Si, dans le cadre académique, ces débats sont tombés dans l’oubli, on peut établir une continuité conceptuelle avec la recherche scientifique actuelle, qui gagnerait à relire cette littérature centenaire. In this paper, I suggest that, if we are committed to accepting a threshold approach to personhood, according to which all beings above the threshold are persons with equal moral status, there are strong reasons to also recognise a second threshold that would be reached through human pregnancy, and that would confer on pregnant women a temporary superior moral status. This proposal is not based on the moral status of the fetus, but on the moral status of the pregnant woman. (...) It is not only the fetus which is an organism sui generis: the pregnant woman, also, is a unique being. Following almost any view on the moral status of the fetus, the pregnant woman should be regarded, herself, as more than a singular individual. She is, herself, ‘more than one’. Pregnant women are also necessary for the continued survival of the human species, and there are important justice-based reasons to recognise the higher status. Furthermore, the recognition of a superior moral status for pregnant women does not imply that pregnancy should always be viewed as desirable, or imply any position on the permissibility of abortion. My proposal is not as radical as it might seem, as it does not require that pregnant women should always receive superior treatment, but only that they should to some extent. It could have a range of potential positive practical consequences. Finally, my approach does not threaten, but rather promotes, human equality. (shrink)

Can platforms close the governance gap in the sharing economy, and if so, how? Through an in-depth qualitative case study, we analyze the process by which new regulation and self-regulation emerge in one sector of the sharing economy, crowdfunding, through the actions of a meta-organization. We focus on the principal French sectoral meta-organization, Financement Participatif France. We show that this multi-stakeholder meta-organization not only closed the governance gap through collective legal, ethical, and utilitarian work but also preceded and shaped the (...) new market. We present a hybrid governance approach combining soft multi-agency regulation, self-regulation through a process of “partial meta-organizing”, and direct civil society participation. We expand the literature by highlighting features of platforms’ partial meta-organizing and by identifying conditions for successful joint regulation and self-regulation of the sector. (shrink)

These attempts include ones which would have moderately restricted access to abortion in certain limited cases, and another that might have opened to door to a number of different possibilities, including both to options that could have restricted access to abortion, and to other options that might (...) have increased access. Finally, this article will also examine reasons why some of the most important challenges surrounding disability equality cannot be sufficiently addressed through legal change alone. While there are strong reasons to support some form of change in the law, a more foundational change in values is necessary if we want to live in a more ethical society that is truly capable of welcoming disabled children. According to moral error theorists, moral claims necessarily represent categorically or robustly normative facts. But since there are no such facts, moral thought and discourse are systematically mistaken. One widely discussed objection to the moral error theory is that it cannot be true because it leads to an epistemic error theory. We argue that this objection is mistaken. Objectors may be right that the epistemic error theory is untenable. We also agree with epistemic realists that our epistemological claims are not (...) systematically in error. However, this is not because there are robustly normative facts, but rather because the truth of our epistemic claims doesn’t turn on whether there are such facts. Epistemic facts, we argue, are not robustly or categorically normative. Moral error theorists should therefore respond to the objection that their view does not commit them to the epistemic error theory. (shrink)

In my feature article, ‘Pregnancy and superior moral status: a proposal for two thresholds of personhood’, 1 I argue that there are reasons to recognise that pregnant women have a superior moral status. This is a new argument on personhood in philosophy, and I am not surprised that it has generated some discussion. While I am grateful that many authors have engaged with my ideas, I have not identified from the six commentaries any aspect in my approach that would need (...) to be revised. I will do my best here, in the space available, to address the main points raised. Gibson starts off by correctly noting that my proposal rests on a starting assumption (which I do not defend) that we follow a first threshold of personhood, but then seems to leave this aside in the rest of his critique. 2 He says I have not justified... Despite growing awareness around human impacts on marine ecosystems, little action is taken to reduce the negative effects of organizations on the ocean, thus increasing risks of global collapse. In this paper, I argue that organizations act as systems of ocean destruction, and I explore how to operate a shift to organizations as systems of ocean conservation and thriving, enabling human–ocean socio‐ecological coviability. To do so, I analyze the organizational affordances of the ocean: incommensurability, open access and complex property regimes, (...) structural domination by humans and land, perceived inexhaustibility, and cognitive distance. Then, based on the transdisciplinary analysis of mechanisms of ocean destruction, I discuss the constitution of ocean negative commons and the ruining of the ocean. Lastly, based on four drivers (technology and innovation, consumption, marginalization and social orders), I suggest alternative organizing principles that might allow to manage these commons and to transform organizations to achieve socio‐ecological coviability with the ocean: degrowth, total responsibility, full cost allocation, ocean equity, and adaptive, place‐based co‐management. Epistemology is widely seen as a normative discipline like ethics. Just like moral facts, epistemic facts – i.e. facts about our beliefs’ epistemic justification, rationality, reasonableness, correctness, warrant, and the like – are standardly viewed as normative facts. Yet, whereas many philosophers have rejected the existence of moral facts, few have raised similar doubts about the existence of epistemic facts. In recent years however, several metaethicists and epistemologists have rejected this Janus-faced or dual stance towards the existence of moral and (...) epistemic facts. As recent developments in metaethics and normativity theory have made clear, objections to the existence of moral facts really are metanormative objections that target the existence of normative facts more generally. But since epistemic facts are no less normative than moral facts, the argument goes, the existence of the former is equally threatened by metaethical objections. In this thesis, I argue that this rejection of the dual stance fails because epistemic facts are not normative facts. Although they imply norms, they do not imply genuine normativity since the epistemic norms of belief that they imply lack necessary normative authority or force. Unlike moral norms and just like e.g. norms of etiquette and the law, there is not automatically a normative reason to conform to epistemic norms. Therefore, even if metaethical objections target all normative facts, it does not follow that they also target epistemic facts. I offer a two-part abductive argument in favour of that conclusion. First, I argue that epistemic facts lack five commonly cited features of normative facts (but not of merely norm-implying facts). Then, I argue that this is best explained by the thesis that epistemic facts are merely norm-implying and not genuinely normative. I end by exploring the potential consequences of this conclusion for epistemology and metaethics. (shrink)

