruction by going back to his writings on theory and practice and subsequently shows what the method’s main principles (...) are. He then specifies how this methodological conception is used in Habermas’s political theory. Finally, the introduction of an empirical design allows the author to discuss one of the fundamental tensions in Habermas’s approach: the hypotheses arrived at through rational reconstruction are empirical hypotheses but cannot be tested by empirical means. Inherited wealth will be of increasing importance in years to come. Yet inheritance taxation is unpopular, and part of this unpopularity is due to family concerns. Such taxation is seen by many as morally problematic because it is taken to violate important family values. In this article, we explore five family arguments against inheritance taxation: firstly, whether we have a right to benefit our children; secondly, whether it is a virtue to benefit one's children; thirdly, whether children have a right (...) to their parent's belongings, due to common ownership; fourthly, whether inheritance taxation may impair a vital sense of continuity and belonging; and lastly, an argument from incentives that appeals specifically to the relation between parents and children. We conclude that none of the arguments provide strong objections against a moderate or even a high inheritance tax rate, at least not when special provisions are made for things like family houses or farms. However, since the arguments all introduce concerns that should be assigned some weight, it would be unjust to abolish inheritance entirely. (shrink)

In this article, an anthropological definition of literature is attempted. Since all communities seem to have some kind of literature (including its simple forms: myth, folktale, fable, proverb, and song), literature is claimed to be a human universal. Hence, literary discourse should be added to the four basic discourses that Habermas has pointed out and discussed; namely, theoretical, practical, historical, and technical discourses. Five characteristics of literary discourse are pointed out here: fictionality, poeticity, inquisitoriality, poetic licence, and contemplation. It is (...) not claimed that every text that is classified as literary necessarily contains all five features, but a vast majority of them do. Finally, it is argued that literary discourse is special because it redefines Habermas' four so-called ‘universal-pragmatic validity’ claims: understandability, truth, normative rightness, and sincerity. These claims are not altogether suspended, but they are given new meanings and attenuated in literary discourse. (shrink)
