The contributors to this international volume take up questions about a phenomenology of time that begins with and attunes to gender issues. Themes such as feminist conceptions of time, change and becoming, the body and identity, memory and modes of experience, and the relevance of time as a moral and political question, shape Time in Feminist Phenomenology and allow readers to explore connections between feminist philosophy, phenomenology, and time. With its insistence on the importance of gender experience to the experience (...) of time, this volume is a welcome opening to new and critical thinking about being, knowledge, aesthetics, and ethics. Although birth marks the entrance of a human being into the world and establishes the very possibility of experience the philosophical implications of this event have been largely ignored in the history of thought. This is particularly troubling in phenomenology in general and in the work of Martin Heidegger in particular. While Heidegger raises the issue of birth he drops it very quickly on the path to defining Dasein''s existence as constituted from the standpoint of death, as being-towards-death. In this (...) paper I argue, contra Heidegger, that intentional existence can only be understood from the standpoint of birth. I begin by showing that intentionality inheres in a double difference that is fundamentally dependent on birth insofar as birth is an original differentiating from prenatal existence. I conclude with the argument that only a philosophy that regards Dasein from the standpoint of birth, as being-from-birth, can give an adequate account of humans as beings who live with others and who can initiate sense constitution and action. Menschen sind zeitsensibel. Ihr Fühlen, Erleben, Wollen und Handeln ist zeitlich strukturiert und bestimmt. Zeitregime beeinflussen und beherrschen durch ihre imperative Apodiktizität, Homogenität, Durchsetzungskraft und Geschwindigkeit die historische, kulturelle und gesellschaftliche Ordnung des Lebens und die Erfahrungen der Menschen. Aber nicht jede Lebensphase ist gleichermaßen in die jeweilige Ordnung und Gestaltung des herrschenden Zeitregimes eingebunden, wie am Beispiel des Alters gezeigt werden kann. Der folgende Beitrag richtet einen phänomenologischen und kulturtheoretischen Blick auf die modernen und spätmodernen Zeitregime des Alters. Diese (...) Lebensphase fordert in brisanter Weise zur Frage nach der Zeitsensibilität auf, weil sich das Zeiterleben im Alter verändert. Interpreting Plato’s story of the Thracian handmaid, this essay focuses on questions concerning the supposition of an opposition between common sense and philosophical thinking. Taking the laughter of the maid seriously the author discusses the role of laughter for Plato’s approach. By reevaluating the function of laughter she argues for its strength in revealing ideological thinking or an undisclosed hypothesis, and in enabling philosophical thinking. Thus, the author argues that (...) the alliance of laughter and thinking unsettles the state of being enclosed in ideology, everydayness or thoughtlessness, and both distances and unsettles human beings. Prenatal diagnosis, especially noninvasive prenatal testing, has changed the experience of pregnancy, prenatal care and responsibilities in Israel and Germany in different ways. These differences reflect the countries' historical legacies, medico-legal policies, normative and cultural identities. Building on this observation, the contributors of this book present conversations between leading scholars from Israel and Germany based on an empirical bioethical perspective, analyses about the reshaping of 'life' by biomedicine, and philosophical reflections on socio-cultural claims and epistemic horizons of responsibilities. The concept of the ‘well-being of the child’ (like the ‘child’s welfare’ and ‘best interests of the child’) has remained underdetermined in legal and ethical texts on the needs and rights of children. As a hypothetical construct that draws attention to the child’s long-term welfare, the well-being of the child is a broader concept than autonomy and happiness. This paper clarifies some conceptual issues of the well-being of the child from a philosophical point of view. The main question is how (...) well-being could in practice acquire a concrete meaning and content for a particular issue or situation. A phenomenological-hermeneutic research perspective will be outlined that allows the child’s well-being to be elucidated and specified as an anthropological and ethical idea. It is based on a contextual understanding of generative relationships, a combination of the theory and practice of making sense, here described as ‘generative insight’, which could provide ethical guidance for decision making in families, legal practice, medicine or biomedical research. Definition of the problemFrom an ethical point of view we analyse the ruling of the German Federal Joint Committee (Gemeinsamer Bundesausschuss, G‑BA) of September 2019 to revise the guidelines about the coverage of noninvasive prenatal tests (NIPT) by mandatory health insurance, in order to include them under specified conditions. The decision contains four essential elements: a definition of the aim of NIPT testing (to avoid invasive testing), a criterion of access (test must be “necessary” for the pregnant woman to tackle (...) her individual situation), statements about the process of decision-making (after counselling by a physician and case by case) and a normative contextualization (termination of pregnancy under § 218 a German penal law) which is to be found in its explanations. There are tensions in the proposed model that oscillate about two axes: (1) The suffering that results from a possible birth of a child with trisomy or from not knowing about the genetic condition of the fetus can ultimately only be evaluated subjectively, from the perspective of the pregnant woman. (2) The meaning of an individual decision in the case-by-case model remains unclear because when judging about individual cases general points of view also need to be considered. However, we argue that the model of the G‑BA could be a sociopolitically and ultimately also ethically defensible pragmatic solution, exactly because of its paradoxes and its inherent flexibility. Responsibility is central to Emmanuel Levinas as well as Hannah Arendt. A reading of their understanding of the concept and role of responsibility for politics and ethics and in regard to its social-ontological status of primacy, its reference to historical, worldly, and human conditions, brings out the similarities and differences of their work. Regarding their historical context, they could have engaged in a dialogue; but they never did. Their personal temperament and thematic approach to key issues concerning the concept of (...) responsibility—such as subjectivity, primordiality, or relationality—can be used to build pillars for a bridge between the two thinkers’ respective approaches. To explore how cultural beliefs are reflected in different popular views of pre-implantation genetic diagnosis for human leukocyte antigen match (popularly known as “savior siblings”), we compare the reception and interpretations, in Germany and Israel, of the novel/film My Sister’s Keeper. Qualitative analysis of reviews, commentaries and posts is used to classify and compare normative assessments of PGD for HLA and how they reproduce, negotiate or oppose the national policy and its underlying cultural and ethical premises. Four major themes emanated (...) from the comparison: loss of self-determination and autonomy; loss of dignity through instrumentalization; eugenics and euthanasia; and saving life. In both countries, most commentaries represented a dominant position, with a few negotiated positions. We also highlight the decoding of a relatively less explored bioethical aspect of My Sister’s Keeper’s narrative, namely the meaning of euthanasia. We conclude by discussing how the findings relate to attempts of providing cultural explanations for the regulation of HLA-PGD. (shrink)

