: In the early twentieth century, psychoanalysis tries to investigate a specific logic of the appearance and the incident of what is taken to be unintended in everyday communication and human behavior. What before hardly seemed to be worth systematic research, now becomes a privileged field, in which the meaningful signs of a hidden and unwelcome past appear. For representing this new field of research Freud often makes use of archaeological metaphors. But in quoting the knowledge and the techniques of (...) archaeology, he evokes imaginary landscapes of a reappearing human past, which is not depraved and repressed but glorious and precious. This contradiction or gap between the character of analytical objects and their representation gives reason for an 'archaeological' investigation of psychoanalysis itself. To this end one of the heroes of nineteenth century archaeology, Heinrich Schliemann, will be confronted with two little works of Rudolf Virchow, in which he follows up the astonishing idea of an archaeology of refuse. Relating treasure troves and rubbish dumps it can be asked whether 'archaeological' practices in the late nineteenth century constituted a type of historical knowledge which runs counter to contemporary historicism and is crucial not only for Freud but also for today's theoretical reflections on archaeological perspectives in cultural studies. The normative force of evidence can seem puzzling. It seems that having conclusive evidence for a proposition does not, by itself, make it true that one ought to believe the proposition. But spelling out the condition that evidence must meet in order to provide us with genuine normative reasons for belief seems to lead us into a dilemma: the condition either fails to explain the normative significance of epistemic reasons or it renders the content of epistemic norms practical. The first (...) aim of this paper is to spell out this challenge for the normativity of evidence. I argue that the challenge rests on a plausible assumption about the conceptual connection between normative reasons and blameworthiness. The second aim of the paper is to show how we can meet the challenge by spelling out a concept of epistemic blameworthiness. Drawing on recent accounts of doxastic responsibility and epistemic blame, I suggest that the normativity of evidence is revealed in our practice of suspending epistemic trust in response to impaired epistemic relationships. Recognizing suspension of trust as a form of epistemic blame allows us to make sense of a purely epistemic kind of normativity the existence of which has recently been called into doubt by certain versions of pragmatism and instrumentalism. Die vorliegende Untersuchung stellt die Frage nach der Gerechtigkeit des Rechts, wobei sich das Wort "Recht" sowohl auf das Ganze der Rechtsordnung als auch auf einzelne Rechtsnormen beziehen kann. Dabei wird ausgelotet, was eine rechtsethische Rechtfertigung des Rechts überhaupt zu leisten vermag und welches ihre Grenzen sind. Die Untersuchung geht systematisch vor. Es erfolgt in erster Linie eine Auseinandersetzung mit problembezogenen Lösungsvorschlägen. Historische Positionen sowie philosophiegeschichtliche Betrachtungen dienen der Abrundung. Der Aufbau des Werkes erfolgt in Form einer Stufenpyramide, wobei auf (...) jeder Stufe die Problembehandlung immer weiter konkretisiert wird. John Rawls’ “reflective equilibrium” ranges amongst the most popular conceptions in contemporary ethics when it comes to the basic methodological question of how to justify and trade off different normative positions and attitudes. Even where Rawls’ specific contractualist account is not adhered to, “reflective equilibrium” is readily adopted as the guiding idea of coherentist approaches, seeking moral justification not in a purely deductive or inductive manner, but in some balancing procedure that will eventually procure a stable adjustment of relevant doctrines (...) and standpoints. However, it appears that the widespread use of this idea has led to some considerable deviations from its meaning within Rawls’ original framework and to a critical loss of conceptual cogency as an ethico-hermeneutical tool. This contribution identifies three kinds of “balancing” constellations that are frequently, but inadequately brought forth under the heading of Rawlsian “reflective equilibrium”: (a) balancing theoretical accounts against intuitive convictions; (b) balancing general principles against particular judgements; (c) balancing opposite ethical conceptions or divergent moral statements, respectively. It is argued that each of these applications departs from Rawls’ original construction of “reflective equilibrium” and also deprives the idea of its reliability in clarifying and weighing moral stances. Eva Schmidt argues that facts about incoherent beliefs can be non-evidential epistemic reasons to suspend judgment. In this commentary, I argue that incoherence-based reasons to suspend are epistemically superfluous: if the subjects in Schmidt’s cases ought to suspend judgment, then they should do so merely on the basis of their evidential reasons. This suggests a more general strategy to reduce the apparent normativity of coherence to the normativity of evidence. I conclude with some remarks on the independent interest (...) that reasons-first epistemology might have within an evidentialist framework. (shrink)

