We consider the complex interactions between rape culture and epistemology. A central case study is the consideration of a deferential attitude about the epistemology of sexual assault testimony. According to the deferential attitude, individuals and institutions should decline to act on allegations of sexual assault unless and until they are proven in a formal setting, i.e., a criminal court. We attack this deference from several angles, including the pervasiveness of rape culture in the criminal justice system, the epistemology of testimony (...) and norms connecting knowledge and action, the harms of tacit idealizations away from important contextual factors, and a contextualist semantics for 'knows' ascriptions. Counterspeech is communication that tries to counteract potential harm brought about by other speech. Theoretical interest in counterspeech partly derives from a libertarian ideal – as captured in the claim that the solution to bad speech is more speech – and partly from a recognition that well-meaning attempts to counteract harm through speech can easily misfire or backfire. Here we survey recent work on the question of what makes counterspeech effective at remedying or preventing harm, in those cases where it (...) is effective, as well as work investigating when and why there is a duty to engage in counterspeech. We suggest that the most fruitful area for philosophical inquiry on this topic, currently, relates to the questions about efficacy. Specifically, we argue that there is a need for better frameworks for conceptualizing the efficacy of counterspeech. Philosophers have collaborative work to do, alongside social scientists, in developing these frameworks. (shrink)

Fitting Attitudes accounts of value analogize or equate being good with being desirable, on the premise that ‘desirable’ means not, ‘able to be desired’, as Mill has been accused of mistakenly assuming, but ‘ought to be desired’, or something similar. The appeal of this idea is visible in the critical reaction to Mill, which generally goes along with his equation of ‘good’ with ‘desirable’ and only balks at the second step, and it crosses broad boundaries in terms of philosophers’ other (...) commitments. For example, Fitting Attitudes accounts play a central role both in T.M. Scanlon’s [1998] case against teleology, and in Michael Smith [2003], [unpublished] and Doug Portmore’s [2007] cases for it. This research was designed to develop an inventory of vendor-related problems experienced by buyers for small retail apparel stores during the merchandise buying process, determine how frequently each difficulty occurs, and identify the experiences perceived to be unethical. Among the 22 vendor-related difficulties examined minimum order requirements, 6 month advance purchase, incomplete orders, late shipments, and shipping overcharges were identified most frequently. Analysis of results suggested that one factor, misleading vendor practices, and eight background variables (annual sales, price line, full- (...) and part-time employees, retail and buying experience, and shopping large or small markets) were associated with unethical experiences. Ethically troublesome experiences mentioned most frequently were padded orders, selling competitor same merchandise, withholding return authorization and credit, shipping overcharges, and dealing with vendor's factor. Only things that I believe (or could believe) rationally, or perhaps, with justification, count as part of the evidence that I have. It seems to me that this is a good reason to include an epistemic acceptability constraint on evidence (...) possessed…1 It is a truism that adopting an unjustified belief does not put you in a better evidential position with respect to believing its consequences. This truism has led many philosophers to assume that there must, at a minimum, be a justification condition (and perhaps even a knowledge condition) on what it takes to count as having evidence. This is the best (or only) possible explanation of the truism, these philosophers have believed. This paper explores an alternative explanation for the truism. According to the alternative explanation that I will offer, unjustified beliefs do not put you in a better evidential position with respect to believing their consequences because any evidence you have in virtue of having an unjustified belief is guaranteed to be defeated. Since the lack of justification for a belief guarantees its defeat, I will suggest, we don't need to postulate a special justification condition (much less a knowledge condition) on what it takes to count as having evidence. Why is this important? It is important because the assumption that there must be a justification condition (or perhaps a knowledge condition) on what it takes to count as having evidence places a high bar on what it takes to have evidence - such a high bar that it is difficult to see how this bar could be met in the case of basic, perceptually justified beliefs. As a result, the high bar set by this condition plays a fundamental role, I will claim, in central features of a core dialectic from the epistemology of basic perceptual belief which plays a central role in the debates between internalism and externalism, foundationalism and coherentism, and rationalism and empiricism.. In this paper, the authors present a presuppositional account for a class of evaluative terms that encode both a descriptive and an evaluative component: slurs and thick terms. The authors discuss several issues related to the hybrid nature of these terms, such as their projective behavior, the ways in which one may reject their evaluative content, and the ways in which evaluative content is entailed or implicated (as the case may be) by the use of such terms.

