Appellate Court Modifications Extraction consists of, given an Appellate Court decision, identifying the proposed modifications by the upper Court of the lower Court judge’s decision. In this work, we propose a system to extract Appellate Court Modifications for Portuguese. Information extraction for legal texts has been previously addressed using different techniques and for several languages. Our proposal differs from previous work in two ways: our corpus is composed of Brazilian Appellate Court decisions, in which we look for a set of (...) modifications provided by the Court; and to automatically extract the modifications, we use a traditional Machine Learning approach and a Deep Learning approach, both as alternative solutions and as a combined solution. We tackle the Appellate Court Modifications Extraction task, experimenting with a wide variety of methods. In order to train and evaluate the system, we have built the KauaneJunior corpus, using public data disclosed by the Appellate State Court of Rio de Janeiro jurisprudence database. Our best method, which is a Bidirectional Long Short-Term Memory network combined with Conditional Random Fields, obtained an \ score of 94.79%. (shrink)

For many years, the game of chess has provided an invaluable task environment for research on cognition, in particular on the differences between novices and experts and the learning that removes these differences, and upon the structure of human memory and its paramaters. The template theory presented by Gobet and Simon based on the EPAM theory offers precise predictions on cognitive processes during the presentation and recall of chess positions. This article describes the behavior of CHREST, a computer implementation of (...) the template theory, in a memory task when the presentation time is varied from one second to sixty, on the recall of game and random positions, and compares the model to human data. Strong players are better than weak players in both types of positions, especially with long presentation times, but even after brief presentations. CHREST predicts the data, both qualitatively and quantitatively. Strong players' superiority with random positions is explained by the large number of chunks they hold in LTM. Their excellent recall with short presentation times is explained by templates, a special class of chunks. CHREST is compared to other theories of chess skill, which either cannot account for the superiority of Masters in random positions or predict too strong a performance of Masters in such positions. In the last decades aquaculture is receiving great attention because of its health-related benefits.The objective of this work was to verify the socioeconomic profile and identify the fish consumption of individuals residing in the municipality of Seara, located in the west of Santa Catarina state, as well as the quantity they consume and the reasons that would make them consume more fish. The research has a quali-quantitative, descriptive, and transversal nature. 376 individuals were interviewed, with a questionnaire consisting of 30 (...) objective and subjective questions. This research project was submitted to and approved by the Ethics and Research Committee of the Universidade Federal da Fronteira Sul (UFFS). The results showed that as the level of education and income increases, so does the amount of fish consumed by the interviewees. It was noticed that a large part of the population consumes fish, however the amount consumed is below the recommended. Among the reasons that would make the population increase their fish intake are more accessible prices and incentives. (shrink)

