While the academic separation of policing and regulation is still largely operative, points of convergence are more significant than ever in the digital age, starting with concomitant debates about algorithms as a new figure of power. From the policing of illegal activities to the regulation of legal ones, the algorithmization of such critical social ordering practices has been the subject of growing attention. These burgeoning discussions are focused on one common element: big data surveillance. In accordance with such similarities and (...) paralleled developments in policing and regulation, the article aims to further bridge the gap between literatures to respond to the calls for studying big data surveillance across institutional domains and social fields. To do so, it is focused on one case study that articulates algorithmic policing and regulation domains, in-between security and economic fields. This is the fight against illicit finance, i.e. ‘the global action against the financial flows that fuel crime and terrorism’. To what extent does big data surveillance make a difference in the main global policy of crime-fighting and financial regulation? Drawing on a fieldwork in a large North American bank, the present article takes stock of the algorithmic overlap between policing and regulation. It argues that the final result is policing and regulation of neither too much nor too little, which gives rise to automated and everyday mass surveillance while remaining as far removed from regulatory and crime-fighting ambitions as it is from dystopian visions of big data and algorithmic drama. The standard by which we apply decision-making for those unable to do so for themselves is an important practical ethical issue with substantial implications for the treatment and welfare of such individuals. The approach to proxy or surrogate decision-making based upon substituted judgement is often seen as the ideal standard to aim for but suffers from a need to provide a clear account of how to determine the validity of the proxy's judgements. Proponents have responded to this demand by providing (...) the truth-conditions for the substituted judgement in terms of counterfactual reasoning using a possible worlds semantics. In this paper, I show how these underpinnings fail to support the substituted judgement approach as a reasonable standard for decision-making. Firstly, I show how this counterfactual element has been poorly interpreted. I then explain how various accounts have failed to reflect problems and limitations associated with providing an interpretation of their truth-conditions using counterfactuals. Finally, I argue that, even when we attend to the initial problems of providing a counterfactual analysis, it still deeply problematic as a means of determining the validity of substituted judgements for two main reasons. Firstly, making determinate judgements as to the truth-value of these judgements will often not be possible and, secondly, there is a strong requirement when interpreting many counterfactual claims to charitably accede to their being true. I conclude that substituted judgements, as interpreted through counterfactual reasoning and possible worlds semantics, do not therefore provide an adequate standard for surrogate decision-making. Both critique and an appropriation of a large and diverse body of work, Home and Beyond is a major contribution to contemporary Husserl scholarship.

This research work examines Heidegger's (1889-1976) contention that phenomenology can inspire, illuminate, motivate, reinforce and guide (human) individual's actions. It achieves this by adapting Heidegger's phenomenological approach to analyze and interpret representative everyday factical experiences of nepotism, selfishness and mass mentality in the (Nigerian) society. Doing this helps to ascertain whether these experiences have any phenomenological link with inauthenticity. Also, it provides a close reading and interpretation of Heidegger's treatment of authentic existence, and explores the possibility of complimenting it with (...) the phenomenology of Commensality, as a mode of care and a way to authenticity. In this manner, it strategically explores possible ways of inspiring individual Daseins to authenticity, and with it engendering a positive transformation of the (Nigerian) society. Presenting and elaborating the phenomenology of Commensality, the work highlights the relationship and the differences between the phenomenology of Commensality and the ontical or sociological understanding of commensality as obtained in African traditional societies. Phenomenology of Commensality argues for the 'renaissance' of Commensality, concretely expressed as Onyenkeanyi, and not just for its 'revival'. The research work further develops the phenomenology of education for Commensality, discussing the possible content and focus of its curriculum, while differentiating it from ethics. The proper implementation of phenomenology of education for Commensality could inspire and illuminate individual Daseins to authenticity, and thereby becomes an improvement strategy for the positive transformation of the (Nigerian) society. As a phenomenology, it is appropriate that the people and places analyzed take on a definite character, which is why the Nigerian society is used. However, it is expected that the implications of the findings presented here will be general and accurate enough to allow application to any number of similar situations. (shrink)

