Can one do better than this? For D. C. Clarke, Western philosophy has undergone two revolutionary breaks with its past: the first initiated by Descartes directed against classical philosophy and the second initiated at the turn of this century that came to be known as analytic philosophy. (Continental philosophy is barely mentioned. Heidegger is briefly referred to as a bad example of a philosopher who “employs vacuously general language better designed for expressing attitudes than for advancing claims vulnerable to criticism” [192].) A revolutionary shift of framework, for Clarke, eliminates a whole set of problems. Even though the problems discussed by analytic philosophers seem similar to many of those discussed by Plato and Descartes, in fact the relation is tenuous, and current problems have new meanings (190).Clarke offers little help in defining analytic philosophy for “we find today the clear sense of purpose of analytic philosophy which flourished forty years ago being replaced by a variety of programs sharing no easily discernible common thread” (xi). It looks as if the revolutionary élan has been replaced by business as usual. Clarke’s volume is not, however, a history of analytic philosophy but a survey intended for students and the general reader of the views of analytic philosophers on a selected group of problems: approaches to language, the relation of mind to body, the nature of belief, knowledge, and understanding, the relation between philosophy and science, ethics, and philosophical method. Clarke discusses each issue with clarity and insight and argues for his own views, which are always interesting. He criticizes the current tendency in analytic philosophy toward excessive specialization and argues that the special task of philosophy is to search for a framework capable of integrating various aspects of culture. He emphasizes the importance of the study of the history of philosophy: “The central concepts of any integrating framework are few.... The history of philosophy is an indispensable aid in providing such understanding in choosing those [End Page 481] concepts that can serve this function in the present” (191). This book can be recommended for courses in analytic philosophy and in the history of philosophy in the twentieth century.Most of the essays in the volume edited by Glock are concerned to advance ways of characterizing analytic philosophy. Most of them reject Dummett’s claim that analytic philosophy is distinguished by its concern with explaining thought by giving an account of language. In his essay, Dagfinn Føllesdal recognizes the difficulty of constructing any useful classification of intellectual trends. Because analytical philosophy cannot be characterized by reference to doctrines or problems, he proposes to distinguish it by reference to its approach to philosophical problems: “analytic philosophy is very strongly concerned with argument and justification. An analytic philosopher asks: what reasons are there for accepting or rejecting this position?” (7). The interest in language is merely an offshoot of this more fundamental concern. It follows that “the analytic/non-analytic distinction runs across other divisions.... Whether one is an analytic philosopher depends on what importance one ascribes to argument and justification” (14). Thus Aquinas and Descartes, among others, count as analytic philosophers but not Heidegger or Derrida because “they predominantly make use of rhetoric” (12). Graebe (Steubenville, OH: Emmaus Academic, 2021), 351 pp.Though Mary's undiminished virginity in giving birth (virginitas in partu) was long understood to be an event as miraculous and a teaching as authoritative as her virginity (...) in conceiving (virginitas ante partum), virginitas in partu underwent a kind of existential reinterpretation in the middle of the twentieth century. Authors such as Albert Mitterer and Karl Rahner suggested that, physically speaking, Jesus's birth might have happened like any other, rupturing the hymen, distending the birth canal, and causing Mary pain, albeit not in the spiritually disintegrating way common to postlapsarian humanity. These arguments effectively "unsettled" the traditional understanding of virginitas in partu, leading theologians of the highest stature to distinguish between the doctrine itself and the anatomical aspects attached to it over time. Fr. Brian Graebe has written a fine book arguing that the bodily dimensions of the virgin birth, including the physical "seal" of virginity, belong to the substance of the doctrine. This more inclusive understanding not only does better justice to the data of tradition, he argues, but illuminates the ecclesiology of the Second Vatican Council. The book impresses by its theologically reflective method, its clarity of exposition, [End Page 1106] and its depth of research—especially into the archival and antepreparatory sources of Vatican II.Vessel of Honor responds in effect to Rahner's argument that physical intactness is peripheral to the dogmatic core of Mary's virginity in partu. To show otherwise, Rahner contended, one would need to show that such a doctrine can be found directly in the apostolic teaching, or that it, "being implicitly contained therein, has grown out of the apostolic doctrine, by a legitimate historical, logical, and theological process, as its authentic development" (68–69). If the bodily