The routinization of prenatal diagnosis is the source of bioethical and policy debates regarding choice, autonomy, access, and protection. To understand these debates in the context of cultural diversity and moral pluralism, we compare Israel and Germany, focusing on two recent repro-genetic “hot spots” of such policy-making at the beginning of life: pre-implantation genetic diagnosis and non-invasive prenatal genetic testing, two cutting-edge repro-genetic technologies that are regulated and viewed very differently in Germany and Israel, reflecting different medicolegal policies as well (...) as public and bioethical considerations. First, we compare policy-making in the context of PGD for HLA typing, used to create sibling donors, approved in Israel under specific conditions while prohibited in Germany. Second, we compare policy-making in the context of NIPT, which came under fire in Germany, while in Israel there has been little public debate about it. Both countries justify their contrasting policies as reflecting a concern for the well-being and care of the embryo/child, thus highlighting different concepts of embryo/child protection, autonomy, family relations, and the impact of religion and history on the promotion/protection of life. We use the juxtaposition of PGD and NIPT to highlight some inconsistencies in policies concerning the protection of extra- and intra-corporeal embryos. The present paper offers a philosophical discussion of phenomena which in the empirical literature have recently been subsumed under the concept of ‘mental time travel’. More precisely, the paper considers differences and similarities between two cases of ‘mental time travel’, recollective memories (‘R-memories’) of past events on the one hand, and sensory imaginations (‘S-imaginations’) of future events on the other. It develops and defends the claim that, because a subject who R-remembers a past event is experientially aware of a past (...) particular event, while a subject who S-imagines a future event could not possibly be experientially aware of a future particular event, R-memories of past events and S-imaginations of future events are ultimately mental occurrences of two different kinds. ABSTRACT:Partnerships between companies and NGOs have received considerable attention in CSR in the past years. However, the role of NGO legitimacy in such partnerships has thus far been neglected. We argue that NGOs assume a status as special stakeholders of corporations which act on behalf of the common good. This role requires a particular focus on their moral legitimacy. We introduce a conceptual framework for analysing the moral legitimacy of NGOs along three dimensions, building on the theory of deliberative democracy. (...) In their paper "Remembering," first published in the Philosophical Review in 1966, Martin and Deutscher develop what has since come to be known as the Causal Theory of Memory. The core claim of the Causal Theory of Memory runs as follows: If someone remembers something, whether it be "public," such as a car accident, or "private," such as an itch, then the following criteria must be fulfilled: 1. Within certain limits of accuracy he represents that past thing. 2. I f (...) the thing was "public," then he observed what he now represents. If the thing was "private," then it was his. 3. His past experience of the thing was operative in producing a state or successive states in him finally operative in producing his representation. These three statements express the condition which we consider to be separately necessary and jointly sufficient, if an event is to be an instance of remembering. (shrink)

