Das Werk des Münsteraner Philosophen erscheint der Erziehungswissenschaft bisher nicht nur deshalb als terra incognita, weil er sich zu pädagogischen Themen kaum geäußert hat, sondern auch, weil sein Werk bereits zu Lebzeiten einen beachtlichen Umfang aufwies und durch zahlreiche Veröffentlichungen aus dem Nachlass nochmals bedeutend erweitert wurde. Nur vereinzelt und verstreut liegen bisher disziplinbezogene Anschlussversuche vor. Mit diesem Band (...) wird deshalb der erste Sammelband zur erziehungswissenschaftlichen Blumenberg-Rezeption vorgelegt, der Beiträge zu Blumenbergs Metaphorologie, Anthropologie und seiner kritischen Auseinandersetzung mit Platons Höhlenmythos zusammenträgt. We enter here upon a history of conversational traffic between the respective departments of philosophy and law in the old academy of liberalism, where lawyers hear much from philosophers, yes-and philosophers hear from lawyers, too, in what has fruitfully been a both-ways exchange. Our philosophical protagonist is John Rawls. This book comprises a study of the rise and workings, within the Rawlsian political-liberal philosophy, of the idea of a country's higher-legal constitution as a public platform for the justification of political (...) coercion. A study of Rawls on constitutionalism can help us, I believe, in scoping out and managing a cluster of constitutional lawyers' debates-interminable ones, it seems, in the constitutional-democratic precincts of our times-that I will catalogue soon below. But conversely, I believe, those seeking the best and truest readings of Rawls might have something to learn from the controversies of the lawyers. My approach to Rawls has accordingly been that of a critically leavened (while no doubt broadly sympathetic) exegesis, while with the legal-discursive materials I take more of a diagnostic turn. My hope is that a treatment of these two discourses in relation to each other will prove an aid to both political-philosophical and legal-practical reflection. (shrink)

Recent experiments in moral psychology have been taken to imply that moral reasoning only serves to reaffirm prior moral intuitions. More specifically, Jonathan Haidt concludes from his moral dumbfounding experiments, in which people condemn other people’s behavior, that moral reasoning is biased and ineffective, as it rarely makes people change their mind. I present complementary evidence pertaining to self-directed reasoning about what to do. More specifically, Albert Bandura’s experiments concerning moral disengagement reveal that moral reasoning often does contribute effectively to (...) the formation of moral judgments. And such reasoning need not be biased. Once this evidence is taken into account, it becomes clear that both cognition and affect can play a destructive as well as a constructive role in the formation of moral judgments. (shrink)

In The Democratic Horizon: Hyperpluralism and the Renewal of Political Liberalism, Alessandro Ferrara seeks a philosophical breakthrough from what looks like it could be a pending dead-end for democracy. The best hope, Ferrara superbly maintains, lies through an extension or updating – a “renewal,” as he calls it – of lines of thought bequeathed to us, by John Rawls and others, under the name of political liberalism. Somewhere near the crux of Ferrara’s reflection stands a class of institutional fixtures whose (...) name is missing from his title. I mean the class “constitution.” I use that word to name a country’s scriptural basic law, its publicly cognizable corpus of canonically worded sentences ordaining the country’s basic institutional framework. My suggestion will be that it is no less tellingly a “constitutional” than a “democratic” horizon that Ferrara’s work, in conjunction with Rawls’s, shows us to be facing. (shrink)