Nos anos 1930 e 1940, Max Horkheimer investigou as origens da agressividade manifesta na vida social, sobretudo na forma do antissemitismo. Suas referências ao conceito de pulsão de morte divergem nestes contextos, uma distinção que se relaciona estreitamente a mudanças consideráveis em sua filosofia. A princípio, este conceito é preterido por reproduzir uma concepção ideológica que justifica e hipostasia o vínculo da civilização com a repressão pulsional, vínculo supostamente necessário em vista da ameaça de suas manifestações destrutivas para a vida (...) em sociedade. Posteriormente, no entanto, foi compreendido como sintoma do retorno do impulso mimético recalcado, em uma investigação sobre o estatuto da subjetividade desde a sua formação arcaica. Este artigo analisa as premissas destas interpretações da pulsão de morte e os conflitos em sua recepção pela teoria crítica, que lançaram as bases para uma discussão ainda em andamento sobre a sua apropriação pela teoria social. Para tal, será explicitado por que a necessidade física do mundo deve derivar da necessidade metafísica e quais as decorrências disto. Automated neuropsychiatric batteries have been used in research and clinical practice, including for chronic diseases, such as Systemic Lupus Erythematosus. The Pediatric Automated Neuropsychological Assessment Metrics battery, originally developed for use in American-English speaking individuals, allows tracking of cognitive functions. It can be applied to people over 9 years old. The aim of this study was to translate and present initial validation data from the Ped-ANAM into Brazilian-Portuguese. We translated the battery according to Beaton’s guidelines. Psychometric properties were tested, internal (...) consistency was analyzed by Cronbach’s alpha coefficient, test-retest reliability by the intraclass correlation coefficient. Further, we measured the test execution speed at both times as a temporal stability. Principal component analysis was used for structural validity. Evidence of construct validity was assessed through assessment of the relationships with the Wechsler Intelligence Scales. All participants prior to the start of study related activities signed an informed consent form approved by the local ethics committee. A sample of 230 individuals [mean of age: 23 years; 65% females] was included; a subset of 51 individuals [mean of age: 18 years, 59% female] completed the Ped-ANAM twice to assess test-retest reliability, and another subset of 54 individuals [mean of age: 20.4 years; 67% female] completed the Wechsler Intelligence Scales for Children and Adult for assessment of the Ped-ANAM’s construct validity. Our results suggest that the internal consistency of the Ped-ANAM and its subtest test-retest reliability were excellent. There was no clustering in the Principal Components Analysis, suggestive of non-grouping of the evaluated variables. Construct validity assessment to the Wechsler Scales showed expected ranges of low to strong correlations. We concluded that, based on the results of this study, a cross-culturally validated Brazilian-Portuguese version of the Ped-ANAM has been developed and it is a reliable tool for the screening cognitive function. Understanding how look-ahead search and pattern recognition interact is one of the important research questions in the study of expert problem solving. This paper examines the implications of the template theory Gobet & Simon, 1996a , a recent theory of expert memory, on the theory of problem solving in chess. Templates are chunks Chase & Simon, 1973 that have evolved into more complex data structures and that possess slots allowing values to be encoded rapidly. Templates may facilitate search in three (...) ways: a by allowing information to be stored into LTM rapidly; b by allowing a search in the template space in addition to a search in the move space; and c by compensating loss in the minds eye due to interference and decay. A computer model implementing the main ideas of the theory is presented, and simulations of its search behaviour are discussed. The template theory accounts for the slight skill difference in average depth of search found in chess players, as well as for other empirical data. (shrink)

Several authors have hailed intuition as one of the defining features of expertise. In particular, while disagreeing on almost anything that touches on human cognition and artificial intelligence, Hubert Dreyfus and Herbert Simon agreed on this point. However, the highly influential theories of intuition they proposed differed in major ways, especially with respect to the role given to search and as to whether intuition is holistic or analytic. Both theories suffer from empirical weaknesses. In this paper, we show how, with (...) some additions, a recent theory of expert memory (the template theory) offers a coherent and wide-ranging explanation of intuition in expert behaviour. It is shown that the theory accounts for the key features of intuition: it explains the rapid onset of intuition and its perceptual nature, provides mechanisms for learning, incorporates processes showing how perception is linked to action and emotion, and how experts capture the entirety of a situation. In doing so, the new theory addresses the issues problematic for Dreyfus’s and Simon’s theories. Implications for research and practice are discussed. (shrink)

Simone Weil (1909-1943) was a defining figure of the twentieth century; a philosopher, Christian, resistance fighter, anarchist, feminist, labor activist and teacher. She was described by T. S. Eliot as "a woman of genius, of a kind of genius akin to that of the saints," and by Albert Camus as "the only great spirit of our time." Originally published posthumously in two volumes, these newly reissued notebooks, are among the very few unedited personal writings of Weil's that still survive (...) today. Containing her thoughts on art, love, science, God and the meaning of life, they give context and meaning to Weil's famous works, revealing a unique philosophy in development and offering a rare private glimpse of her singular personality. David Albert explains why we can typically influence the future but not the past by appealing to an initial low-entropy state of the universe. And he argues that in the rare cases where we can influence the past, we cannot use this influence to knowingly gain future rewards: so it does not constitute control. I introduce an important new case in which Albert's account implies we can not only influence the past but control it: a case where our actions in (...) the present are reliably correlated with several events in the present and past. To deal with such cases, we need to appeal to epistemic conditions on deliberation: being agents requires our decisions being epistemically undetermined at the time we make them. In a world with the past-hypothesis, this implies that deliberation will typically come prior to decision. Once deliberation in this direction is established, correlations towards the past cannot then be exploited for control. To explain why we cannot effectively control the past, we need to appeal to deliberation, whether as part of a defence of Albert's account, or used independently to explain the asymmetry of control. Particle indistinguishability has always been considered a purely quantum mechanical concept. In parallel, indistinguishable particles have been thought to be entities that are not properly speaking objects at all. I argue, to the contrary, that the concept can equally be applied to classical particles, and that in either case particles may (with certain exceptions) be counted as objects even though they are indistinguishable. The exceptions are elementary bosons (for example photons).