Phantasia is viewed as a unified concept in Aristotle. When the metaphoric meaning of ‘phantisizing’ is excluded, the causal account for all imagination is the same: all phantasiai are motions in the soul caused by sense-perceptions. These are sensory images or imprints that can exist independently from their original source. Their history may be different, and their character and value may vary. Aristotle’s insistence on their sensory nature indicates that he saw them as a unitary phenomenon in the soul, as (...) sensory appearances. (shrink)

The following paper considers one important feature of our experiential or ‘recollective’ memories, namely their spatial perspectival characteristics. I begin by considering the ‘Past-Dependency-Claim’, which states that every recollective memory (or ‘R-memory’) has its spatial perspectival characteristics in virtue of the subject’s present awareness of the spatial perspectival characteristics of a relevant past perceptual experience. Although the Past-Dependency-Claim might for various reasons seem particularly attractive, I show that it is false. I then proceed to develop and defend the ‘Present-Dependency-Claim’, namely (...) the claim that the spatial perspectival characteristics of an R-memory depend on the spatial perspectival characteristics of perceptual experiences that the subject has at the time at which the R-memory occurs. Lastly, I discuss the phenomenon of so-called ‘observer-memories’, which presents a special challenge for any attempt to account for the spatial perspectival characteristics of R-memories. I argue that we have no good reason to deny that the relevant experiences should count as memories, and I show that we can account for the spatial perspectival characteristics of observer-memories with the help of the ‘Present-Dependency-Claim’. More generally, the paper shows that certain events that occur in a subject’s mental life (namely, a subject’s R-memories) are necessarily dependent on other events that occur in the relevant subject’s mental life (namely, on certain perceptual experiences). This more general conclusion in turn should be relevant for any attempt to develop an appropriate account of a subject’s mental life as a whole. (shrink)

Imagine you are walking through a park. Suddenly, a mugger points a gun at you, threatening to shoot you if you do not hand over your valuables. Is this an instance of domination? Many authors working within the neo-republican framework - including Philip Pettit himself - are inclined to say 'yes'. After all, the mugger case seems to be a paradigmatic example of what it means to be at someone's mercy. However, I argue that this conclusion is based on a (...) misleading, interactional account of domination that misconceives its structural character. Domination, I maintain, is a structurally constituted form of power. Whether the mugger in the park dominates you or not can only be established by analysing the wider power structures in which your interaction is embedded. (shrink)