An analysis of the counter-intuitive properties of infinity as understood differently in mathematics, classical physics and quantum physics allows the consideration of various paradoxes under a new light (e.g. Zeno’s dichotomy, Torricelli’s trumpet, and the weirdness of quantum physics). It provides strong support for the reality of abstractness and mathematical Platonism, and a plausible reason why there is something rather than nothing in the concrete universe. The conclusions are far reaching for science and philosophy.

An analysis of the physical implications of abstractness reveals the reality of three interconnected modes of existence: abstract, virtual and concrete, corresponding in physics to information, energy and matter. This triple-aspect monism clarifies the ontological status of subatomic quantum particles. It also provides a non-spooky solution to the weirdness of quantum physics and a new outlook for the mind-body problem. The ontological implications are profound for both physics and philosophy.

For many epistemologists and normativity theorists, epistemic norms necessarily entail normative reasons. Why or in virtue of what do epistemic norms have this necessary normative authority? According to what I call epistemic constitutivism, it is ultimately because belief constitutively aims at truth. In this paper, I examine various versions of the aim of belief thesis and argue that none of them can plausibly ground the normative authority of epistemic norms. I conclude that epistemic constitutivism is not a promising strategy for (...) grounding epistemic normativity. (shrink)

According to epistemic instrumentalism, epistemic normativity arises from and depends on facts about our ends. On that view, a consideration C is an epistemic reason for a subject S to Φ only if Φ-ing would promote an end that S has. However, according to the Too Few Epistemic Reasons objection, this cannot be correct since there are cases in which, intuitively, C is an epistemic reason for S to Φ even though Φ-ing would not promote any of S’s ends. After (...) clarifying both EI and the Too Few Epistemic Reasons objection, I examine three major instrumentalist replies and argue that none of them is satisfactory. This paper presents some impossibility results for certain views about what you should do when you are uncertain about which moral theory is true. I show that under reasonable and extremely minimal ways of defining what a moral theory is, it follows that the concept of expected moral choiceworthiness is undefined, and more generally that any theory of decision-making under moral uncertainty must generate pathological results.

Republican and so-called independence conceptions of freedom stand out from other conceptions by embedding strong modal conditions on what it takes for a person to count as being free to do something. For this reason, the extent of one’s freedom, conceived under republican/independentist lights, cannot be measured by any of the measures of freedom that have been developed so far in the literature on freedom, since these do not register the requisite modal constraints. In this paper I propose a measure (...) of freedom that does capture the requisite modal concerns. I do so by relying on work in the semantics of counterfactuals to define a measure of how modally robustly available an option is to an individual. (shrink)

