C'est une vieille évidence qu'il n'est rien sujet à plus de continuelle agitation que les lois. Et en effet, l'ordre juridique est toujours instable. Il traduit un point d'équilibre momentané, qui n'était pas le seul possible, ni le seul prévisible. Le meilleur des Codes n'a jamais pu le fixer. Son contenu évolue sans cesse. Car, à l'image de la vie, le champ du droit est un espace ouvert, où s'affrontent un chaos de forces en perpétuel mouvement. Ni Providence, ni Progrès (...) n'y apparaissent avec certitude, l'esprit souffle apparemment où il veut et nul ne sait où il va. La preuve en est que la meilleure des règles en un temps donné finit toujours par avoir des effets pervers et qu'il est peu de lois vicieuses qui n'aient parfois d'heureux effets. Dans ces conditions, il ne faut pas attendre de l'enseignement du droit qu'il fournisse un catalogue de recettes pratiques, stables et sûres. Son seul but devrait être d'apprendre à poser les bonnes questions, qui sont presque toujours les mêmes, pour parvenir un jour à trouver de bonnes réponses, toujours provisoires. Or, aucune démarche n'est plus propice à la réalisation d'un tel but que la méthode historique. Elle révèle qu'il n'y a jamais de solution bonne et durable et que chaque civilisation, chaque génération doit trouver elle même ses propres réponses, avec une étroite marge de manœuvre. Pour trouver sa voie, explique l'auteur, ni la science, ni la philosophie ne livrent de clé. Si l'une peut l'éclairer et l'autre le guider, le droit n'est ni assimilable à une science, ni réductible à une philosophie. C'est un art subtil, qui nécessite de se plier à une discipline spécifique, mais dont la parfaite maîtrise dépasse celle des règles techniques qui lui sont indispensables. Elle suppose la sagesse d'admettre les pesanteurs, la complexité et la relativité de la vie, ainsi que la sérénité d'accepter ce qui ne peut être changé, le courage de modifier ce qui peut l'être et le désir de chercher à distinguer l'un de l'autre sans parti-pris. Ceci requiert une tournure d'esprit et une culture à laquelle il ne paraît pas concevable d'accéder sans le secours de l'expérience et le recours à l'histoire. (shrink)

Nietzsche once proclaimed himself the 'Buddha of Europe', and throughout his life Buddhism held enormous interest for him. While he followed Buddhist thinking in demolishing what he regarded as the two-headed delusion of Being and Self, he saw himself as advocating a response to the ensuing nihilist crisis that was diametrically opposed to that of his Indian counterpart. In this book Antoine Panaïoti explores the deep and complex relations between Nietzsche's views and Buddhist philosophy. He discusses the psychological models (...) and theories which underlie their supposedly opposing ethics of 'great health' and explodes the apparent dichotomy between Nietzsche's Dionysian life-affirmation and Buddhist life-negation, arguing for a novel, hybrid response to the challenge of formulating a tenable post-nihilist ethics. This study shows how institutional work contributes to institutional resilience in extreme operating environments. The authors draw from a longitudinal analysis of the operations of Desjardins International Development, a French Canadian nongovernmental organization that, both before and after the major earthquake of 2010, supported the implementation of cooperative banking in Haiti. Building on a unique access to DID’s internal documents as well as on 49 interviews with DID employees, the authors highlight the ways in which political, technical, and cultural forms (...) of institutional work triggered the emergence of social capital, which in turn supported the rise of new forms of institutional work that enabled institutional resilience. The results show how organizational activities focused on shaping institutions may have unintended effects that enable institutional resilience in EOEs, and demonstrate how the accumulation of institutional work by an organization contributes to the enhancement of its social capital. To fulfill their crucial duty of relieving suffering in their patients, physicians may have to administer palliative sedation when they implement treatment-limitation decisions such as the withdrawal of life-supporting interventions in patients with poor prognosis chronic severe brain injury. The issue of palliative sedation deserves particular attention in adults with serious brain injuries and in neonates with severe and irreversible brain lesions, who are unable to express pain or to state their wishes. In France, treatment limitation decisions for these patients (...) are left to the physicians. Treatment-limitation decisions are made collegially, based on the presence of irreversible brain lesions responsible for chronic severe disorders of consciousness. Before these decisions are implemented, they are communicated to the relatives. Because the presence and severity of pain cannot be assessed in these patients, palliative analgesia and/or sedation should be administered. However, palliative sedation is a complex strategy that requires safeguards to prevent a drift toward hastening death or performing covert euthanasia. In addition to the law on patients' rights at the end of life passed in France on April 22, 2005, a recent revision of Article 37 of the French code of medical ethics both acknowledges that treatment-limitation decisions and palliative sedation may be required