This essay critiques Professor Martha Nussbaum's book, Liberty of Conscience: In Defense of America's Tradition of Religious Equality . Nussbaum's thesis is that the entire tradition of religious liberty in America can be both best understood and justified by recourse to the overarching principle of equal respect —that “[a]ll citizens have equal rights and deserve equal respect from the government under which they live.” Nussbaum insists that equal respect pervades the tradition and that all other values of religious liberty are (...) subordinate to it. She examines various free-exercise and establishment issues in light of this principle, concluding that the tradition of religious equality is under threat and calling for renewed vigilance in its defense. This essay criticizes Nussbaum's elevation of the principle of equal respect to supreme normative status. It claims that Nussbaum's single-minded focus on equal respect distorts and misunderstands the conflicts actually at issue in many religious liberty disputes. The essay focuses specifically on the inadequacies of her assessment of two prominent religious liberty cases, one in the free exercise and the other in the established context. This essay concludes that there are reasons for deep skepticism about Nussbaum's approach as a comprehensive theory of the religion clauses. (shrink)

To mitigate risk, should companies signal a broad range of environmental, social, and governance initiatives or instead focus on only a few ESG issues? Drawing on signaling theory, we propose that a broad array of ESG initiatives generates not only signal consistency but also accelerating signal costs. Our empirical results support the resultant hypothesis of a curvilinear relationship between ESG scope and equity risk. In addition, this U-shaped curve seems to become steeper when firms face multiple media-reported ESG controversies. Overall, (...) our study qualifies the conventional wisdom that firms can reduce equity risk by attending to a wide variety of stakeholders and highlights the moderating impact of the firm’s media environment. Whenever we grasp and lift an object, our tactile system provides important information on the contact location and the force exerted on our skin. The human brain integrates signals from multiple sites for a coherent representation of object shape, inertia, weight, and other material properties. It is still an open question whether the control of grasp force occurs at the level of individual fingers or whether it is also influenced by the control and the signals from the other fingers of (...) the same hand. In this work, we approached this question by asking participants to lift, transport, and replace a sensorized object, using three- and four-digit grasp. Tactile input was altered by covering participant's fingertips with a rubber thimble, which reduced the reliability of the tactile sensory input. In different experimental conditions, we covered between one and three fingers opposing the thumb. Normal forces at each finger and the thumb were recorded while grasping and holding the object, with and without the thimble. Consistently with previous studies, reducing tactile sensitivity increased the overall grasping force. The gasping force increased in the covered finger, whereas it did not change from baseline in the remaining bare fingers. Digit placement and object tilt were not systematically affected by rubber thimble conditions. Our results suggest that, in each finger opposing thumb, digit normal force is controlled locally in response to the applied tactile perturbation. (shrink)

This article sets out a new conception of ‘property as an asset of resilience’. Building on Fineman’s emphasis on ‘webs’ of resilience, and applying insights from Actor-Network Theory and Resilient Property Theory, we examine how the rhetorical claims asserted by owners and non-owners, individually and collectively, and the ways that law recognizes and endorses those claims, affect the production of property-as-resilience. Applying Fineman’s framework, we argue that the ‘embodiment’ and ‘embeddedness’ of human vulnerability is revealed by the necessary and inevitable (...) relationship we have with land, housing and place. Everyone—including homeless people—must ‘be’ somewhere (embodiment); however, it is our ability to access ‘assets of resilience’ through our social embeddedness in institutional structures and relationships that mitigates (or not) our experience and life opportunities. In this article we analyze the nature of real property as an asset of resilience, the consequences of exclusionary concepts of ownership for how resilience is allocated, and the implications for how we think and talk about ‘exclusion’ and ‘inclusion’ in property theories and property law. We consider the roles that states perform in the allocation of property as an asset of resilience: both directly, through the protection and enforcement of private property rights and official narratives about the nature of private property; and indirectly, as owners leverage the hinterland of privilege extended to ‘ownership’ and owners to deepen their own networks of resilience. When people are performing a task, it is hard to know whether they are about to make a mistake. Klaproth, Halbrügge, Krol, Vernaleken, Zander, and Russwinkel address this by recording EEG signals while people are performing a flight control task, and show that by examining the EEG signal they can determine when people failed to notice particular stimuli, which could lead to better assistive tools.