The discussion of Kuukkanen’s bookPostnarrativist Philosophy of Historiography is presented here in the form of a dialogue. The dialogue addresses the following five issues: 1) the kind of claims typically made in- and by the historical text, 2) narrativism and historical representation, 3) representational holism, 4) representationalism and non-representationalism and 5) the role of argument in historical writing. While agreement is within reach for the two participants in the dialogue in case of the two first issues, opinions begin to diverge (...) with the third one. Disagreement boils down to the hierarchy between representation and argument: is representation the master that argument has to serve, or has representation nothing to add to what argument can and will give us? John Rawls proposed, as what he called “the liberal principle of legitimacy,” that coercive exercises of political power can be justified to free and equal dissenters when “in accordance with a constitution (written or unwritten) the essentials of which all citizens, as reasonable and rational, can endorse.” Does “unwritten constitution” there refer to norms of constitutional import, but that subsist only as custom, not as law? To norms that subsist as common law but not as code law? To empirical regularities (...) of political practice, as opposed to normative rules and standards? Which interpretation is best? (shrink)

The capacity of narrative to submit to the desires of this or that mind without giving up secret potential may be crudely represented as a dialogue between story and interpretation. This dialogue begins when the author puts pen to paper and it continues through every reading that is not merely submissive. In this sense we can see without too much difficulty that all narrative, in the writing and the reading, has something in common with the continuous modification of text that (...) takes place in a psychoanalytical process or in the distortions induced in historical narrative by metahistorical considerations. All that I leave to Roy Schafer1 and Hayden White. My immediate purpose is to make acceptable a simple proposition: we may like to think, for our purposes, of narrative as the product of two intertwined processes, the presentation of a fable and its progressive interpretation . The first process tends toward clarity and propriety , the second toward secrecy, toward distortions which cover secrets. The proposition is not altogether alien to the now classic fabula/sujet distinction. A test for connexity is that one can accurately infer the fable . The sujet is what became of the fable when interpretation distorted its pristine, sequential propriety . · 1. This doctoral dissertation is a study of Nietzsche's views on morality in order to assess his contribution to moral philosophy. Towards this end, it examines Nietzsche's understanding of morality as well as the scope of his attack. I then offer a reading of Nietzsche's critique of morality, arguing that he rejects morality insofar as it functions within society to preserve the 'herd' at the expense of 'higher types' whose flourishing resides elsewhere. In short, I claim that Nietzsche rejects morality insofar (...) as it proves inimical to the flourishing of these 'higher types'. I also claim that Nietzsche is more than a mere critic of morality, and that his fundamental 'ethical' preoccupation with exemplary individuals is what motives his critique, and forms the basis of his affirmative ethic of human flourishing. Moreover, I contend that Nietzsche defends his positive morality by presenting the character of Zarathustra , and later himself as exemplars of human excellence who must rely on their ability to convince others performatively, rather than by means of discourse, or argumentation. Ultimately, I conclude that Nietzsche's ethics does not fit comfortably within the moral tradition as he is an opponent of deontological ethics, utilitarianism, and virtue ethics despite certain affinities with the latter. This fact does not detract from the rich contribution that Nietzsche makes to moral philosophy as bode critic and champion of an affirmative ethic. (shrink)

This research looks what happens to human reproduction when human genetic information is digitized. By employing speculative design as a transdisciplinary strategy to construct such an alternative future to open up public dialogues, it aims to stimulate audiences in an artistic way to deliberate two key questions: (1) how will biotechnology recondition and recontextualize the natural processes of genetic information (i.e. expression, replication, transmission and mutation) and our physiological processes (e.g. reproduction)? And (2) what might be the ethical, legal and (...) social implications (ELSI) for using such biotechnology? To this end, this practice-based research introduces the ‘e-gamete Digital Procreation Service’ (2019) – a speculative design project that has been developed as an approach to invite audiences to a future scenario of network-transmitted genetic information and computer-simulated human procreation. The carefully designed future service (an ironic practice of commercialization) allows human reproduction to take place outside of the human body. Audiences are encouraged to contemplate what novel situations might occur within their own futures and to consider broader questions like how family, parenthood, marriage, etc. are redefined and what new social relationships might emerge. By employing speculative design as an artistic research tool/tactic to step outside the technical limitations and craft the future service, the project asks vital question about the future in a provocative and quasi-realistic manner. Thus, the research forms a unique entanglement of sensitive topics by dealing with future biotechnology and human reproduction. (shrink)