Doing theology with children, in a systematic and focused way, is a new practice. This article contributes to this theological practice by examining its emergence, nature and mission and proposing multimodal narrativity as a practical theological methodology for doing such theology. The article argues, from a practical theological standpoint, that doing theology with children should be understood as a synodal event – a journeying together with children about their faith; as a way of seeing the mysteries of God through the (...) eyes of the child and of encouraging a robust understanding of God and God’s plan for humanity and the entire creation; and as a way of seeing the faces of children and hearing their voices, thereby accounting for their suffering and hope. Children themselves are sources and disruptors of hope. The use of multimodal narrativity creates space for these narratives and disruptions of hope and encourages children to theologise their experiences in the midst of their different communities. The following paper argues that the conception of truth evolves significantly after the WL-1804-ii, and that, in such texts as the Erlanger Metaphysik, the Spekulation zu Koppenhagen, and the 1812 WL, Fichte, building on the account of the hiatus in the WL-1804-ii while moving away (...) from its notion of absolute truth, seeks to understand truth in terms of freedom, or indeed, as what »yields to freedom«, wherein freedom, through the negativity of the concept, produces an emptiness, a clearing, that is »fulfilled« with truth. Anticipating the phenomenological account of truth yet without abandoning a strong sense of normativity, Fichte’s alethology remains a compelling alternative to contemporary positions. (shrink)

Through a radically conceived sentimentality – the unmediated juxtaposition of the abjection of things, conceived as a paradoxical “desire for desire” having no place in the world, with a cruel, apathetic gaze – Andersen challenges the existence of the soul or subjectivity as what, by combining the theoretical gaze with contemplative pleasure, grants coherence to experience. Thus undermining not only Romantic self-reflection, and its suturing of philosophy to criticism, but (...) There is no doubt that the model presented here is incomplete. Many important categories, particularly negation and the adverbials, have been entirely ignored, and the treatment of Tense and the affixes is certainly inadequate. It also remains to be seen how the many constructions that have been ignored here are to be accommodated within the framework that has been outlined. However, the fact that a standard categorial lexicon, plus the four rule schemata, seems to come close to exhaustively specifying the (...) main clause constructions of English, and also seems to explain a number of major constraints on transformations, encourages us to compare the theory with certain alternatives, and to examine its broader implications. An ethic of the fitting: a conceptual framework for nursing practiceNurses are expected to act within an ethos of care cognisant of duty, the right, and the good. Concepts of virtue theory, utilitarianism and deontology are used to outline a conceptual ethical framework for nurses in practice. This ‘Moebius’ framework aims to locate the virtues in a symbiotic relationship with the principles of utilitarianism and deontology. Under this framework, fitting ethical responses are sought. Within an ethic of the fitting, rules (...) and principles do not guarantee the most ethically justifiable outcomes. Within the Moebius approach, the nurse ought to respond with a sense of compassion that befits the moment rather than adhere to a rule at all costs. (shrink)

Disvaluing nature—a cognitive act—usually leads quickly to devaluing it too: to real-world exploitation and destruction. Worse, in fact, nature in its devalued state can then be held up as an excuse and justification for the initial disvaluation. In this way, dismissal and destruction perpetuate themselves. I call this process “self-validating reduction.” It is crucial to recognize the cycle of self-validating reduction, both in general and specifically as it applies to nature, if we are to have any chance of reversing it.

