The question "Why should I be moral?," taken as a request for reasons to be moral, strikes many philosophers as silly, confused, or otherwise out of line. Hence we find many attempts to dismiss it as spurious. This paper addresses four such attempts and shows that they fail. It does so partly by discussing various errors about reasons for action, errors that lie at the root of the view that "Why should I be moral?" is ill-conceived. Such errors include the (...) mistake of confusing different uses of "moral reason for A to ø" and the mistake of treating as axiomatic, as in need of no argument, the view that moral considerations furnish every agent with practical reasons. Among the philosophers discussed are John Hospers, Philippa Foot, Stephen Toulmin, H. A. Prichard, and William Frankena. (shrink)

When someone blames you, you might accept the blame or you might reject it, challenging the blamer’s interpretation of the facts or providing a justification or excuse. Either way, there are opportunities for edifying moral discussion and moral repair. But another common, and less constructive, response is to simply dismiss the blame, refusing to engage with the blamer. Even if you agree that you are blameworthy, you may refuse to engage with the blame—and, specifically, with blame coming from this particular (...) person. This is a common response if the blamer is being hypocritical or meddlesome in blaming the wrongdoer. This paper aims to make sense of this kind of response: What are we doing when we dismiss blame? A common thought is that we dismiss demands issued by blame, but we still must identify the content of the relevant demands. My proposal is that when we dismiss blame, we dismiss a demand to respond to the blame with a second-personal expression of remorse to the blamer. (shrink)

My intent is to bring a key group of critical terms associated with the emotions-bitterness, sentimentality, and emotionality-to greater feminist attention. These terms are used to characterize emoters on the basis of how we express ourselves, and they characterize us in ways that we need no longer be taken seriously. I analyze the ways in which these terms of emotional dismissal can be put to powerful political use.

Manuel Padilla Cruz has written an excellent response piece (Padilla Cruz 2019) to my initial article (Cull 2019) on dismissive incomprehension, where he raises a number of interesting issues and has put forward a number of excellent ideas for avenues for further research. Here I seek to deepen our understanding of the phenomenon by developing some responses that have come forward in thinking about and discussing dismissive incomprehension, especially in reference to what Padilla Cruz has said. Marshall and O’Leary’s thoughtful response to our article suggests that dismissal policies are ethically justifiable because they might induce parents to immunize their children. This outcome is conceivable, but we have only anecdotes about how often it occurs. Such evidence became the thin reed on which the American Academy of Pediatrics rested its new policy of tolerating the practice of dismissing vaccine-hesitant parents. It seems likely that relatively few parents would agree to vaccinate because they were threatened with (...) class='Hi'>dismissal. Other heavy-handed interventions have failed to move most such parents. When Washington state made nonmedical exemptions more difficult to obtain, nearly two-thirds of vaccine refusers were unmoved and their children remained unvaccinated. Even if dismissal threats led some parents to accept vaccines, this alone would not justify a dismissal policy. The benefits would still have to be weighed against the risks of dismissing those families who do not change their minds. (shrink)

Thousands of U.S. parents choose to refuse or delay the administration of selected vaccines to their children each year, and some choose not to vaccinate their children at all. While most physicians continue to provide care to these families over time, using each visit as an opportunity to educate and encourage vaccination, an increasing number of physicians are choosing to dismiss these families from their practice unless they agree to vaccinate their children. This paper will examine this emerging trend along (...) with the reasons given by those who advocate such an approach. I will argue that the strategy of refusing to allow families into a clinic unless they agree to vaccinate their children is misguided, and the arguments for doing so fail to stand up to close scrutiny. Such a strategy does not benefit the child or the health of the community, and may have a negative impact on both. Furthermore, some of the arguments in support of dismissal policies ignore the importance of professional obligation and appear to favor self-interest over the interest of the patient. (shrink)

