Political realists like Bernard Williams and Raymond Geuss reject political moralism, where ideal ethical theory comes first, then applied principles, and politics is reduced to a kind of applied ethics. While the models of political moralism that Williams criticizes are endorsed by G.A. Cohen and Ronald Dworkin respectively, I argue that this realist case against John Rawls cannot be sustained. In explicating and defending Rawls’s realistically utopian conception of ideal theory I defend a Kantian conception of theory where it (...) is by abstracting from immediate realities that theory is fit to guide practice by providing a framework for political judgment. What do we want from a theory of justice? Amartya Sen argues that what we should not want is to follow the social contract approach revived by John Rawls, or transcendental institutionalism, in its preoccupation with perfectly just institutions. Sen makes an effective case against approaches, such as G. A. Cohen’s, concerned with transcendent, fact-independent principles of justice, but not against Rawls’ constructivist approach to justice when this is properly interpreted as making a weak transcendental argument. Situating Rawls’ approach (...) within the tradition of the liberalism of freedom provides a basis for interpreting his Kantian constructivism as a form of transcendental institutionalism, and for revealing the affinities between Rawls’ idea of reflective equilibrium and Jürgen Habermas’ method of rational reconstruction. Such a Kantian conception of justice, concerned with constituting relations of equal liberty between free and equal citizens, remains essential for orienting our pursuit of justice. (shrink)

While Kantian constructivism has become one of the most influential and systematic schools of thought in analytic moral and political philosophy, Hegelian approaches to practical normativity hold out the promise of building upon Kantian insights into individual self-determination while avoiding their dualistic tendencies. : In the early twentieth century, psychoanalysis tries to investigate a specific logic of the appearance and the incident of what is taken to be unintended in everyday communication and human behavior. What before hardly seemed to be worth systematic research, now becomes a privileged field, in which the meaningful signs of a hidden and unwelcome past appear. For representing this new field of research Freud often makes use of archaeological metaphors. But in quoting the knowledge and the techniques of (...) archaeology, he evokes imaginary landscapes of a reappearing human past, which is not depraved and repressed but glorious and precious. This contradiction or gap between the character of analytical objects and their representation gives reason for an 'archaeological' investigation of psychoanalysis itself. To this end one of the heroes of nineteenth century archaeology, Heinrich Schliemann, will be confronted with two little works of Rudolf Virchow, in which he follows up the astonishing idea of an archaeology of refuse. Relating treasure troves and rubbish dumps it can be asked whether 'archaeological' practices in the late nineteenth century constituted a type of historical knowledge which runs counter to contemporary historicism and is crucial not only for Freud but also for today's theoretical reflections on archaeological perspectives in cultural studies. Theories of discourse bring to realism new ideas about how knowledge develops and how representations of reality are influenced. We gain an understanding of the conceptual aspect of social life and the processes by which meaning is produced. This collection reflects the growing interest realist critics have shown towards forms of discourse theory and deconstruction. The diverse range of contributions address such issues as the work of Derrida and deconstruction, discourse theory, Eurocentrism and poststructuralism. What unites all of the contributions (...) is a sense that it is essential to provide a realist alternative to the hitherto dominance of social constructionism, hermeneutics and postmodernism, over many of the issues discussed. By developing a realist perspective the different authors attempt to embed discourse within the structured nature of the reality of the world. Realism can situate language, discourse and ideology within context specific, or 'causally efficacious' circumstances. Realism can help to uncover issues of power, representation, and subjectivity and how discursive and other social practices produce real effects. This can help us understand the manner in which social structures are reproduced through various forms of ideology and discourse. John Dupre warns that our understanding of human nature is being distorted by two faulty and harmful forms of pseudo-scientific thinking. Not just in the academic world but in everyday life, we find one set of experts who seek to explain the ends at which humans aim in terms of evolutionary theory, while the other set uses economic models to give rules of how we act to achieve those ends. Dupre demonstrates that these theorists' explanations do not work and (...) that, if taken seriously, their theories tend to have dangerous social and