aspects of this doctrine really belonged to the deposit of faith, in other words, one would need to show how they are implied in the traditio divino-apostolica, as well as how they cohere organically with the rest of the deposit. The two major parts of Vessel of Honor respond in turn to each aspect of Rahner's challenge.The first three chapters argue that Mary's bodily integrity in parturition belongs at least implicitly to the traditio divino-apostolica. Turning first to the postapostolic tradition, Fr. Graebe shows that—apart from the early exceptions of Origen and Tertullian—patristic sources either affirm or strongly imply a miraculous delivery. This constant witness culminates in the Lateran Council (649 AD), which, while not itself an ecumenical council, was received into the magisterium of Pope Martin and affirmed by the Third Council of Constantinople (680 AD). Its teaching that Mary "gave birth without corruption" (incorruptibiliter... genuisse) would be defended by Paschasius, Ratramnus, Thomas Aquinas, and others. This consensus remained undisturbed until the eve of Vatican II.Even at Vatican II, Fr. Graebe argues in the next chapter, the Council Fathers intended to reaffirm the more inclusive idea of virginitas in partu against those who would marginalize its bodily dimensions. Playing on popular enthusiasm for science and technology, Jackson rehearsed the wondrous progress of the arts and the role of science in that progress. Science was the ‘Hand-maiden of the Arts’, and most assuredly the ‘maid of honor’, (...) he declared, for science was the ‘progressive power’ which inspired new inventions. Hegel called world history a court of judgement, a world court, and in his Lectures on the Philosophy of World History he took Africans before that court and found them to be barbaric, cannibalistic, preoccupied with fetishes, without history, and without any consciousness of freedom. -/- In this paper, after rehearsing some of the more familiar objections to Hegel's verdict against Africa, I turn the tables and put Hegel on trial. More specifically, given that much of Hegel's (...) account is directed against the Ashanti, I will use what is known about them and especially what Hegel either did know or should have known, to take him before the court of the Ashanti, where the use of evidence can be interrogated. The results of this examination render all the more pressing the need to give an account of how Hegel applied his system of justice to Africa, which I attempt to do in the second part of the paper. In the third part, I return to the interpretation of Hegel's statement about Africa as unhistorical and, having restored it to its context in Hegel's system, show its. (shrink)

There is a common tradition in European education going back to the Middle Ages which long played a part in providing the curriculum of schools which catered both for the wealthy and for able sons of less well-to-do families. Originally published in 1974, this volume examines the relationship between education and society in the different countries of Europe from which differences in tradition and practice emerge. The countries discussed include: France, Germany, the former Soviet Union, Poland and Sweden.

I examine Heidegger's reflections on the Anaximander fragment, concentrating on the question of justice. In his commentary, Heidegger draws on Nietzsche's thoughts about justice, the will to power, and nihilism to formulate an interpretation of the fragment that connects it to the epochal history and destiny of being. This "ontological" interpretation, constructed in a compelling reading of the history of philosophy, requires that Heidegger first address the historicism and "ontological forgetfulness" prevailing in historical consciousness and historiography, in order (...) to begin thinking towards the possibility of another epoch of being, releasing us from the injustice that is inherent in the ontology that rules in the present historical dispensation. Although Heidegger avoids moral prescription, he cannot avoid critical entanglement in the moral-juridical sense of justice, despite his claims and protestations, since, as his own account of the fragment implies, justice and ontology must be inseparable. Reading Heidegger's commentary in relation to Benjamin's philosophy of history, I argue that Heidegger's reflections on justice suggest a narrative of tragic hope that resembles Benjamin's configuration of justice in his reading of the Baroque mourning-play, where the hopelessly fragmented and imperiled image of justice is revealed as emerging from a Leidensgeschichte fatefully bound up in the continuum of a Schuldgeschichte. Since Opuz v. Turkey (2009), the European Court of Human Rights (ECHR) delivered over a dozen judgments in which it examined domestic violence through the prism of gender-based discrimination. Apart from the individual circumstances of the cases, the Court considered the general approach to domestic violence in the defendant states, searching for a large-scale structural gender bias. Hence, although the Court has not directly referred to the notion of “structural discrimination” in relation to domestic violence, it engaged in unveiling this (...) problem within the state parties. Building on the case law of the Court, the article presents and systemizes information that may prove structural gender discrimination in domestic