The “new natural lawyers” (NNLs) are a prolific group of philosophers, theologians, and political theorists that includes John Finnis, Robert George, Patrick Lee, Gerard Bradley, and Germain Grisez, among others. These thinkers have devoted themselves to developing and defending a traditional sexual ethic according to which homosexual sexual acts are immoral per se and marriage ought to remain an exclusively heterosexual institution. The sterility objection holds that the NNLs are guilty of making an arbitrary and irrational distinction between same-sex couples (...) and sterile heterosexual couples. The NNLs believe that it is a necessary condition for two people’s being morally and legally entitled to get married that they be able to perform sexual acts that are “suited to procreating.” But sterile heterosexual couples are incapable of performing such acts. Therefore, it should follow from the NNLs’ own premises that sterile heterosexual couples are not entitled to marry. But the NNLs do not draw this conclusion. Instead, they maintain that sterile heterosexuals can marry while denying that the same is true of same-sex couples. The sterility objection claims the NNLs are being inconsistent in treating the two kinds of couples differently. Although the sterility objection has been endorsed by recent critics, I don’t think it has yet been adequately defended. The NNLs have responded by arguing that there is a sense in which the sex acts of sterile heterosexual couples are as suited to reproduction as those of fertile heterosexuals. Thus they maintain that the distinction they draw between the two kinds of couple has a rational basis. A successful defense of the sterility objection must show that this response on the part of the NNLs fails. Such is the task I undertake in this paper. I argue that the NNLs’ response fails because acts of penile-vaginal intercourse between sterile heterosexuals lack the actual causal power to produce conception that sexual acts need to be considered truly reproductive, and because their assumption that penile-vaginal intercourse always functions reproductively is bad biology. Feminists are divided on whether consent should be employed in legal definitions of rape. Catharine MacKinnon has criticized the usefulness of consent in enabling legal systems to recognize and prosecute instances of rape (MacKinnon 1989, 2005, 2016). In a recent article in this journal, Lisa H. Schwartzman defends the use of affirmative consent in rape law against MacKinnon’s critique (Schwartzman 2019). In contrast to MacKinnon, Schwartzman claims our understanding of rape must include both force and consent components. In this paper, (...) I will argue in agreement with Schwartzman and against MacKinnon that the legal definition of rape should include an affirmative consent component. I will take Schwartzman’s discussion as my point of departure and consider whether she has responded adequately to MacKinnon’s criticisms of consent. I will argue that her responses are not fully adequate. In particular, she has not successfully rebutted the argument that an appeal to consent is unnecessary once we have accepted an expanded definition of coercion. I will then provide a more affirmative defense of affirmative consent in response to MacKinnon’s most challenging criticism. (shrink)

Nicholas Wolterstorff and Christopher J. Eberle have defended the view that the ethics of liberal citizenship allows citizens to publicly support the passage of coercive laws based solely on their religious convictions. They also develop positive conceptions of virtuous citizenship that place moral limits on how citizens may appeal to their religion. The question I address in this essay is whether the limits they impose on citizens’ appeals to their religion are adequate. Since Eberle’s “ideal of conscientious engagement” provides us (...) with the most extensive statement of these limits, it is the primary focus of my attention here. My conclusion is that in its current form, Eberle’s ideal is not constraining enough. In the first section, I argue that Eberle’s ideal does not require citizens to be self-critical enough about their religious and political commitments. In the second section, I highlight a conflict between Eberle’s ideal and the need for citizens to respect the religious freedom of their fellow citizens. I argue that the way to resolve this conflict is to adopt a more fine-grained conception of religious reasons and to hold that citizens should not rely on religious reasons of certain kinds. In the final section, I argue that laws punishing or discouraging homosexual conduct (which Eberle’s ideal would apparently allow) violate what Wolterstorff calls “the Idea of liberal democracy” and so are not the kind of proposal that virtuous citizens can defend. We enjoy sounds. What about silence: the absence of sound? Certainly not all, but surely many of us seek out, attend to, and appreciate silence. But, if nothing is there, then there is nothing to possess aesthetic qualities that might engage aesthetic interest or reward aesthetic attention. This is at least puzzling, perhaps even paradoxical. In this paper, I attempt to dispel the sense of paradox and provide a way to understand aesthetic appreciation of silence. I argue that silence can (...) have an aesthetic character and can sustain the kinds of rich experiences apt for aesthetic assessment and appraisal. (shrink)