How can we be responsible for our attitudes if we cannot normally choose what we believe, desire, feel, and intend? This problem has received much attention during the last decades, both in epistemology and in ethics. Yet its connections to discussions about reasons and rationality have been largely overlooked. Responsibility for Rationality is the first book that connects recent debates on responsibility and on rationality in a unifying dialectic. It achieves four main goals: first, it reinterprets the problem of responsibility (...) for attitudes as a problem about the normativity of rationality; second, it breaks the stalemate between rationalist and voluntarist accounts of mental responsibility by defending a hybrid view; third, it provides novel support to recent accounts of the normativity of rationality by arguing that epistemic reasons and other ‘right-kind’ reasons are genuine normative reasons; fourth, it sets the foundations and the research agenda for an ‘ethics of mind’, including an illustration of how to approach applied issues in epistemology within the presented framework. This article improves our understanding of the reasons underlying the intellectual migration of scientists from existing cognitive domains to nascent scientific fields. To that purpose we present, first, a number of findings from the sociology of science that give different insights about scientific migration. We then attempt to bring some of these insights together under the conceptual roof of an actor-based approach linking expected utility and diffusion theory. Intellectual migration is seen as the choice of scientists who decide under uncertainty (...) and on the base of estimations about probabilities, costs, and benefits of the migration. The resulting choice model can be used as a heuristic base for further exploration of the subject. (shrink)

The inclusion of the history and philosophy of science in science teaching is widely accepted, but the actual state of implementation in schools is still poor. This article investigates possible reasons for this discrepancy. The demands science teachers associate with HPS-based teaching play an important role, since these determine teachers’ decisions towards implementing its practices and ideas. We therefore investigate the perceptions of 8 HPS-experienced German middle school physics teachers within and beyond an HPS implementation project. Within focused interviews these (...) teachers describe and evaluate the challenges of planning and conducting HPS-based physics lessons using collaboratively developed HPS teaching materials. The teachers highlight a number of obstacles to the implementation of HPS specific to this approach: finding and adapting HPS teaching material, knowing and using instructional design principles for HPS lessons, presenting history in a motivating way, dealing with students’ problematic ideas about the history of science, conducting open-ended historical classroom investigations in the light of known historical outcomes, using historical investigations to teach modern science concepts, designing assessments to target HPS-specific learning outcomes, and justifying the HPS-approach against curriculum and colleagues. Teachers' perceived demands point out critical aspects of pedagogical content knowledge necessary for confident, comfortable and effective teaching of HPS-based science. They also indicate how HPS teacher education and the design of curricular materials can be improved to make implementing HPS into everyday teaching less demanding. (shrink)

While video games have blossomed into the foremost expression of contemporary popular culture over the past decades, their critical study occupies a fringe position in American Studies. In its engagement with video games, this book contributes to their study but with a thematic focus on a particularly important subject matter in American Studies: spatiality. The volume explores the production, representation, and experience of places in video games from the perspective of American Studies. Contributions critically interrogate the use of spatial myths (...) ("wilderness," "frontier," or "city upon a hill"), explore games as digital borderlands and contact zones, and offer novel approaches to geographical literacy. Recent developments in neuroscience have inspired proposals to perform deep brain stimulation on psychopathic detainees. We contend that these proposals cannot meet important ethical requirements that hold for both medical research and therapy. After providing a rough overview of key aspects of psychopathy and the prospects of tackling this condition via deep brain stimulation, we proceed to an ethical assessment of such measures, referring closely to the distinctive features of psychopathic personality, particularly the absence of subjective suffering and a lack (...) of moral motivation. Scrutiny of these factors reveals that two essential bioethical criteria, individual medical benefit and voluntary informed consent, cannot be met in performing neurosurgical experiments or treatments on psychopathic inmates. The prospective introduction of autonomous cars into public traffic raises the question of how such systems should behave when an accident is inevitable. Due to concerns with self-interest and liberal legitimacy that have become paramount in the emerging debate, a contractarian framework seems to provide a particularly attractive means of approaching this problem. We examine one such attempt, which derives a harm minimisation rule from the assumptions of rational self-interest and ignorance of one’s position in a future accident. We contend, (...) however, that both contractarian approaches and harm minimisation standards are flawed, due to a failure to account for the fundamental difference between those ‘involved’ and ‘uninvolved’ in an impending crash. Drawing from classical works on the trolley problem, we show how this notion can be substantiated by reference to either the distinction between negative and positive rights, or to differences in people’s claims. By supplementing harm minimisation with corresponding constraints, we can develop crash algorithms for autonomous cars which are both ethically adequate and promise to overcome certain significant practical barriers to implementation. Many of our attitudes are non-culpable: there was nothing that we should have done to avoid holding them. I argue that we can still be blameworthy for non-culpable attitudes: they can impair our relationships in ways that make our full practice of apology and forgiveness intelligible. My argument poses a new challenge to indirect voluntarists, who attempt to reduce all responsibility for attitudes to responsibility for prior actions and omissions. Rationalists, who instead explain attitudinal responsibility by appeal to reasons-responsiveness, can (...) make sense of blameworthiness for non-culpable attitudes. In response, voluntarists could propose a revision of our actual practices. This would lead us into a quite different debate. (shrink)