violence cases. It navigates potential applicants through the Court’s interpretation and indicates arguments and sources that may support their claims. In particular, it discusses what kind of data and information may demonstrate the general, discriminatory attitude of the authorities towards domestic violence and what sources the applicants may use while seeking the evidence. The constitutional right to self-expression, used by societies professing democratic values (Constitution, Article 25), is a highly important feature for forming the political will of the citizenry. A broad, multi-sided public discussion on all issues of public interest is only possible with the existence of an appropriate amount of freedom of information. A strong mechanism for disseminating information that operates between citizens and the parliament is able to generate a sphere for discussion and mutual influence which are essential for indirect (...) democracy. A discussion’s depth, quality and comprehensiveness constitute important factors which determine the correctness of choices made by citizens and politicians. Mainly, it is the free press which fosters communication between political parties and citizens. The role of the “watchdog” is fundamental to revealing the circumstances under which politicians or other public persons make different political and administrative decisions. This is what permits the identification of motives for rulings and the circumstances under which they were approved. (shrink)

This article deals with military honour in nineteenth-century Spain, after first examining how the meaning of this term evolved from the revolutionary Napoleonic wars onwards. This highly important moral value was learnt from the moment someone joined the army, and even before then, through education and common public military demonstrations. It related to individual behaviour, while also maintaining a high collective and corporative aspect, and it varied depending on gender or class and on the identity of the social group. It (...) was part of the political thought of most relevant Spanish generals, and consequently it influenced the political dynamics of Spain. The Court of Honour, an institution in Spain that was not regulated until 1811, controlled honour compliance. The last section of this article focuses on how and why these institutions were born and explains their early legislative evolution. Spanish political and military development are inevitably bound together to the extent that an understanding of the nature of honour and its effects on the army and civilian ethics provides us with a deep socio-political and ethical analysis of the country during the nineteenth century. The history of Ammianus Marcellinus states that Constantius II renamed the Pontic diocese Pietas, in honour of his second wife, Aurelia Eusebia . pietas refers to sacred dutiful conduct toward all, specifically gods, state, and family. Constantius’ purpose in renaming the diocese poses an interesting question because it holds an important key to understanding the role Eusebia played in supporting her husband's position as emperor. In other words, what kind of part could an empress play in the Late Empire? (...) Constantius may indeed have been honouring his wife. Why, however, would he honour her so? Is pietas just a play on the empress's name, which means ‘piety’ in Greek, or is there a deeper meaning? A search of late Imperial evidence on this woman and etymology on this word is needed. ABSTRACT The academic defense of honor for its positive political and moral effects has surged recently among moral philosophers and political theorists. Challenging the narrative that the feudal legacy of honor has become outdated but acknowledging the reasonable points that opponents of honor have made, contemporary defenders aim to render honor compatible with society and politics today. This defense is reminiscent of that in the seventeenth and eighteenth centuries, especially four modes of honor developed respectively (...) by Hobbes, Mandeville, Montesquieu, and Rousseau. Like contemporary scholars, these thinkers were conscious of the problems often associated with honor but appreciated its political usefulness. They aimed to preserve this feudal legacy in the early modern context. However, a comparative examination of these modes of honor reveals that, despite their internal coherence, they conflicted with one another owing to their authors’ conflicting understandings of the nature of honor. This conflict contributed to the tragic failure of the early modern defense of honor and testified to the conceptual elusiveness of honor. It is a cautionary tale for contemporary scholars who develop and defend essentialist and ahistorical understandings of honor. (shrink)