The terms “politics” and “political” have become so overdetermined that it is difficult to use them in any effective manner. We argue that this has dangerous political consequences, and that this could be addressed by providing a new, sounder, notion of politics. This paper argues that defining politics in relation to the notion of play can provide a notion both intuitively appealing and able to withstand the problematic overdeterminations. We argue that politics is the set of practices through which the (...) indeterminate of Spielraum is made more determinate. This suggests that politics is always partly a matter of play: it is about instituting values without making any claims about the legitimacy of this instituting act. With reference to Huizinga and Nietzsche’s analyses of play, we define play as the living unity of seriousness and frivolity, and non-play as either seriousness without frivolity or frivolity without seriousness. In order to illustrate this, we comparatively analyse the attitudes of Barack Obama and Donald Trump in the single context of the well-known yearly White House Correspondent’s Dinner. There, we see two opposed attitudes to playfulness. Our analysis allows us to apply our _Spielraum_ model of politics to show that the thrust of Obama’s attitude involves an embrace of the non-foundational nature of politics as play, whereas Trump’s attitude is politicidal: it is animated by a refusal to acknowledge its own lack of foundation, leading to an oscillation between over-seriousness and over-frivolity. With the advent of synthetic biology, scientists are increasingly relying on digital sequence information, instead of physical genetic resources. This article examines the potential impact of this shift on the access and benefit-sharing (ABS) regime of the Convention on Biological Diversity (CBD) and the Nagoya Protocol. These treaties require benefit-sharing with the owners of genetic resources. However, whether “genetic resources” include digital sequence information is unsettled. The CBD conceives genetic resources as genetic material containing functional units of heredity. “Material” implies (...) tangibility, and for some scholars, “functional units of heredity,” undefined in both treaties, mean full-coding sequences. This article argues that digital sequence information obtained from physical genetic resources, full-coding or not, should be treated as genetic resources. Literal construction of the CBD risks eroding its usefulness and the ABS regime. This is because through bioinformatics, sequence information can easily be obtained from genetic resources for utilization, without physically moving them or concluding ABS agreement with owners. The CBD must evolve with scientific progress also because sequence functionality depends on the state of knowledge. These arguments are vindicated by domestic ABS laws equating genetic information with genetic resources; Nagoya Protocol provisions deeming research exploiting the genetic composition of genetic resources as utilization of genetic resources; and CBD provisions requiring the sharing of benefits from the utilization of genetic resources. Moreover, treaty interpretation and case law demand that generic, scientific terms, such as “genetic resources” and “functional units of heredity” be interpreted in an evolutionary manner to capture scientific developments. Like many governments in this COVID-19 pandemic, the Nigerian government imposed a lockdown on the country. As a consequence of the lockdown, many businesses shutdown and effectively had no source of revenue. Yet, without receiving any bailout or palliatives from the government, these businesses are required to meet their tax obligations to the government. Bearing in mind that this time (COVID-19 era) is different, one wonders what is required of businesses in view of the taxation problem and the social contract (...) between the businesspersons and the government. In view of social contract obligations, in this COVID-19 pandemic should businesses pay tax to a government that seems to have delegitimised itself by its exploitative actions in terms of taxation and delinquent omission in terms of the provision of public goods and social services? The Nigerian government at all tiers (federal, state and local) seldom respect the essence of taxation. Therefore, businesses often pay tax for nothing. For many businesses, as far as taxation is concerned, to pay or not to pay? that is the question. This article is aimed at teasing out this taxation problem that may or may not be a moral dilemma. In view of certain ethical considerations, this article shows why in spite of social contract obligations, there is no consensus or canonical agreement on whether, as law-abiding citizens and juridical persons (legal entities), businesspersons and businesses ought to or ought not to pay tax to the Nigerian government in this COVID-19 pandemic. It is thus urgent to show what people would gain from a shift to a post-neoliberal and post-growth convivialist future.