in patients with severe brain injuries and provides legal and ethical safeguards against a shift towards euthanasia. This legislation may hold value as a model for other countries where euthanasia is illegal and for countries such as Belgium and Netherlands where euthanasia is legal but not allowed in patients incapable of asking for euthanasia but in whom a treatment limitation decision has been made. The epistemology of models has to face a conundrum: models are often described as highly idealised, and yet they are considered to be vehicles for scientific explanations. Truth-oriented—veritist—conceptions of explanation seem thereby undermined by this contradiction. In this article, I will show how this apparent paradox can be avoided by appealing to the notion of fiction. If fictionalism is often thought to lead to various flavours of instrumentalism, thereby weakening the veritist hopes, the fiction view of models offers a framework (...) much richer than it seems at first sight. To do so, I will call upon the concepts of modality, counterfactual structure and credible worlds. In the end, veritism of explanation and fiction can indeed go hand in hand, but the scope of explanations we can hope to draw from models must be more precisely delineated. (shrink)

In the present article I attribute to the common topic in the Rhetoric a two-fold suggestive function and a guarantee function. These three functions are possible because this type of topic, while often quite abstract, nevertheless contains thought-steering, substantial terms, and formulates a generally empirical or normative endoxon. Assuming that according to Aristotle an enthymeme has at least two premises, it would appear that a common topic is the abstract principle behind the often implicit major premise. This means that the (...) topic may be regarded as the – generalizing – if-then statement in a modern argumentation scheme. Therefore it should be possible to see the enthymemes of Rhetoric 2.23 as a combination of a logical argument form (which can usually be reconstructed as modus ponens) and an argumentation scheme – even though we may not attribute this idea to Aristotle himself. Johnson-Laird's mental models theory claims that reasoning is a semantic process of construction and manipulation of models in working memory of limited capacity. Accordingly, both a deduction and a given interpretation of a premise would be all the harder the higher the number of models they require. The purpose of the present experiment was twofold. First, it aimed to demonstrate that the interpretation of if...then conditional sentences in children (third, sixth, and ninth graders) evolves as a function of the number (...) of models the children can produce. We proposed a theory of conditional reasoning development that hypothesises a developmental trend of three successive levels of interpretations underlain by one, two, and then three models, i.e. conjunctive, biconditional, and conditional respectively. Second, we aimed to show that these different levels correlate with working memory capacities: the higher the working memory span, the higher the number of models underlying the conditional interpretation. These two hypotheses were verified, supporting the mental models theory. The results are compared with the rival theory of mental logic. (shrink)

Nombreux sont cependant les textes dans lesquels Marx apporte des éléments décisifs à l'analyse de la dimension politique d'une conjoncture et sur l'évolution des formes étatiques du XIXe siècle. Mais on ne trouve pas chez lui une théorie de l'Etat moderne équivalente à son analyse des rapports de production dans le " capital ". Cela laisse en suspens des problèmes (...) d'importance. Ainsi, comment concevoir le lien entre le rapport salarial, la forme juridique et la représentation politique? Il en est de même pour les phénomènes bureaucratiques. Cela lègue aussi un point aveugle sur une question cruciale : que faut-il entendre par dépérissement de l'Etat? Antoine Artous aborde ces problèmes sans chercher à les esquiver, au travers d'un effort pour "faire parler les textes de Marx". Il ne s'agit pas de restituer une pensée mal comprise ou trahie. Il s'agit d'une lecture critique qui n'hésite pas à relever les lacunes, à mettre Marx à l'épreuve de sa postérité. Un dialogue ainsi s'organise avec des auteurs tels que Max Weber, Nicos Poulantzas ou Ernst Bloch. Pour Antoine Artous, l'œuvre de Marx ne peut sortir indemne de l'inscription historique du marxisme dans ce siècle. Croire le contraire serait illusoire. Elle apparaît néanmoins incontournable pour qui veut penser la formidable rupture dans l'histoire des sociétés que représente l'avènement de l'Etat moderne. The paper presents a research programme for the neuroscience of consciousness called 'neurophenomenology' and illustrates it with a recent pilot study . At a theoretical level, neurophenomenology pursues an embodied and large-scale dynamical approach to the neurophysiology of consciousness . At a methodological level, the neurophenomenological strategy is to make rigorous and extensive use of first-person data about subjective experience as a heuristic to describe and quantify the large-scale neurodynamics of consciousness . The paper focuses on neurophenomenology in relation to (...) three challenging methodological issues about incorporating first-person data into cognitive neuroscience: first-person reports