In this essay I examine how we use indexicals. The key function of indexicals, I claim, is to help the audience --- that is the hearers or readers of the utterance with whom the speaker intends to be communicating---to find supplementary channels of information about the object to which the indexical refers. To keep the discussion manageable, I will oversimplify the epistemology of conversation. I ignore the fact that people sometimes lie and sometimes make mistakes. Legitimate political authority is often said to involve a “right to rule,” which is most plausibly understood as a Hohfeldian moral power on the part of the state to impose obligations on its subjects (or otherwise to change their normative situation). Many writers have taken the state’s moral power (if and when it exists) to be a correlate, in some sense, of an obligation on the part of the state’s subjects to obey its directives. Thus legitimate political authority is said (...) to entail a general obligation to obey the law, and a general obligation to obey the law is said to entail legitimate political authority. With some version of this idea in mind, many writers attempt to establish full (or partial) legitimate political authority by first arguing for the intermediate conclusion that there exists a general (or partial) obligation to obey the law. This article argues that such a strategy is fundamentally mistaken, because while legitimate authority does indeed entail an obligation to obey the law, an obligation to obey the law does not, in and of itself, entail legitimate authority. This can be referred to as “the reverse entailment problem.” To avoid this problem, a theory of political authority must argue directly for the existence of the appropriate kind of moral power on the part of the state. This article argues for the “value-based” conception of a moral power, which states, very roughly, that one person holds a power over another if there is sufficient value in the former possessing the capacity intentionally to impose an obligation on the latter (or otherwise to change her normative situation). This seemingly simple understanding of a moral power gives rise to surprisingly strong adequacy conditions on what can count as an acceptable theory of legitimate political authority, and these conditions decisively rule out most of the standard theories in the literature. In this essay I distinguish three kinds of self-knowledge. I call these three kinds agent-relative knowledge, self-attached knowledge and knowledge of the person one happens to be. These aspects of self-knowledge dier in how the knower or agent is represented. Most of what I say will be applicable to beliefs as well as knowledge, and to other kinds of attitudes and thoughts, such as desire, as well.1 Agent-relative knowledge is knowledge from the perspective of a particular agent. To have this (...) sort of knowledge, the agent need not have an idea of self, or a notion of himself or herself. This sort of knowledge can be expressed by a simple sentence containing a demonstrative for a place or object, and without any term referring to the speaker. For example, “There is an apple” or “that is a toaster”. Ideas of specic objects I call notions. Ideas of properties and relations I just call ideas. ”Self-beliefs” are beliefs of the sort one ordinarily has about oneself, and expresses with the first person. These contrast with the beliefs one has in ”Casta˜neda cases,” in which one has a belief about oneself without knowing it. This paper advances an account of the nature of self-belief. According to this account, self-belief is a special case of interacting with things via notions that serve as repositories for information about objects with certain important relations to the knower, and as motivators (...) for actions the success of which is dependent on the object in that relation to the agent. Identity is such a relation, and ”self-notions” play this special role: they are the repositories for information gained in normally self-informative ways, and the motivators of types of action whose success normally depends on facts about the agent. Self-beliefs involve such self-notions, while the beliefs that one has about oneself in Casta˜neda cases do not. (shrink)

This paper examines the historical rise of both cardiopulmonary resuscitation and the do-not-resuscitate order and the wisdom of their continuing status in U.S. hospital practice and policy. The practice of universal presumed consent to CPR and the resulting DNR policy are the products of a particular time and were responses to particular problems. In order to keep the excesses of technology in check, the DNR policies emerged as a response to the in-hospital universal presumed consent to CPR. We live with (...) this historical concretion, which seems to perpetuate a false culture that the patient's wishes must be followed. The authors are critical of the current U.S. climate, where CPR and DNR are viewed as two among a panoply of patient choices, and point to UK practice as an alternative. They conclude that physicians in the United States should radically rethink approaches to CPR and DNR. (shrink)

Trading on non-public material information is fertile ground for a discussion of ethical behavior. The long-running legal tug-of-war over what constitutes illegal insider trading delivers challenges to regulatory authorities charged with detecting and enforcing the law, and is likely one of the reasons that prosecution of insider trading events remains rather uncommon. One can observe both increased volume in the equity and option markets and run-ups in the stock price prior to the announcement of the acquisitions; however, the detection of (...) illegal or unethical insider trading can be difficult. Given the legal uncertainty around insider trading and the circumstantial evidence from the trading activity, it is almost impossible to identify unethical insider trades unless there is a whistleblower or trades are large in size and impeccable in timing. Using call option trading around two merger announcements with similar firms that resulted in different ultimate treatment from the SEC, we illustrate the struggle regulators and prosecutors have with identifying and enforcing unethical insider trades. This book proposes a philosophical framework, based on the work of John Dewey, to develop a new model for community colleges in the 21st century.

Merker's core idea, that the experience of being conscious reflects the interactions of actions, targets, and motivations in the upper brainstem, with cortex providing the content of the conscious experience, merits serious consideration. However, we have two areas of concern: first, that his definition of consciousness is so broad that it is difficult to find any organisms with a brain that could be non-conscious; second, that the focus on one cortical–subcortical system neglects other systems (e.g., basal forebrain and brainstem cholinergic (...) systems and their cortical and thalamic target areas) which may be of at least equal significance. The sources and methods of espionage, the goals and tactics of covert action, and the professional conduct of intelligence officers are matters typically hidden from public scrutiny, yet clearly worthy of public debate and philosophical attention. Recent academic studies of intelligence that have had any intentional bearing on ethics or political philosophy have largely focused on procedural questions surrounding the proper degree of oversight of intelligence agencies. But what is often missed in such examinations is substantive ethical analysis of intelligence (...) operations themselves. (shrink)

The term 'indexical' comes into the philosophy of language from Charles Sanders Peirce's use of the term 'index'. Paradigm indexicals include pronouns such as 'I' and 'you', as well as words like 'here', 'now', 'today', 'tomorrow', and 'yesterday' that occur as both nouns and adverbs. This chapter looks at how such paradigms work, then look at less paradigmatic examples, and eventually try to arrive at plausible definitions of indexical and indexicality. Eliminative theories treat indexicals as short‐cuts for descriptions that the (...) speaker has in mind. Indexicals play no essential role in language and communication and can be eliminated for serious purposes. The chapter reviews McTaggart's use of indexicals in his famous argument about time. In fact indexicals, for all their conversational utility and humble origins, seem indispensable in talking about philosophical topics. Simple and untechnical ‘I’ and ‘now’ may be, compared to words that embody great insights of science or philosophy, they still are words, that express ideas, and connect with complex thoughts words can express.