Developers are often the engine behind the creation and implementation of new technologies, including in the artificial intelligence surge that is currently underway. In many cases these new technologies introduce significant risk to affected stakeholders; risks that can be reduced and mitigated by such a dominant party. This is fully recognized by texts that analyze risks in the current AI transformation, which suggest voluntary adoption of ethical standards and imposing ethical standards via regulation and oversight as tools to compel developers (...) to reduce such risks. However, what these texts usually sidestep is the question of how aware developers are to the risks they are creating with these new AI technologies, and what their attitudes are towards such risks. This paper asks to rectify this gap in research, by analyzing an ongoing case study. Focusing on six Israeli AI startups in the field of radiology, I carry out a content analysis of their online material in order to examine these companies’ stances towards the potential threat their automated tools pose to patient safety and to the work-standing of healthcare professionals. Results show that these developers are aware of the risks their AI products pose, but tend to deny their own role in the technological transformation and dismiss or downplay the risks to stakeholders. I conclude by tying these findings back to current risk-reduction recommendations with regards to advanced AI technologies, and suggest which of them hold more promise in light of developers’ attitudes. The author of the article analyzes the constitutional doctrine of the dismissal of a judge from office upon the expiration of the term of powers. The author discusses the guarantees of the independence of courts and judges, one of which is the guarantee of the inviolability of the length of powers of judges. The previously valid Law on Courts used to provide that the President of the Republic could appoint a person as a judge of a local court when (...) such an appointment is made for the first time, for a five-year term, and that upon the expiration of the five-year term, the President of the Republic could appoint such a person as a judge of a local court without examination or selection until the person reaches the age of 65. Under the Law on Courts valid at present, judges of all courts are appointed at once for the term until they reach 65 years of age. It is asserted in the article that the Constitution of the Republic of Lithuania has not established the right of a person, who was for the first time appointed as a judge of a local court for a five-year term, to be appointed as a judge until he reaches 65 years of age. After introducing the debate between substance philosophy and process philosophy, and clarifying the relevance of the category of ‘substance’ in Peirce’s thought, the present paper reconstructs the role of ‘substance’ and ‘being’ from Peirce’s early works to his theory of the proposition, provided after his studies on the logic of relatives. If those two categories apparently disappear in Peirce’s writings from the mid-1890s onwards, the account of ‘subject’ and ‘copula’ in Peirce’s analysis of the proposition allows one to grasp the (...) reasons why Peirce omits ‘substance’ and ‘being’ in favor of his three categories (Firstness, Secondness, Thirdness), and to understand why his philosophy cannot be considered as a substance philosophy. Gender role congruity theory emphasizes the ubiquity of male-typed leadership schemas as barriers to female leaders’ career development (i.e., descriptive stereotypes); however, the expectation of female leaders’ fulfilling their gender role (i.e., prescriptive stereotypes) has received limited attention. Extending this line of research, we propose the concept of female-typed leadership schemas and suggest that the (mis)match between female CEOs’ gender-stereotyped behavioral differences (agentic vs. communal) and female-typed leadership stereotypes helps explain the prescriptive gender stereotypes that women face in the CEO (...) post-succession stage. Using data from 251 female CEO succession events at publicly listed firms on the Shanghai and Shenzhen Stock Exchanges from 2007 to 2017 in China, we found that the risk-taking behaviors of new female CEOs may lead to a perceived mismatch between prescriptive gender-stereotyped expectations and the actual behaviors of female CEOs as top leaders, increasing their likelihood of being dismissed during the post-succession process. Moreover, gender inequality beliefs in local contexts and adverse selection at the time of succession amplify the gender-stereotyped attribution. This study contributes to the female leadership and ethics literature by developing a comprehensive theoretical framework to test how female-typed leadership stereotypes hinder the career development of women in top executive positions. Cartesian scepticism poses the question of how we can justify our belief that other humans experience consciousness in the same way that we do. Wittgenstein’s response to this scepticism is one that does not seek to resolve the problem by providing a sound argument against the Cartesian sceptic. Rather, he provides a method of philosophical inquiry which enables us to move past this and continue our inquiry without the possibility of solipsism arising as a philosophical problem in the first place. In this paper, I propose that Wittgenstein’s method of dismissing the Cartesian sceptic can also be applied to the problems posed by the ‘moral sceptic’, who denies the truth of all ethical or moral claims. I will argue that in the same way Wittgenstein’s focus on public language