In addition to its two world wars, the rapid decolonization after 1947 has been the most important phenomenon of the 20th century. The two wars led to the decline of the European colonial empires and speeded up decolonization. This process has spawned more than one hundred new nations which in many cases did not exist in this way before. It also fixed territorial boundaries, most of which have remained unaltered ever since. In the course of decolonization constitutions have been made (...) which have also survived unless they have been suspended by military coups. Many of these constitutions bear the stamp of the process of decolonization because they were framed with a view to facilitating the transfer of power. Usually the grant of independence was preceded by various steps in the devolution of power which left their traces in the constitutional documents. Since this devolution implied the prescription of administrative procedures, these constitutional documents often contain a great deal of contingent detail, whereas ‘normal’ constitutions are restricted to statements of fundamental rights and basic principles. This led to ironies of fate such that the Independence of India Act, which subsequently formed the basis of the Indian constitution, is the longest act ever passed by the British Parliament, which is itself based on an unwritten constitution. The constitutions of the decolonized new nations were marked by the process of the devolution of power. This process had an impact on the agenda setting and arena setting embedded in these constitutions. ‘Agenda’ refers to the conduct of political affairs and ‘arena’ to the delimitation of the powers of Parliament, the design of constituencies, etc. As a special feature, federalism was introduced by several constitutions. It emerged as a device for the gradual devolution of power. In some instances it (...) proved to be a permanent asset (India), in others it was contested (Nigeria) or rejected (Rhodesia). None of the new constitutions contained adequate provisions for the civilian control of the armed forces. The armed forces were simply taken for granted and their potential political role disregarded. But in many new nations political power was soon usurped by the armed forces and constitutional government was suspended. (shrink)

Wenn man den freien Willen nicht mehr als ursachenlose Ursache bzw. als Erstauslöser deutet, sondern als neuronal und kulturell bedingte Fähigkeit begreift, für verschiedene Gründe zugänglich zu sein und ungehindert Entschlüsse fassen zu können, so kann man durch Tadel im Sinne eines asymmetrischen Sprachspiels - so die These - lernen, willensfrei(er) zu werden und aus Gründen zu handeln. Tadel ist somit in der Erziehung unentbehrlich, denn bevor man sich für einleuchtende Gründe entscheidet, muss man überhaupt aus Gründen handeln und ungehindert (...) entscheiden können. Obwohl dieser Eingriff als eine die Freiheit nicht fördernde Intervention erscheinen mag, kann er mentale Ereignisse in Gang setzen, mit denen Entschlüsse erneut abgewogen werden können, wodurch sich ein Zuwachs an Willensfreiheit doch noch ereignet. Die alte pädagogische Antinomie von Zwang und Freiheit ist damit auflösbar, ohne die neuronale Bedingtheit mentaler Phänomene zu leugnen. (shrink)

We investigate the expressive power of Parikh's Game Logic interpreted in Kripke structures, and show that the syntactical alternation hierarchy of this logic is strict. This is done by encoding the winning condition for parity games of rank n. It follows that Game Logic is not captured by any finite level of the modal -calculus alternation hierarchy. Moreover, we can conclude that model checking for the -calculus is efficiently solvable iff this is possible for Game Logic.

In den 1980er Jahren wurde das Erhabene im Kontext der Debatten um die Postmoderne wiederentdeckt. Dabei konzentrierte man sich auf die Theorien Burkes und Kants, in denen das Schöne dem Erhabenen gegenübergestellt wird. Die Geschichte des Erhabenen in der Frühen Neuzeit dagegen blieb weitgehend im dunkeln. Diese Geschichte wird hier dargestellt, wobei die Studie von der These ausgeht, daß für diesen Zeitraum gerade nicht die Dichotomie von Schönem und Erhabenem zentral ist, sondern die Opposition zweier Modelle des Sublimen selbst: das (...)