Mitochondrial replacement techniques have the potential to allow prospective parents who are at risk of passing on debilitating or even life-threatening mitochondrial disorders to have healthy children to whom they are genetically related. Ethical concerns have however been raised about these techniques. This article focuses on one aspect of the ethical debate, the question of whether there is any moral difference between the two types of MRT proposed: Pronuclear Transfer and Maternal Spindle Transfer. It examines how questions of identity impact (...) on the ethical evaluation of each technique and argues that there is an important difference between the two. PNT, it is argued, is a form of therapy based on embryo modification while MST is, instead, an instance of selective reproduction. Few aspects of social behavior tell us more about a culture than those practices that involve the roles it assigns to models and copies. Under interpretation, such conduct reveals its attitudes toward authority and antiquity, its sense of identity and regard for security, and the relative importance that it attached to imitation and invention. To varying degrees, all societies display these concerns, but in none were they so firmly grounded in a considered theory of the relation between prototype and derivative (...) as they were in Byzantium. An example from the domain of law will illustrate, though not explain, this cultural difference. As against the Roman tradition in which the use of copies as evidence in court was prohibited, at least from the tenth century on Byzantine tribunals accepted the legitimacy of certified copies of documents. The very word used for an official copy—ison, meaning equal— suggests the conceptual distinction between it and the terms copie, Kopie, kopiya, and so on, in modern languages, all derived from the Latin word for abundance. Rejecting the tendency to regard Fichte as merely a transitional figure in the development of German idealism, the following paper argues that, in the years following his dismissal from Jena, Fichte will come to map out a unique and compelling philosophical trajectory. This will be demonstrated, in particular, through a close reading of the Erlanger lectures Institutiones omnis philisophiae of 1805: in these texts, which undertake the pedagogical task of introducing his students to philosophy and indeed achieving a “transformation” of (...) perspective, Fichte makes a fundamental philosophical breakthrough. This becomes possible precisely because his focus on the pedagogical task draws his attention to the most fundamental subjective or even “existential” conditions of philosophical insight, leading him, in turn, to a theorization of the capacity of understanding, by producing contradictions, to open up a space of negativity; a negativity that is itself the essence of human freedom, and through which truth is yielded rather than either discovered or produced. Whereas Hegel and Schelling regard Kant’s residual dualism as a philosophical scandal, Fichte, through this notion of a radical freedom born from the unresolved negativity of the understanding, will seek not to overcome dualism through a higher perspective but to recognize its absolutely binding character. Taking its departure from The Differend’s analysis of Auschwitz as a sign for the evental character of history, I argue that the looming ecological disaster we now face reveals both the continuing relevance and limits of Lyotard’s thought. While the form of political agency of the catastrophe to come involves a differend, this differend cannot be attached to a proper name, however problematic its mode of signification. This, however, suggests the even greater relevance of Lyotard’s treatment, in the conclusion of (...) The Differend, of capitalism in terms of temporal contradiction, as well as his theorization of oikos and ecology in subsequent works, where he distinguishes between the economic and the ecological. This distinction, I conclude, is rendered problematic by the catastrophe to come, as indeed is any attempt to draw an absolute distinction between “philosophical politics” and mere technocratic management or even to exclude speculation from the heart of philosophy. The following paper argues that J.G. Fichte, despite his apparent philosophical neglect of art and aesthetics, does develop a strong, original, and coherent account of art, which not only allows the theorization of modern, non-representative art forms, but indeed anticipates Nietzsche and Heidegger in conceiving of truth in terms of art rather than scientific rationality. While the basis of Fichte’s philosophy of art is presented in the essay “On Spirit and Letter in Philosophy,” it is not developed systematically either in (...) this text or anywhere else in his writings, but must be reconstructed through a broad consideration of all his