In August 2011 Edward Fullbrook, the editor of the Real World Economics Review and the driving force behind the World Economics Association (WEA), asked the three of us to take on editorial roles in the newly established philosophy, methodology and history of thought journal of the association. The project was, to say the least, rather daunting. We had a document outlining the scope and editorial policies of the would-be journal written by Grazia Ietto-Gillies. Grazia had also developed the proposed Open (...) Peer Discussion Forum (OPD), based on her research into similar peer review systems used within the natural sciences. However, we had never met each other nor worked together and we lacked administrative and technical support. In addition, scheduling editorial meetings between Rome, Mexico City and Oxford proved rather challenging! Nevertheless, a combination of belief in the cause of the WEA and foolhardiness led us all to accept. The first issue of the journal is the fruit of our collective labours as well as those of our authors. In addition, both Jake McMurchie (the association's IT expert) and Jane Spurr (our production and layout expert) have been instrumental in the process of transforming a vibrant open peer discussion into six conventional journal articles. 'It would ... be a pity if the sketch of religious controversy in the 1670s contained in Richard Ashcraft's bold and exhilarating attempt to reconstruct the argument and intellectual framework of Locke's political thinking and activity should be thought to represent the entire debate accurately.' (Spurr 1988, 567 n. 17).

This chapter addresses the growing problem of unwanted sexual interactions in virtual environments. It reviews the available evidence regarding the prevalence and severity of this problem. It then argues that due to the potential harms of such interactions, as well as their nonconsensual nature, there is a good prima facie argument for viewing them as serious moral wrongs. Does this prima facie argument hold up to scrutiny? After considering three major objections – the ‘it’s not real’ objection; the ‘it’s just (...) a game’ objection; and the ‘unrestricted consent’ objection – this chapter argues that it does. The chapter closes by reviewing some of the policy options available to us in addressing the problem of virtual sexual assault. (shrink)

Historically, philosophical discussions of relations have featured chiefly as afterthoughts, loose ends to be addressed only after coming to terms with more important and pressing metaphysical issues. F. H. Bradley stands out as an exception. Understanding Bradley's views on relations and their significance today requires an appreciation of the alternatives, which in turn requires an understanding of how relations have traditionally been classified and how philosophers have struggled to capture their nature and their ontological standing. Positions on these topics range (...) from the rejection of relations altogether, to their being awarded the status as grounds for everything else, to various intermediary positions along this spectrum. Love them, hate them, or merely tolerate them, no philosopher engaged in ontologically serious metaphysics can afford to ignore relations. (shrink)

