AimThe functional prognosis of patients after coma following either cardiac arrest or acute structural brain injury is often uncertain. These patients are associated with high mortality and disability. N20 and N70 somatosensory evoked potentials are used to predict prognosis. We evaluated the utility of SSEP as an early indicator of long-term prognosis in these patients.MethodsThis was a retrospective cohort study of patients admitted to the intensive care unit with a diagnosis of coma after CA or ABI. An SSEP study was (...) performed, including N20 and N70 at 24–72 h, after coma onset. Functional recovery was assessed 6–12 months later using the modified Glasgow scale. The study was approved by our local research ethics committee.ResultsIn the CA and ABI groups, the absence of N20 or N70 was a strong indicator of poor outcome. Conversely, the presence of N70 was an indicator of a good outcome.ConclusionSomatosensory evoked potentials are useful early prognostic markers with high specificity and sensitivity. Our aim in this paper is to clarify the distinctions and the relationships among several phenomena, each of which has certain characteristics of what is generally called “deference”. We distinguish linguistic deference, which concerns the use of language and the meaning of the words we use, from epistemic deference, which concerns our reasons and evidence for making the claims we make. In our in-depth study of linguistic deference, we distinguish two subcategories: default deference, and deliberate deference. We also discuss the (...) phenomenon of im-perfect mastery, often associated with deference, and which we show to be independent both of linguistic deference and of epistemic deference. If our analysis is correct, then some recent debates on deference can be shown to result from a failure to appreciate all the distinctions that we draw here. (shrink)

Several recent studies (see Knobe & Yalcin, 2014; Khoo, 2015; Marques, 2018; Kneer, 2021a) address linguistic retraction from an experimental perspective. In these studies, speakers’ intuitions regarding the mandatory nature of retraction are tested. Pace MacFarlane, competent speakers (of English) do not consider retraction to be obligatory. This paper examines two methodological features of the above-mentioned studies: they do not take into consideration the difference between public and private contexts; neither do they incorporate the distinction between evaluative and descriptive statements. (...) In this paper, we report the results of two studies conducted to empirically test the hypothesis that retraction is, above all, a public phenomenon. Our findings show that context exerts a significant effect on speakers’ attitudes toward retraction. (shrink)

Drawing on a landscape analysis of existing data-sharing initiatives, in-depth interviews with expert stakeholders, and public deliberations with community advisory panels across the U.S., we describe features of the evolving medical information commons. We identify participant-centricity and trustworthiness as the most important features of an MIC and discuss the implications for those seeking to create a sustainable, useful, and widely available collection of linked resources for research and other purposes.

La elaboración de esta obra ha sido posible gracias a las aportaciones tan versátiles que el Seminario de Epistemología de las Ciencias de la Salud (SECS) acogió en su programa transversal: donde se trataba de articular aquello que hemos venido llamando una filosofía de la medicina en concreto y una filosofía de las ciencias de la salud en general. BackgroundThe last few decades have seen the rising global acknowledgment of the importance of ethics in the conduct of health research. But research ethics committees or institutional review boards (IRBs) have also been criticized for being barriers to research. This article examines the case of the Philippines, where little has been done to interrogate the health research and IRB culture, and whose circumstances can serve as reflection points for other low- and middle-income countries.MethodsSemi-structured interviews were conducted from July to October (...) 2020 to elicit health researchers’ perspectives and experiences regarding IRBs and the ethics approval process in the country, as well as counterpoint narratives from researchers who have also worked for IRBs.ResultsAcross the fields of clinical, public health, and social science research, the issue of ethics review revealed itself to be foremost an issue of inequity. IRB processes serve as a barrier for those outside the academe; those belonging to institutions, cities, or entire regions without their own accredited IRBs; and researchers working independently, without ample budget, or on highly specialized topics—more so for non-clinical researchers who must grapple with the primarily biomedical framework of most IRBs. Consequently, the research landscape invariably favors those with the resources to do research, and researches that tend to attract funding.ConclusionThe broader challenge of equity in health research will entail more fundamental reforms, but proximal interventions can be done to make the ethics approval process more equitable, such as enhancing institutional oversight, regulating IRB fees, and enabling a more supportive and welcoming environment for early-career, student, independent, and non-clinical health researchers. This article ends by reflecting on the implications of our findings toward the larger research culture. (shrink)