works, including, above all, his political and economic writings. For Fichte, the art-work does not exist as an object possessing “aesthetic value” and which can, in turn, be possessed, consumed, and enjoyed through the subjective act of aesthetic experience. Rather, it involves a mode of praxis which, grounded in a radical and original power of imagination, creatively discloses possibilities for future forms of existence, experience, and political community that cannot be theoretically anticipated. While Fichte cannot himself theorize specific forms of art, since the art that concerns him belongs to the future, we can, however, retrospectively try to understand non-representational painting and non-mimetic dance as concrete realizations of Fichte’s art-work of the future. In this way, Fichte’s philosophy of art ultimately suggests an alternative to Heidegger’s understanding of the work of art as a projective institution of truth. I’m certainly not alone in noting that the year 2011 brings, for those of us who are students of the work of Frantz Fanon, two different anniversaries. This year marks the fiftieth anniversary of the publication of Les damnés de la terre , Fanon’s final book and, for many, his most lasting achievement. But it also marks the fiftieth anniversary of Fanon’s death: he died, tragically young, on December 6, 1961, not long after the book’s publication. It is no exaggeration (...) to say that Les damnés de la terre was composed by Fanon from his deathbed, and that he was well aware that he was racing death as he rushed to complete the manuscript, as his publisher François Maspero remarked, “in pitiful haste.” Fanon had managed to complete it by July, although, as he told a friend, “I should have liked to have written something more.” As David Macey notes in his indispensable biography, “Fanon did see copies of his last book, but for its first readers, Les damnés de la terre was a posthumous work.” The book and Fanon’s death thus come to us bound inextricably together, fifty years later. So it would seem that we have an anniversary to celebrate (and in doing so, we would thus be celebrating the continuing relevance of a classic work, as this special issue intends us to do), but also a death to mourn. If I proceed to make a suggestion that will seem at first to be the height of perversity, let me preface it by saying that this suggestion is occasioned by what I believe to be Fanon’s greatest legacy, a legacy of unsparing intellectual and political commitment. For I want to begin by suggesting that this year brings us the mournful fact that fifty years on, Les damnés de la terre remains, in many ways, as relevant to our contemporary world as it was in 1961; but conversely, the anniversary of Fanon’s death offers us a cause for celebration. . Ideophony is a neglected aspect of investigations of world poetic traditions. This article looks at the use of ideophony in a variety of Navajo poetic genres. Examples are given from Navajo place-names, narratives, and songs. A final example involves the use of ideophony in contemporary written Navajo poetry. Using the work of Woodbury, Friedrich, and Becker it is argued that ideophones are an example of form-dependent expression, poetic indeterminacy, and the inherent exuberances and deficiencies of translation and thus strongly resists (...) translation. This fact becomes more relevant when understood in light of the current language shift from Navajo to English. (shrink)

In this essay I propose an environmental ethic in the pragmatic vein. I begin by suggesting that the contemporary debate in environmental ethics is forced into a familiar but highly restrictive set of distinctions and problems by the traditional notion of intrinsic value, particularly by its demands that intrinsic values be self-sufficient, abstract, and justified in special ways. I criticize this notion and develop an alternativewhich stresses the interdependent structure of values, a structure which at once roots them deeply in (...) our selves and at the same time opens them to critical challenge and change. Finally, I apply this alternative view back to environmental ethics. It becomes easy to justify respect for other life forms and concern for the natural environment, and indeed many of the standard arguments only become stronger, once the demand to establish intrinsic values is removed. This thoughtful book argues that skepticism -- the view that reliable knowledge is beyond our grasp -- is unavoidable unless knowledge is thought of not as merely an intellectual matter but as crucial to practical activity and emotional life. Author Anthony Rudd ties this idea to the work of Wittgenstein and Heidegger, exploring important similarities between the former's reminders of the "expressive" character of human experience and the latter's account of ways to experience the physical world "expressively.".

