For Pieper, the study of tradition is anything but antiquarian. He begins with a consideration of tradition in a changing world and is well aware of the need to confront the all-too-common perception that "tradition" is nowadays irrelevant. On the basis of his profound knowledge of the Western philosophical tradition from Plato and Aristotle through Augustine, Boethius, Thomas Aquinas, and Descartes, to modern Existentialism and Marxism, Pieper is able to highlight the values established - and challenged - down through the (...) centuries. He sees the need to re-examine these values, to rid them of the false interpretations and misunderstandings that threaten to consign them to oblivion. He attempts to restate them in language which, in fact, not only reflects the clarity of his mind but also expresses his conviction that these values, freshly examined and understood, provide a sound basis for healthy living and for our survival against the dangers that pose a serious threat to the very existence of Western civilization. He illustrates these values by examining the contrast between an exponent of them, like Socrates, and an opportunist, like the Sophist Protagoras; between the man of principle and the nihilistic pragmatist. The book consists of a mixture of articles and speeches, produced by a man who, though often wooed by the academy, was not concerned with achieving personal status as an academic professor. He insisted, for the most part, in combining purely academic teaching with the education of teachers in teacher-training colleges. In The Christian Idea of Man Josef Pieper brings off an extraordinary feat. He acknowledges that whoever introduces the theme of "virtue" and "the virtues" can expect to be met with a smile - of various shades of condescension. He then proceeds to single out "prudence" as the fundamental virtue on which the other cardinal virtues are based. In defining it, he does away with the shallow connotations which have debased it in modern times. Similarly, he manages to divest it (...) of all traces of "moralism," which, to a large extent has become identified with the Christian idea of virtue and has made it fall into general disrepute. For Pieper, prudence is fundamentally based on a clear perception of reality - of things as they are - and the prudent person is the one who acts in accordance with this perception. It has nothing to do with knowing how to avoid decisions which might be to one's disadvantage. Similarly, justice, which is based on prudence, involves acting toward other persons according to one's perception of the truth of the circumstances - again, a perception of things "as they are." This is not a reference to any "status quo," but to the reality as constituted by the Creator. In referring to courage [fortitude], Pieper discusses the overcoming of fear. This does not imply having no fear but, precisely, overcoming it. With regard to the fundamental fear of death, Pieper rejects the approaches which contend that there is nothing to fear in death. On the contrary, there is everything to fear in death: it concerns the question of possible absolute annihilation! Here Pieper introduces the consideration of the "theological" virtues of faith, hope, and love [charity]. When confronted with the question of possible annihilation, the Christian's faith is paramount. Belief in God lets him confront danger and overcome even the most radical fear - through hope in God. His love of God does not wipe out fear but gives him courage. Moderation is seen as the last in the hierarchy of the cardinal virtues. Through its manifestation, in recent Christian thinking, with chastity and abstinence, it became in the Christian mind the most prominent characteristic of the Christian idea of man and one that dominated everything else. It has been reduced to the status of the most private of the virtues and is combined with a moralistic conception of the good. Pieper's analysis of moderation shows how this virtue needs to be rethought, although, even then, it will remain the last in the hierarchy of virtues. (shrink)

Pieper distinguishes between Platonic stones in which Plato crystallizes mythical fragments from the mere stories which contain them, and Platonic myths, in which he purifies the proper mythical elements, freeing them of the non-mythical elements which tend to obscure them.

Paterson’s study of Stirner and his philosophy is divided into three main sections. The first deals with the man and his work, the second with his adversaries and successors; and the final section presents an appraisal of Stirner’s philosophy.

