For more than sixty years, surgeons have used bioethical strategies to promote patient self‐determination, many of these now collectively described as “informed consent.” Yet the core framework—understanding, risks, benefits, and alternatives—fails to support patients in deliberation about treatment. We find that surgeons translate this framework into an overly complicated technical explanation of disease and treatment and an overly simplified narrative that surgery will “fix” the problem. They omit critical information about the goals and downsides of surgery and present untenable options (...) as a matter of patient choice. We propose a novel framework called “better conversations.” Herein, surgeons provide context about clinical norms, establish the goals of surgery, and comprehensively delineate the downsides of surgery to generate a deliberative space for patients to consider whether surgery is right for them. This paradigm shift meets the standards for informed consent, supports deliberation, and allows patients to anticipate and prepare for the experience of treatment. (shrink)

This classic is the benchmark against which all modern books about Nietzsche are measured. When Walter Kaufmann wrote it in the immediate aftermath of World War II, most scholars outside Germany viewed Nietzsche as part madman, part proto-Nazi, and almost wholly unphilosophical. Kaufmann rehabilitated Nietzsche nearly single-handedly, presenting his works as one of the great achievements of Western philosophy. Responding to the powerful myths and countermyths that had sprung up around Nietzsche, Kaufmann offered a patient, evenhanded account of his life (...) and works, and of the uses and abuses to which subsequent generations had put his ideas. Without ignoring or downplaying the ugliness of many of Nietzsche's proclamations, he set them in the context of his work as a whole and of the counterexamples yielded by a responsible reading of his books. More positively, he presented Nietzsche's ideas about power as one of the great accomplishments of modern philosophy, arguing that his conception of the "will to power" was not a crude apology for ruthless self-assertion but must be linked to Nietzsche's equally profound ideas about sublimation. He also presented Nietzsche as a pioneer of modern psychology and argued that a key to understanding his overall philosophy is to see it as a reaction against Christianity. Many scholars in the past half century have taken issue with some of Kaufmann's interpretations, but the book ranks as one of the most influential accounts ever written of any major Western thinker. This paper argues against the moral Turing test as a framework for evaluating the moral performance of autonomous systems. Though the term has been carefully introduced, considered, and cautioned about in previous discussions :251–261, 2000; Allen and Wallach 2009), it has lingered on as a touchstone for developing computational approaches to moral reasoning :98–109, 2015). While these efforts have not led to the detailed development of an MTT, they nonetheless retain the idea to discuss what kinds of action and reasoning (...) should be demanded of autonomous systems. We explore the flawed basis of an MTT in imitation, even one based on scenarios of morally accountable actions. MTT-based evaluations are vulnerable to deception, inadequate reasoning, and inferior moral performance vis a vis a system’s capabilities. We propose verification—which demands the design of transparent, accountable processes of reasoning that reliably prefigure the performance of autonomous systems—serves as a superior framework for both designer and system alike. As autonomous social robots in particular take on an increasing range of critical roles within society, we conclude that verification offers an essential, albeit challenging, moral measure of their design and performance. The rapid adoption and implementation of artificial intelligence in medicine creates an ontologically distinct situation from prior care models. There are both potential advantages and disadvantages with such technology in advancing the interests of patients, with resultant ontological and epistemic concerns for physicians and patients relating to the instatiation of AI as a dependent, semi- or fully-autonomous agent in the encounter. The concept of libertarian paternalism potentially exercised by AI (and those who control it) has created challenges to conventional assessments (...) of patient and physician autonomy. The unclear legal relationship between AI and its users cannot be settled presently, an progress in AI and its implementation in patient care will necessitate an iterative discourse to preserve humanitarian concerns in future models of care. This paper proposes that physicians should neither uncritically accept nor unreasonably resist developments in AI but must actively engage and contribute to the discourse, since AI will affect their roles and the nature of their work. One’s moral imaginative capacity must be engaged in the questions of beneficence, autonomy, and justice of AI and whether its integration in healthcare has the potential to augment or interfere with the ends of medical practice. Originally published in 1959, The Faith of a Heretic is the most personal statement of the beliefs of Nietzsche biographer and translator Walter Kaufmann. A first-rate philosopher in his own right, Kaufmann here provides the fullest account of his views on religion. Although he considered himself a heretic, he was not immune to the wellsprings and impulses from which religion originates, declaring it among the most vital and radical expressions of the human mind. Beginning with an autobiographical prologue that traces (...) his evolution from religious believer to "heretic," the book touches on theology, organized religion, morality, suffering, and death—all examined from the perspective of a "quest for honesty." Kaufmann also subjects philosophy's faith in truth, reason, and absolute morality to the same heretical treatment. This paper tries to answer the question why the epistemic value of so many social simulations is questionable. I consider the epistemic value of a social simulation as questionable if it contributes neither directly nor indirectly to the understanding of empirical reality. To examine this question, two classical social simulations are analyzed with respect to their possible epistemic justification: Schelling’s neighborhood segregation model and Axelrod’s reiterated Prisoner’s Dilemma simulations of the evolution of cooperation. It is argued that Schelling’s simulation is (...) useful because it can be related to empirical reality, while Axelrod’s simulations and those of his followers cannot and thus that their scientific value remains doubtful. I relate this findingto the background beliefs of modelers about the superiority of the modeling method as expressed in Joshua Epstein’s keynote address “Why model?”. (shrink)