A person suffering a mental illness or disorder may differ dramatically from his or her previous well self. Family and close friends who knew the person before the onset of illness tend to regard the illness as obscuring their loved one's true self and see the goal of treatment as the restoration of that self. ‘He is not really like this,’ they will say with increasing desperation. Treatment teams and others, who have no acquaintance with the person when well, respond (...) to what they see in front of them and do sometimes make harmful judgments of character based on the person's presentation when ill. The Introduction to "Non-Derogatory Uses of Slurs", special issue of Grazer Philosophische Studien.

Scientists have the ability to influence policy in important ways through how they present their results. Surprisingly, existing codes of scientific ethics have little to say about such choices. I propose that we can arrive at a set of ethical guidelines to govern scientists’ presentation of information to policymakers by looking to bioethics: roughly, just as a clinician should aim to promote informed decision-making by patients, a scientist should aim to promote informed decision-making by policymakers. Though this may sound like (...) a natural proposal, I show it offers guidance that conflicts with standard scientific practices. I conclude by considering one cost of the proposal: that it would prevent scientists from acting as advocates in a way that is currently common in certain fields. I accept that the proposal would restrict scientists’ political advocacy rights, but argue that the benefits of adopting it — promoting democratic governance — justify the restriction. (shrink)

In Slurs and Thick Terms, Bianca Cepollaro explores the ways in which certain pieces of evaluative language, such as slurs and so-called thick terms, not only reflect speakers’ moral perspectives, but also contribute to promote the speaker’s evaluative stance.

A diagnosis of schizophrenia is often taken to denote a state of global irrationality within the psychiatric paradigm, wherein psychotic phenomena are seen to equate with a lack of mental capacity. However, the little research that has been undertaken on mental capacity in psychiatric patients shows that people with schizophrenia are more likely to experience isolated, rather than constitutive, irrationality and are therefore not necessarily globally incapacitated. Rational suicide has not been accepted as a valid choice for people with schizophrenia (...) due in part to a belief that characteristic irrationality prevents autonomous decision-making. Since people with schizophrenia are often seen to lack insight into the nature of their disorder, both psychiatric and ethical perspectives generally presume that suicidal acts result directly from mental illness itself and not from second-order desires. In this article, I challenge notions of global irrationality conferred by a diagnosis of schizophrenia and argue that, where delusional beliefs are unifocal, schizophrenia does not necessarily lead to a state of mental incapacity. I then attempt to show that people with schizophrenia can sometimes be rational with regard to suicide, where this decision stems from a realistic appraisal of psychological suffering. (shrink)

In this book Brian Schroeder, Silvia Benso, and an international group of philosophers address the relationship between Levinas and the world of ancient thought. In addition to philosophy, themes touching on religion, mythology, metaphysics, ontology, epistemology, ethics, and politics are also explored. The volume as a whole provides a unified and extended discussion of how an engagement between Levinas and thinkers from (...) the ancient tradition works to enrich understandings of both. Abstract In the last fifteen years philosophers and linguists have turned their attention to slurs: derogatory expressions that target certain groups on the basis of race, gender, sexual orientation, nationality and so on. This interest is due to the fact that, on the one hand, slurs possess puzzling linguistic properties; on the other hand, the questions they pose are related to other crucial issues, such as the descriptivism/expressivism divide, the semantics/pragmatics divide and, generally speaking, the theory of meaning. Despite these (...) recent investigations about pejoratives, there is no widely accepted explanation of slurs:in my paper I consider the intuitions we have about slurs and I assess the difficulties that the main theories encounter in explaining how these terms work in order to identify the phenomena that a satisfactory account of slurs needs to explain. Then, I focus on the pragmatic theories that deal with the notions of conventional implicature and pragmatic presupposition: I assess the objections that have been raised and I propose two ways of defending the presuppositional account, taking into consideration the notion of cancellability. I will claim that the reason why most pragmatic strategies seem to fail to account for slurs is that they assume a rigid divide between conventional implicatures and presuppositions that should not be taken for granted. Reconsidering the relationship between these two notions gives a hint about how a pragmatic account of slurs should look like. Finally, I assess the problem of which presupposition slurs in fact trigger. (shrink)