What is the source of epistemic normativity? In virtue of what do epistemic norms have categorical normative authority? According to epistemic teleologism, epistemic normativity comes from value. Epistemic norms have categorical authority because conforming to them is necessarily good in some relevant sense. In this article, I argue that epistemic teleologism should be rejected. The problem, I argue, is that there is no relevant sense in which it is always good to believe in accordance with epistemic norms, including in cases (...) where the matter at hand is completely trivial. This article argues for a novel approach to the measurement of freedom of choice, on which the availability of an option is a matter of degree, rather than a bivalent matter of being either available or not. This approach is motivated by case studies involving weakness of will, where deficiencies in willpower seem to impair individual freedom by making certain alternatives much harder to pursue. This approach is perfectly general, however: its graded analysis of option availability can be extended to (...) cases where weakness of will is not involved and can be used to generalize numerous existing measures of freedom. Epistemic instrumentalism views epistemic norms and epistemic normativity as essentially involving the instrumental relation between means and ends. It construes notions like epistemic normativity, norms, and rationality, as forms of instrumental or means-end normativity, norms, and rationality. I do two main things in this paper. In part 1, I argue that there is an under-appreciated distinction between two independent types of epistemic instrumentalism. These are instrumentalism about epistemic norms and instrumentalism about epistemic normativity. In part 2, I argue that this (...) under-appreciated distinction matters for the debate surrounding the plausibility of EI. Specifically, whether we interpret EI as norm-EI or as source-EI matters for the widely discussed universality or categoricity objection to EI, and for two important motivations for adopting EI, namely naturalism and the practical utility of epistemic norms. I will then conclude by drawing some lessons for epistemic instrumentalism going forward. (shrink)

This thesis concerns the measurement of freedom, and its value. Specifically, I am concerned with three overarching questions. First, can we measure the extent of an individual’s freedom? It had better be that we can, otherwise much ordinary and intuitive talk that we would like to vindicate – say, about free persons being freer than slaves – will turn out to be false or meaningless. Second, in what ways is freedom valuable, and how is this value measured? It matters, for (...) example, whether freedom is valuable only insofar as it enables us to pursue specific ends we happen to value for independent reasons, or whether it is also valuable in itself. In the latter case, but not the former, more freedom will always be better. Likewise, it’s important to get clarity on what ends, exactly, freedom is especially instrumentally valuable in promoting, since this goes to how much we should care about it. And finally, the liberal political tradition asserts that there is a special sphere of personal choices within which individuals should be free to do as they please, for reasons over and above the value of freedom itself. Now, can we measure the extent to which states and individuals respect individual liberties, and can we weigh the importance of respecting liberty against competing values like social welfare? To answer these questions, I follow the axiomatic tradition of social choice theory, and I develop several novel measures of freedom – including the first measure of freedom ever proposed that is sensitive to how modally robustly our options are available – a novel approach to measuring the diversity of an opportunity set, and I develop an account of the value of freedom according to which an important part of why freedom matters is that it enables us to improve our preferences through learning, and I construct ways of measuring the value of freedom along this dimension of value. Finally, in later chapters, I provide a representation result for a measure of illiberalism, i.e. of the degree to which states fail to respect the rights of their citizens, and I extend this result to provide a characterization of moral theories that express concern for respecting the rights of others. Many philosophers have adopted epistemic expressivism in recent years. The core commitment of epistemic expressivism is that epistemic claims express conative states. This paper assesses the plausibility of this commitment. First, we raise a new type of problem for epistemic expressivism, the epistemic motivation problem. The problem arises because epistemic expressivists must provide an account of the motivational force of epistemic judgment (the mental state expressed by an epistemic claim), yet various features of our mental economy seem to show that (...) they can’t do so. Second, we develop what we take to be the most promising response to that problem for expressivists. We end by noting that this response faces an important challenge pertaining to the psychology of epistemic criticism and praise. (shrink)