The Catholic Church proscribes methods of birth control other than sexual abstinence. Although the U.S. Food and Drug Administration (FDA) recognizes abstinence as an acceptable method of birth control in research studies, some pharmaceutical companies mandate the use of artificial contraceptive techniques to avoid pregnancy as a condition for participation in their studies. These requirements are unacceptable at Catholic health care institutions, leading to conflicts among institutional review boards, clinical investigators, and sponsors. Subjects may feel coerced by such mandates to (...) adopt contraceptive techniques inconsistent with their personal situation and beliefs; women committed to celibacy or who engage exclusively in non-heterosexual activities are negatively impacted. We propose principles to insure informed consent to safeguard the rights of research subjects at Catholic institutions while mitigating this ethical conflict. At the same time, our proposal respects the interests of pharmaceutical research agencies and Catholic moral precepts, and fully abides by regulatory guidance. (shrink)

Three experiments investigated the relationship between subjective experience and attentional lapses during sustained attention. These experiments employed two measures of subjective experience to examine how differences in awareness correspond to variations in both task performance and psycho-physiological measures . This series of experiments examine these phenomena during the Sustained Attention to Response Task . The results suggest we can dissociate between two components of subjective experience during sustained attention: task unrelated thought which corresponds to an absent minded disengagement from the (...) task and a pre-occupation with one's task performance that seems to be best conceptualised as a strategic attempt to deploy attentional resources in response to a perception of environmental demands which exceed ones ability to perform the task. The implications of these findings for our understanding of how awareness is maintained on task relevant material during periods of sustained attention are discussed. (shrink)

The placozoan Trichoplax adhaerens is a tiny hairy plate and more simply organized than any other living metazoan. After its original description by F.E. Schulze in 1883, it attracted attention as a potential model for the ancestral state of metazoan organization, the “Urmetazoon”. Trichoplax lacks any kind of symmetry, organs, nerve cells, muscle cells, basal lamina, and extracellular matrix. Furthermore, the placozoan genome is the smallest (not secondarily reduced) genome of all metazoan genomes. It harbors a remarkably rich diversity of (...) genes and has been considered the best living surrogate for a metazoan ancestor genome. The phylum Placozoa presently harbors three formally described species, while several dozen “cryptic” species are yet awaiting their description. The phylogenetic position of placozoans has recently become a contested arena for modern phylogenetic analyses and view‐driven claims. Trichoplax offers unique prospects for understanding the minimal requirements of metazoan animal organization and their corresponding malfunctions. (shrink)

Biological evolution provides a creative fount of complex and subtle adaptations, often surprising the scientists who discover them. However, because evolution is an algorithmic process that transcends the substrate in which it occurs, evolution’s creativity is not limited to nature. Indeed, many researchers in the field of digital evolution have observed their evolving algorithms and organisms subverting their intentions, exposing unrecognized bugs in their code, producing unexpected adaptations, or exhibiting outcomes uncannily convergent with ones in nature. Such stories routinely reveal (...) creativity by evolution in these digital worlds, but they rarely fit into the standard scientific narrative. Instead they are often treated as mere obstacles to be overcome, rather than results that warrant study in their own right. The stories themselves are traded among researchers through oral tradition, but that mode of information transmission is inefficient and prone to error and outright loss. Moreover, the fact that these stories tend to be shared only among practitioners means that many natural scientists do not realize how interesting and lifelike digital organisms are and how natural their evolution can be. To our knowledge, no collection of such anecdotes has been published before. This paper is the crowd-sourced product of researchers in the fields of artificial life and evolutionary computation who have provided first-hand accounts of such cases. It thus serves as a written, fact-checked collection of scientifically important and even entertaining stories. In doing so we also present here substantial evidence that the existence and importance of evolutionary surprises extends beyond the natural world, and may indeed be a universal property of all complex evolving systems. As outlined in part 1, placozoans have been subject of hot evolutionary debates and placozoans have challenged some fundamental evolutionary concepts. Here in part 2 we discuss the exceptional genetics of the phylum Placozoa and point out some challenging model system applications for the best known species, Trichoplax adhaerens.

