Roughly three years after the creation of his mandate, United Nations Special Rapporteur Maina Kiai reflects on the global state of assembly and association rights. Although the mandate was created against the backdrop of shrinking space for civil society, a massive and growing global protest movement has grabbed most of the headlines since 2011. Kiai argues that the mandate has made a measurable impact – it has helped raise awareness of repressive NGO laws, provided technical assistance to governments to strengthen (...) assembly and association rights and developed soft law. But perhaps, the most important work of the mandate has been its contribution to a better understanding of just how important the rights to freedom of peaceful assembly and association are. Assembly and association rights are a powerful tool to promote dialog, pluralism, broadmindedness, tolerance and civic participation; they satisfy people's fundamental desire to take control of their own destinies. And if anything, the past few years have taught us that the worst turmoil comes when this desire is suppressed. When people are denied something so fundamental, rage inevitably follows. When people have no outlet for that rage, it can ultimately manifest itself as something much more chaotic than a street protest. (shrink)

The logical consequence relations η▹η provide a very attractive way of inferring new facts from inconsistent knowledge bases without compromising standards of credibility. In this short note we provide proof theories and completeness theorems for these consequence relations which may have some applicability in small examples.

This paper argues that certain central tenets of the traditional theory of the just war cannot be correct. It then advances an alternative account grounded in the same considerations of justice that govern self-defense at the individual level. The implications of this account are unorthodox. It implies that, with few exceptions, combatants who fight for an unjust cause act impermissibly when they attack enemy combatants, and that combatants who fight in a just war may, in certain circumstances, legitimately target noncombatants (...) who bear a significant degree of moral responsibility for a wrong, when the prevention or rectification of that wrong constitutes a just cause for war. Psychologism in logic is the doctrine that the semantic content of logical terms is in some way a feature of human psychology. We consider the historically influential version of the doctrine, Psychological Individualism, and the many counter-arguments to it. We then propose and assess various modifications to the doctrine that might allow it to avoid the classical objections. We call these Psychological Descriptivism, Teleological Cognitive Architecture, and Ideal Cognizers. These characterizations give some order to the wide range of modern views (...) that are seen as psychologistic because of one or another feature. Although these can avoid some of the classic objections to psychologism, some still hold. (shrink)

It is sometimes suggested that if a moral theory implies that infanticide can sometimes be permissible, that is sufficient to discredit the theory. I argue in this article that the common-sense belief that infanticide is wrong, and perhaps even worse than the killing of an adult, is challenged not so much by theoretical considerations as by common-sense beliefs about abortion, the killing of non-human animals, and so on. Because there are no intrinsic differences between premature infants and viable fetuses, it (...) is difficult to accept that an abortion performed after the point of viability can be permissible while denying that infanticide can be permissible for a comparably important reason. This and other challenges to the consistency of our intuitions exert pressure on us either to accept the occasional permissibility of infanticide or to reject liberal beliefs about abortion. J. E. Malpas discusses and develops the ideas of Donald Davidson, influential in contemporary thinking on the nature of understanding and meaning, and of truth and knowledge. He provides an account of Davidson's holistic and hermeneutical conception of linguistic interpretation, and, more generally, of the mind. Outlining its Quinean origins and the elements basic to Davidson's Radical Interpretation, J. E. Malpas' book goes on to elaborate this holism and to examine the indeterminacy of interpretation and the principle of charity. The (...) metaphysical and epistemological consequences of Davidson's approach are considered, particularly in relation to scepticism and relativism, the realist/anti-realist debate, and the problem of truth. Parallels are drawn between the Davidsonian emphasis on the centrality of the notion of truth and Heidegger's notion of truth as aletheia, as the book looks to structuralist, hermeneutical and phenomenological sources to illuminate Davidson's position. This essay explores problems of consistency among commonsense beliefs about the comparative moral status of animals, fetuses, and human beings congenitally endowed with cognitive capacities and potential no higher than those of higher animals. The possibility of genetic cognitive enhancement exacerbates some of these problems, but also offers new resources for understanding the basis of our moral status as inviolable.