As G. A. Cohen’s camping trip argument shows, community is an important value. But is there anything particularly socialist about it? Critics suggest not. Jason Brennan argues that we don’t need socialist institutions to secure community; capitalist ones will do just fine. Louis-Philippe Hodgson argues, in a similar spirit, that we don’t need explicitly socialist principles to secure community; standard-issue liberal egalitarian ones (like Rawls’s) suffice. But these critics are mistaken. Pace Brennan, I show that capitalism inevitably runs roughshod over (...) community. Pace Hodgson, I show that Rawls’s justice as fairness cannot, absent explicitly socialist supplementation, adequately protect community. In sum, I show that advocates of community must also, and for that reason, be advocates for distinctively socialist principles and institutions. Or, in a slogan: no community without socialism. To organise future behaviour, it is important to remember both the central and contextual aspects of a situation. We examined the impact of contextual threat or safety, learned through verbal instructions, on face identity recognition. In two studies (N = 140), 72 face–context compounds were presented each once within an encoding session, and an unexpected item/source recognition task was performed afterwards (including 24 new faces). Hierarchical multinomial processing tree modelling served to estimate individual parameters of item (face identity) and source (...) memory (threat or safety context) as well as guessing behaviour. Results show that language was highly effective in establishing threatening and safe context conditions. In Study 1, a fleeting picture stream (1 s per picture) led to poor item and source recognition. Prolonged presentation times (Study 2 with 6 s per picture) improved face memory but no contextual modulation was observed. Thus, incidental face learning was surprisingly poor and rapidly changing contextual settings might have interfered with the accurate encoding of face identity information and item–source binding. While Thomas Kuhn's theory of scientific revolutions does not specifically deal with validation, the validation of simulations can be related in various ways to Kuhn's theory: 1) Computer simulations are sometimes depicted as located between experiments and theoretical reasoning, thus potentially blurring the line between theory and empirical research. Does this require a new kind of research logic that is different from the classical paradigm which clearly distinguishes between theory and empirical observation? I argue that this is not the case. (...) 2) Another typical feature of computer simulations is their being ``motley'' (Winsberg 2003) with respect to the various premises that enter into simulations. A possible consequence is that in case of failure it can become difficult to tell which of the premises is to blame. Could this issue be understood as fostering Kuhn's mild relativism with respect to theory choice? I argue that there is no need to worry about relativism with respect to computer simulations, in particular. 3) The field of social simulations, in particular, still lacks a common understanding concerning the requirements of empirical validation of simulations. Does this mean that social simulations are still in a pre-scientific state in the sense of Kuhn? My conclusion is that despite ongoing efforts to promote quality standards in this field, lack of proper validation is still a problem of many published simulation studies and that, at least large parts of social simulations must be considered as pre-scientific. Recent scholarship has shed more light on the relationship between Husserl and Lotze. And Husserl indeed claims of Lotze that “his inspired interpretation of the Platonic doctrine of Forms […] put up a bright first light and determined all further studies” ( 2002a, 297). In this paper I will try to answer the question what exactly Husserl saw in this “bright light”—the answer being much more complicated than “Platonism.” As I will show, Lotze misreads Plato, but in interesting ways, and (...) Husserl in turn misreads Lotze. In other words, this paper is about a misreading of a misreading—yet one fundamental for the development of phenomenology in that Husserl’s engagement with Lotze enabled him (a) to expand and differentiate his own anti-reductionism in regard to ideal entities, leading him to two forms of what he calls “Platonism,” one of which even runs contrary to Lotze’s own account, and (b) to conceive of a method to gain truths about the material apriori. After a brief introduction, I will discuss (1) Lotze’s interpretation of Plato, (2) what Husserl took from it, and finally (3) Plato’s Platonism, to substantiate my claims 1. (shrink)

In this volume, scientists, historians, and philosophers join to examine computer simulations in scientific practice. One central aim of the volume is to provide a multiperspective view on the topic. Therefore, the text includes philosophical studies on computer simulations, as well as case studies from simulation practice, and historical studies of the evolution of simulations as a research method.