ABSTRACT A widespread thesis in contemporary philosophy of language is that certain speech constitutes, rather than merely causes, harm. McGowan develops a prescriptive account of harm constitution, according to which harm-constituting speech enacts norms that prescribe harm. Ordinary verbal bigotry, she claims, is harmful in this sense. We submit that the norms enacted by ordinary racist (or otherwise bigoted) utterances are not prescriptive. In our view, ordinary verbal bigotry enacts ‘non-neutrally’ permissive norms rendering harmful behaviours locally permitted—and indeed preferred over (...) non-harmful options. We conclude by arguing that, although ordinary verbal bigotry enacts non-prescriptive norms, it can still constitute harm. (shrink)

Social responsibility is typically examined at the firm level, yet there are instances in which consumers’ social responsibility perceptions of the firm’s product brands differ from social responsibility perceptions with regard to the firm [i.e., corporate social responsibility ]. This article conceptualizes brand social responsibility and delineates it from CSR. Following the development of a BSR scale, this research demonstrates variations in consumers’ social responsibility perceptions across product brands even if they are owned by the same corporation and compete in (...) the same product category. BSR is distinct from CSR, and better predicts consumers’ responses to product brands compared to corporate level measures. Consistent with the conceptual distinction, this research demonstrates the unique contribution of BSR and CSR in predicting product brand and corporate outcomes, respectively. From a theoretical viewpoint, this research is one of the few to examine differences between product brand and CSR. From a managerial viewpoint, the consideration of social responsibility at the product brand level facilitates the assessment of social responsibility perceptions across brands in brand portfolios managed under a mixed-branding or house-of-brands strategy. The goal of this study was to construct a valid new instrument to measure the effect of moral intensity on managers' propensity to manage earnings. More specifically, this study is a pilot study of the impact of moral intensity on financial accountants' propensity to manage earnings. The instrument, once validated, will be used in a full-study of managers in the hotel industry. Different ethical scenarios were presented to respondents in the survey; each ethical scenario was designed in both high or (...) low moral intensity form, to reflect the importance of the moral dilemma at hand. The results were analysed by factor analysis. The findings of this study have positively validated the instrument, with three of the five moral intensity components identified as having appropriate eigenvalues. This indicates that they have a significant influence in the study. The first factor captures the social consensus dimension and one scenario of the proximity dimension. The second factor indicates an interaction between the temporal immediacy and the magnitude of consequences dimension. The third dimension is probability of effect and one scenario of the proximity dimension. In addition, t-tests indicated that the manipulation of high and low conditions within each scenario were also successful. One limitation of the study might be the use of undergraduate accounting students as manager proxies, although prior evidence suggests use of accounting students as proxies is a valid approach in this type of study. This is a highly novel project as most prior studies have focussed on moral intensity and the general ethical decision-making process. (shrink)

It is no secret that various versions of logical empiricism argued for the importance of unified science. Carnap was a proponent of unity of science views, although he expressed this in different idioms at different times. In the Aufbau (1928) he spoke of the unity of the object domain secured through definability in the constitutional system, in his physicalist period he argued that a physicalist language could serve as the universal language of science, and in his mature philosophical work he (...) investigated a variety of meanings that might be attached to reductionist projects for unifying various scientific fields. Our essay focuses less on Carnap’s several proposals than on a prior interpretive question: what was philosophically at stake for Carnap in the question of the unity of science? We begin with some suggestions in Carnap’s 1963 Intellectual Autobiography, where he calls unity of science “one of the main tenets of our general philosophical conception” and one in which Neurath’s emphasis on the “interdependence of all decisions … made a strong impression” on him. We follow Carnap in the suggestion that an account of his approach to unity of science does not take us into questions of unity of nature but rather of the scientific attitude and the unity of reason. Metaethics is the study of metaphysics, epistemology, the philosophy of mind, and the philosophy of language, insofar as they relate to the subject matter of moral or, more broadly, normative discourse – the subject matter of what is good, bad, right or wrong, just, reasonable, rational, what we must or ought to do, or otherwise. But out of these four ‘core’ areas of philosophy, it is plausibly the philosophy of language that is most central to metaethics – and not simply (...) because ‘metaethics’ was for a long time construed more narrowly as a name for the study of moral language. The philosophy of language is central to metaethics because both the advantages of and the open problems facing different metaethical theories differ sharply over the answers those theories give to central questions in the philosophy of language. In fact, among the open problems over which such theories differ, are included particularly further problems in the philosophy of language. This article briefly surveys a range of broad categories of views in metaethics and both catalogues some of the principal issues faced by each in the philosophy of language, as well as how those arise out of their answers to more basic questions in the philosophy of language. This study examines cheating behaviors among 422 business students at two public Association to Advance Collegiate Schools of Business-accredited business schools. Specifically, we examined the simultaneous influence of attitudinal characteristics and motivational factors on reported prior cheating behavior, the tendency to neutralize cheating behaviors, and likelihood of future cheating. In addition, we examined the impact of in-class deterrents on neutralization of cheating behaviors and the likelihood of future cheating. We also directly tested potential mediating effects of neutralization on cheating behavior. (...) Using structural equations modeling procedures, we conducted an assessment of the validity of a modified version of the K. J. Smith, Davy, Rosenberg, and Haight model of cheating behavior and its antecedents. The modified model included motivation as a potential predictor of cheating behavior. Results supported the differentiation of the theoretical constructs within the specified process model. Furthermore, tests of the aforementioned theoretical model indicated a significant positive relation between extrinsic motivation and prior cheating and a significant negative relation between both intrinsic motivation and academic performance, and prior cheating. Finally, prior cheating had a significant positive relation, whereas deterrents had a significant negative relation to likelihood of future cheating. (shrink)