can be biased or inaccurate; the process of generating first-person reports about an experience can modify that experience; and there is an 'explanatory gap' in our understanding of how to relate first-person, phenomenological data to third-person, biobehavioural data. The Rhetoric to Alexander (about 340 B.C.) contains a list of proofs (pisteis) and other types of argumentation which may be seen as the oldest surviving typology of argumentation schemes (avant la lettre). The double analyze of the teacher’s action – observation of teacher gestures and analysis of retroaction - requires two complementary methods to make the links between interactive and postactive phase. It is widely agreed that fiction is necessarily incomplete, but some recent work postulates the existence of universal fictions—stories according to which everything is true. Building such a story is supposedly straightforward: authors can either assert that everything is true in their story, define a complement function that does the assertoric work for them, or, most compellingly, write a story combining a contradiction with the principle of explosion. The case for universal fictions thus turns on the intuitive priority we assign (...) to the law of non-contradiction. My goal in this paper is to show that our critical and reflective literary practices set constraints on story-telling which preclude universal fictions. I will raise four stumbling blocks for universal fictionalists: the gap between saying and making true, our actual interpretive reactions to story-level contradictions, the criteria we accept for what counts as a story in our literary practices, and the undesirability of the universal fictionalist’s closure principles. The premise that every work belongs to an art-kind has recently inspired a kind-centred approach to theories of art. Kind-centred analyses posit that we should abandon the project of giving a general theory of art and focus instead on giving theories of the arts. The main difficulty, however, is to explain what makes a given kind an art-kind in the first place. Kind-centred theorists have passed this buck on to appreciative practices, but this move proves unsatisfactory. I argue that the (...) root of this dissatisfaction stems not from the act of kicking the can down the road, but from not kicking it far enough. The missing ingredient, I argue, is a notion of convention which does the work of marking the difference between art and non-art for a given physical medium. (shrink)

Spiritualism designates a philosophy that lays claim to the separation of mind and body and the ontological and epistemological primacy of the former. In France, it is associated with the names of Victor Cousin and René Descartes, or more precisely with what Cousin made of Descartes as the founding father of a brittle rational psychology, closed off from the positive sciences, and as a critic in respect to the empiricist legacy of the idéologues. Moreover, by considering merely the end result, (...) severed from its polemical genesis, we are prevented from understanding how the category of experience constituted a crucial question for spiritualism itself. Through returning to the origin of these discussions in the 1826 preface to Cousin’s Fragments philosophiques, this essay pursues a threefold path: to show that the public birth of Cousinian spiritualism coincides with the affirmation of applying the experimental method, issuing from Bacon, to the study of facts of consciousness; that Cousin’s later evolution follows a process of radicalization—that is, in this context, of ontologization and of reduction; and that by recovering this genesis, we can distinguish many forms of spiritualisms committed to the experimental method, both in alliance with the early Cousin and against the later Cousin. In this way, we can rediscover the interwoven philosophical links, lost in the process of institutionalization, between metaphysical demands and empiricist concerns, or between “French” philosophy and the legacy of Condillac. Calm is a little-theorized but important link between Roland Barthes and Samuel Beckett. Beginning with Beckett, moving on to Barthes, and then interleaving the two, this paper proposes calm as a ‘scandalous’ category not reducible to kindred states like languor or apatheia. In dialogue with theorists of repose, such as Kant and De Quincey, calmness becomes less a sedated condition than an interactive process, entailing intense sensitivity to the fluctuations of what Barthes calls ‘the affective minimal’. Artistically generative, this ‘emotive (...) lucidity’ encourages inquisitiveness towards the natural world, and enables in both writers specific writing practices — from lists to notation to haiku. Summary New information technology can be an invaluable aid to research in the history of ideas provided it is built on scientific foundations. This article discusses the case of Diderot and D'Alembert's Encyclopédie and analyses its use of earlier dictionaries (the Dictionnaire de Trévoux, Chambers's Cyclopaedia and Moréri's dictionary). It also shows how neglect of existing research in the history of ideas and ignorance of how these eighteenth-century European publications were elaborated, combined with inappropriate use of software for detecting plagiarism, (...) have led to totally mistaken findings. These findings, widely publicised thanks to the Internet, constitute a real danger for future research. The article concludes that the intellectual community urgently needs to invest seriously in the digital humanities in order to safeguard future research. (shrink)