Decisions made so far by the Federal Constitutional Court of Germany have always been characterized by their writing and content, even down to details, precision, accuracy, professional legal style of writing, always clear in the elaboration and adjudication of cases from its competence, but surprisingly, in our country, only a few have paid attention to the German Court in a scientific context, which can be seen from the only few materials we possess in the Albanian language. The purpose of this (...) paper is to provide an overview of this Court, so that the comparative aspects can be made, highlighting its advantages and disadvantages, in case of dictating the state need for reform of the Constitutional Courts. Those who have institutionalized this constitutional institution know its value in the system of constitutional justice, which performs it in terms of protection of constitutions, its principles and value, and most importantly in the protection of freedoms and rights of human beings and citizens. The Federal Constitutional Court of Germany, to this date, has conveyed the efficiency of the protection of the German legal order, the serious approach and law interpretation, for the protection of freedoms and human rights, which ranks this court into a high level among all other powers in the German law system. The author, in the following paper, gives an overview of this Court starting with its history, organization and functioning, which today undoubtedly constitutes one of the most important constitutional courts in the world. In this paper, I show that the Parmenides provides important insight into how to properly engage in philosophical discussion—or, more accurately, how not to engage in it. From references to age, love-of-winning and love-of-honor, and a paral­lel to the Phaedo, I show that Parmenides is ruled by the spirited part of his soul in a way that compromises his ability to philosophize, and that the Parmenides is a warning about doing philosophy from a love of honor. Ideally, we (...) should do philosophy from a love of wisdom. When we are honor-loving, we are not only motivated by the wrong kind of thing, but our love of honor can also blind us to the specific ways in which we might be falling short of ideal philosophical engagement, such as missing the potential dangers of engaging in philosophy with certain kinds of interlocutors. In this project, I present a combination of philosophical and political perspectives on universal human rights and the establishment of a permanent International Criminal Court in which to prosecute the most egregious violations of universal human rights. I then present William F. Jasper's reasons why the United States ought not ratify the permanent International Criminal Court. Contrary to the Jasper's pragmatic objections, I argue in favor of the International Criminal Court. I illustrate that the International Criminal Court will have protective (...) measures designed to prevent the political abuses of justice that worry Jasper. When working properly, these protective measures will satisfy Jasper's pragmatic concerns. In addition, I offer principled reasons why the United States ought not abandon its longer history of supporting the establishment of an international criminal court. I conclude that Jasper's pragmatic concerns do not justify the rejection of the International Criminal Court by the United States. (shrink)

The International Court of Justice advisory opinion on the Legality of the Threat or Use of Nuclear Weapons in 1996 was a landmark case because, for the first time in history, the legal aspect of nuclear weapons was addressed. The decision has evoked controversies regarding the Court’s conclusion, the legal status of international humanitarian law in relation to nuclear weapons, and a newly introduced concept of state survival. While much legal scholarship discusses and criticizes the legal significance of the (...) opinion, there has not been enough scholarship examining the Court’s specific choice of words and concepts that sustain its wider ideological and political position in the opinion. The paper argues that the Court’s vague and controversial logic is attributed to its confrontation with two international orders/codes: the legal order and the political order. The paper engages in legal semiotics as methodology to decode legal text and discover a deep structure that sustains networks of codes, according to which text is interpreted. Through the semiotic examination of three sets of key concepts “permitted” and “prohibited,” “threat of use” and “possession of the weapon,” and “state survival,” the paper shows the ICJ’s confrontation with two orders/codes and eventual prioritization of the political order over the international legal order. The analysis of the opinion based on legal semiotics indicates an intimate and inseparable relationship between state practice and international law, which must be disentangled for the sake of the rule of law. In 2023, the Grand Chamber of the European Court of Human Rights issued its ruling in the case of Sanchez v France. The case revolved around the conviction of the applicant, a politician, for inciting hatred or violence against people due to their religious affiliation. What makes this case unique among hate speech cases before the Strasbourg Court was that the applicant’s conviction did not stem from his own words but rather from his alleged failure to promptly remove commends made (...) by others under one of his (non-offensive) Facebook posts. This case has prompted a myriad of significant questions, the main one being, how an earth did we reach a point where imposing a criminal penalty on an internet user for someone else’s speech and how does such a penalty align with the principles of necessity and proportionality outlined in Article 10 of the European Convention on Human Rights (freedom of expression)? This paper aims to address this question by examining the Court’s approach to hate speech, particularly in the realm of politics, how to the Court situates politicians within the scope of Article 10 and how the gradual expansion of ‘duties and responsibilities’ incorporated in Article 10 to engulf those who are not the actual speakers (namely internet intermediaries and, with Sanchez individual politicians). It concludes that Sanchez constitutes a worrying term for the very worst of hate speech and free speech jurisprudence as individuals (at the moment just politicians) have a duty to be vigilant of what others say on the former’s social media pages. If they are not, criminal penalties are deemed to be justified and legitimate by Strasbourg. (shrink)