The relationship of part to whole is one of the most fundamental there is; this is the first and only full-length study of this concept. This book shows that mereology, the formal theory of part and whole, is essential to ontology. Peter Simons surveys and criticizes previous theories, especially the standard extensional view, and proposes a more adequate account which encompasses both temporal and modal considerations in detail. We demonstrate that the quantum-mechanical description of composite physical systems of an arbitrary number of similar fermions in all their admissible states, mixed or pure, for all finite-dimensional Hilbert spaces, is not in conflict with Leibniz's Principle of the Identity of Indiscernibles (PII). We discern the fermions by means of physically meaningful, permutation-invariant categorical relations, i.e. relations independent of the quantum-mechanical probabilities. If, indeed, probabilistic relations are permitted as well, we argue that similar bosons can also be discerned in all (...) their admissible states; but their categorical discernibility turns out to be a state-dependent matter. In all demonstrated cases of discernibility, the fermions and the bosons are discerned (i) with only minimal assumptions on the interpretation of quantum mechanics; (ii) without appealing to metaphysical notions, such as Scotusian haecceitas, Lockean substrata, Postian transcendental individuality or Adamsian primitive thisness; and (iii) without revising the general framework of classical elementary predicate logic and standard set theory, thus without revising standard mathematics. This confutes: (a) the currently dominant view that, provided (i) and (ii), the quantum-mechanical description of such composite physical systems always conflicts with PII; and (b) that if PII can be saved at all, the only way to do it is by adopting one or other of the thick metaphysical notions mentioned above. Among the most general and influential arguments for the currently dominant view are those due to Schrodinger, Margenau, Cortes, Dalla Chiara, Di Francia, Redhead, French, Teller, Butterfield, Giuntini, Mittelstaedt, Castellani, Krause and Huggett. We review them succinctly and critically as well as related arguments by van Fraassen and Massimi. (shrink)

Gravity and Grace was the first ever publication by the remarkable thinker and activist, Simone Weil. In it Gustave Thibon, the priest to whom she had entrusted her notebooks before her untimely death, compiled in one remarkable volume a compendium of her writings that have become a source of spiritual guidance and wisdom for countless individuals.