Memory can play two quite different roles in grief. Memories involving a deceased loved one can make them feel either enjoyably present, or especially and painfully absent. In this paper, we consider what makes it possible for memory to play these two different roles, both in grief and more generally. We answer this question by appeal to the phenomenological nature of vivid remembering, and the context in which such memories occur. We argue that different contexts can make salient different aspects (...) of memory's phenomenological nature, thus making what is remembered sometimes feel pleasantly 'present' again, and sometimes painfully absent. Sometimes we remember past objects or events in a vivid, experiential way. The present paper addresses some fundamental questions about the metaphysics of such experiential or ‘recollective’ memories. More specifically, it develops the ‘Relational Account’ of recollective memory, which consists of the following three claims. A subject who recollectively remembers a past object or event stands in an experiential relation to the relevant past object or event. The R‐remembered object or event itself is a part of the R‐memory; that is, (...) the subject's present R‐memory is partly constituted by the relevant past object or event. When a subject R‐remembers a past object, the past object is a constitutive part of the conscious experience itself; that is, the object is immediately available to the subject in conscious experience. In developing the Relational Account, the present paper hopes to make a substantial contribution to any attempt to account for the nature of recollective memory. Furthermore, in order to explain how a subject could understand the beliefs that she forms about the past on the basis of an R‐memory, and how a subject could, on the basis of an R‐memory, gain any knowledge about the past, we arguably also need to rely on the Relational Account of recollective memory. Thus, the Relational Account will also play an important role in an attempt to account for various other ways in which a subject might be related to the past in general, and to her own past in particular. Standing in such relations to the past is, in turn, a central feature of our human existence. Ultimately, therefore, the Relational Account of recollective memory should also play a crucial role in furthering our understanding of ourselves, and of our own existence in time. (shrink)

First published in 1918, this volume was partly based on lectures delivered by Dorothea Jane Stephen at and near Bangalore and was intended to illustrate the considerable influence exercised by the early literature of India on later Indian philosophy and culture. Examining themes of divinity and religion together with morality and human nature, the essays in this book combine to offer a fitting introduction to the importance and far-reaching effects of early Indian thought.

The present article aims to show that a subject can only fully grasp the concept of the past if she has some experiential, or recollective, memories of particular past events. More specifically, I argue that (1) in order for a subject to understand the concept of the past, it is necessary that the subject understand the concept of a particular past event in such a way that it might contribute to her understanding of the concept of the past. (2) But (...) then, in order for a subject to understand the concept of a particular past event in such a way that it might contribute to her understanding of the concept of the past, it is necessary that the subject have some recollective memories of particular past events. (C) Hence, a subject can only understand the concept of the past if she has some recollective memories of particular past events. I defend the premises of the present argument against various objections, indicate why we should accept both premises, and accordingly end by endorsing the argument's conclusion. (shrink)

In this paper, I present and explore some ideas about how factive emotional states and factive perceptual states each relate to knowledge and reasons. This discussion will shed light on the so-called ‘perceptual model’ of the emotions.

ABSTRACT While multiple crisis phenomena have sparked experimentation with alternative forms of production and consumption on the micro level, it is not clear if and how these alternative practices may become hegemonic and thus displace capitalism as the hegemonic order on the macro level, rather than merely fostering pockets of a solidarity economy within capitalism. This question is hard to research, because it relates to post-capitalist futures rather than actual events or phenomena in the past or present. In this article, (...) I propose a methodological framework for studying the transformative potential of counter-hegemonic initiatives. Building on debates on causality and prediction within Critical Realism, I introduce the concept of ‘ex-ante’ retroduction. Using this mode of reasoning helps to identify possible generative mechanisms for the viability and achievability of alternative futures which can then be empirically investigated. (shrink)

In recent years, most political theorists have agreed that shame shouldn't play any role in democratic politics because it threatens the mutual respect necessary for participation and deliberation. But Christina Tarnopolsky argues that not every kind of shame hurts democracy. In fact, she makes a powerful case that there is a form of shame essential to any critical, moderate, and self-reflexive democratic practice. Through a careful study of Plato's Gorgias, Tarnopolsky shows that contemporary conceptions of shame are far too (...) narrow. For Plato, three kinds of shame and shaming practices were possible in democracies, and only one of these is similar to the form condemned by contemporary thinkers. Following Plato, Tarnopolsky develops an account of a different kind of shame, which she calls "respectful shame." This practice involves the painful but beneficial shaming of one's fellow citizens as part of the ongoing process of collective deliberation. And, as Tarnopolsky argues, this type of shame is just as important to contemporary democracy as it was to its ancient form. Tarnopolsky also challenges the view that the Gorgias inaugurates the problematic oppositions between emotion and reason, and rhetoric and philosophy. Instead, she shows that, for Plato, rationality and emotion belong together, and she argues that political science and democratic theory are impoverished when they relegate the study of emotions such as shame to other disciplines. The present paper considers our ability to ‘shape our own mental lives’; more specifically, it considers the claim that subjects sometimes can and do engage in ‘mental self-regulation’, that is, that subjects sometimes can be, and are, actively involved with their own mental lives in a goal-directed way. This ability of mental self-regulation has been rather neglected by contemporary philosophers of mind, but I show why it deserves careful philosophical attention. In order to further our understanding of the nature of (...) the phenomenon of mental self-regulation and to locate it within the wider context of our everyday lives and the world we live in, I proceed to develop some conditions which need to be met in order for a subject to be able to engage in mental self-regulation. In developing those conditions we find that compared to the physical realm, our mental lives are a rather elusive domain in the face of attempts at intervention, and our ability to intervene in our own mental lives is rather fragile. We also find that our ability to regulate our own mental lives in many cases depends on our possession of mental skills and mental know-how. Both these observations in turn throw new light on our understanding of the nature of the human mind. (shrink)