Taking its cue from this special issue on the interweaving of different types of time through science and museum collections, this epilogue gives an overview of what sorts of new insights seem possible when different temporal qualities embedded in all collections are allowed to come together? In this essay I enter into a recently published debate between Stephen Schiffer and Jerry Fodor concerning whether adequate sense can be made of the ceteris paribus conditions in special science laws, much of their focus being on the case of putative psychological laws. Schiffer argues that adequate sense cannot be made of ceteris paribus clauses, while Fodor attempts to overcome Schiffer's arguments, in defense of special science laws. More recently, Peter Mott has attempted to show that Fodor's response to (...) Schiffer fails, and furthermore that further study shows that the logical framework in which Schiffer and Fodor address their issue is susceptible to inconsistency.In this essay I argue that adequate sense can be made of ceteris paribus conditions. Against Mott, I argue that recent work in the model theory of non-monotonic logic indicates how his problem involving logical inconsistencies can be overcome. Against Schiffer, I argue that the claims that he makes against ceteris paribus clauses would lead to a fatal skepticism concerning indefinitely many of the claims we make about the world (and indeed that his claims would be destructive of the view of the special sciences that Schiffer himself presents in his paper), and that the semantical considerations from non-monotonic logic that I present provide a suitable framework for dealing with his complaints. Thus I come out on the whole on Fodor's side of this debate, although for my own reasons, as I argue against much of Fodor's own argumentation. (shrink)

Ecology has become a popular conceptual model in numerous fields of inquiry and it seems especially appropriate for environmental philosophy. Apart from its literal employment in biology, ecology has served as a useful metaphor that captures the interdependence of factors in a field of research. At the same time as ecology is suggestive, it cannot be followed literally or blindly. This paper considers the appropriateness of the uses to which ecology has been put in some recent discussions of architectural and (...) environmental aesthetics, and develops a critique of the differing ecological aesthetics of Jusuck Koh and Xiangzhan Cheng. This article describes our efforts to screen and enrol clinical trial participants conscientiously in the COVID-19 pandemic setting. We present the standard screening and enrolment process prior to, and our process of adapting to, the pandemic. Our goal was to develop a way to screen and enrol people for clinical trials that was both equitable and effective. In addition, we outline the steps our research department took to ensure that ethical, clinical and logistical factors were considered when matching a patient (...) to a clinical trial. (shrink)

It is well established that language production and comprehension are influenced by information status, for example, whether information is given, new, topical, or predictable, and many scholars suggest that an important component of information status is keeping track of what information is in common ground, and what is not. Information status affects both speakers' choices and how listeners interpret the speaker's meaning. Although there is a wealth of scholarly work on information status, there is no consensus on the mechanisms by (...) which it is used, and in fact relatively little discussion of the underlying representations and psycholinguistic mechanisms. Moreover, a major challenge to understanding information status is that its effects are notoriously variable. This study considers existing proposals about information status, focusing on two questions: how is it represented; and by what mechanisms is it used? I propose that it is important to consider whether representations and mechanisms can be classified as either explicit or emergent. Based on a review of existing evidence, I argue that information status representations are most likely emergent, but the mechanisms by which they are used are both explicit and emergent. This review provides one of the first considerations of information status processing across multiple domains. (shrink)

After providing a brief history of global climate change, we consider and reject the influential position that free markets and responsive democracies relieve corporations of obligations to protect the environment. Five main objections to the free market view are presented, focusing in particular on the roles of business organizations in the transportation and electricity generation sectors. Ethically grounded management and public policy recommendations are offered.

This article argues that because racial inequalities are embedded in American society, as well as in medicine, more evidence-based investigation of the effects and implications of affirmative action is needed. Residency training programs should also seek ways to recruit medical students from underrepresented groups and to create effective mentorship programs.