political consequences. For these reasons, it is important to resist scientism: an exaggerated conception of what science can be expected to do for us. Dupre restores sanity to the study of human nature by pointing the way to a proper understanding of humans in the societies that are our natural and necessary environments. The practice-dependent approach to global justice makes a welcome attempt to steer a course between egalitarian liberal cosmopolitanism, on the one hand, and statism and nationalism, on the other. In so doing, it seeks to reconcile the universality of justice with the particular role principles of justice play within the context of different social practices. In this paper, I argue, however, that the “practice turn” in theorising about justice has not gone far enough, either methodologically or substantively. Methodologically, it is (...) necessary to move beyond the residual positivism of the practice-dependent approach to an interpretive approach that takes account of the reflexive, developmental nature of social practices. Substantively, focusing on the reflexivity of social practices, and particularly practices of reflexive constitution-making, provides a framework for a republican approach to international justice concerned with reconciling Kant’s idea of the universality of justice with the emphasis on popular sovereignty of Rousseau and Hegel. Nous examinons ici les schémas lexico-grammaticaux (LG) associés à trois verbes supports (« effectuer », « réaliser », « procéder ») dans deux corpus juridiques comparables (un corpus de directives européennes rédigées en français et leur transposition en France dans les textes de lois). A cette fin, nous utilisons Le Trameur, un logiciel de textométrie qui permet une comparaison systématique des données textuelles en mobilisant plusieurs méthodes statistiques exploratoires : analyse des fréquences par partie, spécificités, segments répétés, co-occurrences, poly-cooccurrences, etc. (...) Le recours à ce type d’outils permet au linguiste d’élaborer des unités de base de son système analytique en suivant un protocole de recherche précis, qui tient compte des indices quantitatifs. Finalement, des distinctions lexico-grammaticales fines entre des lexèmes dont le sémantisme serait trop proche pour une comparaison hors contexte, sont visualisées de façon synthétique au fil du texte, tout en permettant de différentier certaines constructions spécifiques du français « eurolectal » et les éléments du discours technocratique « national ». For many years, the downtown in Clarksdale, with a municipal population of 17,960 and located in the northern part of the Mississippi Delta, had lost its role as the centre providing a wide range of jobs and services to those living in the surrounding region. For many cities and towns in America, downtown decline has been associated with the flight to the suburbs and the growth in shopping malls serving flourishing gated communities. In Clarksdale’s case, downtown decline has been due (...) largely to the advent of big box retailing and the location of new retail and commercial developments along the state highway on the edge of town, combined with the loss of jobs and population associated with agricultural restructuring. Today, however, Clarksdale has taken up the challenge to ‘revitalize’ the downtown in the face of economic adversity. Recovery is under way, and much of this is associated with blues music and Delta culture: Clarksdale is situated at the fabled ‘crossroads’ of Highways 49 and 61 and is also the home to national icons in literature, art and other cultural pursuits. These are key elements around which the downtown revitalization effort is focused. This paper charts the process by which the Clarksdale community has embarked on the road to downtown recovery, and highlights the town’s indelible links with the blues, borne out of years of toil, hardship and social deprivation. The paper emphasizes the importance of ‘champions’ and ‘creative people’, drawing on community support, in achieving downtown revitalization. Positive results are becoming evident with new businesses and jobs, improved levels of service, refurbishment of derelict buildings, a renewed sense of place, and an uplift in community confidence. The significance of cultural tourism to downtown revitalization is highlighted, with particular emphasis on the global appeal of blues, but with its roots firmly established in Clarksdale and the Delta. Whether the law should permit voluntary euthanasia or physician-assisted suicide is one of the most vital questions facing all modern societies. Internationally, the main obstacle to legalisation has proved to be the objection that, even if they were morally acceptable in certain 'hard cases', voluntary euthanasia and physician-assisted suicide could not be effectively controlled; society would slide down a 'slippery slope' to the killing of patients who did not make a free and informed request, or for whom palliative care would (...) have offered an alternative. How cogent is this objection? This book provides the general reader with a lucid introduction to this central question in the debate, not least by reviewing the Dutch euthanasia experience.