We sometimes experience emotions which are directed at past events (or situations) which we witnessed at the time when they occurred (or obtained). The present paper explores the role which such "autobiographically past-directed emotions" (or "APD-emotions") play in a subject's mental life. A defender of the "Memory-Claim" holds that an APD-emotion is a memory, namely a memory of the emotion which the subject experienced at the time when the event originally occurred (or the situation obtained) towards which the APD-emotion is (...) directed. On this view, APD-emotions might play an important role in our acquiring knowledge about our own past emotions, which renders the view rather attractive. However, as I show in the present paper, none of the various possible versions of the Memory-Claim are tenable. This leaves us with the "Universal-New-Emotion-Claim", according to which all APD-emotions are new emotional responses to the past events (or situations) towards which the relevant APD-emotions are directed. Further consideration of the "Universal-New-Emotion-Claim" shows that while APD-emotions do not play the epistemological role they could have played had some version of the Memory-Claim turned out to be true, a subject's APD-emotions nevertheless do play a vital role in a subject's mental life: they help the subject to develop a balanced sense of self. Global reproductive landscapes and with them cross-border routes are rapidly changing. This paper examines the reproductive routes and choices of fertility travellers from China to Russia as reported by medical professionals and fertility service providers. Providing new empirical data, it raises new ethical questions on the facilitation of cross-border reproductive travel and the commercialisation of reproductive treatment. The relaxation of the one-child policy in 2014 in China, the increasing demand for ART exceeding the capacity of national fertility clinics and the (...) difficulty of accessing treatment with donor eggs concomitant with a growing economic power of the upper–middle class are shaping the ART industry in Asia in new ways. A new development is Chinese citizens increasingly seeking ART treatment in Russia, which has a long-standing practice of ART governed by a liberal legislation. Furthermore, as China prohibits the export of gametes, Chinese fertility travellers rely on acquiring donor gametes once starting treatment abroad. Clinicians in Russia report three strategies amongst their Chinese patients: One group is using donor eggs of women of Asian appearance living in Russia or is hiring women of resembling appearance from third-party countries to donate their eggs in Russia to create resemblance in their offspring. Another group is buying white donor gametes to create Eurasian mixed children and thus ‘enhance’ their offspring. Providing novel empirical data, this article informs ethical deliberation and raises imminent questions for further research in this understudied geographic region and on cross-border reproductive treatment. According to one understanding of the problem of dirty hands, every case of dirty hands is an instance of moral conflict, but not every instance of moral conflict is a case of dirty hands. So, what sets the two apart? The dirty hands literature has offered widely different answers to this question but there has been relatively little discussion about their relative merits as well as challenges. In this paper I evaluate these different accounts by making clear which understanding of (...) concept distinctness underlies them and which of them is, ultimately, the most plausible one in the case of dirty hands and ordinary moral conflict. In order to do so, I will borrow from the terminology employed in recent debates in the philosophy of evil which have tackled a similar problem to the one at hand, i.e. defining what sets evil apart from ordinary wrongdoing. Here it has been argued that concepts could be distinct in three ways: they can have a quantitative difference, a strong qualitative or a moderate qualitative difference. I conclude that the most convincing definition of dirty hands draws a moderate qualitative distinction between ordinary moral conflict according to which dirty hands are those moral conflicts that involve a serious violation or betrayal of a core moral value.