However much one may wish for nonviolent solutions to the problems of unjust and unrestrained human violence that Glover explores in Humanity, some of those problems at present require violent responses. One cannot read his account of the Clinton administration’s campaign to sabotage efforts to stop the massacre in Rwanda in 1994 – a campaign motivated by fear that American involvement would cost American lives and therefore votes – without concluding that Glover himself believes that military intervention was morally required (...) in that case. Military intervention in another state that is intended to stop one group within that state from brutally persecuting or violating the human rights of members of another group is now known as “humanitarian intervention.” Those against whom the intervention is directed are almost always the government and its supporters, though this is not a necessary feature of humanitarian intervention. It is, however, a conceptual condition of humanitarian intervention that it does not occur at the request or with the consent of the government. The use of force within another state with the consent of the government counts as assistance rather than intervention. The principal reason that humanitarian intervention is contentious is that it seems to violate the target state’s sovereign right to control its own domestic affairs. Because humanitarian intervention is a response to human rights violations within the target state, it is regarded as altogether different from wars of defense against aggression. Four experiments examined how accurately participants can report the times of their own decisions. Within an auditory reaction time task, participants reported the time at which the tone was presented, they decided on the response, or the response key was pressed. Decision time reports were checked for plausibility against the actual RTs, and we compared the effects of experimental manipulations on these two measures to see whether the reported decision times showed appropriate effects. In addition, we estimated the amount of (...) error associated with individual decision time reports by checking how often participants’ decision time reports were implausibly early or late , and by using several quantitative models. Overall, the results suggest that decision time reports are not very accurate but they may be usable for some purposes. (shrink)

Public attention on embryo research has never been greater. Modern reproductive medicine technology and the use of embryos to generate stem cells ensure that this will continue to be a topic of debate and research across many disciplines. This multidisciplinary book explores the concept of a 'healthy' embryo, its implications on the health of children and adults, and how perceptions of what constitutes child and adult health influence the concept of embryo 'health'. The concept of human embryo health is considered (...) from preconception to pre-implantation genetic diagnosis to recent foetal surgical approaches. Burgeoning capacities in both genetic and reproductive science and their clinical implications have catalysed the necessity to explore the concept of a 'healthy' embryo. The trigonometric table and its construction principles were introduced to China as part of calendar reform, spear-headed by Xu Guangqi in the late 1620s to early 1630s. Chinese scholars attempted and succeeded in uncovering how the construction principles were established in the seventeenth century and then in the eighteenth century expanded to include more algorithms to compute the values of trigonometric lines. Successful as they were in discoursing the construction principles, most Chinese scholars did not actually construct trigonometric tables anew. (...) In the early nineteenth century, a revolutionary approach was developed, which resembles computing a finite sum of power series to trigonometric functions of an arbitrary arc less than a one-half circle. Though hailed by many modern historians as Chinese achievements in developing “infinite series” of trigonometric functions, this approach was viewed by the actors at the time as a quick means to construct trigonometric tables. Interestingly, even with these “quick” methods, no trigonometric table was constructed. Besides the fact that constructing a trigonometric table afresh is a time-consuming business, the classification of the trigonometric table and their construction principles into different genres of knowledge by scholars offers an additional explanation of drastically uneven treatment of trigonometric tables and their construction principles. The following commentaries are responses to the rough drafts of six lectures — the Hourani Lectures—that I delivered at the University of Buffalo in November of 2006. This draft manuscript is being extensively revised and expanded for publication by Oxford University Press as a book called The Morality and Law of War. Even though in January 2007 the book was still both unpolished and incomplete, David Enoch at that time generously organized a workshop at the Law School of the Hebrew (...) University of Jerusalem to discuss its ideas and arguments. George Fletcher chaired the meeting and Re’em Segev, Yuval Shany, and Noam Zohar all presented superb commentaries. This paper is a review essay of two collections of essays focused on the work of Alasdair MacIntyre. The review focuses on three core themes. First, it discusses those papers that explore the central role that the relationship between practices and institutions plays in MacIntyre’s critique of modernity. Second, it turns to those papers that examine the foundational role that human needs play in MacIntyre’s ethics. Third, it places in dialogue those papers that defend MacIntyre’s politics as a form of (...) ‘revolutionary Aristotelianism’ with those that contest the soundness of this categorization. (shrink)

