El texto plantea una lectura de la obra de Michel Foucault según la cual en la época clásica –siglos XVII y XVIII– se construye una concepción del espacio que es correlativa a las prácticas discursivas que caracterizan la “episteme de la representación”. Esta concepción vincula los campos estético, social y epistémico a través de la idea del espacio como un ‘campo de visibilidad’ cuyas reglas de constitución comunican un tipo de representación pictórica, un modelo de distribución de las poblaciones y (...) una forma de discurso sobre la enfermedad. Dado que esas reglas, a su vez, se realizan a través de dispositivos concretos de producción de saber y de relaciones de poder, en su descripción espero dar cuenta de los límites históricos y epistémicos de la época clásica. Este artículo presenta una reflexión sobre el lugar y la pertinencia de la filosofía del arte en un mundo del arte en el cual cualquier cosa puede ser una obra de arte, a partir de la propuesta teórica de Arthur Danto. Si la filosofía aún tiene algo que decir sobre el arte, sería desde una posición que reconozca la centralidad de la práctica artística sin delimitarla. La apertura en el arte no puede ser un motivo de negación o juicio, sino (...) un incentivo al pensamiento. Sin embargo, según Danto, ello exige aceptar puntos de partida y consecuencias que modifican la relación entre arte y filosofía. (shrink)

This paper presents a reflection on subjectivity in the context of consumer society, discussing two alternative approaches: on the one hand, the iden- tification between subject and commodity, traceable, among others, to Bauman, and, on the other hand, Žižek’s interpretation of subjectivity as an emerging surplus of the conflict within the symbolic order. The result- ing exchange between these alternatives shows the constitutive relations of the subject of consumption in the dimension of desire, in the margin of freedom, and in (...) the role of reflexivity. Finally, the understanding of the relationship between the subject and the material world is proposed as a constructive performativity of subjectivity. (shrink)

This paper investigates the emotive (or expressive) meaning of words commonly referred to as “loaded” or “emotive,” which include slurs, derogative or pejorative words, and ethical terms. We claim that emotive meaning can be reinterpreted from a pragmatic and argumentative perspective, which can account for distinct aspects of ethical terms, including the possibility of being modified and its cancellability. Emotive meaning is explained as a defeasible and automatic or automatized evaluative and intended inference commonly associated with the use of specific (...) terms, which can be represented and assessed considering its logical structure and its defeasibility conditions. This automatic inference is conceived as part of the connotation of an ethical term, and is not necessarily stable. By means of quasi-definitions, it is possible to modify the emotive meaning while maintaining the descriptive one, automaticizing the inferences drawn from an ethical word. Through examples drawn from the recent US presidential campaign, we show how re-contextualization and emotive contexts can affect emotive meaning. (shrink)

The purpose of this paper is to provide a basis for a systematic development of signaling theory on CSR initiatives. The paper proposes signaling theory as a framework supportive of a strategic CSR approach; maps extant research on signaling through CSR initiatives; offers a comprehensive assessment of the most diffused CSR initiatives and discusses their eligibility as signaling devices; and outlines a research agenda to further develop and test signaling theory in business ethics. A Brief History of the Philosophy of Time is a concise and accessible survey of the history of philosophical and scientific developments in understanding time and our experience of time. It discusses prominent ideas about the nature of time, plus many subsidiary puzzles about time, from the classical period through the present.