Ils inventent tous les trois une manière " marrane " d'être juif, en jouant la comédie de l'universalité pour laquelle ils cryptent ce qu'ils cherchent. Persécutés par l'inquisition, obligés de mimer la vie chrétienne, les Marranes portent en eux et au-delà un double jeu, une comédie judéo-chrétienne. Il ne s'agit pas pour eux d'une (...) nouvelle religion, mais d'un secret et de nouvelles Lumières qui constituent peut-être un signe adressé aux temps à venir. La scène judéo-chrétienne, habitée par les Marranes, est comme l'inconscient de la démocratie européenne, elle a été enterrée par l'histoire et on a tenté d'effacer les traces. Les Marranes déjouent le trait d'union judéo-chrétien, en rejouant les équivoques des épîtres de Saint Paul. Ils nous invitent à repenser et à subvertir le théâtre qui commande, depuis ces épîtres, la pensée politique (notamment celle du sacrifice et de la guerre) et à libérer une tout autre idée de la démocratie : une vie libérée de la politique religieuse et de la religion politique (qui se développent, aujourd'hui, sur l'économie abyssale de la dette, de la pauvreté et de la misère). Les Marranes nous obligent aussi à interroger la philosophie contemporaine qui oscille entre l'anamnèse et l'amnésie du théâtre judéo-chrétien de la pensée politique. (shrink)

Data from the World Values Survey shows that generalized trust in Mainland China—trust in out-group members—is very low, but generalized trust in Taiwan is much higher. The present article argues that positive interactions with out-group members in the context of Taiwan’s export-oriented economy fostered generalized trust—and so explains this difference. This line of argument provides evidence for Albert O. Hirschman’s doux commerce thesis, that market interaction can improve persons and even stabilize the social order. The present article defends this point (...) by separating two theses that Hirschman combines under that label, a countervailing forces thesis and a doux commerce thesis narrowly understood. These theses offer different explanations (or mechanisms) for how commerce could have those positive effects. The data about Taiwanese trust practices provides evidence for the latter. (shrink)