Herding behavior occurs when security analysts ignore their private opinions and issue public forecasts that mimic the earnings forecasts of others. Joining the consensus provides cover for analysts' reputations. We question the ethics of this practice when the motive to protect one's reputation takes precedence over the forecase accuracy motive. While seemingly predictable behavior from a self interested perspective, herding behavior has subtle but long term ramifications for the efficient pricing of securities and the preservation of the public trust in (...) the financial services profession. We call upon each individual analyst as well as the profession to exercise the moral courage necessary to cultivate a climate of personal and public integrity. Personal resistance and pro-active policies are prescribed as actions to assist analysts to become more cognizant of their motivations, as well as to promote a more ethical professional context. The paper examines Simplicius's doctrine of propensities in his commentary on Aristotle's Categories and follows its application by the late thirteenth century theologian and philosopher James of Viterbo to problems relating to the causes of volition, intellection and natural change. Although he uses Aristotelian terminology and means his doctrine to conflict minimally with those of Aristotle, James's doctrine of propensities really constitutes an attempt to provide a technically rigorous dressing to his Augustinian and Boethian convictions. Central to James's procedure is (...) his rejection, following Henry of Ghent, of the principle that “everything that is moved is moved by another”. James uses Simplicius' doctrine of propensities as a means of extending the rejection of that principle, which Henry had limited to the case of the will, to cognitive operations and natural change. The result is a theory of cognition and volition that sees the soul as the principal cause of its own acts, and a theory of natural change that minimizes the causal impact of external agents. This article examines G.H. Mead’s critique of psychoanalysis, in order to show how it reflects the parallels with his own conception of social psychology. In showing that both Freud and Mead address the same issues of the redefinition of the psyche based on experimental psychology in their own theoretical entreprise, the analysis makes clear that Freud’s two topics (Conscious, Preconscious, Unconscious; Superego, Ego, Id) and Mead’s theory of the Self (I, Me, Self) are closely related but nevertheless kept apart by (...) fundamental oppositions. However, further explorations in Lacan’s reading of Freud help in seeing how close psychoanalysis and social psychology can be, by shifting attention to the distinction between unconscious and conscious communication. By addressing the issue of emotions in social life, a final look at the transformation of social norms shows how the confrontation between social psychology and psychoanalysis can be fruitful. According to epistemic deontologism, attributions of epistemic justification are deontic claims about what we ought to believe. One of the most prominent objections to this conception, due mainly to William P. Alston, is that the principle that ‘ought’ implies ‘can’ rules out deontologism because our beliefs are not under our voluntary control. In this paper, I offer a partial defense of Alston’s critique of deontologism. While Alston is right that OIC rules out epistemic deontologism, appealing to doxastic involuntarism is not (...) necessary for generating that tension. Deontologists would still have a problem with OIC if doxastic voluntarism turned out to be true or if deontologism did not require voluntarism. This is because, in short, epistemic justification does not imply ‘can’. If, as deontologists maintain, epistemic justification implies ‘oughts’, then epistemic justification must also imply ‘can’ given OIC. But since epistemic justification does not imply ‘can’, OIC dictates that we reject deontologism. I end by exploring the possible consequences of this incompatibility between OIC and deontologism. My conclusion is that at least one of the following claims must be true. Either ‘ought’ does not imply ‘can’, attributions of epistemic justification are not deontic claims, or epistemic claims lack necessary or categorical normative authority. (shrink)

ABSTRACT According to G.E. Moore’s ‘Open Question’ argument, moral facts cannot be reduced or analyzed in non-normative natural terms. Does the OQA apply equally in the epistemic domain? Does Moore’s argument have the same force against reductionist accounts of epistemic facts and concepts? In a recent article, Daniel Greco has argued that it does. According to Greco, an epistemological version of the OQA is just as promising as its moral cousin, because the relevant questions in epistemology are just as ‘open’ (...) as those in ethics. In this paper, I offer a two-part reply to Greco. First, I argue that his argument in favor of the openness of epistemology is not persuasive. Second, I offer a case against the openness of epistemology. Unlike claims linking natural and moral properties, claims linking natural and epistemological properties do give rise to closed questions. An epistemological OQA is therefore not as promising as its moral cousin. (shrink)

Effective altruism (EA) requires that when we donate to charity, we maximize the beneficial impact of our donations. While we are in broad sympathy with EA, we raise a practical problem for EA, which is that there is a crucial empirical presupposition implicit in its charity assessment methods which is false in many contexts. This is the presupposition that the magnitude of the benefits (or harms) generated by some charity vary continuously in the scale of the intervention performed. We reviewed critically and systematically the literature concerning the ethics of conducting research in order to engage in a reflection about the vocabulary and conceptual categories used in the publications reviewed. To understand better how the ethical issues involved in conducting research are conceptualised in the publications reviewed, we 1) established an inventory of the conceptualisations reviewed, and 2) we (...) critically assessed them. We found that the publications reviewed mostly showed examples of descriptive ethics, in that most authors describe ethical issues without reflecting much on them, which could be explained both by 1) a lack of ethical education in research contexts, and 2) by the fact that we do not know what researchers know (or do not) about ethical issues. Additionally, the definitions identified in the publications are scarce and at times imprecise, but this seems more to point out the ethical vocabulary’s difficulties in certain contexts. Further, very few authors offer proper conceptualisations of the ethical issues arising in conducting research. When dealing with vast arrays of ethical issues to conceptualise, perhaps one ought to remember that some typologies already exist that could guide further reflection and help understand other realities for which the current ethical vocabulary may be lacking. We believe that combining the reviewed typologies, both with other well-developed typologies and critical reflection, could help support better ethical practice in conducting research. (shrink)

Deontologists are united in asserting that there are side-constraints on permissible action, prohibiting acts of murder, theft, infidelity, etc., even in cases where performing such acts would make things better overall from an impartial standpoint. These constraints are enshrined in the vocabulary of rights apply even when violating those constraints would lead to fewer constraint-violations overall: I am prohibited from killing an innocent even when doing so is the only way to prevent you from killing five. However, deontologists are divided (...) over whether we have a duty to violate a smaller number of rights when this is necessary to prevent ourselves from later violating a larger number of rights that are at least as stringent. I argue that individuals do have such a duty, a duty which follows from widely accepted consistency constraints on choice. (shrink)