The analysis of multimodal argumentation in advertising is a crucial and problematic area of research. While its importance is growing in a time characterized by images and pictorial messages, the methods used for interpreting and reconstructing the structure of arguments expressed through verbal and visual means capture only isolated dimensions of this complex phenomenon. This paper intends to propose and illustrate a methodology for the reconstruction and analysis of “double-mode” arguments in advertisements, combining the instruments developed in social semiotics, pragmatics, (...) and argumentation theory. An advertisement is processed through a five-step path. The analysis of its context, text genre, and images leads to a first representation of the messages that it encodes both pictorially and verbally (step 1). These first semantic representations are further enriched by including their polyphonic articulations and presuppositions (step 2), their explicatures (step 3), and their dialogical functions and illocutionary forces (step 4). These pragmatic steps retrieve the commitment structure of the ad, which allows a further argument analysis conducted through argumentation schemes (step 5). (shrink)

By transcendental aesthetic, Kant means “the science of all principles of a priori sensibility” (A 21/B 35). These, he argues, are the laws that properly direct our judgments of taste (B 35 – 36 fn.), i.e. our aesthetic judgments as we ordinarily understand that notion in the context of contemporary art. Thus the first part of the Critique of Pure Reason, entitled the Transcendental Aesthetic, enumerates the necessary presuppositions of, among other things, our ability to make empirical judgments about particular (...) works of art. These presuppositions are sensible rather than intellectual because on Kant’s view, all intellection that considers objects of any kind, whether abstract or concrete, must at base connect to actual, material objects with which we come into direct contact; and this we can do only through sensibility (A 19/B 33). Thus the following discussion explores what Kant claims must be true of us in order to make the sorts of aesthetic judgments we make, rather than any particular class or quality of aesthetic judgments itself. On Kant’s view, what must be true of us in order to make aesthetic judgments is not different from what must be true of us in order to make any other kind of judgment about empirical objects. In a series of influential articles (Kim 1989b, 1992b, 1993a and 1998), Jaegwon Kim has developed a strong argument against nonreductive physicalism as a plausible solution to mental causation. The argument is commonly called the ’causal exclusion argument’, and it has become, over the years, one of the most serious threats to the nonreductivist point of view. The article is divided into two parts. The first part offers a careful reconstruction and detailed discussion of the argument of causal exclusion, as well as of the implications it has for physicalism. In its second part the article examines two important objections to the causal exclusion argument: the generalization objection, which holds that the argument is unacceptable since it confers causal efficacy only to ultimate basic properties, which arguably might not exist; and Yablo’s objection, according to which underlying the (...) argument of causal exclusion there is a principle of causal parsimony which leads to strong counterintuitive results and should therefore be abandoned. The article offers grounds for rejecting both objections as well as a new diagnosis of the problem for mental causation generated by the causal exclusion argument. (shrink)

RESUMEN El artículo ingresa en la ontología del acontecer y recorre cuatro momentos. En primer lugar, distingue la visión del mundo en general, propia de la llamada “metafísica” de la visión del ser como acontecer, y busca un diálogo entre la perspectiva del ser en la metafísica y ontología de Hans-Georg Gadamer. En segundo lugar, analiza la estructura del acontecer o el modo como se despliega el movimiento del sentido, para determinar la lógica de la pregunta como estructura del acontecer. (...) En tercer lugar, entabla un diálogo entre la idea de acontecer y la categoría de finitud, para evidenciar que, cuando se piensa en una ontología del acontecer, esta remite a la determinación de la finitud. Y, finalmente, plantea algunas líneas de desarrollo para profundizar en esta investigación. ABSTRACT The articles discusses the ontology of the event and covers four moments. First, it identifies the general worldview typical of the “metaphysics” of being as event, and seeks to establish a dialogue between the perspective of being in Hans-Georg Gadamer’s metaphysics and his ontology. Secondly, it analyzes the structure of the event or the way in which the movement of meaning unfolds, in order to determine the logic of the question as structure of the event. Third, through a dialogue between the idea of event and the category of finitude, the article shows that thinking the ontology of the event leads to the determination of finitude. Even though, over the last two decades, the boundaryless career concept has stimulated a wide theoretical debate, scholars have recently claimed that research on the competencies that are necessary for managing a cross-boundary career is still incomplete. Similarly, the literature on emotional and social competencies has demonstrated how they predict work performance across industries and jobs but has neglected their influence in explaining the individual's mobility across boundaries and their impact on career success. This study aims to fill these gaps (...) by examining the effects of emotional and social competencies on boundaryless career and on objective career success. By analyzing a sample of 142 managers over a period of 8 years, we found evidence that emotional competencies positively influence the propensity of an individual to undertake physical career mobility and that career advancements are related to the possession of social competencies and depend on the adoption of boundaryless career paths. This study also provides a contribution in terms of the evaluation of the emotional and social competencies demonstrated by an individual and of the operationalization of the measurement of boundaryless career paths, considering three facets of the physical mobility construct (organizational, industrial, and geographical boundaries). So far, legal translation studies have generally been concerned with multilingual legislation, which they have dissected using comparative law methods. The time seems to have come for a differentiated research that recognises various types of legal translation, including the category of translation by professionals for public authorities and business concerns. This latter category’s context is rapidly changing. Globalization is aggravating the crisis of national legislation. First and foremost, networks of authorities have sprung up alongside international organisations. The texts translated are (...) regulatory rather than prescriptive. Then, in the field of international commerce, a standardization of contracts is occurring. Globalized administrative and commercial varieties of English are no longer the English of the common law but, rather, a neutral or hybrid English that needs to be further sub-classified by reference to specific legal sectors. Furthermore, by reducing costs and deadlines, globalization and digitalization have forced translation to be economically efficient. Several legislative provisions now allow the translation of legal texts by way of extracts or summaries. In multilingual monitoring translators are being asked to assess and select the documents for translation themselves. The quality required is often that which is “sufficient” to achieve the sought-after goal. All these changes must be incorporated into the university education of translators. (shrink)