Our recent paper reported that 43% of reviewer comment sets shared with authors contained at least one unprofessional comment or an incomplete, inaccurate of unsubstantiated critique. Publication of this work sparked an online conversation surrounding professionalism in peer review. We collected and analyzed these social media comments as they offered real-time responses to our work and provided insight into the views held by commenters and potential peer-reviewers that would be difficult to quantify using existing empirical tools. Overall, 75% of comments (...) were positive, of which 59% were supportive and 16% shared similar personal experiences. However, a subset of negative comments emerged, that provided potential insight into the reasons underlying unprofessional comments were made during the peer-review process. These comments were classified into three main themes: forced niceness will adversely impact the peer-review process and allow for publication of poor-quality science ; dismissing comments as not offensive to another person because they were not deemed personally offensive to the reader ; and authors brought unprofessional comments upon themselves as they submitted substandard work. Here, we argue against these themes as justifications for directing unprofessional comments towards authors during the peer review process. We argue that it is possible to be both critical and professional, and that no author deserves to be the recipient of demeaning ad hominem attacks regardless of supposed provocation. Suggesting otherwise only serves to propagate a toxic culture within peer review. While we previously postulated that establishing a peer-reviewer code of conduct could help improve the peer-review system, we now posit that priority should be given to repairing the negative cultural zeitgeist that exists in peer-review. In his seminal reflection on the badness of death, Nagel links it to the permanent loss “of whatever good there is in living.” I will argue, following McMurtry, that “whatever good there is in living” is defined by the life-value of resources, institutions, experiences, and activities. Enjoyed expressions of the human capacities to experience the world, to form relationships, and to act as creative agents are intrinsically life-valuable, the reason why anyone would desire to go on living indefinitely. As Nagel (...) argues, “the fact that we will eventually die in a few score years cannot by itself imply that it would not be good to live longer. If there is no limit to the amount of life that it would be good to have, then it may be that a bad end is in store for all of us.” In this paper I want to question whether in fact there is no limit to the amount of life it would be good to have. My general conclusion will be that it is not the case that the eternal or even indefinite prolongation of any particular individual life necessarily increases life-value. Were death thus somehow removed as an inescapable limiting frame on human life, overall reductions of life-value would be the consequence. Individual and collective life would lose those forms of moral and material life-value that form the bases of life’s being meaningful and purposive. (shrink)