I show that frequentism, as an explanation of probability in classical statistical mechanics, can be extended in a natural way to a decoherent quantum history space, the analogue of a classical phase space. The result is a form of finite frequentism, in which Gibbs’ concept of an infinite ensemble of gases is replaced by the quantum state expressed as a superposition of a finite number of decohering microstates. It is a form of finite and actual frequentism (as opposed to hypothetical (...) frequentism) insofar as all the microstates exist, in keeping with the decoherence-based Everett interpretation, and some versions of pilot-wave theory. Este artigo apresenta o resultado de uma pesquisa desenvolvida no Programa de Pós-Graduação em Ensino de História da Universidade Federal de Uberlândia (ProfHistória/UFU). Nos limites do texto o objetivo consistiu em apresentar o processo que culminou na elaboração do Curso intitulado “Por uma educação antirracista: o estudo da história da África, cultura afro-brasileira e relações étnico-raciais” produzido como resultado da pesquisa desenvolvida no mestrado profissional, tendo como base e público alvo estudantes jovens e adultos. O estudo está fundamentado em uma (...) pesquisa qualitativa, com revisão bibliográfica em livros e artigos acadêmicos tendo como principais referências autores que realizaram estudos sobre Educação de Jovens e adultos (EJA) e Educação e relações étnico-raciais. Analisamos documentos que regularizam a educação brasileira e as leis antirracistas dedicando atenção especial à Lei de Diretrizes e Bases da Educação (LDB) 9.394/96 e à Lei 10.639/03, alterada posteriormente pela Lei 11.645/08 que estabelece a obrigatoriedade da temática História e cultura afro-brasileira e indígena. Recorreu também a um questionário diagnóstico aplicado aos jovens e adultos estudantes do Centro Estadual de Educação Continuada (CESEC Uberlândia). Conclui-se que para efetivar uma educação antirracista, o ensino de História da África e Cultura Afro-Brasileira não pode se limitar a ações pontuais. É necessário descolonizar os currículos. The central claim of this article is that post-truth requires a political and socio-economical perspective, rather than a moral or epistemological one. The article consists of two parts. The first part offers a critical examination of the dominant analyses of post-truth in terms of shifting standards of the origin and the evaluation of facts. Moreover, the claim that postmodernism is the cause of post-truth is examined and refuted. In the second part an alternative perspective is developed, centring around the notion (...) of gatekeepers. Rather than linking post-truth to bullshit and postmodernism, it should be understood as a symptom of a contemporary shift in the gatekeepers of truth and knowledge. Knowledge and truth are always mediated in society through the hands of gatekeeping institutions such as journalism or science. Post-truth is a symptom of a broader transformation of the gatekeeping institutions of our current society. It therefore requires a political philosophy of these institutional shifts and the new risks they involve. (shrink)

This is a very short introduction to ethics. It divides into three parts: first, introducing and discussing reasons for skepticism about ethics; second introducing themes of birth, death, happiness, desire and freedom to show how deeply our lives are interwoven with ethics; third, introducing attempts to found ethics, due to Aristotle, Kant, and the contractarian tradition.

One Stoic response to the skeptical indistinguishability argument is that it fails to account for expertise: the Stoics allow that while two similar objects create indistinguishable appearances in the amateur, this is not true of the expert, whose appearances succeed in discriminating the pair. This paper re-examines the motivations for this Stoic response, and argues that it reveals the Stoic claim that, in generating a kataleptic appearance, the perceiver’s mind is active, insofar as it applies concepts matching the perceptual stimulus. (...) I argue that this claim is reflected in the Stoic definition of the kataleptic appearance, and that it respects their more general account of mental representation. I further suggest that, in attributing some activity to the mind in creating each kataleptic appearance, and in claiming that the expert’s mind allows her to form more kataleptic appearances than the amateur, the Stoics draw inspiration from the wax tablet model in Plato’s Theaetetus (190e–196d), where Socrates distinguishes the wise from the ignorant on the basis of how well they match sensory input with its appropriate mental ‘seal’ (σφραγίς). This is a book about the religious life of the Greeks from the eighth century BC to the fifth century AD, looked at in the context of a variety of different cities and periods. Simon Price does not describe some abstract and self-contained system of religion or myths but examines local practices and ideas in the light of general Greek ideas, relating them for example, to gender roles and to cultural and political life (including Attic tragedy and the trial of (...) Socrates). He also lays emphasis on the reactions to Greek religions of ancient thinkers - Greek, Roman, Jewish and Christian. The evidence drawn on is of all kinds: literary texts, which are translated throughout; inscriptions, including an appendix of newly translated Greek inscriptions; and archaeology, which is highlighted in the numerous illustrations. We argue that the value of authenticity does not explain the value of self-knowledge. There are a plurality of species of authenticity; in this paper we consider four species: avoiding pretense (section 2), Frankfurtian wholeheartedness (section 3), existential self-knowledge (section 4), and spontaneity (section 5). Our thesis is that, for each of these species, the value of (that species of) authenticity does not (partially) explain the value of self-knowledge. Moreover, when it comes to spontaneity, the value of (that species of) (...) authenticity conflicts with the value of self-knowledge. (shrink)