enables us to dismiss the traditional problem of other minds, a focus on public moral practices or language-games also enables us to dismiss the idea that moral claims are always ‘meaningless’, ‘false’ or ‘nonsensical’. On this account, the moral sceptic is misguided in much the same way as the solipsist who implicitly admits the existence of other minds in her practices. The moral sceptic who still engages in moral activities also implicitly admits the existence of meaningful moral positions. Wittgenstein’s dismissal of the Cartesian sceptic, as I understand it, can be broadly divided into two parts. The first part is an account of language acquisition. This part outlines how we might come to see other humans as conscious, thinking, feeling beings from a causal perspective. This suggests that we can arrive at an understanding of other minds as a primary perception itself - without needing to posit this perception as a kind of deductive or inductive hypothesis. Secondly, we can see how this relates to an epistemic model of language. This focuses on the role of language as something which consists of rule-governed activities, where the existence of other minds is embedded in our understanding of the world as a kind of grammatical rule, rather than an observational hypothesis. From both these arguments the Cartesian sceptic is,, irrelevant to some forms of philosophical inquiry. This is because the sceptic takes the existence of other minds to be a rational hypothesis/inference when it is not. I suggest that this approach can be applied to moral scepticism if we take certain normative claims as grammatical dispositions, rather than rational or metaphysical propositions. Hence, the moral sceptic who offers a rational or logical critique of these moral foundations is not necessarily saying anything relevant to our practices – the moral stances which they refute as rationally meaningless were never based on purely rational or logical hypotheses in the first place. Actor-network theory has contributed greatly to the development of science and technology studies. However, recent critiques appear to have left ANT in a gloomy theoretical black box. What is the likelihood of ANT exiting its current theoretical discontent? Is ANT worthy of salvation and on what grounds? Law argues that recent critiques stem from ANT’s development into a particular theoretical strategy. However, this article will argue that by focusing on strategy as messy and impure, ANT can be afforded the opportunity (...) to shift from a fixed approach to an ambiguous and contingent strategy, well placed to carry on. The article achieves such an argument by first highlighting how ANT has contributed to a recent study of strategy in action; second, by outlining the strategic aspects of ANT; and third, by using the study of strategy in action as a means of engaging with ANT’s current theoretical discontent. It is generally accepted that women have the right to participate in the workplace, although only if replicating the traditional male mode of working. To this extent, the right to formal equality with men is generally agreed to be a legitimate goal for legislation. However, where the limitations of such assimilation to a male norm come into sharp focus, as they do in the context of pregnancy, the restrictions placed on improving the position of women are evident. The courts seek (...) to accept the arguments of employers that some limitation on the rights of women to participate fully in the workplace is necessary, with the unarticulated assumption that pregnancy constitutes a real difference between the sexes, incompatible with their notion of (formal) equality. Thus, it is argued, that the advances so far gained in the relation to pregnancy dismissals do not represent a cultural shift in attitudes towards accommodating pregnant women and women with children into the workplace. They have been adopted only reluctantly by the UK courts and legislature, with limitations still being placed on their effect particularly in respect of dismissals on account of pregnancy-related illness. The rights of women not to be discriminated against solely on the basis of their biological ability to give birth must continue to be advocated and given attention; complacency will likely see those rights progressively restricted. Given that conspiracies exist, can we be justified in dismissing conspiracy theories without concerning ourselves with specific details? I answer this question by focusing on contrarian conspiracy theories, theories about conspiracies that conflict with testimony from reliable sources of information. For example, theories that say the CIA masterminded the assassination of John F. Kennedy, 9/11 was an inside job, or the Freemasons are secretly running the world are contrarian conspiracy theories. When someone argues for a contrarian conspiracy theory, their options (...) are to appeal to eyewitness testimony, incriminating documents, photographs, audio recordings, video recordings, allegedly scientific evidence, anomalies, or considerations of cui bono (who benefits). Most laypeople don’t know how to adequately respond to arguments for contrarian conspiracy theories, but this doesn’t mean that it’s dogmatic to reject them. I argue that many