In chapter 3 of Wild Animal Ethics Johannsen argues for a collective obligation based on beneficence to intervene in nature in order to reduce the suffering of wild animals. In the same chapter he claims that the non-identity problem is merely a “theoretical puzzle” which doesn’t affect our reasons for intervention. In this paper I argue that the non-identity problem affects both the strength and the nature of our reasons to intervene. By intervening in nature on a large scale we (...) change which animals come into existence. In doing so, we enable harmful animals to inflict harms on other animals, and we put other animals in harm’s way. The harms that these animals will inflict and endure are foreseeable. Furthermore, since non-human animals aren’t moral agents, harmful animals cannot be morally responsible for their harmful actions. I argue therefore that by causing animals to exist, knowing that they will inflict and suffer harms, we become morally responsible for those harms. By engaging in identity-affecting actions then we take on secondary moral duties towards the animals we have thereby caused to exist, and these secondary moral duties may be extremely demanding, even more so than the initial costs of intervention. Finally, these duties are duties of justice rather than duties of beneficence, and as such are more stringent than purely beneficence-based moral reasons. Furthermore, this conclusion flows naturally from several plausible principles which Johannsen explicitly endorses. (shrink)

The burgeoning literature on global value chains has recast our understanding of how industrial clusters are shaped by their ties to the international economy, but within this context, the role played by corporate social responsibility continues to evolve. New research in the past decade allows us to better understand how CSR is linked to industrial clusters and GVCs. With geographic production and trade patterns in many industries becoming concentrated in the global South, lead firms in GVCs have been under growing (...) pressure to link economic and social upgrading in more integrated forms of CSR. This is leading to a confluence of “private governance”, “social governance”, and “public governance”. This new form of “synergistic governance” is illustrated with evidence from recent studies of GVCs and industrial clusters, as well as advances in theorizing about new patterns of governance in GVCs and clusters. In the voluminous literature on the subject of bovine growth hormone (bGH) we have yet to find an attempt to frame the issue in specifically moral terms or to address systematically its ethical implications. I argue that there are two moral objections to the technology: its treatment of animals, and its dislocating effects on farmers. There are agricultural biotechnologies that deserve funding and support. bGH is not one of them.

We model happiness as a measurement tool used to rank alternative actions. Evolution favors a happiness function that measures the individual’s success in relative terms. The optimal function, in particular, is based on a time-varying reference point –or performance benchmark –that is updated over time in a statistically optimal way in order to match the individual’s potential. Habits and peer comparisons arise as special cases of such updating process. This updating also results in a volatile level of happiness that continuously (...) reverts to its long-term mean. Throughout, we draw a parallel with a problem of optimal incentives, which allows us to apply statistical insights from agency theory to the study of happiness. (shrink)

In 1956 U. T. Place proposed that consciousness is a brain process. More attention should be paid to his word ‘process’. There is near-universal agreement that experiences are processive—as witnessed in the platitude that experiences are occurrent states. The abandonment of talk of brain processes has benefited functionalism, because a functional state, as it is usually conceived, cannot be a process. This point is dimly recognized in a well-known but little-discussed argument that conscious experiences cannot be functional states because the (...) former are occurrent, while the latter are dispositional. That argument fails, but it can be made sound if we reformulate it with the premise that occurrent states are processive. The only way for functionalists to meet the resulting challenge is to abandon the standard individuation of functional states in terms of purely abstract causal roles. (shrink)