Roche and Sober have offered a new argument for the view that a hypothesis H is not confirmed by its capacity to explain some observation O. Their argument purports to work by showing that O screens H off from the fact that H would explain O. This paper offers several objections to this argument. Firstly, the screening-off test cannot identify whatever evidential contribution Hs explanatoriness may make. Secondly, that H would explain O may be logically necessary, eluding the screening-off test. (...) RESUMO Este artigo pretende introduzir o conceito de “interpelação fantasmagórica”. O esforço teórico se inspira nos conceitos de “fantasmagoria”, de Walter Benjamin, e de “interpelação ideológica”, de Louis Althusser. A proposta é aliar suas respectivas filosofias em processo a seus materialismos “antropológico” e “aleatório”, a fim de fazer uma análise sociopolítica da estética capitalista de hoje, tal como ela aparece na arquitetura pós-moderna e no design da vida cotidiana. Trata-se também de abrir novas perspectivas de resistências a normatividade do imaginário (...) consumista com uma interpretação crítica das criações culturais que, conforme a inspiração dos autores, pode desvelar um novo sujeito capaz de surgir na cena da história. ABSTRACT This article aims at presenting the concept of “phantasmagorical interpellation”. This theoretical effort is inspired from Walter Benjamin’s concept of “phantasmagoria” and Louis Althusser’s concept of “ideological interpellation”. The proposal is to connect their respective philosophical work-in-progress in their “anthropological” and “aleatory” materialisms for a socio-political analysis of today’s capitalist aesthetic as displayed in postmodern architecture and the design of everyday life. It is also to open new perspectives of resistance to the normativity of the consumer imaginary with a critical interpretation of cultural creations that, following the inspiration of both authors, could reveal a new subject of history able to suddenly appear on the scene of history. Darwin offered an intriguing answer to the species problem. He doubted the existence of the species category as a real category in nature, but he did not doubt the existence of those taxa called ‘‘species’’. And despite his scepticism of the species category, Darwin continued using the word ‘‘species’’. Many have said that Darwin did not understand the nature of species. Yet his answer to the species problem is both theoretically sound and practical. On the theoretical side, DarwinÕs answer is (...) confirmed by contemporary biology, and it offers a more satisfactory answer to the species problem than recent attempts to save the species category. On the practical side, DarwinÕs answer frees us from the search for the correct theoretical definition of ‘‘species’’. En la primera parte de este artículo Marc Richir plantea el problema fenomenológico central de la Crisis de las ciencias europeas y la fenomenología trascendental de Edmund Husserl y que encuentra en El origen de la geometría su prueba concreta: el problema del irreductible hiatus o laguna en la continuidad fenomenológica entre la Lebenswelt y la ciencia. La exposición de este problema se desarrolla en la segunda parte mostrando que el primer problema fenomenológico fundamental de la Krisis es el (...) del movimiento de la formación de sentido originario (Sinnbildung), es decir del despliegue de la temporalidad concreta de una conciencia irreductible a la presencia, conciencia de la que es coextensivo un fenómeno-de- lenguaje consistente en fases de presencia de sentido originariamente plurales y múltiples, en un tiempo lacunar originariamente estallado. En la tercera parte, y en relación esta vez con la institución simbólica como el segundo problema fenomenológico fundamental de la Krisis, Richir problematiza el paso de la Sinnbildung originaria a la sedimentación con el que Husserl, en un gesto metafísico clásico de estructuración, compromete a la fenomenología. Finalmente, en la cuarta parte Richir se aventura a explicar, con el ejemplo concreto del Origen de la geometría, las condiciones fenomenológicas bajo las cuales nace la institución simbólica de la geometría como ciencia al encajarse en la institución simbólica del mundo de la pre-geometría, es decir en el orden de una Sinnbildung originaria en operación en un trazado de figuras que no conduce ipso facto a la institución propiamente geométrica. Este artículo se basa en el texto nº1 del tomo XXIII de Husserliana, Phantasia, conciencia de imagen, recuerdo. En primer lugar entendemos que Husserl es el mayor crítico de la filosofía de la representación que ha dado el siglo XX. No sólo en punto a la percepción; también, como se verá, en punto a la phantasia. Sin embargo, por la misma razón, probablemente ha sido también el más fino analista del fenómeno de la representación entendido, ahora sí, como conciencia de (...) imagen. Husserl estudia el fenómeno de la conciencia de imagen en el texto principal de Hua XXIII, diseccionándolo, con una acribia sin precedentes, en sus componentes de soporte físico (ausente en el caso de la Imagination o la Einbildungskraft, a distinguir de la phantasia), Bildobjekt y Bildsujet. Mención especial merece el escurridizo estatuto ontológico (de innúmeras consecuencias, por ejemplo en psicopatología) del Bildobjekt que se entiende, en términos de Husserl, como Fiktum. Phantasia de un lado, imaginación y conciencia de imagen de otro, constituyen dos tipos esencialmente distintos de acto, con estructuras distintas. La phantasia es un acto tan directo e inmediato como la percepción, y carece de toda mediación por un Bildobjekt. A la luz del texto nº1 de Hua XXIII recogemos las características del no presente de la phantasia (distinto del no presente de la imaginación): la phantasia, amén de no presente, es proteiforme, intermitente y discontinua. Las paradojas relativas a los phantasmata de las apariciones de phantasia (Phantasieerscheinungen) nos conducirán a proponer una nueva interpretación de la representificación (Vergegenwärtigung) phantaseante como retemporalización en presencia (sin presente asignable). Por último analizamos el proceso de transposición arquitectónica de la phantasia en imaginación para terminar retomando la crítica, esbozada al principio del texto, de la perspectiva de las neurociencias en el análisis de la conciencia. tent and discontinuous. In this paper, based on video recordings of Orientation and Mobility (O&M) lessons for visually-disabled students, I will examine how occasioned maps (Psathas, 1979 ; Garfinkel, 2002 ), drawn in the student’s palm are interactionally traced, felt, and noticed in order to represent the shape of a crossing for all practical purposes. Touching will be examined from the perspective of the live production of "trails" on a specific region of the body, the palm of the hand. We will begin to (...) question how such hand-drawing map episodes occur during O&M courses, stressing how the coparticipants establish a participation framework that facilitates the making of the drawing, hand-map drawings are based on lines that are neither evanescent nor permanent. Their “persistence” is not an intrinsic feature but a systematic multimodal accomplishment. We will show how the drawn lines become depictions of the streets and contribute to producing two contrasting geometrical representations of the layout of a junction. (shrink)