laypeople are defeasibly justified in rejecting a variety of contrarian conspiracy theories based on testimony and this justification is rarely defeated by arguments for contrarian conspiracy theories even if we don’t know how to respond to these arguments. A recent American Academy of Pediatrics (AAP) clinical report states that it is an acceptable option for pediatric care clinicians to dismiss families who refuse vaccines. This is a clear shift in guidance from the AAP, which previously advised clinicians to “endeavor not to discharge” patients solely because of parental vaccine refusal. While this new policy might be interpreted as encouraging or recommending dismissal of vaccine-refusing families, it instead expresses tolerance for diverse professional approaches. This is unlike the earlier (...) guidance, which promoted a unified response to vaccine refusal. In fact, the resolution (which was presented at the AAP’s Annual Leadership Forum) that led to this clinical report also calls on the AAP “to continue to support pediatricians who continue to provide health care to children of parents who refuse to immunize their children.” However, the shift toward embracing dismissal as an acceptable response to vaccine refusal may erode professional solidarity. Pediatricians are clearly divided on this question; most do not dismiss vaccine-refusing families. By declaring that dismissal is an acceptable option, the AAP has sanctioned a practice that may be unfair to the many clinicians who do not dismiss these families. Clinicians who adopt a policy of dismissal toward families who refuse vaccines might impose burdens on colleagues who remain willing to offer care to those families, and their actions might show insufficient commitment to the efforts of their profession to promote health for all children. One of the most notorious — and dismissive — passages in Wittgenstein’s Philosophical Investigations is Part II section xiv, which begins like this: The confusion and barrenness of psychology is not to be explained by calling it a “young science”; its state is not comparable with that of physics, for instance, in its beginnings. (Rather with that of certain branches of mathematics. Set theory.) For in psychology there are experimental methods and conceptual confusion. (As in the other case conceptual confusion (...) and methods of proof.) The existence of the experimental method makes us think we have the means of solving the problems which trouble us; though problem and method pass one another by. Strong words. But we know that at one stage in his life Wittgenstein’s interest in psychology was sufficient for him to have done some experimental research, and that he was well acquainted with the work of at least some of the prominent psychologists active in his own lifetime. That is, his quoted remarks were not made from ignorance; and we should accordingly take them seriously enough to consider why he made them, what he had in mind, and to what extent — if any — they may have been (and, though this was all a long time ago, may still be) justified. Dismissal is a major issue for distributive justice at work, because it normally has a drastic impact on an employee’s livelihood, self-esteem and future career. This article examines distributive justice under the US’s employment-at-will (EAW) system and New Zealand’s just-cause dismissal system, focusing on the three main categories of dismissal, namely misconduct, poor performance and redundancy. Under EAW, employees have limited protection from dismissal and remedies are restricted to just a few so-called exceptions. Comparatively, New Zealand’s (...) just-cause system delivers much more just outcomes, both in terms of remedies and punishments. Despite a few shortcomings, it should be considered as a reasonable reference for policy changes in the US. (shrink)

This article discusses the problematic aspects relating to the employee dismissal based on application of the disciplinary liability. It contains analysis of two grounds for termination of the employment contract without any previous notice: 1) imposing several disciplinary sanctions upon the employee in the course of twelve months, and 2) the employee has only one breach of labour discipline but a gross one. The article is based on legal acts and judgements of Judicial Assemblies of the Civil Division of (...) the Supreme Court of Lithuania and resolutions of the Senate of the Supreme Court of Lithuania in order to provide the legislative execution practice as well as reveal the problems in this field of labour law. EDITOR’S ABSTRACTThe popular Chinese portrayal of the victory of Confucianism, or in Chinese terms “dismiss the hundred schools of thought and revere only the Confucian arts,” has been challenged by some scholars in the past decades. Ding’s essay illustrates not only how it has been challenged but also how the catch phrase influences the scholarly discussion. As he indicates, recent Chinese studies that attempt to subvert the traditional theory share the same “flow.” They fail to note that the expression “dismiss (...) the hundred schools of thought and revere only the Confucian arts” has had very negative connotations since it was invoked by Yi Baisha 易白沙 to harshly denounce Confucianism for