La biologie ne se prête jamais à un usage militaire moralement défendable parce que le confinement au champ de bataille est impossible. De ce fait, les applications de la biologie ont été vite écartées du domaine de la Défense permise par les traités internationaux. La Convention de 1972 sur l’Interdiction des Armes Biologiques et à Toxines (CIABT), entrée en vigueur en 1975, est aujourd’hui signée par 183 pays (ratifiée par 175) sur un total de 193, sans compter Taïwan qui l’a ratifiée mais n’est pas reconnu par l’ONU. Elle interdit la mise au point, la fabrication, l’acquisition, le transfert, la conservation, le stockage et l’utilisation des armes bio- logiques et à toxines. Recent brain imaging studies using functional magnetic resonance imaging (fMRI) have implicated insula and anterior cingulate cortices in the empathic response to another’s pain. However, virtually nothing is known about the impact of the voluntary generation of compassion on this network. To investigate these questions we assessed brain activity using fMRI while novice and expert meditation practitioners generated a loving-kindness-compassion meditation state. To probe affective reactivity, we presented emotional and neutral sounds during the meditation and comparison periods. Our main hypothesis (...) was that the concern for others cultivated during this form of meditation enhances affective processing, in particular in response to sounds of distress, and that this response to emotional sounds is modulated by the degree of meditation training. The presentation of the emotional sounds was associated with increased pupil diameter and activation of limbic regions (insula and cingulate cortices) during meditation (versus rest). During meditation, activation in insula was greater during presentation of negative sounds than positive or neutral sounds in expert than it was in novice meditators. The strength of activation in insula was also associated with self-reported intensity of the meditation for both groups. These results support the role of the limbic circuitry in emotion sharing. The comparison between meditation vs. rest states between experts and novices also showed increased activation in amygdala, right temporo-parietal junction (TPJ), and right posterior superior temporal sulcus (pSTS) in response to all sounds, suggesting, greater detection of the emotional sounds, and enhanced mentation in response to emotional human vocalizations for experts than novices during meditation. Together these data indicate that the mental expertise to cultivate positive emotion alters the activation of circuitries previously linked to empathy and theory of mind in response to emotional stimuli.. Antoine Pecquet wrote in the eighteenth century during the reign of Louis XV. Although he included Pascal among those he admired, he considered Alexander Pope his true mentor. In Part 1 of "Diverse Thoughts on Man," Pecquet reflects on Man's responsibilities as an individual: in Part 2, on Man's responsibilities as a member of society. Among these responsibilities he includes human and social concerns, such as parental and filial obligations, and the transfer of wealth between generations. In the tradition (...) of Montaigne, Pecquet intended his "Diverse Thoughts on Man" to help his readers learn more about themselves. Although he felt that those who would profit most from his book were readers who had not greatly pondered about themselves, he believed that every reader could find something of value in it. Antoine Arnauld and Pierre Nicole were philosophers and theologians associated with Port-Royal Abbey, a centre of the Catholic Jansenist movement in seventeenth-century France. Their enormously influential Logic or the Art of Thinking, which went through five editions in their lifetimes, treats topics in logic, language, theory of knowledge and metaphysics, and also articulates the response of 'heretical' Jansenist Catholicism to orthodox Catholic and Protestant views on grace, free will and the sacraments. In attempting to combine the categorical theory of (...) the proposition with a Cartesian account of knowledge, their Logic represents the classical view of judgment which inspired the modern transformation in logic and semantic theory by Frege, Russell, Wittgenstein and recent philosophers. This paper analyzes an explicit instantiation of the program of “neurophenomenology” in a neuroscientific protocol. Neurophenomenology takes seriously the importance of linking the scientific study of consciousness to the careful examination of experience with a specific first-person methodology. My first claim is that such strategy is a fruitful heuristic because it produces new data and illuminates their relation to subjective experience. My second claim is that the approach could open the door to a natural account of the structure of human (...) experience as it is mobilized in itself in such methodology. In this view, generative passages define the type of circulation which explicitly roots the active and disciplined insight the subject has about his/her experience in a biological emergent process. As a singular witness and actor of the tumultuous 20th century, Ernst Jünger remains a controversial and enigmatic figure