This concise little book on tradition says a lot in a few pages. The breadth and depth of Pieper’s philosophical and theological knowledge show through at every step, though the strictly methodical and economical treatment of his theme ensures that the structure of his argument is never obscured by an avalanche of unnecessary detail. Beginning with an analysis of what tradition means in ordinary speech, Pieper carefully works towards a definition of the term. He limits his study to the kind (...) of tradition that means, in general terms at first, the handing on of a doctrine. By comparing tradition with discussion, teaching and learning, informing and receiving information, Pieper is able to clarify his definition and establish the role that faith plays in tradition. The recent case of German siblings Patrick Stübing and his sister Susan Karolewski has reignited debate over the criminalisation of sexual intercourse among consanguine descendants. The primary justification for criminalising incest is the purported increased risk of genetic disabilities among offspring, but is criminalising sexual intercourse an empirically sound and proportionate response to this increased risk? To answer this question we must consider the specifics of the harm in question and the magnitude of the harms of the intervention. The example (...) of incest law has important implications for liberal societies. If we can justify imprisoning consenting adults for choosing partners who will increase the risk of having children with disabilities, then we set a troubling precedent for all couples who may pass on genetic disorders to their children. We explore the different meanings of “quantum uncertainty” contained in Heisenberg’s seminal paper from 1927, and also some of the precise definitions that were developed later. We recount the controversy about “Anschaulichkeit”, visualizability of the theory, which Heisenberg claims to resolve. Moreover, we consider Heisenberg’s programme of operational analysis of concepts, in which he sees himself as following Einstein. Heisenberg’s work is marked by the tensions between semiclassical arguments and the emerging modern quantum theory, between intuition and rigour, and between (...) shaky arguments and overarching claims. Nevertheless, the main message can be taken into the new quantum theory, and can be brought into the form of general theorems. They come in two kinds, not distinguished by Heisenberg. These are, on one hand, constraints on preparations, like the usual textbook uncertainty relation, and, on the other, constraints on joint measurability, including trade-offs between accuracy and disturbance. Monuments and statues are forms of commemoration. They typically pay tribute to people or events and aim to serve as a permanent marker, a link between present and past generations, committing them to memory and assigning them with importance and meaning. While commemorations can be beneficial in terms of recognising a legacy of the past and helping foster relationships between opposing groups, they can also be divisive and painful, failing to acknowledge other dimensions of historical fact and further hardening the (...) boundaries between groups in conflict. Essentially, what we choose to commemorate reflects what we as a society actually value. This paper focuses on the unsettled fates of the Captain Cook statue that stands with prominence in Hyde Park, Warrane, and other colonial monuments in Australia. It also discusses the emotionality surrounding such commemorations. We question whether Cook’s actual achievements constitute the notoriety that has been bestowed upon him. A range of commentators have put forward ideas around what to do about the Cook statue which we discuss while also considering what the future might look like if the truth of colonial history is known and open conversations can be had. Political philosophers have recently begun to take seriously methodological questions concerning what a theoretical examination of political ideals is suppose to accomplish and how effective theorising in ideal theory is in securing those aims. Andrew Mason and G.A. Cohen, for example, believe that the fundamental principles of justice are logically independent of issues of feasibility and questions about human nature. Their position contrasts sharply with political theorists like John Dunn and Joseph Carens who believe that normative theorising must be integrated (...) with an appreciation of the empirical realities of one’s society. Rather than bracket questions of feasibility and human nature, empirically-oriented political theorists believe that real, non- ideal considerations must be taken seriously when deriving normative theories of justice.1 And some justice-theorists, most notably John Rawls, attempt to. In 2016, France passed a major law that is unique in giving terminally ill and suffering patients the right to the controversial procedure of continuous deep sedation until death (CDS). In so doing, the law identifies CDS as a sui generis clinical practice, distinct from other forms of palliative sedation therapy, as well as from euthanasia. As such, it reconfigures the ethical debate over CDS in interesting ways. This paper addresses one aspect of this reconfiguration and its implications for the (...) intentions at work in this complex time at the end of life. The concept of intention is often considered central to the ethics of end-of-life care, but its role is recognized to be problematic, with charges of elusiveness and ambiguity. I aim to show that consideration of the French law affords a new understanding of the intentionality of CDS, and that in addition to the obvious importance of this for clarifying the ethics of the practice, it may suggest new ways of addressing the wider problem of ambiguous clinical intentions at end of life. It is commonly believed that Edmund Husserl (1859-1938), well known as the founder of phenomenology and as the teacher of Heidegger, was unable to free himself from the framework of a classical metaphysics of subjectivity. Supposedly, he never abandoned the view that the world and the Other are constituted by a pure transcendental subject, and his thinking in consequence remains Cartesian, idealistic, and solipsistic. The continuing publication of Husserl’s manuscripts has made it necessary to revise such an interpretation. Drawing upon (...) both Husserl’s published works and posthumous material, Husserl’s Phenomenology incorporates the results of the most recent Husserl research. It is divided into three parts, roughly following the chronological development of Husserl’s thought, from his early analyses of logic and intentionality, through his mature transcendental-philosophical analyses of reduction and constitution, to his late analyses of intersubjectivity and lifeworld. In the newly emerging debates about genetics and justice three distinct principles have begun to emerge concerning what the distributive aim of genetic interventions should be. These principles are: genetic equality, a genetic decent minimum, and the genetic difference principle. In this paper, I examine the rationale of each of these principles and argue that genetic equality and a genetic decent minimum are ill-equipped to tackle what I call the currency problem and the problem of weight. The genetic difference principle (...) is the most promising of the three principles and I develop this principle so that it takes seriously the concerns of just health care and distributive justice in general. Given the strains on public funds for other important social programmes, the costs of pursuing genetic interventions and the nature of genetic interventions, I conclude that a more lax interpretation of the genetic difference principle is appropriate. This interpretation stipulates that genetic inequalities should be arranged so that they are to the greatest reasonable benefit of the least advantaged. Such a proposal is consistent with prioritarianism and provides some practical guidance for non-ideal societies–that is, societies that do not have the endless amount of resources needed to satisfy every requirement of justice. In this article I critically examine Adam Moore’s claim that the threshold for overriding intangible property rights and privacy rights is higher, in relation to genetic enhancement techniques and sensitive personal information, than is commonly suggested. I argue that Moore fails to see how important advances in genetic research are to social justice. Once this point is emphasised one sees that the issue of how formidable overriding these rights are is open to much debate. There are strong reasons, on grounds (...) of social justice, for thinking the importance of such rights is likely to be diminished in the interests of ensuring a more just distribution of genes essential to pursuing what John Rawls calls a person’s ”rational plan of life’. Using the concept of social denial, this article puts the American Psychological Association's (APA’s) pattern of willful blindness, identified by independent reviewer David Hoffman, in historical context by examining the contributions of Cold War social scientists to the CIA's KUBARK torture manual, and discusses the implications of this history for the reform of the APA's ethics policies. David Hoffman found that the leadership of the APA colluded with Department of Defense (DoD) to ensure that the APA's ethical policies were no (...) stronger than those issued by the DoD. While the independent reviewer did not find evidence of collaboration between the CIA and the APA, this was not due to a lack of effort on the part of the APA, which was anxious to establish good relations and so promote the use of psychology in the national security arena. While Hoffman did not find that the APA knew that its collaborations would facilitate the development of abusive interrogation techniques, it showed a marked, motivated lack of interest in whether or not the DoD or CIA was abusing prisoners. The APA maintained its strategic ignorance even while engaging in a public relations campaign designed to give the impression that it was deeply concerned about multiple reports of psychologist involvement in a system of torture. This willful ignorance was not unprecedented and follows a predictable pattern of knowing and not-knowing to which all psychologists should attend. (shrink)