What, for Kant, is the semantic status of the proposition: Water is H2O? Is it analytic or synthetic? The question is not one of merely esoteric import since an answer to it would constitute a statement about the meaningfulness of all our scientific propositions. And, insofar as the Critique is a defense of the possibility of the natural sciences, it seems that we should be able to find in it the answer to our question. Further, we should be able to (...) find an answer to the question of whether or not Kant is a scientific essentialist. I attempt to show that he is not an essentialist despite the fact that his semantics of natural kind terms greatly resembles that of some contemporary authors who are essentialists and take their semantic theories to provide evidence for their views. One way to go about this would be simply to locate Kant's criteria for the analytic/synthetic distinction and then to place the proposition in the category dictated by those criteria. Rather than employ this method, I will examine instead some of Kant's own examples. The hope is that by means of the examples the criteria themselves will achieve a greater degree of clarity and that through this clarification Kant's position will emerge as a genuine alternative to contemporary positions. I argue that silence is replete with aesthetic character and that it can be a rewarding object of aesthetic appreciation, assessment, and appraisal. The appreciation of silence might initially seem impossible, for, it might seem, there is nothing there to behold. Taking up this challenge, I attempt to dispel the sense of paradox. I contend that, despite our never actually experiencing absolute silence, there is much to enjoy in the silences that we do experience. I go on to argue that (...) proper appreciation of silence is a two-way street, involving quiet on the outside and stillness on the inside. I conclude by offering some suggestions for how to make the aesthetic appreciation of silence part of a flourishing life. (shrink)

I look at a recent argument offered in defense of a doctrine which I will call generalized scientific essentialism. This is the doctrine according to which, not only are some facts about substance composition metaphysically necessary, but, in addition, some facts about substance behavior are metaphysically necessary. More specifically, so goes the argument, not only is water necessarily composed of H2O and salt is necessarily composed of NaCl, but, in addition, salt necessarily dissolves in water. If this argument is sound, (...) and if the statement that necessarily salt dissolves in water is a statement of a law of nature, then one conclusion of the argument is that there is at least one metaphysically necessary law of nature. My paper examines the extent to which this kind of argument could be generalized to provide a case for a full-blown scientific essentialism: the doctrine according to which all of the laws of nature are necessary. Or, in terms of dispositions, it is the doctrine according to which natural kinds have all of their powers, capacities and propensities as a matter of necessity. (shrink)

I identify a commonly held position in environmental philosophy, “the received view,” and argue that its proponents beg the question when challenged to demonstrate the relevance of environmental aesthetics for environmental justice. I call this “the inference problem,” and I go on to argue that an alternative to the received view, Arnold Berleant’s participatory engagement model, is better equipped to meet the challenge it poses. By adopting an alternative metaphysics, the engagement model supplies a solution to the inference problem and (...) thereby provides a more useful theoretical framework for application to pressing concernsin environmental justice, such as the plight of the historical Ironbound District of Newark, New Jersey. Philosophers concerned with the problem of freedom and determinism differ strikingly over the analysis of the concept of human freedom of the will. Compatibilists and incompatibilists, determinists and indeterminists populate the conceptual landscape with a dizzying array of theories differing in complex and subtle ways. Each of these analyses faces an under-appreciated potential challenge: the challenge from scientific essentialism. Might all traditional analyses of freedom of the will be radically ill-conceived because the concept—the nature of freedom itself—is something discoverable only (...) by empirical science? Does a company that strives to attain good environmental performance decrease its market risk or is environmental performance just a disadvantageous cost that increases such risk levels for these firms? Answers to this question have important implications for the management of companies and the investment decisions of individuals and institutions. The purpose of this paper is to (...) examine the relationship between corporate environmental performance and firm risk in the British context. Using the largest dataset assembled so far, with community and environmental responsibility (CER) rankings for all rated UK companies between 1994 and 2006, we show that a company's environmental performance is inversely related to its systematic financial risk. This book is a phenomenological investigation of the zoo visit experience. Why Do We Go to the Zoo? is rooted in Husserlian phenomenology and focuses on the communicative interactions between humans and animals in the zoo setting.

Royzman and Kurzban suggest that disgust-related facial activity in response to unfairness may reflect a metaphorical communication rather than genuine feelings of disgust. We argue that this is a partial reading of our findings and that our experimental data, and those of others, are inconsistent with a social metaphor interpretation.