It has been suggested in the literature about actions that one can honour the philosophical intuition lying behind Davidson’s argument for the Anscombe Thesis (the claim that by-sentences --sentcnccs used to report actions of the general form: ‘A X-ed by V-ing’-- involve two descriptions of the same action) without accepting the argument’s conclusion. The suggestion in question is to interpret by-sentences as referring to two synchronous but different actions of the same agent. I argue that this suggestion, together with two (...) plausible semantic principles about the naming of events and a reasonable metaphysical principle about the constitution of events, leads to certain ontological commitments which are hardly acccptable. My conclusion is then that in order to deny the Anscambe Thesis what must be done is to show that Davidson’s intuition is wrong. (shrink)

Argument from analogy is a common and formidable form of reasoning in law and in everyday conversation. Although there is substantial literature on the subject, according to a recent survey ( Juthe 2005) there is little fundamental agreement on what form the argument should take, or on how it should be evaluated. Th e lack of conformity, no doubt, stems from the complexity and multiplicity of forms taken by arguments that fall under the umbrella of analogical reasoning in argumentation, dialectical (...) studies, and law. Modeling arguments with argumentation schemes has proven useful in attempts to refine the analyst’s understanding of not only the logical structures that shape the backbone of the argument itself, but also the logical underpinning of strategies for evaluating it, strategies based on the semantic categories of genus and relevance. By clarifying the distinction between argument from example and argument from analogy, it is possible to advance a useful proposal for the treatment of argument from analogy in law. (shrink)