In this paper I make the case for answering in the affirmative. I examine, and critique, what I call the Fairness Objection to making aging research a (...) greater priority than it currently is. The Fairness Objection presumes that support for aging research is limited to a simplistic utilitarian justification. That is, a mode of justification that is aggregative and permits imposing high costs on a few so that small benefits could be enjoyed by numerous recipients. I develop two arguments to refute the Fairness Objection. The Fairness Objection mischaracterizes the utilitarian argument for retarding human aging. It does so by invoking the fallacious conceptual distinction between "saving lives" and "extending lives", as well as making a number of mistaken assumptions concerning the likely benefits of retarding human aging. Secondly, I argue that the case for tackling aging can be made on contractualist , in addition to utilitarian, grounds. Because the harms of senescence are "morally relevant" to the harms of disease, contractualists can permit aggregation within lives. And thus no one could reasonably reject, I contend, a principle that makes the aspiration to tackle human aging more of a priority than it currently is. CiteULike Connotea Del.icio.us What's this? Imagination and idealism are particularly important creative epistemic virtues for the medical sciences if we hope to improve the health of the world’s ageing population. To date, imagination and idealism within the medical sciences have been dominated by a paradigm of disease control, a paradigm which has realised significant, but also limited, success. Disease control proved particularly successful in mitigating the early-life mortality risks from infectious diseases, but it has proved less successful when applied to the chronic diseases of late (...) life (like cancer). The time is ripe for the emergence and prominence of a supplementary medical research paradigm, the paradigm of ‘healthy ageing’ which prioritises the goal of rate (of ageing) control rather than disease control. This is the difference between extending the human healthspan versus extending survival by managing (or trying to eliminate) the multi-morbidities, frailty and disability currently prevalent in late life. The idealism of the disease control paradigm is myopic because it ignores the health constraints imposed by the inborn ageing process itself, a biological reality which is already inflicting significant economic and disease burdens on the world’s ageing populations. Unless the medical sciences retard the rate of biological ageing, these problems will continue to be amplified as larger numbers of persons survive into late life. (shrink)