Although much research on emotion and morality has treated emotion as a relatively undifferentiated construct, recent work shows that moral transgressions can evoke a variety of distinct emotions. To accommodate these results, we propose a multiple-appraisal model in which distinct appraisals lead to different moral emotions. The implications of this model for our understanding of the relationship between appraisals, emotions and judgments are discussed. The complexity of moral emotional experience presents a methodological challenge to researchers, but we submit that a (...) complete understanding of human morality must acknowledge the differentiated nature of moral emotions. In my response to Kevin Carnahan, I explain the concept of religion that I have been working with in my writings on the place of religious reasons in public political discourse. While acknowledging that religion is often privatized, my concern has been with religion as a way of life. It is religion so understood that raises the most serious issues concerning the role of religion in public discourse. In my response to Erik A. Anderson, I go beyond what (...) I have previously said about the role of religious reasons in public discourse. As an alternative to Rawlsian public reason, I argue that the essence of liberal democracy is that every citizen is to have equal political voice. I go on to consider what it is to exercise one’s equal political voice as a moral engagement. (shrink)

In this study of an economic field and its relationships to a cultural field, we apply Pierre Bourdieu’s central concepts of economic capital, cultural capital, symbolic capital and field, and thus follow in a tradition that at the outset was considered to be post-structuralism, but which by Bourdieu later has been brought into the realm of realism. We have mapped relationships between the actors and thus the field structures that these relationships entail. The fields in which a segment of an (...) art world is operating is represented in multi-dimensional figures which illustrate relationships and bonds between the different categories of organizations. Some of the business actors we have studied are engaging in cultural activities with a great deal of autonomy, others are connected to the cultural field in less active ways. In participating in the cultural field they are in different ways and to different extents accumulating symbolic capital including prestige and honor. The method we have applied is multiple correspondence analysis which was frequently used by Bourdieu. (shrink)

We sley Salmon, in his influential and detailed book, Four Decades of Scientific Explanation, argues that the pragmatic approach to scientific explanation, “construed as the claim that scientific explanation can be explicated entirely in pragmatic terms” (1989, 185) is inadequate. The specific inadequacy ascribed to a pragmatic account is that objective relevance relations cannot be incorporated into such an account. Salmon relies on the arguments given in Kitcher and Salmon (1987) to ground this objection. He also suggests that Peter Railton’s (...) concepts of the ideal explanatory text and explanatory information (Railton 1981) can provide what the pragmatic approach lacks. This suggestion is not a conclusion of course; we read it as the promotion of part of a research program aimed at forging a greater consensus on scientific explanation-an admirable goal. However, we do not see the pragmatic approach as inadequate. We will show that a synthetic account inspired by Salmon’s adaptation of Railton would be equivalent to van Fraassen’s pragmatic account in three respects: accepting or rejecting requests for explanation; the practice of giving scientific explanations; and the evaluation of the goodness of explanations. We include all three under the general rubric of explanatory “practice.” Admittedly these are not the only three features by which an account of explanation might be evaluated. Roughly, we mean to show that a synthetic account cannot do a better job of accounting for the scientific practices which are of importance to the constructive empiricist, and therefore no argument can be presented to the constructive empiricist to convince her that by her own standards the synthetic account is superior. This book contains the text of the Hulsean Lectures for 1929 on the teachings of Jesus and the apostles. Scott was the first non-clergyman to hold this lectureship, and in these lectures he charts the development and gradual evolution of the teachings of Jesus though their interpretation by later teachers.