Statements about the future are central in everyday conversation and reasoning. How should we understand their meaning? The received view among philosophers treats will as a tense: in ‘Cynthia will pass her exam’, will shifts the reference time forward. Linguists, however, have produced substantial evidence for the view that will is a modal, on a par with must and would. The different accounts are designed to satisfy different theoretical constraints, apparently pulling in opposite directions. We show that these constraints are (...) jointly satisfied by a novel modal account of will. On this account, will is a modal but doesn't work as a quantifier over worlds. Rather, the meaning of will involves a selection function similar to the one used by Stalnaker in his semantics for conditionals. The resulting theory yields a plausible semantics and logic for will and vindicates our intuitive views about the attitudes that rational agents should have towards future-directed contents. The reasonableness is a basic ideal of a philosophical education. Such ideal is especially expressed in “Philosophy for Children” by the notion, still open to multiple interpretations, of “good reasons”. “Being reasonable” means, in its widest sense, the trend, the finely cultivated habit, of giving, asking and evaluating reasons for our thoughts, feelings, actions, words, actions, or wishes. What is demanded of those who participate in a community of inquiry is the permanent effort of searching for the best reasons for (...) what we are, feel, think, say or wish to do. Why are good reasons necessary? How are those reasons to be evaluated? What allows us to distinguish between a good and a bad reason? What are the main characteristics of a good reason? These are some of the main questions I aim to examine in this paper. I begin by trying to clarify what gives rise to the need to give, ask and evaluate reasons. Then I try to answer the question I consider to be central: what is a good reason, or what does one consist of? I conclude my thoughts with some notes on the possibility and meaning of a “logic of good reasons” and on the role it plays in the P4C project. I show the diversity of reasons that can be offered according to the circumstances and the circles of interest in which we move. Since we live simultaneously in different worlds , the kind of reasons we must offer in each case may be entirely different. Therefore, the criteria according to which we can evaluate the reasons offered in each context may also be very different. I emphasize that good reasons are, in a great number, intuitive. They are immediate, that is, not mediated by long analysis, but ‘emerge’ in our minds rather ‘spontaneously’. Though good reasons may show up in a rather intuitive way, in general they are supported by a long process of analysis. Good reasons would not be such if they were not timely; therefore, they cannot take too long to show up; pressing circumstances require them to show up swiftly. Nonetheless, they are not produced casually or by chance. As a matter of fact, they are prepared in our permanent exercise of making good judgments, that is, careful, relevant and well enlightened judgments. This implies a process of decomposing a problematic situation into its constitutive parts , which happens too fast in our minds and shows up finished in those who permanently strive to reason in a sensible and coherent way when confronted with different situations. Martin (2002, 2004, 2006), disjunctivism is currently discussed, advocated, and opposed in the philosophy of perception, the theory of knowledge, the theory of practical reason, and the philosophy of action. But what is disjunctivism?

RESUMEN El presente artículo tiene como objetivo reflexionar a partir de las principales ideas filosóficas de Walter Benjamin y Frantz Fanon sobre el problema de la violencia política para luego mostrar las diferencias y posibles relaciones en los planteamientos de los autores. En un primer momento se mostrarán las denuncias hechas por los dos autores al sistema político moderno en cuanto a que la apariencia pacífica de las relaciones sociales se fundamenta en relaciones mediadas por la violencia. Luego, se analizarán (...) los principales planteamientos acerca de la violencia divina y de la violencia revolucionaria o contraviolencia en cada uno de los filósofos. Por último, se aportarán algunas conclusiones que contrasten las propuestas de este diálogo y permitan trazar límites y posibilidades en la lucha política que cada autor en su particularidad está presentando. ABSTRACT The aim of this article is to reflect about the main philosophical ideas of Walter Benjamin and Frantz Fanon on the problem of political violence and then to present the differences and possible relations in the author's approaches. At the first time, will show the denunciations made by the two authors to the modern political system as a pacific appearance of social relations that are based on relations mediated by violence. Later, the main approaches to divine violence and revolutionary violence or counter-violence in each of the philosopher will be analyzed. Finally, some conclusions will be drawn to contrast with this dialogue and thus allow us to observe the limits and possibilities in the political struggle that each author in his particularity is presenting. Drawing on the work of Rorty and Putnam, I will present an argument for the desirability of an anti-foundationalist approach to cultural difference and intercultural dialogue that gives priority to the ethical and the political over the ontological and the epistemological. It will be formulated in terms of the normative requirements for the fullest realization of the liberal democratic project at all levels of social organisation, from the local to the global. Drawing from both the deliberative turn in democratic theory (...) and the capability approach to human development, I will argue that the normative core of liberal democracy should be identified in the commitment to self-reflexive, open-ended, un-distorted and all-inclusive practice of collective deliberation and decision-making. I motivate and characterize an intensional semantics for ‘ought’ on which it does not behave as a universal quantifier over possibilities. My motivational argument centers on taking at face value some standard challenges to the quantificational semantics, especially to the idea that ‘ought’-sentences satisfy the principle of Inheritance. I argue that standard pragmatic approaches to these puzzles are either not sufficiently detailed or unconvincing.