In this paper I seek to explore how the idea of modus vivendi might help us to understand political legitimacy. A suitable conception of modus vivendi, I suggest, can represent a way of underpinning a viable and attractive account of political legitimacy. On my account a modus vivendi is basically a set of arrangements that are accepted as basis for conducting affairs by those who are party to them. Political legitimacy, I argue, is ultimately rooted in the judgements of those (...) subject to it, but is mediated through a language in which claims to it are argued and assessed. The thought is that the web of operative beliefs and values in any given society, which constitute the grounds of judgements about political legitimacy, are what sustains a modus vivendi around the basic political institutions and practices. On this view, legitimate political institutions and practices incline towards a modus vivendi in that they are the outcome of an historical and ongoing conglomeration of settlements reflecting shifting and conflicting values and interests, as well relative balances of power, both currently and in the past. The marriage of modus vivendi and political legitimacy, therefore, seeks to reflect the contingent and ‘negotiated’ character of basic political institutions and practices and an understanding of political legitimacy that sees it as mediated through an ongoing and emergent discourse of argument and judgement, which remains nonetheless always vulnerable to challenge and change. However, his models fail to adequately represent an important evolutionary dynamic. Central to this dynamic is the selection that impinges on RNA molecules in the context of their association with proto-metabolisms. This selection shapes the role of RNA in the emergence of life. When this evolutionary dynamic is appropriately taken into account, it predicts a role for RNA that (...) is consistent with the Managed-Metabolism Hypothesis about the origins of life, and inconsistent with Deacon’s account. There are several features of law which rightly draw the interest of philosophers, especially those whose expertise lies in ethics and social and political philosophy. But the law also has features which haven’t stirred much in the way of philosophical investigation. I must say that I find this surprising. For the fact is that a well-run criminal trial is a master-class in logic and epistemology. Below I examine the logical and epistemological properties of greatest operational involvement in a criminal proceedings, (...) concepts such as evidence, proof, argument, inference, relevance, probability, and more. My principal objective is to expose the deep cleavage between establishment norms in epistemology and logic and standard practice in criminal proceedings. This gives us two options to reflect upon. In one, the establishment norms for the correct management of the concepts in question are basically sound. In that case, as I will show, common law criminal practice would be basically unsound; its convictions would be basically false and unjust. Seen from the other perspective, the criminal justice system would be basically sound, and its criminal convictions basically true and just. It turns out to matter that option one meets with widely spread common disbelief and is generally taken as contrary to common knowledge. What is needed here is an epistemology which gives these sentiments some air to breathe. I will argue that on balance it is the logico-epistemic establishment which requires some serious rethinking. This paper, originating from a Wittgenstein conference in Delphi, Greece in June 2001, questions Brandom’s reading of Wittgenstein on “Following a Rule”. For the purpose of our current investigative dispute, it is a very good starting point to draw our attention to some of the vital differences between Wittgenstein’s and Brandom’s approach to the relation between practice and rules that may not be quite as clear at first sight from Brandom’s own writings. This writing maintains that Brandom misconstrues Wittgenstein’s remarks (...) about signposts and Philosophical Investigations §201 with the consequence that his own explications about tacit rules involved in practice seem more Wittgensteinian than they really are. For one, Brandom duplicates Wittgenstein’s requirement of correctness in rule following: “...correctness that consists in following a rule [does not presuppose] correctness that does not.” On the other hand Brandom’s reading makes Wittgenstein’s quietism look like ”a pretext for not doing constructive work”, while Wittgenstein’s point is that there is nothing left to enquire. To be more than a meta-ethical stance, moral phenomenology must provide an account of moral norms. This paper unites two sorts of phenomenological considerations. The first considers the teleological character of intentional experiences as ordered toward "truthfulness" in all the spheres of reason and toward a notion of self-responsibility for our beliefs, attitudes, and actions as the flourishing of rational agents. The second considers the phenomenological tradition's identification of empathy as the experience in which we encounter others as conscious agents (...) like me but irreducibly different from me and that grounds the emotions of respect and sympathy. Respect grasps the other conscious agent as an irreducibly different cognizing, rational, reflection-capable being, as making articulated judgments of value, and as making articulated choices about what activities conduce to what ends. Respect for others cannot be separated from a sympathetic care for others, a sympathy that inclines one toward caring for and aiding the other person in developing her own rational capacities. Sympathy, in brief, complements respect. At the same time, respect complements sympathy insofar as sympathy runs the risk of transmuting into paternalism. This is why, just as we need sympathy in relation to respect, we need respect in relation to sympathy. The paper introduces a distinction between first-order goods for an agent and the second-order goods associated with truthfulness. The second-order goods, the paper argues, necessarily override first-order goods when they prevent the attainment of the second-order goods for anyone. (shrink)

According to one prominent form of moral individualism, how an individual is to be treated is determined, not by considering her group membership, but by considering her own particular characteristics. On this view, so this paper argues, it is not possible to provide an account of why people with profound cognitive disabilities are owed respect. This conclusion is not new, but it has been challenged by writers who are sympathetic to the recommended emphasis. The paper aims to show that the (...) conclusion cannot be avoided, and to look at what is to be learned from an approach that leads us to this point. It suggests that any account of why profoundly disabled people are owed respect will have to supplement discussion of their particular capacities with a normative account of their humanity. (shrink)

While previous studies of Dewey's work have taken either a historical or topical focus, Shook offers an innovative, organic approach to understanding Dewey and eloquently shows that Dewey's instrumentalism grew seamlessly out of his idealism. He argues that most current scholarship operates under a mistaken impression of Dewey's early philosophical positions.