In 1864 - two years before the publication of The Communist Manifesto and 21 years before the publication of Das Kapital - Karl Marx published an essay titled Peuchet on Suicide. The essay was originally presented as a translation of excerpts from the memoirs of Jacques Peuchet, a leading French police administrator, economist and statistician. Plaut and Anderson reveal that Marx's Peuchet on Suicide is not a straightforward translation, but is an edited version in which Marx adds passages of (...) his own, altering the emphasis of the text from a moral and psychological focus to a profoundly social one. Thus, the essay very strongly reflects Marx's own position on this controversial subject. Sociologist Kevin Anderson provides an extensive introduction situating the essay in the context of Marx's work, especially that on gender; Plaut's essay focuses on the psychological aspects of the work, in particular contrasting Marx's thoughts on suicide with those of Freud and Durkheim. Does the contemporary Natural Law position that only heterosexual couples are capable of marriage rest upon an “arbitrary and irrational distinction between same-sex couples and sterile heterosexual couples?” Anderson :759–775, 2013: 759). There are many who think so. In a recent article in these pages, Erik Anderson offers his case that these critics are correct. In what follows I examine Anderson’s argument and conclude that, whether or not one ultimately agrees with the New Natural Law account (...) of marriage, the distinction found there between same sex couples and sterile heterosexual couples is neither arbitrary nor irrational. _Sigmund Freud and His Impact on the Modern World_, volume 29 of The Annual of Psychoanalysis, is a comprehensive reassessment of the influence of Sigmund Freud. In 1958 William L. Langer, in a well-known presidential address to the American Historical Association, declared the informed use of psychoanalytic depth psychology as "the next assignment" for professional historians. _Psychoanalysis and History_, volume 31 of _The Annual of Psychoanalysis_, examines the degree to which Langer's directive has been realized in the intervening 45 years. Section I makes the case for psychobiography in the lives of historical figures and exemplifies this perspective with analytically informed studies of the art of Wassily (...) Kandinsky; the films of Stanley Kubrick; and the anti-Semitism of Adolf Hitler. Section II reviews Freud's own psychohistorical contributions and then considers the relevance to historical inquiry of the more recent perspectives of Winnicott, Kernberg, and Kohut. Section III explores an intriguing tributary of psychobiographical inquiry: the impact of the biographer's own subjectivity on his or her work. Section IV turns to a topic of perennial interest: the psychobiographical study of American presidents. Section V turns to the special challenges of applying psychoanalysis to topics of religious history and includes topical studies of religious figures as disparate as the 15th century Asian Drukpa Kunley and Osama bin Laden. Section VI focuses on the recent extension of psychohistorical inquiry to groups of people and to cultural phenomena more generally: an investigation of the youth movement in pre-Nazi Germany; consideration of how societies, no less than individuals, reenact and work through traumas over time; and an outline of the role of analysis in constructing a depth-psychological "social psychology" of use to historians. The issue of same-gender sexual identity has challenged our understanding of psychological development and psychological intervention throughout the century just past and continues to provoke discussion in the century upon us. Over the past three decades, psychoanalysis advanced toward a contemporary perspective, which holds that the dynamics of sexual orientation must be an important element of the psychoanalytic process, but must be approached without prejudice regarding the outcome of analytic exploration of wish and desire. Taken together, the essays in _Rethinking (...) Psychoanalysis and the Homosexualities, a thematic volume of The Annual of Psychoanalysis_, provide a developmentally grounded and clinically consequential enlargement of this basic premise. The result is a timely overview of contemporary approaches to the study of sexual orientation within psychoanalysis that highlights issues salient to clinical work with lesbian and gay patients. The section on "The Meaning of Sexualization in Clinical Psychoanalysis" demonstrates the importance of psychoanalytic study of same-gender desire and sexual orientation for analyst and analysand alike. Philips considers the analyst's own sexual identity as a factor shaping the analysand's experience of sexuality, whereas Shelby, Lynch, Roughton, and Young-Bruehl, from their various perspectives, address the problem of stigma and prejudice as they distort same-gender desire and same-gender sexual identity. Two concluding sections of the book explore the implications of a clinical psychoanalytic perspective for the study of gay and lesbian lives. Timely and essential reading for all mental health professionals, _Rethinking Psychoanalysis and the Homosexualities_ underscores the profound distance traversed by psychoanalysis in arriving at its contemporary understandings of gender, sexual identity, and sexual desire. _Psychoanalysis and Women_, Volume 32 of _The Annual of Psychoanalysis_, is a stunning reprise on theoretical, developmental, and clinical issues that have engaged analysts from Freud on. It begins with clinical contributions by Joyce McDougall and Lynne Layton, two theorists at the forefront of clinical work with women; Jessica Benjamin, Julia Kristeva, and Ethel Spector Person, from their respective vantage points, all engage the issue of passivity, which Freud tended to equate with femininity. Employing a self-psychological framework, Christine Kieffer returns (...) to the Oedipus complex and sheds new light on the typically Pyrrhic oedipal victory of little girls. Section III broadens the historical context of contemporary theorizing about women by offering the personal reminiscences of Nancy Chodorow, Carol Gilligan, Brenda Solomon, and Malkah Notman. A final section, dedicated to "women who shared psychoanalysis," features historical essays on Ida Bauer, Anna Freud, Dorothy Burlingham, Edith Jacobson, and Therese Benedek, along with Linda Hopkins's revealing interview of Marion Milner. Of special note is Marian Tolpin's examination of three women - Bauer, Helene Deutch, and Anna Freud - who helped shape Freud's notion of the "femail castration complex," and Elisabeth Young-Bruehl's exploration of how two women - Anna Freud and Dorothy Burlingham - developed parent-infant observation. _Psychoanalysis and Women_ is an extraordinary chronicle of the distance traveled since Freud characterized women's sexual life as "the dark continent."