known above all for his vivid autobiographical accounts of experience in the trenches of the First World War. This article will argue that throughout his entire oeuvre, from personal diaries to novels and essays, he never ceased to grapple with what he viewed as the central question of the age, namely that of the problem of nihilism and the means to overcome (...) it. Inherited from Nietzsche’s diagnosis of Western civilization in the late 19th century, to which he added an acute observation of the particular role of technology within it, Jünger would employ this lens to make sense of the seemingly absurd industrial slaughter of modern war and herald the advent of a new voluntarist and bellicist order that was to imminently sweep away timorous and decadent bourgeois societies obsessed with security and self-preservation. Jünger would ultimately see his expectations dashed, including by the forms of rule that National Socialism would take, and eventually retreated into a reclusive quietism. Yet he never abandoned his central problematique of nihilism, developing it further in exchanges with Martin Heidegger after the Second World War. And for all the ways in which he may have erred, his life-long struggle with meaning in the age of technique and its implications for war and security continues to make Jünger a valuable interlocutor of the present. We argue that ecology in general and biodiversity and ecosystem function research in particular need an understanding of functions which is both ahistorical and evolutionarily grounded. A natural candidate in this context is Bigelow and Pargetter’s evolutionary forward-looking account which, like the causal role account, assigns functions to parts of integrated systems regardless of their past history, but supplements this with an evolutionary dimension that relates functions to their bearers’ ability to thrive and perpetuate themselves. While Bigelow and Pargetter’s account (...) focused on functional organization at the level of organisms, we argue that such an account can be extended to functional organization at the community and ecosystem levels in a way that broadens the scope of the reconciliation between ecosystem ecology and evolutionary biology envisioned by many BEF researchers. By linking an evolutionary forward-looking account of functions to the persistence-based understanding of evolution defended by Bouchard and others, and to the theoretical research on complex adaptive systems, we argue that ecosystems, by forming more or less resilient assemblages, can evolve even while they do not reproduce and form lineages. We thus propose a Persistence Enhancing Propensity account of role functions in ecology to account for this overlap of evolutionary and ecological processes. (shrink)

Which properties are characteristic of the enthymeme in Aristotle's Rhetoric? There is no consensus on this point. The present discussion centres on three properties. 1. Is there always an implicit premise? (Answer: Above all, a pragmatic level and a logical level must be distinguished.) 2. Do the premises consist by definition of probabilities and signs? Assembly of minimal genomes revealed many genes encoding unknown functions. Three overlooked functional categories account for some of them. Cells are prone to make errors and age. As a first key function, discrimination between proper and changed entities is indispensable. Discrimination requires management of information, an authentic, yet abstract, cur- rency of reality. For example proteins age, sometimes very fast. The cell must identify, then get rid of old proteins without destroying young ones. Implementing discrimination in cells leads to the (...) second set of functions, usually ignored. Being abstract, information must nevertheless be embodied into material entities, with unavoidable idiosyncratic properties. This brings about novel unmet needs. Hence, the buildup of cells elicits specific but awkward material implementations, ‘kludges’ that become essential under particular settings, while difficult to identify. Finally, a third functional category char- acterizes the need for growth, with metabolic implementations allowing the cell to put together the growth of its cytoplasm, membranes, and genome, spanning different spatial dimensions. Solving this metabolic quandary, critical for engineering novel synthetic biology chassis, uncovered an unexpected role for CTP synthetase as the coordinator of nonhomothetic growth. Because a significant number of SynBio constructs aim at creating cell factories we expect that they will be attacked by viruses (it is not by chance that the function of the CRISPR system was identified in industrial settings). Substantiating the role of CTP, natural selection has dealt with this hurdle via synthesis of the antimetabolite 30-deoxy-30,40-didehydro- CTP, recruited for antiviral immunity in all domains of life. In initial teacher training, the micro-teaching activities and retroaction have for goals to develop reflexive practitioners and competent professionals with a high professional identity. The double analyze of the teacher’s action – observation of teacher gestures and analysis of retroaction - requires two complementary methods to make the links between interactive and postactive phase. In this article, the authors describe the different training activities, and explain the research approach with an illustration of a concrete case.