Parfit’s (1984) Non-Identity Problem provides a strong line of argument that we cannot be harmed by pre-conception choices or actions. I argue that we can no longer appeal to the Non-Identity problem in order to justify using pre-conception genetic screening and selection techniques as a harmless tool to determine the genetic constitution of future individuals. My criticism of the Non-Identity problem is based on a rejection of the metaphysical foundations of Parfit’s argument - Kripke’s (1980) essentialist arguments for the necessity (...) of origin. I offer an alternative account of modal harms based on counterpart theory such as that offered by David Lewis (1986). On this account, individuals can make legitimate harm claims in regard to pre-conception choices made in determining their genetic constitution by appeal to their counterparts across possible worlds. Addressing the matter of attention from a phenomenological perspective as it bears on the problem of becoming aware, I draw on Edmund Husserl''s analyses and distinctions that mark his genetic phenomenology. I describe several experiential levels of affective force and modes of attentiveness, ranging from what I call dispositional orientation and passive discernment to so-called higher levels of attentiveness in cognitive interest, judicative objectivation, and conceptualization. These modes of attentiveness can be understood as motivating a still more active mode of (...) reflective attention, i.e., philosophical attentiveness, and to this extent, even it would be subject to varying influences of affection. What role, if any, does affection play in a peculiar kind of reflective attention that is phenomenological? I conclude by briefly considering phenomenological reflective attentiveness and its relation to affection. (shrink)

The standard definition of atomicity—the thesis that everything is ultimately composed of entities that lack proper parts—is satisfied by a model that is not atomistic. The standard definition is therefore an incorrect characterization of atomicity. I show that the model satisfies the axioms of all but the strongest mereology and therefore that the standard definition of atomicity is only adequate given some controversial metaphysical assumptions. Increasing computational power and improving deep learning methods have made computer vision technologies pervasively common in urban environments. Their applications in policing, traffic management, and documenting public spaces are increasingly common (Ridgeway 2018, Coifman et al. 1998, Sun et al. 2020). Despite the often-discussed biases in the algorithms' training and unequally borne benefits (Khosla et al. 2012), almost all applications similarly reduce urban experiences to simplistic, reductive, and mechanistic measures. There is a lack of context, depth, and specificity in these (...) practices that enables semantic knowledge or analysis within urban contexts, especially within the context of using and occupying urban space. This paper will critique existing uses of artificial intelligence and computer vision in urban practices to propose a new framework for understanding people, action, and public space. This paper revisits Geertz's (1973) use of thick descriptions in generating interpretive theories of culture and activity and uses this lens to establish a framework to approach evaluating the varied uses of computer vision technologies that weigh meaning. By discussing cases of implemented examples of urban computer vision—from LinkNYC and Numina's urban measurements to the Detroit Police's use of DataWorks Plus's facial recognition technology—it proposes a framework for evaluating the thickness of the algorithm's conclusions against the computational method's complexity required to produce that outcome. Further, we discuss how the framework's positioning may differ (and conflict) between different users of the technology, from engineer to urban planner and policymaker, to citizen. This paper also discusses how the current use and training of deep learning algorithms and how this process limits semantic learning and proposes three potential methodologies toward gaining a more contextually specific, urban-semantic, description of urban space relevant to urbanists. This paper contributes to the critical conversations regarding the proliferation of artificial intelligence by challenging the current applications of these technologies in the urban environment by highlighting their failures within this context while also proposing an evolution of these algorithms that may ultimately make them sensitive and useful within this spatial and cultural milieu. Online debates typically possess a large number of argumentative comments. Most readers who would like to see which comments are winning arguments often only read a part of the debate. Many platforms that host such debates allow for the comments to be sorted, say from the earliest to latest. How can argumentation theory be used to evaluate the effectiveness of such policies of sorting comments, in terms of the actually winning arguments displayed to a reader who may not have read (...) the whole debate? We devise a pipeline that captures an online debate tree as a bipolar argumentation framework, which is sorted depending on the policy, giving a sequence of induced sub-BAFs representing how and how much of the debate has been read. Each sub-BAF has its own set of winning arguments, which can be quantitatively compared to the set of winning arguments of the whole BAF. We apply this pipeline to evaluate policies on Kialo debates, where it is shown that reading comments from most to least liked, on average, displays more winners than reading comments earliest first. Therefore, in Kialo, reading comments from most to least liked is on average more effective than reading from the earliest to the most recent. (shrink)