Epigenetic research has brought several important technological achievements, including identifying epigenetic clocks and signatures, and developing epigenetic editing. The potential military applications of such technologies we discuss are stratifying soldiers’ health, exposure to trauma using epigenetic testing, information about biological clocks, confirming child soldiers’ minor status using epigenetic clocks, and inducing epigenetic modifications in soldiers. These uses could become a reality. This article presents a comprehensive literature review, and analysis by interdisciplinary experts of the scientific, legal, ethical, and societal issues (...) surrounding epigenetics and the military. Notwithstanding the potential benefit from these applications, our findings indicate that the current lack of scientific validation for epigenetic technologies suggests a careful scientific review and the establishment of a robust governance framework before consideration for use in the military. In this article, we highlight general concerns about the application of epigenetic technologies in the military context, especially discrimination and data privacy issues if soldiers are used as research subjects. We also highlight the potential of epigenetic clocks to support child soldiers’ rights and ethical questions about using epigenetic engineering for soldiers’ enhancement and conclude with considerations for an ethical framework for epigenetic applications in the military, defense, and security contexts. Many studies have shown that marijuana can negatively affect the cognitive development of adolescents. For some individuals, marijuana use may also initiate opioid use, dose escalation, and opioid use disorder. States that legalize marijuana should help adolescents through regulation of advertising and availability of marijuana-infused edibles. Such policies may assist in protecting neurodevelopment of the adolescent and young adult brain. The federal government should also remove its prohibition of marijuana sales and use, leaving their regulation to state law-makers.

The cremation of human bodies and the incineration of urban waste provide two interrelated examples of technologies using the destructive power of fire that “travelled” in both directions between India and the West in the nineteenth and twentieth centuries. Rather than granting an automatic ascendency to western ways of burning the dead or disposing of urban rubbish, these case studies indicate the manner in which culture and environment inhibited or prevented their advance and favoured the survival or re-articulation of pre-existing (...) technological practices and the socio-political infrastructure in which they were embedded. In the process of travelling, in part made possible by the agency of colonial personnel and the instruments of imperial exchange, but also through Indian opinion and diasporic dissemination, some technologies substantially changed their meaning, context and material form while others, seemingly untouched, underwent more subtle transformation. Object-hood is central to Husserl’s work, yet he employs several different notions of object-hood without clarifying the differences; his work thus offers rich and nuanced reflections on object-hood, but in a theoretically underdeveloped, at times even paradoxical, form. This paper aims to develop Husserl’s theory of objects systematically. In order to achieve this I distinguish five object-concepts operative in Husserl’s phenomenology and prove that they are not co-extensional. I also argue that they form a layer in terms of transcendental constitution, (...) one implying the other. I conclude the paper by exploring Husserl’s paradoxical claim that the absolute is not an object. From these considerations, two meta-phenomenological lessons emerge: object-hood is not total ; yet we cannot escape objectification while engaged in phenomenological reflection. (shrink)

There is tension in the US healthcare system due to conflicting goals of maximizing the public's health and at the same time ensuring shareholder profit among the many private organizations that provide care to those in need. As a result, nurses (often the frontline workers in this mixed public/private and economized system) may experience dissonance between their professional values and the capitalistic values embodied in the healthcare system. Beyond the workplace, nurses are also committed to championing health and wellness, to (...) advocating for social justice, and driving health policy. Yet, constrained by the conflicts between neoliberal values in an economized system and the values of care that inspire many to join the healthcare profession, nurses may lose the ability to live up to their moral ideals, to champion social justice, and to improve public health outcomes. In this paper, we use the critical theory of Juergen Habermas to explore these tensions and to suggest a path forward for nurses. We suggest that by engaging in dialog with each other and the public, and working for greater inclusivity, nurses can find ways to deconstruct ideologies inherent in our current healthcare system, to consider alternatives, and liberate healthcare from the dominance of market forces. Recent developments in the field of artificial intelligence (AI) present profound challenges for law. These challenges stem from law’s anthropocentrism, which is often left unspoken. This essay examines both the epistemic and normative dimensions of anthropocentrism within German Law, with a focus on Private Law. It defends the proposition that law’s anthropocentrism does not inherently oppose the idea of granting AI some form of legal capacity. Rather, so the essay argues, it is essentially a question of regulatory prudence to determine (...) the conditions and criteria under which the law should grant a legal status, legal capacity, or partial legal capacity to AI entities. Nonetheless, it is crucial to acknowledge that the core principles of private law as well as questions of liability for fault and negligence are rooted in human agency and cannot be directly applied to AI. It will be argued that the legal discourse on the recognition of AI is to be understood as a fundamentally political discourse. The political dimension of that discourse will be analyzed through the lens of the political theories of Hannah Arendt and Jaques Rancière, among others. (shrink)

Stem cells and their malignant counterparts require the support of a specific microenvironment or “niche”. While various anti‐cancer therapies have been broadly successful, there are growing opportunities to target the environment in which these cells reside to further improve therapeutic efficacy and outcome. This is particularly true when the aim is to target normal or malignant stem cells. The field aiming to target or use the niches that harbor, protect, and support stem cells could be designated as “nichotherapy”. In this (...) essay, we provide a few examples of nichotherapies. Some have been employed for decades, such as hematopoietic stem cell mobilization, whereas others are emerging, such as chemosensitization of leukemia stem cells by targeting their niche. (shrink)