being responsible for the centuries-long Chinese autocracy. According to a popular line of thought, being excluded from interpersonal life is to be exempted from accountability, and vice versa. In ordinary life, this is most often illustrated by the treatment of people with serious psychological disorders. When people are excluded from valuable domains on the basis of their arbitrary characteristics (such as race and sex), they are discriminated against, prevented from receiving the benefits of participation in those domains for morally irrelevant reasons. Exemption from accountability—via exclusion from the (...) interpersonal domain—seems to prevent exempted parties from receiving crucial human goods for morally irrelevant reasons. This chapter discusses two widely deployed ways of trying to ameliorate morally costly disabilities. Both fail to apply viably to various psychopathologies. The solution involves disentangling accountability and interpersonality in a way that also provides insights into our shared human nature. (shrink)

This paper provides a systematic analysis of how hometown ties, the most common and distinct bases for interpersonal ties to build upon in China, could influence corporate governance in Chinese corporations by focusing on its impact on CEO dismissals and corporate social responsibility. We find that hometown ties between CEOs and board chairs reduce the likelihood of CEO dismissals and that the negative relationship between firm performance and CEO dismissals is weaker for hometown-connected CEOs in locally administered state-owned enterprises, for (...) inside CEOs, for firms located outside board chairs’ hometowns, and for firms operating in regions with low social trust. Moreover, we find consistent evidence that hometown ties affect Chinese firms’ engagement in corporate social responsibility. Our study highlights the important role of hometown ties in Chinese relationship-based corporate governance. It also advances a normative ethical assessment of hometown-based favoritism by highlighting its distinct dynamics and impacts on focal actors and the third parties in specific contexts of actions. From early in the Christian era—certainly from the time of Clement of Alexandria—and for centuries thereafter, Western philosophy was considered the “handmaid of theology.” Its job was to be of whatever assistance possible to “faith seeking understanding.” In the modern period, with the gradual waxing of a liberated science and waning of ecclesiastical dominance over every facet of intellectual life, the functions of the maid became recognized as of comparable value and validity with those of the mistress. While ostensibly finding (...) it necessary to “deny knowledge, in order to make room for faith,” Kant sought to establish faith philosophically as rational, his theology emerging from a more fundamental moral philosophy. In late 1949 the former Soviet Union conducted an open trial of eight Japanese physicians and researchers and four other military servicemen in Khabarovsk, a city in eastern Siberia. Despite its strong ideological tone and many obvious shortcomings such as the lack of international participation, the trial established beyond reasonable doubt that the Japanese army had prepared and deployed bacteriological weapons and that Japanese researchers had conducted cruel experiments on living human beings. However, the trial, together with the evidence presented (...) to the court and its major findings — which have proved remarkably accurate — was dismissed as communist propaganda and totally ignored in the West until the 1980s. This paper reviews the 1949 Khabarovsk trial, examines the West's dismissal of the proceedings as mere propaganda and draws some moral lessons for bioethics today. As an important historical case, set in the unique socio-political context of the Cold War, the West's dismissal of the trial powerfully illustrates some perennial ethical issues such as the ambivalence of evidence and the power of ideology in making (or failing to make) cross-national and cross-cultural factual and moral judgments. Drawing on the relevant alternatives framework and Mary Kate McGowan’s work on conversational scorekeeping, I argue that usage of the term ‘conspiracy theory’ in ordinary language and public discourse typically entails the performance of what I call a dismissive conversational exercitive, a kind of speech act that functions to exclude certain propositions from (or prevent their inclusion in) the set of alternatives considered relevant in a given conversational context. While it can be legitimate to perform dismissive conversational exercitives, excluding alternatives (...) that deserve to be taken seriously can be highly problematic for a variety of reasons. For one, it can give rise to what I call the problem of premature conclusions when subjects illegitimately dismiss certain propositions as irrelevant and, as a result, prematurely take certain conclusions or claims to be warranted. Depending on the kind of conclusion or claim, the problem can come in different variants, three of which I shall examine in more detail: the problem of premature knowledge claims, the problem of premature causal claims, and the problem of premature generic generalizations.
