This book, formed as a series of essays in honour of Professor Carl Baudenbacher, addresses the very art of judicial reasoning, and features contributions from many of the foremost current or former national, supranational, or international judges. This unique volume is intended first and foremost for legal scholars, but its approachable style makes it readily accessible for students and for those with a general interest in the application of the law and justice in today's multi-layered world. This book contributes to current bioethical debates by providing a critical analysis of the philosophy of human death. Bernard N. Schumacher discusses contemporary philosophical perspectives on death, creating a dialogue between phenomenology, existentialism, and analytic philosophy. He also examines the ancient philosophies that have shaped our current ideas about death. His analysis focuses on three fundamental problems: (1) the definition of human death, (2) the knowledge of mortality and of human death as such, and (3) the question of whether (...) death is nothing to us or, on the contrary, whether it can be regarded as an absolute or relative evil. During the last years of his life, the mathematician Karl Menger worked on a biography of his father, the economist and founder of the Austrian School of Economics, Carl Menger. The younger Menger never finished the work. While working in the Menger collections at Duke University’s David M. Rubenstein Rare Book and Manuscript Library, we discovered draft chapters of the biography, a valuable source of information given that relatively little is known about Carl Menger’s life nearly a hundred years after (...) his death. The unfinished biography covers Carl Menger’s family background and his life through early 1889. In this article, we discuss the biography and the most valuable new insights it provides into Carl Menger’s life, including Carl Menger’s family, his childhood, his student years, his time working as a journalist and newspaper editor, his early scientific career, and his relationship with Crown Prince Rudolf. Background: Only data of published study results are available to the scientific community for further use such as informing future research and synthesis of available evidence. If study results are reported selectively, reporting bias and distortion of summarised estimates of effect or harm of treatments can occur. The publication and citation of results of clinical research conducted in Germany was studied.Methods: The protocols of clinical research projects submitted to the research ethics committee of the University of Freiburg in 2000 were (...) analysed. Published full articles in several databases were searched and investigators contacted. Data on study and publication characteristics were extracted from protocols and corresponding publications.Results: 299 study protocols were included. The most frequent study design was randomised controlled trial , followed by uncontrolled studies , laboratory studies and non-randomised studies . 182 were multicentre studies including 97 international collaborations. 152 of 299 had commercial funding and 46 non-commercial funding. 109 of the 225 completed protocols corresponded to at least one full publication ; the publication rate was 48%. 168 of 210 identified publications were cited in articles indexed in the ISI Web of Science. The median was 11 citations per publication .Conclusions: Results of German clinical research projects conducted are largely underreported. Barriers to successful publication need to be identified and appropriate measures taken. Close monitoring of projects until publication and adequate support provided to investigators may help remedy the prevailing underreporting of research. (shrink)

Folgende Abhandlung zeigt, daß diese Deutung auf einem Mißverständnis der dunklen zentralen Textstelle De anima III 3 beruht. Während Aristoteles den strengen Begriff der Phantasie von ihrem metaphorischen Begriff unterscheidet, führt die Verwechslung beider Aspekte zu einer Subjektivierung der Wahrnehmung und zu einer Kognitivierung der Phantasie, die bei Aristoteles ein (...) rein sinnliches Vermögen ist. Dadurch wird die deutliche Zäsur in der Begriffsgeschichte von phantasia, imaginatio und Einbildungskraft eingetrübt, die Aristoteles und die Antike von Avicena und Kant trennt. (shrink)

Cusanus hatte es in seinem Leben und in seinem Werk mit einer Fulle von Konflikten verschiedenster Art zu tun: juristische, kirchenpolitische, philosophische und theologische Konflikte. Gibt es Prinzipien, die Nikolaus von Kues bei den jeweiligen Konfliktlosungen leiteten? Der Verfasser bejaht diese Frage und subsumiert abschliessend die erarbeiteten Prinzipien unter den Begriff <I>ordo im Sinne des Titels der Arbeit.".

An analysis is presented of published methods that have been used by experimenters to justify the reliability of the theory of invasion of microorganisms into cultured cells. The results show that, to demonstrate this invasion, many experimenters used two or more methods that were based on independent technical and theoretical principles, and by doing so improved the reliability of the theory. Subsequently I compare this strategy of 'multiple derivability' with other strategies, discussed in the literature in relation to the mesosome, (...) a bacterial organelle that had been detected with the electron microsope, but which appeared later to be an artifact. I propose that different strategies have been applied in this problem, and multiple derivability may have been the decisive one. Finally I discuss the idea that multiple derivability may help to anchor theories in a larger network of theories. (shrink)