Bovine growth hormone is a protein that occurs naturally in cattle. A chain of 190 amino acids, bGH is produced by the pituitary gland and helps to regulate a cow’s lactational cycle; generally speaking and up to a certain point, the more bGH a cow has, the more milk she gives. Using the techniques of genetic engineering, researchers at Monsanto Company have isolated the gene that produces the protein and devised low-cost techniques to manufacture it. Bacteria are placed into fermentation (...) chambers where they multiply rapidly; lab technicians then extract and purify the final product, which is identical to the naturally occurring protein in 189 of the 190 amino acids; and the product is then injected into cows. While the claim that certain functional states are sufficient for conscious experience has received substantial critical attention, the claim that functional states are necessary is rarely addressed. Yet the latter claim is perhaps now more common than the former. I aim to revive and revise a neglected argument against the necessity claim, by Michael Antony. The argument involves manipulating a conscious subject's brain so as to cancel a disposition which is supposedly crucial to the realization of an experience that the (...) subject is having at the time. The key step in the argument is to show that, contrary to what the functional necessity claim implies, the experience can survive such a manipulation. I defend that key step in a new way, by arguing that since the manipulation cannot influence the subject's thoughts, emotions, or behavior, there is no reason to suppose that it alters his conscious experience. Michael Burroughs and Deborah Tollefsen (2016) claim that children are subject to widespread testimonial injustice. They argue that empirical data shows that children are prejudicially accorded less epistemic credibility in forensic contexts, and that this in turn shows that the same is true in broader contexts. While I agree that there is indeed testimonial injustice against children, I argue that Burroughs and Tollefsen exaggerate its severity and extent, by exaggerating children’s testimonial reliability. Firstly, the empirical data do not quite support (...) their claim about children’s performance in forensic contexts. Secondly, while they advocate a relational conception of children’s agency which emphasizes the role of adults in realizing their testimonial abilities, Burroughs and Tollefsen miss the full implications of such a conception for our evaluation of children’s credibility, and for our behavior towards them in testimonial contexts. Thirdly, they underestimate the significance of children’s limited general knowledge. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. We reject arbitrary distinctions that deny adequate protections to other animals who share with protected humans relevantly similar vulnerabilities to harms and relevantly similar interests in avoiding such harms. We strongly urge this Court, in keeping with the best philosophical standards of rational judgment and ethical standards of justice, to recognize that, as a nonhuman person, Happy should be (...) released from her current confinement and transferred to an appropriate elephant sanctuary, pursuant to habeas corpus. The discussion of Kant's Practical Philosophy has been marred by viewing it as purely formalist and centered only on the categorical imperative. This important new study sets out a much more vivid account of the nature and range of Kant's concerns demonstrating his commitment to the notion of rational religion and including extensive discussion of his treatment of evil. Several recent authors have argued that children are subject to testimonial injustice in the same way as are women, Blacks, and several other social identity groups. Testimonial injustice is standardly conceptualized, following Miranda Fricker’s seminal account, as a wrongful credibility deficit. I argue that this concept of testimonial injustice is too narrow to capture testimonial injustice against children. There is good reason to think that children are less reliable testifiers than adults, so it is not necessarily wrong to assign a (...) credibility deficit to a child speaker, in the way it is wrong in the case of a female or black speaker. However, I argue that children are nevertheless subjected to testimonial injustice. Testimonial injustice against children is constituted primarily by a failure to actively inquire into assertions by children — that is, by a failure to patiently and reflectively engage in discourse with the child to discover what they may know. Of the theologians and philosophers now writing on biblical narrative, Hans Frei and Paul Ricoeur are probably the most prominent. It is significant that their views converge on important issues. Both are uncomfortable with hermeneutic theories that convert the text into an abstract philosophical system, an ideal typological structure, or a mere occasion for existential decision. Frei and Ricoeur seem knit together in a common enterprise; they appear to be building a single narrative theology. I argue that the appearance of (...) symmetry is an illusion. There is a fundamental conflict between the ‘pure narrativism’ of Frei and the ‘impure narrativism’ of Ricoeur. I give reasons for thinking that Ricoeur’s is the stronger position. (shrink)

In this article I revisit the relationship between Immanuel Kant and the Marquis De Sade, following not Jacques Lacan but Pierre Klossowski. In the process I suggest that Sade's work is marred by a series of antinomies that prevent him from stating a pure practical libertine reason and leave his view purely theoretical.

Agricultural biotechnology refers to a diverse set of industrial techniques used to produce genetically modified foods. Genetically modified (GM) foods are foods manipulated at the molecular level to enhance their value to farmers and consumers. This book is a collection of essays on the ethical dimensions of ag biotech. The essays were written over a dozen years, beginning in 1988. When I began to reflect on the subject, ag biotech was an exotic, untested, technology. Today, in the first year of (...) the millenium, the vast majority of consumers in the United States have taken a bite of the apple. Milk produced by cows injected with a GM protein called recombinant bovine growth hormone (bGH), is found, unlabelled, on grocery shelves throughout the US. In 1999, half of the soybeans and cotton harvested in the US were GM varieties. Billions of dollars of public and private monies are being invested annually in biotech research, and commercial sales now reach into the tens of billions of dollars each year. Whereas ag biotech once promised to change American agriculture, it now is in the process of doing so. (shrink)