Volume II of Vernon Press’s series on the Philosophy of Forgiveness offers several challenging and provocative chapters that seek to push the conversation in new directions and dimensions. Volume I, Explorations of Forgiveness: Personal, Relational, and Religious, began the task of creating a consistent multi-dimensional account of forgiveness, and Volume II’s New Dimensions of Forgiveness continues this goal by presenting a set of chapters that delve into several deep conceptual and metaphysical features of forgiveness. Recent iterations in international legal thought of the debate over the transformative potential of law have tended to echo the long-standing assumption that radical movements, when they employ law-based tactics, do so in the same manner as reformist movements: they mobilise the legitimacy of law for short-term goals, only with more radical long-term goals in mind. However, movements such as the 2012 student strike in the Canadian province of Quebec demonstrate more diverse, creative engagements with law that openly mock the (...) legal system in an effort to simultaneously delegitimise the current legal order. This article argues that this movement’s approach is consistent with the notion of an ‘impudent’ use of law as politics but also extends it further to include ideas raised by this movement’s theatrical ‘over-compliance’ with law, through which the movement turned law itself into a public spectacle. The article examines instances of the state’s unprecedented mobilisation of the legal system to contain the student strike and the student strikers’ creative and subversive engagements with law in response, illustrating how the ideas thrown up by this movement can advance theoretical discussion in legal scholarship about law’s transformative potential. The European Court of Human Rights ("ECtHR") has a distinguished track record. Established under the European Convention on Human Rights 1950 ("ECHR"), it was the world's first international human rights court. It decides thousands of cases every year, and its opinions are cited world-wide. For most of its history, the Court's jurisprudence on equality was uninspiring, as it was based on a formal conception of equality. In recent years, however, the ECtHR has begun to give equality more substantive content.

In lieu of an abstract, here is a brief excerpt of the content:Encounters with Ovid: Gavin Douglas’s The Palis of Honoure and Derek Walcott’s “The Hotel Normandie Pool” CAROLE E. NEWLANDS In sixteenth-century Rome, humanist scholars of ancient material and religious culture were exploring the ruins and inscriptions of ancient Rome with a copy of Ovid’s Fasti in hand.1 In London at the same time, Shakespeare was entertaining audiences and inspiring other poets with plots and characters drawn from Ovid’s Metamorphoses. (...) Reception studies of Ovid often focus on these great metropolitan centers. In this article, however, I will explore transformative encounters with Ovid by two poets living on the geographical margins: Gavin Douglas, the Scottish poet whose major work, the Eneados, completed in 1513, was the first translation of Virgil’s Aeneid in the British Isles, and Derek Walcott, the Caribbean Nobel-prize winning poet best known for his epic poem Omeros, published in 1990. As a poet of a small northern country that had fraught political and cultural relations with its much more populous neighbor, England, Douglas can be considered to some extent, like Walcott, within a postcolonial critical paradigm. For despite their stark differences in geographical locale and in period of time, these poets have significant commonalties. Both men were natives of places geographically distant from the major metropolitan center of London. Both were also classically learned poets. They thus shared anxieties relating to their temporal distance from Graeco-Roman culture as well as to their physical distance from the powerful English-language literary center of their day. And significantly, both Douglas and Walcott present transformative visions of Ovid in indiarion 26.3 winter 2019 vidual, early poems, The Palis of Honoure and “The Hotel Normandie Pool” respectively. These imagined but direct encounters with the Roman poet occur in poems before Douglas and Walcott composed the works for which they are chiefly known, in Douglas’s case the translation of the Aeneid, and in Walcott’s Omeros. Ovid appears in both the Palis of Honoure and “The Hotel Normandie Pool” initially, at least, as an outsider, a poet of exile, but not, however, as a self-pitying poet in decline or, as recent scholarship would have it, as a skilled manipulator of the tropes of poetic decline.2 Rather, in Douglas’s and Walcott’s poems Ovid is a figure who authorizes