In the Book of Common Prayer’s Rite II version of the Eucharist, the congregation confesses, “we have sinned against you in thought, word, and deed”. According to this confession we wrong God not just by what we do and what we say, but also by what we think. The idea that we can wrong someone not just by what we do, but by what think or what we believe, is a natural one. It is the kind of wrong we feel (...) when those we love believe the worst about us. And it is one of the salient wrongs of racism and sexism. Yet it is puzzling to many philosophers how we could wrong one another by virtue of what we believe about them. This paper defends the idea that we can morally wrong one another by what we believe about them from two such puzzles. The first puzzle concerns whether we have the right sort of control over our beliefs for them to be subject to moral evaluation. And the second concerns whether moral wrongs would come into conflict with the distinctively epistemic standards that govern belief. Our answer to both puzzles is that the distinctively epistemic standards governing belief are not independent of moral considerations. This account of moral encroachment explains how epistemic norms governing belief are sensitive to the moral requirements governing belief. (shrink)

In nearly forty years’ of work, Simon Blackburn has done more than anyone to expand our imaginations about the aspirations for broadly projectivist/expressivist theorizing in all areas of philosophy. I know that I am far from alone in that his work has often been a source of both inspiration and provocation for my own work. It might be tempting, in a volume of critical essays such as this, to pay tribute to Blackburn’s special talent for destructive polemic, by seeking to (...) take down that by which I’ve been most provoked over the years. But Blackburn’s biting wit has both more wit and more bite than I could hope to emulate. So instead I’ll try to emulate here what I’ve admired the most about Blackburn – the constructive vein of much of his work. (shrink)