Some philosophers, most notably Julian Savulescu, have argued that potential parents have a moral reason to do what they can to have a child with the highest expected level of well-being.1 This is not just a reason to do what will make a particular child better off than he or she would otherwise be but also a reason to choose, from among different possible children, the one that has the highest expected well-being. The claim that potential parents have such a (...) reason is then often deployed as a premise in arguments in support of genetic enhancement. Robert Sparrow has argued in response that this claim implies that potential parents have a reason to choose to have female children only, primarily because women are genetically disposed to live, on average, 3–7 years longer than men.2 He takes this implication to be a reductio of this particular form of argument in support of human enhancement. In her paper, Sexual dimorphism and human enhancement, Paula Casal seeks to rebut Sparrow's argument and then goes on to suggest that a better case for the selection of female children could be made on grounds of moral enhancement, since women are far less genetically disposed to be violent and aggressive than men.3 Recognising, however, that the creation of only female children would lead to human extinction, she concludes that the way to achieve the best outcome would be to use techniques of genetic modification, should they become available, to make men more like women in certain respects: smaller, less aggressive, less competitive, less violent, less obsessed with sex, less prone to taking great risks, and less likely to die early from accident, combat, or disease.Like Larry Temkin, I am largely in agreement with Casal on these matters. The article is a critical examination of Marcuse's speculations about the possibility of determining a biological foundation for ethical norms. It considers three key objections to this project: that Marcuse fails to adequately define needs, that he misinterprets Freud, and that, details aside, he fundamentally misunderstands what a `biological' foundation for ethics would entail. The objections are accepted, to varying degrees, as regards the content of Marcuse's argument. The article concludes, however, with a different account of biological foundations designed to (...) rescue the deeper aims of Marcuse's project. This paper explores the ways in which neoliberal schooling is threatening education. We define education as the development of cognitive and imaginative capacities for understanding of and critical engagement with social reality. Education opens horizons of possibility for collective and individual life-experience and activity by exposing the one-sidedness and contradictions of ruling-value systems. Schooling, by contrast, subordinates thought and imagination to the reproduction of the ruling money-value system, narrowing horizons of possibility for collective and individual life to service to the (...) prevailing structure of power. Our paper draws on our overlapping experiences as educators, one in the university system, the other in the adult education system. In both systems, students’ life-requirement for education is subordinated to the capitalist need for compliant wage-labourers and consumers. In opposition to this instrumentalization we will present an interpretation of “real world education” as a unique form of collective work through which teachers and students construct alternatives that can serve as the guiding ideas for new projects for social and political transformation. What is the relation between our beliefs, or thoughts in general, and the perceptual experience of the world that gives rise to those beliefs? Donald Davidson is usually taken to have a well-known answer to this question that runs as follows: while our beliefs are, at least in part, caused by our experience, such experience does not thereby count as providing a rational ground for those beliefs; our beliefs are thus evidentially grounded in other beliefs, but not in the experience (...) that gives rise to them. John McDowell, among others, has challenged this Davidsonian picture on the grounds that it actually severs the connection between beliefs and their proper evidential grounds. Against such a view, this paper argues the Davidsonian position grounds belief in the specificity of our own locatedness in the world, and in the more general and prior embeddedness of belief in the world that is a part of the very concept of belief. Governments have used several mechanisms to deal with intractable policy conflicts about issues in bioethics. One mechanism is the installment of an ethics committee and another one is the organization of public debates. Often, ethics committees have an implicit or explicit role in the stimulation of such public debate. However, this role is not self-evident and we therefore analyse the relation between committees and public debate. What should the function of biotechnology ethics committees be, how does this relate to their (...) composition, and to what extent are these functions met in practice? To this end, we have examined the three national committees of the Netherlands, Switzerland, and Australia in the field of animal and plant biotechnology. We argue that there is often a mismatchbetween the goals one wants to reach by stimulating public debate and the way this has been given shape, partly through ethics committees. In fact, installing (biotechnology) ethics committees is to a certain extent a premature move that contains rather than stimulates public debate. (shrink)

Speaking is also a form of action. That is one venture. The other is: we start something. We weave our strand into a network of relations. (...) What comes of it we never know. We’ve all been taught to say: Lord forgive them, for they know not what they do. That is true of all action. Quite simply and concretely true, because one cannot know. That is what is meant by a venture. And now I would say that this venture is only possible when there is trust in people. A trust— which is difficult to formulate but fundamental—in what is human in all people. Taking an image by Thomas Hoepker as its starting point, this essay examines the discontinuities and contradictions that appear around the contemporary rhetoric of the ‘event’ as given particular instantiation in the destruction of the World Trade Centre on September 11, 2001. It is argued that the rhetoric at issue here, in spite of its emphasis on the ‘eventful’ character of our time, actually serves to conceal the urgency of our contemporary situation as well as disabling any genuine response to (...) it.