Cuando se trata de música, la palabra «percepción» debe ser puesta entre paréntesis fenomenológicos: no puede tratarse ni de una sucesión de sonidos en la que cada uno de ellos estaría presente, ni de una especie de integral de dicha sucesión (según un modelo matemático), sino, más bien, una vez puesta en suspenso la realidad material del sonido, de una «percepción» a través de la phantasia (que no es imaginación sino puesta en imagen) de aquella extraña «realidad» (Sachlichkeit) inmaterial que (...) es la música en tanto fenómeno de lenguaje ―la cual dice algo distinto de sí misma en tanto puramente sonora al temporalizar el sentido (o los sentidos) en una presencia haciéndose y sin presente asignable, más allá de los límites de tal o cual lengua musical instituida. En ese sentido, el compositor, si es verdaderamente creativo, busca decir algo, mientras que el espectador entiende la música a través de una mímesis activa, no especular y desde dentro, y, finalmente, el intérprete es el mediador que, a través de su propia mímesis, del mismo tipo, reinterpreta la música al fundir su propio cuerpo viviente y su afectividad ―y así sobrepasa tanto la «mecánica» de su cuerpo físico como las afectaciones virtuosas de su narcisismo. En consecuencia, la música no tiene nada que ver con la producción y la recepción físicas y psíquicas de señales. (shrink)