We have argued elsewhere that moral responsibility over time depends in part upon the having of psychological connections which facilitate forms of self-control. In this chapter we explore the importance of mental time travel - our ordinary ability to mentally travel to temporal locations outside the present, involving both memory of our personal past and the ability to imagine ourselves in the future - to our agential capacities for planning and control. We suggest that in many individuals with dissociative disorders, (...) forms of amnesia, or other frontal lobe damage, our capacity for mental time travel is impaired, resulting in commensurate losses to agency autonomy, and a forensic condition essential for holding persons responsible: in legal terms, the capacity for mens rea. Background In the course of the last four decades, the profession of physiotherapy has progressively expanded its scope of responsibility and its focus on professional autonomy and evidence-based clinical practice. To preserve professional autonomy, it is crucial for the physiotherapy profession to meet society's expectations and demands of professional competence as well as ethical competence. Since it is becoming increasingly popular to choose a carrier in private practice in Denmark this context constitutes the frame of this study. Physiotherapy in private (...) practice involves mainly a meeting between two partners: the physiotherapist and the patient. In the meeting, power asymmetry between the two partners is a condition that the physiotherapist has to handle. The aim of this study was to explore whether ethical issues rise during the first physiotherapy session discussed from the perspective of the physiotherapists in private practice. Methods A qualitative approach was chosen and semi-structured interviews with 21 physiotherapists were carried out twice and analysed by using a phenomenological framework. Results Four descriptive themes emerged: general reflections on ethics in physiotherapy; the importance of the first physiotherapy session; the influence of the clinical environment on the first session and; reflections and actions upon beneficence towards the patient within the first session. The results show that the first session and the clinical context in private practice are essential from an ethical perspective. Conclusions Ethical issues do occur within the first session, the consciousness about ethical issues differs in Danish physiotherapy private practice, and reflections and acts are to a lesser extent based on awareness of ethical theories, principles and ethical guidelines. Beneficence towards the patient is a fundamental aspect of the physiotherapists' understanding of the first session. However, if the physiotherapist lacks a deeper ethical awareness, the physiotherapist may reason and/or act ethically to a varying extent: only an ethically conscious physiotherapist will know when he or she reflects and acts ethically. Further exploration of ethical issues in private practice is recommendable, and as management policy is deeply embedded within the Danish public sector there are reasons to explore public contexts of physiotherapy as well. Common-sense allows that talk about moral truths makes perfect sense. If you object to the United States’ Declaration of Independence’s assertion that it is a truth that ‘all men’ are ‘endowed by their Creator with certain unalienable Rights’, you are more likely to object that these rights are not unalienable or that they are not endowed by the Creator, or even that its wording ignores the fact that women have rights too, than that this is not the sort of thing (...) which could be a truth. Whether it is a truth or not seems beside the point, anyway; the writers of the Declaration could just have well written, ‘We hold it to be self-evident that all men are created equal, and also that it is self-evident that all men are endowed by their Creator with certain unalienable Rights,’ save only that its cadence would lack some of the poetic resonance of the version which garnered Hancock’s signature. Yet famously, ethical noncognitivists have proclaimed that moral sentences can’t be true or false – that, like ‘Hooray!’ or ‘dammit!’, they are not even the kinds of things to be true or false. Noncognitivism is sometimes even defined as the view that this is so, but even philosophers who define ‘noncognitivism’ more broadly, as consistent with the idea that moral sentences may be true or false, have believed that they needed to do important philosophical spadework in order to make sense of how moral sentences could be true or false. In this article we’ll look at the puzzle about moral truth as it is faced by early noncognitivists and by metaethical expressivists, the early noncognitivists’ contemporary cousins. We’ll look at what it would take for expressivists to ‘earn the right’ to talk about moral truths at all, and in particular at what it would take for them to earn the right to claim that moral truths behave in the ways that we should expect – including that meaningful moral sentences which lack presuppositions are true or false, and that classically valid arguments are truth-preserving.. The aim of this paper is to provide arguments based on linguistic evidence that discard a truth-conditional analysis of slurs and pave the way for more promising approaches. We consider Hom and May’s version of TCA, according to which the derogatory content of slurs is part of their truth-conditional meaning such that, when slurs are embedded under semantic operators such as negation, there is no derogatory content that projects out of the embedding. In order to support this view, Hom and (...) May make two moves: they point to cases where it looks like projection does not occur and they try to explain away cases where projection seems to occur by appealing to a pragmatic phenomenon that they call ‘offense’. Pace Hom and May, we argue that the derogatory content of slurs does in fact project and, in advocating for our claim, we show that those cases where it looks like projection does not occur are in fact metalinguistic uses in which slurs are not really used, by relying on three linguistic tests ; and we refute Hom and May’s attempt to explain why speakers would entertain the supposedly wrong intuition that the derogatory content of slurs projects out of semantic embedding, by focusing on the case of slurs for fictional entities. We conclude that Hom and May’s strategies to support TCA ultimately fail. (shrink)

Benefit sharing has been a recurrent theme in international debates for the past two decades. However, despite its prominence in law, medical ethics and political philosophy, the concept has never been satisfactorily defined. In this conceptual paper, a definition that combines current legal guidelines with input from ethics debates is developed. Philosophers like boxes; protective casings into which they can put concisely-defined concepts. Autonomy is the human capacity for self-determination; beneficence denotes the virtue of good deeds, coercion is the intentional (...) threat of harm and so on. What about benefit sharing? Does the concept have a box and are the contents clearly defined? The answer to this question has to be no. The concept of benefit sharing is almost unique in that various disciplines use it regularly without precise definitions. In this article, a definition for benefit sharing is provided, to eliminate unnecessary ambiguity. (shrink)