What we think about equality as a value will influence how we think genetic interventions should be regulated. In this paper I utilise the taxonomy of equality put forth by Derek Parfit and apply this to the issue of genetic interventions. I argue that Telic Egalitarianism is untenable and that Deontic Egalitarianism collapses into the Priority View. The Priority View maintains that it is morally more important to benefit those who are worse off. Once this precision has been given to (...) the concerns egalitarians have a number of diverse issues must be considered before determining what the just regulation of genetic interventions would be. Consideration must be given to the current situation of the current situation of the least advantaged, the fiscal realities behind genetic interventions, the budget constraints on other programmes egalitarians believe should receive scarce public funds and the interconnected nature of genetic information. These considerations might lead egalitarians to abandon what they take to be the obvious policy recommendations for them to endorse regarding the regulation of genetic therapies and enhancements. In this paper I argue that the account of deliberative democracy advanced by Amy Gutmann and Dennis Thompson (1996, 2004) is a useful normative theory that can help enhance our deliberations about public policy in morally pluralistic societies. More specifically, I illustrate how the prescriptions of deliberative democracy can be applied to the issue of regulating non-medical uses of pre-implantation genetic diagnosis (PGD), such as gender selection. Deliberative democracy does not aim to win a philosophical debate among rival first-order theories, (...) such as libertarianism, egalitarianism or feminism. Rather, it advances a second-order analysis that strives to help us determine what would constitute a reasonable balance between the conflicting fundamental values that arise in the context of regulating PGD. I outline a theoretical model (called the Reasonable Genetic Intervention Model) that brings these issues to the fore. Such a model incorporates the concern for both procedural and substantive principles; and it does so in way that takes provisionality seriously. (shrink)

He argues that the most fundamental level of selfhood is not socially constructed or dependent upon others, but accepts that certain dimensions of the self and types of self-experience are other-mediated.

Cambridge Quarterly of Healthcare Ethics. What values and principles should inform the regulation of new human genetic technologies? To adequately answer this question we need an account of genetic justice. That is, an account of what constitutes a fair distribution of genetic endowments that influence our expected life-time acquisition of natural primary goods. These are goods that every rational person has an interest in. The decisions we now make regarding the regulation of human genetic technologies will determine how quickly and (...) effectively these benefits are brought into existence, as well as who receives these benefits. In this paper I argue that a necessary condition of a defensible account of genetic justice is that it must track genetic complexity. Genetic complexity encompasses phenomena such as polygenetic traits, gene-gene interactions and complex environmental influences. More specifically, I argue that pluralistic prioritarianism is a theoretical position well-suited for tracking genetic complexity. (shrink)