Should the law recognize an elephant’s right to be released from solitary confinement? The New York State Court of Appeals—the highest court in the State of New York—will consider this question on May 18. At issue is an Asian elephant named Happy. But happy she is not. Every human being has a right to bodily liberty because they have strong interests that this right protects. Crump et al.’s contribution to assessing whether decapods feel pain raises an important question: Is pain distributed unevenly across the order? The case for pain appears stronger in Pleocyemata than in Dendrobranchiata. Some studies report pain avoidance behaviors in Dendrobranchiata (Penaeidae) shrimp, but further studies are needed to determine whether the chemicals used are acting as analgesics to relieve pain, or as soporifics to reduce overall alertness. If the latter, the most farmed shrimp species may not require the same level (...) of protection as crabs, crayfish, and lobsters. (shrink)

We submit this brief in support of the Nonhuman Rights Project’s efforts to secure habeas corpus relief for the elephant named Happy. The Supreme Court, Bronx County, declined to grant habeas corpus relief and order Happy’s transfer to an elephant sanctuary, relying, in part, on previous decisions that denied habeas relief for the NhRP’s chimpanzee clients, Kiko and Tommy. Those decisions use incompatible conceptions of ‘person’ which, when properly understood, are either philosophically inadequate or, in fact, compatible with Happy’s personhood.

In this paper I argue for the following six claims: 1) The problem is that some think metacognition and consciousness are dissociable. 2) The solution is not to revive associationist explanations; 3) …nor is the solution to identify metacognition with Carruthers’ gatekeeping mechanism. 4) The solution is to define conscious metacognition; 5) … devise an empirical test for it in humans; and 6) … apply it to animals.

I am in almost complete agreement with Arlene Lo (2022). Child abuse victims surely suffer hermeneutical injustice if they are denied the concepts necessary to understand their experience, and that injustice is immensely harmful. In this reply, I offer an amendment to Lo’s use of Sally Haslanger’s distinction between manifest and operative concepts. I then raise some wider questions about the hermeneutical marginalization of children. The work that has so far been done on epistemic injustice against children has focused mostly (...) on testimonial injustice. It is time to give more attention to hermeneutical injustice. (shrink)

I sketch a non-rights-based grounding for the impermissibility of spanking. Even if children have no right against being spanked, I contend that spanking can be seen to be impermissible without appeal to such a right. My approach is primarily consequentialist but also has affinities with virtue ethics, for it emphasizes the moral importance of avoiding bad habits in one’s behavior toward one’s children.

Gary Chartier shows how commitment serves to resolve conflicts between ordinary moral intuitions and the reality that the basic aspects of human well-being are incommensurable. He outlines a variety of overlapping and mutually reinforcing rationales for making commitments, explores the relationship between commitment and vocation and the relevance of commitment to love, and notes some reasons why it might make sense to disregard one’s commitments. ‘Linguistic meaning must be public’ – for Quine, here is not a statement to rest with, whether it be reckoned true or reckoned false. It calls for explication. When we do, using Quine’s words to piece together what he thought, we find that much too much is concealed by the original statement. Yes, Quine said ‘Language is a social art’; yes, he accepts behaviourism so far as linguistic meaning is concerned; yes, he broadly agrees with Wittgenstein’s anti-privacy stricture. But precisely (...) what is being said by the original statement to be public, and what does calling it ‘public’ amount to? Pressing such questions complicates the picture enormously, partly though by no means entirely aligning Quine with linguistic internalism vis-à-vis Chomsky. (shrink)

The argument for vegetarianism from overlapping species goes like this. Every individual who is the subject of a life has a right to life. Some humans—e.g., the severely congenitally cognitively limited—lack language, rationality, autonomy, and self-consciousness, and yet they are subjects of a life. Severely congenitally cognitively limited humans have a right to life. Some animals—e.g., all mammals—lack language, rationality, autonomy, and self-consciousness, and yet they are subjects of a life. We ought to treat like cases alike. The cases of (...) some humans are like the cases of some animals. Therefore, some animals have a right to life. -/- The argument seems not to have moved many people to change their diets. The reason, I suggest, is not because the argument is unsound but because our ability to change our dietary practices is difficult and we lack the imaginative resources to see the world from a nonhuman perspective. -/- I suggest that creative artists are of great value here, and I provide an example by referring to the work of the American novelist, Cormac McCarthy.