Neste artigo é defendida a tese de que a noção aristotélica de perfeição silogística não é completamente arbitrária e reflete características lógicas, apesar de alguns aspectos não lógicos. Em consonância com a sugestão de alguns intérpretes de que a validade dos silogismos em primeira figura se fundamenta no dictum de omni et nullo, será apontado como essa fundamentação se desdobra em procedimentos dedutivos encontrados nos textos de Aristóteles. Tomando definições ou explicitações das proposições categóricas como parâmetro, a perfeição ou imperfeição (...) de um silogismo, independentemente das relações de prova que se adote entre as figuras silogísticas, não se mostra arbitrária. This research aimed to explain the defense of oral interactions in the presence of information and communication technologies such as WhatsApp (WA) as well as to explore some of the positive contributions of WA used in building the Real Life Communication, especially in the learning environment. By applying the Exploratory design, this research involved 4 participants from various educational backgrounds as a purposively selected data source indicated as WA users at once. Data were collected through Focus Group Discussion, Interview, and (...) Observation and analyzed by several stages i.e. data reduction, displaying data, categorizing, and verifying and concluding. The results showed that oral interactions can decrease both in the language community and learning environment as the dominant use of WA that is not wise. Nevertheless, the use of WA applications also had some positive contributions in building a real relationship. Finally, the assumption that the negative impact of using the WA application should be able to change the mindset and positive attitude of the scholars in initiating and defending an oral interaction in the learning environment. Mostly learners and even teachers of English as a Foreign Language (EFL) are still not able to speak grammatically and fluently just because they lack of the Indonesian language proficiency and comprehension. This research was done to investigate how the Indonesian (Bahasa Indonesia) can assist the teachers and learners of EFL in improving their English proficiency and comprehension. The data were analyzed by applying Miles’ and Huberman’s framework; data reduction, data display, and drawing then verifying conclusion. The findings showed some (...) positive and negative representative perceptions of the teachers dealing with the roles of the Indonesian in the teaching and learning EFL. The second findings showed and explored the roles of the Indonesian in the teaching and learning EFL. There were five roles by which the Indonesian contribute to such as Functional Equation, Competence Indicator, Linguistic Mediator, Communicative Language Paradigm, and Situational Language Use. The third findings explored the aspects in which the Indonesian had the roles to play in assisting the teaching and learning the EFL such as aspect of the Linguistic Item, aspect of Semantics, and aspect of Pragmatics. There were three other findings in this research that were explored and labeled as Linguistic Competence vs Linguistic Cognition, Cultural Behavior-Based Language, and First Language Interest. This study examines the impact of a social desirability response bias as a personality characteristic (self-deception and impression management) and as an item characteristic (perceived desirability of the behavior) on self-reported ethical conduct. Findings from a sample of college students revealed that self-reported ethical conduct is associated with both personality and item characteristics, with perceived desirability of behavior having the greatest influence on self-reported conduct. Implications for research in business ethics are drawn, and suggestions are offered for reducing the effects (...) of a socially desirable response bias. (shrink)

This paper offers a critical analysis of Stalnaker''s work on presupposition (Stalnaker1973, 1974, 1979, 1999, 2002). The paper examines two definitions of speaker presupposition offered by Stalnaker – the familiar common ground view, and the earlier,less familiar, dispositional account – and how Stalnaker relates this notion to the linguistic phenomenon of presupposition. Special attention is paid to Stalnaker's view of accommodation. I argue that given Stalnaker's views, accommodation is not rightly seen as driven by the presuppositional requirements of utterances, but (...) only by the interests of speakers in eliminating perceived differences among presuppositions. I also consider the revisions which are needed either to the definition of speaker presupposition or to the definition of sentence presupposition in light of the possibility of informative presupposition. In the concluding section, I discuss the ways in which some recent accounts of context and speaker presupposition depart from their Stalnakerian foundations. (shrink)