Where does the aspiration to retard human ageing fit in the ‘big picture’ of medical necessities and the requirements of just healthcare? Is there a duty to retard human ageing? And if so, how much should we invest in the basic science that studies the biology of ageing and could lead to interventions that modify the biological processes of human ageing? I consider two prominent accounts of equality and just healthcare – Norman Daniels's application of the principle of fair equality (...) of opportunity and Ronald Dworkin's account of equality of resources – and conclude that, once suitably amended and revised, both actually support the conclusion that anti-ageing research is important and could lead to interventions that ought to be considered ‘medical necessities’. Non-skeptical robust realists about normativity, mathematics, or any other domain of non- causal truths are committed to a correlation between their beliefs and non- causal, mind-independent facts. Hartry Field and others have argued that if realists cannot explain this striking correlation, that is a strong reason to reject their theory. Some consider this argument, known as the Benacerraf–Field argument, as the strongest challenge to robust realism about mathematics, normativity, and even logic. In this article I offer two closely related accounts (...) for the type of explanation needed in order to address Field's challenge. I then argue that both accounts imply that the striking correlation to which robust realists are committed is explainable, thereby discharging Field's challenge. Philosophers of physics have long debated whether the Past State of low entropy of our universe calls for explanation. What is meant by “calls for explanation”? In this article we analyze this notion, distinguishing between several possible meanings that may be attached to it. Taking the debate around the Past State as a case study, we show how our analysis of what “calling for explanation” might mean can contribute to clarifying the debate and perhaps to settling it, thus demonstrating the (...) fruitfulness of this analysis. Applying our analysis, we show that two main opponents in this debate, Huw Price and Craig Callender, are, for the most part, talking past each other rather than disagreeing, as they employ different notions of “calling for explanation”. We then proceed to show how answering the different questions that arise out of the different meanings of “calling for explanation” can result in clarifying the problems at hand and thus, hopefully, to solving them. Deliberative democrats conceive of the democratic process as a transformative process, one that requires citizens to participate in authentic deliberation with others rather than engaging in the strategic behaviour characteristic of existing democratic practices. Current practices often pit factions of society against one another in a struggle to win or retain political power. The moralized conception of democracy defended by deliberative democrats is one that emphasizes the importance of being open-minded, reasonable and accommodating. These civic virtues are necessary if we (...) are to treat others as equals when decisions are made concerning the use of political power, power that will influence the life prospects of everyone. Deliberative democrats are thus concerned with the normative legitimacy of a democratic decision; this legitimacy depends ‘on the degree to which those affected by it have been included in the decision-making processes and have had the opportunity to influence the outcomes’. Reason, we are told, is what makes us human, the source of our knowledge and wisdom. If reason is so useful, why didn't it also evolve in other animals? If reason is that reliable, why do we produce so much thoroughly reasoned nonsense? In their groundbreaking account of the evolution and workings of reason, Hugo Mercier and Dan Sperber set out to solve this double enigma. Reason, they argue with a compelling mix of real-life and experimental evidence, is not geared (...) to solitary use, to arriving at better beliefs and decisions on our own. What reason does, rather, is help us justify our beliefs and actions to others, convince them through argumentation, and evaluate the justifications and arguments that others address to us. In other words, reason helps humans better exploit their uniquely rich social environment. This interactionist interpretation explains why reason may have evolved and how it fits with other cognitive mechanisms. It makes sense of strengths and weaknesses that have long puzzled philosophers and psychologists--why reason is biased in favor of what we already believe, why it may lead to terrible ideas and yet is indispensable to spreading good ones.--. In this paper I argue that the virtue ethics tradition can enhance the moral discourse on the ethics of prenatal genetic enhancements in distinctive and valuable ways. Virtue ethics prescribes we adopt a much more provisional stance on the issue of the moral permissibility of prenatal genetic enhancements. A stance that places great care on differentiating between the different stakes involved with developing different phenotypes in our children and the different possible means (environmental vs. genetic manipulation) available to parents for (...) pursuing legitimate concerns of parental love and virtue. Key components of the virtue ethics account of morality, such as the Aristotelian account of happiness, love and the doctrine of the mean, provide an adequate basis for rejecting the claim that it is morally impermissible for parents to pursue (safe and effective) prenatal enhancements. Furthermore, there is good reason to believe that a virtue ethics account of morality could actually support the stronger claim that utilising such interventions can (in certain contexts) be morally required. Several authors believe that there are certain facts that are striking and cry out for explanation—for instance, a coin that is tossed many times and lands in the alternating sequence HTHTHTHTHTHT…. According to this view, we have prima facie reason to believe that such facts are not the result of chance. I call this view the striking principle. Based on this principle, some have argued for far-reaching conclusions, such as that our universe was created by intelligent design, that there are (...) many universes other than the one we inhabit, and that there are no mathematical or normative facts. Appealing as the view may initially seem, I argue that we lack sufficient reason to accept it. (shrink)

Mathias Risse’s On Global Justice is a unique and important contribution to the growing literature on global justice. Risse’s approach to a variety of topics, ranging from domestic justice and common ownership of the earth, to immigration, human rights, climate change, and labour rights, is one that conceives of global justice as a philosophical problem. In this commentary I focus on a number of reservations I have about approaching global justice as a philosophical rather than an inherently practical problem. To (...) his credit Risse does acknowledge at various stages of the book that a good deal of the applied terrain he ventures into presupposes complex and contentious empirical assumptions. A greater emphasis on those points would, I believe, helpfully reveal the shortcomings of tackling intellectual property rights by appealing to Hugo Grotius’s stance on the ownership of seas, or the shortcomings of tackling health by invoking the language of human rights without acknowledging and addressing the constraints and challenges of promoting health in an aging world.