marginality as a vital source of poetic re-creation. As both insider and outsider Ovid can offer positive redirection to these authors whether within or beyond their geographical boundaries. Through their visions of Ovid, both Douglas and Walcott are offered the possibility of personal change and generic innovation. For each poet the encounter with Ovid is a form of poetic initiation that leads him to his more ambitious work in the heroic genre. gavin douglas’s THE PALIS OF HONOURE i will start with Gavin Douglas (c. 1474–1522). Douglas is generally classed as one of the “Makars,” a term used to refer to a cluster of brilliant, experimental Scottish poets of the late 15th and early 16th century. Among these were Robert Henryson, William Dunbar, and Gavin Douglas, three poets who thrived under the rule of King James IV of Scotland, an active patron of the arts who sought to make his court a center of cultural excellence that would rival the English court.3 Douglas’s Palis of Honoure is a youthful, ambitious poem, composed in 1502, twelve years before his major achievement, his translation of the Aeneid.4 Dedicated to King James, The Palis comprises 2169 decasyllabic lines with several demanding rhyme schemes.5 It is written in a manner that combines the “aureate” style, that is elegant and Latinate, with down-to-earth Scottish vernacular 74 encounters with ovid diction and forms of expression, and it is also suffused with Ovidian myth and concepts.6 Its format derives from the medieval dream vision, a form employed notably, for instance, by Douglas’s famous English predecessor Chaucer.7 Scholars tend to find The Palis of Honoure less polished than Douglas’s mature work, the Eneados. This perspective, a necessary corrective to a pure history of ideas, takes knowledge as a socially constructed phenomenon and (...) thus subject to sociological analysis. The point of the sociology of knowledge, however, is not to re-hash and bolster old externalist arguments but to do away with the whole debate over whether ideas or social conditions are more important in intellectual history and the history of science. A focus on sociology does not mean that ideas do not matter. This becomes apparent when analyzing the ethics of early modern intellectuals.For example, Anne Goldgar's recent work, Impolite Learning: Conduct and Community in the Republic of Letters, 1680-1750 (1995), gives much attention to the sociology of the seventeenth- and eighteenth-century Republic of Letters--but at the cost of relegating the role of ideas to the sidelines. According to Goldgar, if one wants to understand early modern intellectuals as a community, including their ethics and sense of morality, one should focus on forms of sociability rather than the ideas and philosophies they put forth in their writings. An aristocratic ethic dominated early modern scholarship, she argues, and even took precedence over knowledge claims: "[i]n striving to make its inner workings acceptable to the outside community the Republic of Letters chose, like the aristocracy, to empty its internal relationships of content, choosing instead to concentrate on form.... [A]rguments were often judged on the politeness with which they were presented, rather than on their intrinsic merit." 1 Men of [End Page 433] letters, although often of humble origin, cultivated nobility by emulating aristocratic modes of decorum and noble interests in status and reputation. One way they promoted these ideas was through a literary genre adopted from classical antiquity, the éloge (eulogy), which presented exemplary modes of behavior by praising the lives of the "heroes" of the Republic of Letters. Interestingly, the years on which Goldgar focuses her analysis almost precisely encompass the period of Bernard le Bouyer de Fontenelle's mature intellectual production. Yet Fontenelle (1657-1757), widely hailed during his lifetime as having perfected the art of the éloge, plays no role in her argument.From 1699 to 1740 Fontenelle, as secrétaire perpétuel of the Académie Royale des Sciences, composed some sixty-nine éloges in honor of recently deceased members of the academy and of other notable savants. Even a brief glance at Fontenelle's eulogies reveals an intimate link between philosophy and morality. A more careful examination of them in the context of his life and works shows that this link was logically commensurate with his genuinely held notions of human nature, happiness, reason, and the good. In fact the relationship in the eulogies between notions of nobility and the virtues proper to the savant or philosopher is highly intellectualized. Fontenelle was not as concerned with status and reputation or with self-fashioning as one might think. 2 We can only assimilate his ethics to those of the court aristocracy if we ignore what he actually wrote.Through his eulogies and other writings, Fontenelle's thoughts on philosophy and morality have had a lasting impact on western culture. He presented an image of what would come to characterize the proper, objective, modern scientist and thinker. 3 In order to understand the éloge as an institution in the Republic of Letters (and by extension the early modern intellectual ethic) it is therefore important to examine Fontenelle's moral philosophy more carefully. It is a philosophy expressed in his eulogies but understood clearly only in the context of his life and works.