El presente artículo se apoya en el comentario de un texto contenido en el § 5 del Apéndice general a las Investigaciones lógicas. A partir de ese texto problematizamos el concepto husserliano (jamás de veras comprendido por Heidegger) de fenómeno. A continuación se presentan algunas aporías relativas a la variación eidética en la exposición que de ella se da en Experiencia y juicio, así como otras relativas al problema de la percepción interna que, en la fenomenología no estándar que a (...) la luz de estas aporías se va perfilando, habrá de entenderse como un contacto de sí consigo, contacto ya entrañado en la idea del Nachschwimmen, metáfora que avanza el citado apéndice de Husserl. Proseguimos con una presentación de lo que entendemos, según la sugerencia que nos hiciera J.-T. Desanti, como �fenomenología no estándar�, esbozando algunos de sus conceptos fundamentales y el modo en el que se inscriben en el espíritu (que no en la letra) de la fenomenología de Husserl por cuanto dicha fenomenología no estándar es una versión de la fenomenología genética, versión que entiende que la estructura de correlación ego-cogitocogitatum o noesis-hylè-nóema descansa en estructuras (no eidéticas sino esquemáticas) más profundas. Se trata, fundamentalmente, del territorio de la afectividad (no intencional pero tampoco entendida como auto-afección), territorio correspondiente a la parte infigurable de la vivencia, parte a cuya fenomenalización abre lo que entendemos como �epojé fenomenológica hiperbólica�, y donde la phantasia, la afectividad y el esquematismo desempeñan un papel fundamental. El presente texto expone, en primer lugar, la tautología simbólica que habita la fenomenología del lenguaje en Husserl, en la medida en que, a pesar del reconocimiento de una dotación de sentido ontológico preexistente a la cual el sentido de la expresión debe adaptarse, en realidad la expresión cumple la función de reflejar dicho sentido noemático en una imagen (Abbild) tal y como es, a fin de poder ser figurado (Einbildung) en tanto concepto. Dicha reduplicación especular (Wiederspiegelung), a partir de (...) la cual lo antepredicativo sería reflejo fiel de lo predicativo, se corresponde con un «nominalismo fenomenológico», en tanto implica una pérdida de la densidad propiamente fenomenológica del lenguaje. En segundo lugar, sostiene que la poiética, es decir, la creación artística, es aquello que devela la dimensión de fenomenalidad del lenguaje mismo, en la medida en que hace uso de la «imaginación» (Einbildungskraft) en el sentido de una Einbildung haciéndose, la cual implica tanto una distorsión inherente a su efectuación, como una figuración que opera sin concepto, con lo cual en ella se fenomenalizan Wesen más primitivos o más salvajes que los propios a los eide lógicamente instituidos por el lenguaje. Se abordan aquí algunas dificultades de la ‘psiquiatría fenomenológica’ directamente en relación con la aprehensión de las patologías ‘psíquicas’ o ‘mentales’ dentro de un modelo de ‘normalidad’ derivado de la psicología del siglo XIX de inspiración filosófica. Desde el concepto de ‘sospecha’ freudiano, los estudios de las patologías mentales de Binswanger, los análisis de algunos problemas nucleares sobre la síntesis pasiva husserliana, Richir pretende explorar una nueva ‘vía’, más allá de los límites de la psiquiatría fenomenológica, que incluya, de manera (...) cuasi estructural, las formas de temporalización y espacialización que funcionan en las ‘flexiones’ patológicas del Dasein. En otras palabras, trata de relacionar sistemáticamente la temporalización/espacialización husserliana, entendida como síntesis pasiva, con la filosofía de la afectividad, de la Befindlichkeit heideggeriana, que pone en juego la dimensión de una pasividad originaria del Dasein, entendida bajo el signo de facticidad. Para ello, Richir comenta detallada y magistralmente el conocidísimo §29 de Ser y Tiempo, con el objetivo no solo de captar la matriz transcendental de la división interna de la Stimmung y de la Verstimmung sino, también, mostrar justamente cómo puede logarse, por un lado, cierta articulación de lo que Husserl denomina como síntesis pasiva de la temporalización con la Stimmung y la Befindlichkeit heideggerianas y, por el otro, una posible vía de articulación entre Stimmungen normales y V erstimmungen patológicas, esto es, de una división interna a la Stimmung que haga posible al menos la versión patológica en la Verstimmung. Encontramos en este texto las consideraciones arquitectónicas de algunas cuestiones metafísi- cas en torno a la indisociabilidad entre tiempo- espacio-fenómeno y el tratamiento del mundo como horizonte, como Lichtung y fenómeno. Desde algunos pasajes de Welt und Endlichkeit de Eugen Fink, en su relación con Kant y Heidegger, Richir cuestiona justamente por el carácter de la Lichtung, por su posibilidad como ilusión transcendental y la necesidad de identificarla, como lo señala claramente Fink, con el mundo mismo. Habrán, entonces, en el (...) mundo, fenómenos-de-mundo, heterogéneos o irreductibles a las cosas, los acontecimientos y los entes. Estos fenómenos, intrínsecamente ‘cosmológicos’, en el sentido de Fink, en tanto fenómenos-de-mundo, son, en efecto, inasimila- bles para los entes (cosas o acontecimientos), en la estricta medida en que pueden por principio reabsorberse en la presencia. El presente texto lleva a cabo una interpretación de las Contribuciones de Moritz Geiger. Así, sostiene que el análisis de Geiger del fenómeno del gozo lleva a cabo una epoché de la percepción intencional, en la medida en que la «plenitud» (Fülle) del objeto del gozo sólo puede darse en tanto vivencia de la disposición afectiva misma, en tanto un estar afectado a través de aquello que irradia al interior de sí. El gozo sería, así, una especie de apercepción trascendental (...) inmediata puramente sensible de sí mismo. Ello plantea el problema de cómo es posible dar cuenta fenomenológicamente de una vivencia que consiste en la auto-afección de un yo en su estar absorbido o irradiado. Por último, más allá del análisis de Geiger, la experiencia de lo sublime es interpretada como una epoché en la cual, no es el yo quien toma distancia para considerar al «objeto» del gozo como aquello en lo cual me encuentro afectado en su absorción, sino que es una experiencia de una trascendencia con respecto a mi yo en su parpadeo fenomenológico, con lo cual es ella quien me acoge en su desbordamiento.