The essays in this volume blend historical and philosophical reflection with concern for contemporary political problems. They show that the causes and motivations of civil religion are a permanent fixture of the human condition, though some of its manifestations and proximate causes have shifted in an age of multiculturalism, religious toleration, and secularization.

Practical wisdom and judgment, rather than seen as ‘things’ hidden inside the mind, are best talked of, we suggest, as emerging developmentally within an unceasing flow of activities, in which practitioners are inextricably immersed. Following a performative line of thinking, we argue that when practitioners (namely, individuals immersed in a practice, experiencing their tasks through the emotions, standards of excellence and moral values the practice engenders or enacts) face a bewildering situation in which they do not know, initially at least, (...) how to proceed, the judgment they exercise emerges out of seeking to establish a new orientation to their puzzling surroundings. They do so through actively trying to be in touch with their felt emotions and moral sensibilities, while attempting to articulate linguistically the feelings experienced in order to get a clearer view of relevant aspects of the situation at hand. Coming to a judgment involves moving around within a landscape of possibilities, and in so doing, being spontaneously responsive to the consequences of each move, and assessing which one (or combination of moves) seems best in resolving the initial tension aroused in one’s initial confusion. While the era following the Bland decision in 19931 might be thought of as the time when concepts such as ‘futility’ were placed under pressure and scrutiny, it’s an idea that has been debated for at least forty years. In a 1983 JME commentary Bryan Jennett distinguishes three kinds of reason why Cardiopulmonary Resuscitation might be withheld: > ‘… that CPR would be futile because it is very unlikely to be successful; that quality of life after CPR is likely to (...) be changed to so poor a level as to be a greater burden than the benefit gained from prolongation of life, and that quality of life is already so poor due to chronic or terminal disease that life should not be prolonged by CPR.’ pp-142-1432 This crisp definition seems as applicable as it did then, but it was not the final word on the concept. Empires and nation-states are not opposed or distinct forms of polity but closely linked forms. Pre-modern empire existed without any contrasting form of polity we might call a nation-state. Rather, they contrasted with non-national state forms such as city-states, small kingdoms and mobile, nomadic polities. These in turn were in constant interaction with any neighbouring empire or empires, perhaps becoming the core of an empire themselves, perhaps taking over all or part of an existing empire, perhaps maintaining some autonomy by (...) virtue of remoteness or lack of attractiveness, perhaps by balancing opposed empires against each other. Empires did not have a national core, and non-empires were not national. By contrast, modern empires have always had a clearly designated nation-state core and a physically separate set of non-national peripheries. This has been crucial to ensuring that when formal empire is ended, both the imperial core and the former colonies are defined as nation-states. But ex-imperial nation-states and ex-colonial nation-states are really two kinds of states. Much contemporary confusion about the prospect for a world order of nation-states revolves round the failure to make that basic distinction. (shrink)

I criticize Carpendale and Lewis's attempt to produce a Wittgensteinian theory, as an alternative to work in the “theory of mind” tradition, not because I disagree with it as theory, but because Wittgenstein would be critical of any attempt to make such a use of his work. Theories are concerned with discovering rules, principles, of lawful regularities hidden behind appearances. Wittgenstein's whole latter philosophy is inimical to such an aim. His concern is not with theories but with descriptions—which can be (...) explanatory, but in a relational or orientational rather than a causal fashion. Below, I give some initial examples to show what Wittgensteinian investigations in developmental psychology might look like. (shrink)