This is the third volume of the new series Social, Political, & Legal Philosophy and it deals with the relationship between Law and The Philosophy of Action. In this volume a number of legal issues are illuminated by resource to the analysis of mental concepts. Issues in Criminal Law, Contract Law, Acceptance of Legal Systems, and the nature of Legal Norms are some of the main issues dealt in the papers that constitute the volume. Conceptual analysis is used and new (...) overtures are made into current findings in the Cognitive Sciences. All of this results in illuminating accounts that throw new light on traditional fundamental legal issues. This volume is a precursor in the powerful theorizing of the Cognitive Sciences that is being brought to bear in the Philosophy of Mind and in the theory of Law, and this theorizing will increase in the coming years. This paper aims to provide two abductive considerations adducing in favor of the thesis of Necessitism in modal ontology. I demonstrate how instances of the Barcan formula can be witnessed, when the modal operators are interpreted 'naturally' -- i.e., as including geometric possibilities -- and the quantifiers in the formula range over a domain of natural, or concrete, entities and their contingently non-concrete analogues. I argue that, because there are considerations within physics and metaphysical inquiry which corroborate modal relationalist claims (...) concerning the possible geometric structures of spacetime, and dispositional properties are actual possible entities, the condition of being grounded in the concrete is consistent with the Barcan formula; and thus -- in the geometric setting -- merits adoption by the Necessitist. Part of the appeal of the biological approach to personal identity is that it does not have to countenance spatially coincident entities. But if the termination thesis is correct and the organism ceases to exist at death, then it appears that the corpse is a dead body that earlier was a living body and distinct from but spatially coincident with the organism. If the organism is identified with the body, then the unwelcome spatial coincidence could perhaps be avoided. It is (...) argued that such an identification would be a mistake. A living organism has a different part/whole relationship and persistence conditions than the alleged body. A case will be made that the concept ‘human body’ is a conceptual mess, vague in an unprincipled manner, and that an eliminativist stance towards dead bodies is the appropriate response. Theoretical tools aimed at making explicit the injustices suffered by certain socially disadvantaged groups might end up serving purposes which were not foreseen when the tools were first introduced. Nothing is inherently wrong with a shift in the scope of a theoretical tool: the popularization of a concept opens up the possibility of its use for several strategic purposes. The thesis that we defend in this paper is that some public figures cultivate a public persona for whom the conditions of (...) the notion of testimonial injustice might be taken to apply, and this situation is exploited to their advantage, as a means to advance their political agendas. More specifically, they take advantage of this to generate situations of crossed disagreements, which in turn foster polarization. (shrink)

As a continuation of the work of the third author in [5], we make further observations on the features of Galois cohomology in the general model theoretic context. We make explicit the connection between forms of definable groups and first cohomology sets with coefficients in a suitable automorphism group. We then use a method of twisting cohomology (inspired by Serre’s algebraic twisting) to describe arbitrary fibres in cohomology sequences—yielding a useful “finiteness” result on cohomology sets. Applied to the special case (...) of differential fields and Kolchin’s constrained cohomology, we complete results from [3] by proving that the first constrained cohomology set of a differential algebraic group over a bounded, differentially large, field is countable. Second, we examine the way in which familiar expressivist results can be accommodated within this framework, through a particular interpretation that the expressive realm lends to a theory of meaning. Expressivist theories of meaning address only a portion of the classical problems attributed to this position when they seek to explain why the expressions they (...) deal with have a given meaning. A position can nevertheless be termed ‘expressivist’ – in the minimal sense that we favor – based simply on the following key features of the meaning of these expressions: they can be used as functions of propositions, and they are not used to describe the way the world is. This research analyzes the theoretical answer received by one of the factors that cause the so-called Price Revolution in Europe during the 16th and 17th centuries, specifically the aspect related to the alterations in the monetary values ​​of pieces of vellón and silver in Castile and England. In both countries, these episodes were rigorously analyzed from a theoretical point of view, as can be seen from the study of the monetary ideas of the period that were developed in these territories. In this study, in light of the historical events that took place, we analyze the foundations of the monetary thought of Juan de Mariana and John Locke who oppose the the alteration of money by the sovereign for fiscal reasons, as well as their different reception. The purpose of this paper is to explore the connection between expressivism and disagreement. More in particular, the aim is to defend that one of the desiderata that can be derived from the study of disagreement, the explanation of ‘crossed disagreements’, can only be accommodated within a semantic theory that respects, at the meta-semantic level, certain expressivistic restrictions. We will compare contemporary dynamic expressivism with three different varieties of contextualist strategies to accommodate the specificities of evaluative language –indexical contextualism – (...) truth-conditional pragmatics –, pragmatic strategies using implicatures, and presuppositional accounts. Our conclusion will be that certain assumptions of expressivism are necessary in order to provide a semantic account of evaluative uses of language that can allow us to detect and prevent crossed disagreements. The analysis of TV violence cannot be limited to the quantification of its incidence, but should also take into account the type of violence broadcast and its context (what is depicted and how). Thus, normative models of violence (legitimized violence with positive consequences for the aggressor, or vice versa) could be understood as positive, while contra-normative models of violence (rewarding illegitimate violence and punishing legitimate violence) should be of far greater concern. This paper analyzes the normative contexts of TV violence (...) through a content analysis of randomly selected fragments of TV programming (147 recorded hours). The results show that news programs and TV series/soaps delegitimized violence to a higher extent, while films tend to show legitimized or ambivalent violence. Positive consequences of violence predominate in fictional programs, except for TV series/soaps. Normative presentation of violence is more frequent, especially in nonfiction genres, as fiction has more freedom to depict the socially undesirable. (shrink)