There remains no consensus among social scientists as to how to measure and understand forms of information deprivation such as misinformation. Machine learning and statistical analyses of information deprivation typically contain problematic operationalizations which are too often biased towards epistemic elites' conceptions that can undermine their empirical adequacy. A mature science of information deprivation should include considerable citizen involvement that is sensitive to the value-ladenness of information quality and that doing so may improve the predictive and explanatory power of extant (...) models. I critically discuss two claims which Hannah Ginsborg makes on behalf of her account of meaning in terms of ‘primitive normativity’: first, that it avoids the sceptical regress articulated by Kripke's Wittgenstein; second, that it makes sense of the thought—central to Kripke's Wittgenstein—that ‘meaning is normative’, in a way which shows this thought not only to be immune from recent criticisms but also to undermine reductively naturalistic theories of content. In the course of the discussion, I consider and attempt to (...) shed light on a number of issues: the structure of the sceptical regress; the content of the thought that ‘meaning is normative’, and its force against reductive theories; the connection between meaning and justification; and the notion of ‘primitive normativity’. This study examines how evidence is used differently in argumentative discourse compared to individual arguments. Applying a 1×2 crossover study design, 37 secondary school students were asked either to discuss a social issue with their partner before individually writing an essay outlining their opinion or, vice versa, first to discuss and then to write. As background information, they were provided with pieces of evidence with different levels of quality. Dialogs and essays were analyzed regarding (a) the type of evidence and (...) (b) the way evidence was used. Results showed that in their essays students referred more often to the pieces of evidence provided to them (shared evidence). In contrast, they used evidence more often to address the opposing viewpoint in dialogs by incorporating it in a more elaborated (clearer) line of reasoning. Findings suggest that dialogues are a more effective tool than individual writing production, and the study provides first hints regarding how to design curricula that will encourage students to use evidence in a more sophisticated way in their argumentation. Statutory interpretation involves the reconstruction of the meaning of a legal statement when it cannot be considered as accepted or granted. This phenomenon needs to be considered not only from the legal and linguistic perspective, but also from the argumentative one - which focuses on the strategies for defending a controversial or doubtful viewpoint. This book draws upon linguistics, legal theory, computing, and dialectics to present an argumentation-based approach to statutory interpretation. By translating and summarizing the existing legal interpretative canons (...) into eleven patterns of natural arguments - called argumentation schemes - the authors offer a system of argumentation strategies for developing, defending, assessing, and attacking an interpretation. Illustrated through major cases from both common and civil law, this methodology is summarized in diagrams and maps for application to computer sciences. These visuals help make the structures, strategies, and vulnerabilities of legal reasoning accessible to both legal professionals and laypeople. (shrink)

This paper compares current ways of modeling the inferential structure of practical reasoning arguments, and proposes a new approach in which it is regarded in a modular way. Practical reasoning is not simply seen as reasoning from a goal and a means to an action using the basic argumentation scheme. Instead, it is conceived as a complex structure of classificatory, evaluative, and practical inferences, which is formalized as a cluster of three types of distinct and interlocked argumentation schemes. Using two (...) real examples, we show how applying the three types of schemes to a cluster of practical argumentation allows an argument analyst to reconstruct the tacit premises presupposed and evaluate the argumentative reasoning steps involved. This approach will be shown to overcome the limitations of the existing models of practical reasoning arguments within the BDI and commitment theoretical frameworks, providing a useful tool for discourse analysis and other disciplines. In particular, applying this method brings to light the crucial role of classification in practical argumentation, showing how the ordering of values and preferences is only one of the possible areas of deep disagreement.