In this innovative study, Lea David critically investigates the relationship between human rights and memory, suggesting that, instead of understanding human rights in a normative fashion, human rights should be treated as an ideology. Conceptualizing human rights as an ideology gives us useful theoretical and methodological tools to recognize the real impact human rights has on the ground. David traces the rise of the global phenomenon that is the human rights memorialization agenda, termed 'Moral Remembrance', and explores what happens once (...) this agenda becomes implemented. Based on evidence from the Western Balkans and Israel/Palestine, she argues that the human rights memorialization agenda does not lead to a better appreciation of human rights but, contrary to what would be expected, it merely serves to strengthen national sentiments, divisions and animosities along ethnic lines, and leads to the new forms of societal inequalities that are closely connected to different forms of corruptions. Liberal thinkers of the eighteenth and nineteenth centuries were alert to the political costs and human cruelties involved in European colonialism, but they also thought that European expansion held out progressive possibilities. In Progress, Pluralism, and Politics David Williams examines the colonial and anti-colonial arguments of Adam Smith, Immanuel Kant, Jeremy Bentham, and L.T. Hobhouse. Williams locates their ambivalent attitude towards European conquest and colonial rule in a set of tensions between the impact of colonialism on European states, the possibilities (...) of progress in distant and diverse places, and the relationship between universalism and cultural pluralism. In so doing he reveals some of the central ambiguities that characterize the ways that liberal thought has dealt with the reality of an illiberal world. Of particular importance are appeals to various forms of universal history, attempts to mediate between the claims of identity and the reality of difference, and the different ways of thinking about the achievement of liberal goods in other places. Pointing to key elements in still ongoing debates within liberal states about how they should relate to illiberal places, Progress, Pluralism, and Politics enriches the discussion on political thought and the relationship between liberalism and colonialism. Moral claims not only purport to be true, they also purport to guide our choices. This book presents a new theory of normative judgment, the "standard-based theory," which offers a schematic account of the truth conditions of normative propositions of all kinds, including moral propositions and propositions about reasons. The heart of Copp 's approach to moral propositions is a theory of the circumstances under which corresponding moral standards qualify as justified, the " society -centered theory." He argues that because (...) any society needs a social moral code in order to enable its members to live together successfully, and because it would be rational for a society to choose such a code, certain moral codes, and the standards they include, are justified. According to the standard-based theory then, if certain moral standards are indeed justified, corresponding moral propositions may be true. Copp 's approach to morality and explaining normativity and the truth conditions of moral claims, raises a number of important issues in moral theory, as well as in metaphysics and the philosophy of language. The way digital information technologies work and, more specifically, the possibilities for action that technological devices offer to us affect our processes of political belief formation. In particular, there seems to be a close connection between our digital affordances and the increase of the sort of polarization that threatens the proper functioning of democracy. In this paper, we analyze whether the type of polarization linked to the use of digital technologies, and which endangers the health of public deliberation, has to (...) do with the adoption of beliefs whose contents are increasingly extreme—extremism—or, on the contrary, has more to do with increasing our credence in the core beliefs of our political identity—radicalism.
